The Board discussed the setback requirements of the zoning code, widening of streets and the affects on setbacks and parking. Chairman Goe opened the public hearing. Ron Bartley, 14458 58th Avenue South, General Contractor, described the site and the reasons for the variance request. Jim Thompson, applicant, indicated that when the street improvement project was done six years previously, it did not change the property line. The Board discussed the proposed addition, the passive solar system, and possible alternatives. Chairman Goe commented on the interpretation between the prevailing yard patterns between the industrial areas and residential blocks. Chairman Goe closed the public hearing. MRS. Thompson resi located at 14705: 58th Avenue ; South and is zoned R -1 -7.2 (Single Family Residential). An addition is proposed on the easterly por- tion of the property, facing 58th Avenue South, to a point 23 feet 9 inches from the street. Tukwila Municipal Code (TMC) 18.50.020 requires a front yard setback of 30 feet from 58th Avenue South, therefore, a ariance is requested. FINDINGS O 1. The existing residence lies 19 feet 9 inches from the front property line along 58th Avenue South. The subject property measures 90 feet along this street and extends 180 feet west of the street (Exhibit A). Along the north side of the property lies South 147th Street, thereby creating a corner lot. TMC 18.52.020 requires a front yard setback of 30 feet along 58th Avenue South and 15 feet from South 147th Street. 2. The proposed 395 square foot addition extends into the front yard setback to a point 23 feet 9 .inches from 58th Avenue South and 15 feet from South 147th Street. Therefore, the incursion of6 feet 3.inches into the front yard setback requires a variance for the portion along 58th Avenue South, but no variance is required for the portion of the addition adjacent to South 147th Street. CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 85 -33 -V: THOMPSON VARIANCE g- TMC 18.50.070(3) provides administrative flexibility to reduce the normal 30 foot front yard requirement to comply with the. "prevailing yard pattern" of the area. To take advantage of this administrative deviation justification and documentation must be submitted to substantiate that the existing houses in this area lie less than the 30 feet from 58th Avenue South to the extent that the average existing setback is the same as the proposal. The admi- nistrative interpretation of "area" is that of the same block of the same street on which the house is located. In other words, staff would review the existing homes on the west and east sides of this street to determine the average existing setback. A visual survey was conducted by staff indicating that the structures along the west side of this street are setback more than the Thompson residence and include what appears to be one vacant lot. Along the easterly portion of the street homes appear to be setback approximately 30 feet from the street. On this basis an administrative deviation does not appear justified. TMC 18.72.020 contains the criteria for the granting of a variance and is the sole criteria the Board of Adjustment must use in deciding the application. CONCLUSIONS 1. Criteria TMC 18.72.020(1): "The variance shall not constitute a grant of spe- cial privilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located" Mention was made earlier of the setbacks of the existing structures along 58th Avenue South in the block, of the subject property (south of South 147th Street). The circumstances change for the block of houses on 58th Avenue South north of South 147th Street. The latter homes appear to substantially deviate from the 30 foot front yard building setback requirement of TMC 18.52.020. While no measurements were actually taken, a visual survey by staff indicated that the subject variance is similar to the existing setbacks of these residences. Therefore, the variance would not confer a "special pri- velege" upon the subject property "...inconsistent with the limitation upon uses of other properties in the vicinity... ". QY 2. Criteria TMC 18.72.020(2): "The variance is necessary because of special cir- cumstances relating to the size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located" The subject property is of a moderate slope between the residence and 58th Avenue South. The residence is located on the easterly portion of the lot with some 60 feet separating the residence from the westerly detached garage (Exhibit A). The applicant proposes the easterly addition to the house off the existing kitchen and dining room to provide passive solar collection into what is to be called the "sunroom ". It is commonly recognized that a southern exposure to the sun is necessary for passive solar collection features of such an addition. The issue is not one of the right or privilege to solar collection since ade- quate space exists on other portions of the property surrounding the home in order to achieve a southerly and westerly exposure for passive solar collec- tion. Therefore, there does not appear to exist features of the site such as " ...size, shape, topography, location or surrounding..." causing the need for the variance. . Instead, the reason for the variance appears to lie primarily in the convenience of location adjacent to the existing spaces (kitchen and dining room) of the residence. While the desirability of the proposal loca- tion is understood, this lies without this variance criteria. 3. Criteria TMC 18.72.020(3): "The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or �s. Page -3- Board of Adjustment 85 -33 -V: THOMPSON VARIANCE September 5, 1985 improvements in the vicinity and in the zone in which the subject property is situated." The overall impact of the variance on the public welfare or other properties or improvements does not appear to be "materially detrimental ". The proposal includes 23 feet 9 inches of distance from the proposed addition to 58th Avenue South, which appears to be an adequate distance to safeguard the public welfare and other properties. 4. Criteria TMC 18.72.020(4): "The authorization of such variance will not adversely affect the implementation of the comprehensive land use policy plan." The proposed variance complies with the comprehensive plan Goal 1, p. 12, to "through the regulation of land use and community growth, promote the health, safety, and general welfare of the public." The proposed 23 foot 9 inch dri- veway in front of the proposal to 58th Avenue South is adequate for parking to serve the residence and protect the public welfare and safety in vehicular access. Criteria TMC 18.72.020(5): "The granting of such variance is necessary for the preservation and enjoyment of a substantial property right of the appli- cant possessed by the owners of other properties in the same zone or vicinity." In order for the applicant to secure the same building setback of properties along 58th Avenue South and north of South 147th Street a variance is necessary. On the other hand, the variance is not necessary to comply with the existing building setbacks of properties along 58th Avenue South and south of 147th Street in the same block of the subject site. Furthermore, it appears that a convenient deletion of the most easterly approximately 6 foot portion of the proposal will comply with the front yard building setback requirements of TMC 18.52.020. Compliance with this section is reasonably possible without subtraction of more than appoximately 25% of the proposal, which subtraction would appear to not unreasonably or substantially detract from or reduce usage of the proposed sunroom. On, this basis it appears that C,.. e variance is not necessarily needed to preserve the right to the same set- backs as some, but not all, of the existing setbacks of the existing homes along this street. PRELIMINARY RECOMMENDATION Based upon the above and existing information, staff recommends that the variance be denied and that the proposal be reduced to comply with the building setback requirements of TMC 18.52.020.
