AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON,
ANNEXING CERTAIN REAL PROPERTY COMMONLY KNOWN AS THE
FOSTORIA ASSOCIATES ANNEXATION. PURSUANT TO THE DIRECT
PETITION METHOD SET FORTH IN RCW CHAPTER 35A.14;
REQUIRING SAID PROPERTY TO BE ASSESSED AND TAXED AT THE
SAME RATE AND UPON THE SAME BASIS AS OTHER PROPERTY
WITHIN THE CITY; DIRECTING THE CITY CLERK TO FILE A
CERTIFIED COPY OF THIS ORDINANCE WITH THE COUNTY
COUNCIL; AND FIXING THE EFFECTIVE DATE OF THE
ANNEXATION.
of existing indebtedness,
WHEREAS, a Notice of Intent to Annex, signed by owners of
not less than ten percent in value, according to assessed
valuation for general taxation, of the property for which annexa-
tion is sought, was received by the City on June 3, 1985 and on
July 8, 1985, the City Council met with the petitioners, which
was within sixty (60) days of receipt of said Notice of Intent to
City would accept the proposed
and
authorized circulation of a petition for annexation, and
WHEREAS, a legally sufficient petition pursuant to RCW
35A.14.120, signed by the owners of at least 75 percent of the
assessed value of the land seeking annexation to the City was
filed with the City on August 1, 1985, and
WHEREAS, said proposed annexation was reviewed in accordance
with the State Environmental Policy Act and a Determination of
Non- Significance was issued on September 13, 1985, pursuant to
that Act, and revised on October 16, 1985, and
WHEREAS, said proposed annexation was submitted to the King
County Boundary Review Board pursuant to RCW Chapter 36.93, and
said Board waived review of the proposed annexation at a public
meeting, and
WHEREAS, said property to be annexed is contiguous to and is
a logical extension of the City's corporate limits in light of
circulation, topography, drainage and other City services, and
said'annexation is consistent with the provisions of the Tukwila
Comprehensive Plan, and
WHEREAS, the City Council held a public hearing on September
23, 1985, pursuant to notice published in a newspaper of general
circulation in the City and posted notice in at least three
public places within the territory proposed for annexation, and
at the conclusion of said hearing determined that said property
should be annexed to the City, now therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO.
ORDAIN AS FOLLOWS:
Section 1. The real property commonly known as the Fostoria
Associates Annexation, which property is generally described as
lying in the southeast corner of the intersection of 42nd Avenue
South and S. 133rd Street, and more particularly described on
Exhibit • .:. attlifhed :hereto and incorporated herein by this
reference as if fully set forth, should be and is hereby annexed
to and made a part of. Tukwila.
''section 2. Pursuant to the terms of the annexation
petition, all property within the territory annexed hereby shall
be assessed and taxed at the same rate and on the same basis as
other property within the City, including assessments for taxes
in payment of any bond issued or debts contracted prior to or
existing as of the date of annexation.
Section 3. The City Clerk is hereby directed to file a
certified copy of this ordinance with the King County Council.
Section 4. This ordinance or a summary therof shall be
published in the official newspaper of the City and shall be in
full force and effect five (5) days after the date of
publication.

As required by the provisions of RCW 36.93, a Notice of Intention is hereby
given by the City of Tukwila to annex approximately 2.4 acres lying at the
corporate limits between South 134th Place and 42nd Avenue South and
generally referred to as the "Fostoria Park Annexation ".
As the enclosed materials indicate, the annexation petition is supported by
100% of the property owners involved, consists of less than 10 acres and is
assessed at less than $800,000. We request that you refer this request to
the Boundary Review Board with a recommendation to waive jurisdiction.
Please forward your written response to our request at your earliest con-
venience.
NOTICE OF INTENTION
As required by RCW 36.93, a Notice of Intention is hereby given to the King
County Boundary Review Board by the City of Tukwila.
1. Background Information
In June 1985, owners of two properties on 42nd Avenue South and South
134th Place filed a petition for annexation of property to the City of
Tukwila. The "75% Petition" was filed in August 1985. On September 23
the Tukwila City Council convened a public hearing on the proposal.
The hearing was continued until October 7. The City of Tukwila desires
rational corporate boundaries and thus wishes to annex this 2.36 acre
portion of unincorporated King County generally located in the north-
west portion of the City.
2. The Tukwila City Council will adopt an ordinance stating its intent to
annex the subject area after Boundary Review Board action.
3. A determination of non - significance (DNS) was issued by the City of
Tukwila on September 13, 1985, and is included as Attachment A. The
DNS comment period ended September 28, 1985. Comments were received
from the King County Department of Planning and Community Development
(Attachment B) noting the King County zoning and drainage issues.
4. The City of Tukwila is seeking annexation of the subject area by the
petition method pursuant to RCW 35A.14.120. It should be noted that
both the "10% Petition" and the "75% Petition" contained the signatures
of both property owners, representing 100% of assessed valuation. This
notice is being filed according to RCW 36.93.090 and .120.
The City of Tukwila is requesting that the chairman of the Boundary
Review Board provide a written statement that the Board's review is not
necessary to protect the interest of the various parties and that it
thus waives jurisdiction pursuant to RCW 36.93.110. RCW 36.93.110
allows the Board to waive its normal review process in those cases
where the proposed annexation area is less than 10 acres and less than
$800,000 in assessed valuation. The proposed annexation area encom-
passes 2.43 acres and $129,400 assessed valuation.
5. The legal description of the proposed annexation area is shown in
Attachment D
6. The proposed annexation area with service points is shown on the
Assessor's Map (Attachment E).
7. Government boundaries are shown on Attachments F1, F2, and F3.
8. A map of entity corporate limits is shown on Attachment G.
9. A. There are no residents on the proposed annexation property.
Assessed valuation for the property is $129,400.
B. The land currently contains two vacant single - family homes, one
with a garage. The property will be used for construction of an
City of Tukwila

additional office /warehouse building for an existing commercial
development.
C. 1. The area is within the Tukwila Comprehensive Land Use Plan,
adopted March 16, 1982.
2. Tukwila has no franchise for the area. None is anticipated.
3. The proposal is consistent with the King County Comprehensive
Plan's "Urban" designation. The Highline Community Plan
designates the area as Single Family RS -7200. Possible
changes to the Highline Community Plan are under con-
sideration for 1988 or 1989.
4. No additional county policies, or plans adopted subsequent to
the Comprehensive Plan affect the area.
5. Current King County zoning is S -R (Suburban Residential, 4 to
6 units /acre). The current County Comprehensive Plan

surrounding communities.
6. The area is within a local sewer service district in the King
County Sewerage General Plan, adopted 1/79 by Ordinance
#4035.
D. The annexation area is on top of a hill which slopes down eastward
to the commercial /industrial area. There is currently an open
drainage course along the northwest property line. This will be
diverted into a 5 cmp pipe to South 133rd Street.
E. The projected population growth for the area is likely to be
small.
The proposal lies within Census Tract #272, which had a population
of 1664 in 1980. The estimated 1981, 1982 and 1983 population was
1911, 1948, and 1995, respectively. (PSCOG) Future projections
are not available since the area has been combined with nine other
census tracts to form the Riverton Forecast Area Zone (FAZ)
The City of Tukwila had a 1980 population of 3505 with the 1990
projection of 4001 (PSCOG 3/84; FAZ 3900). Total Tukwila
employment was 20,930 in 1980 with a 1990 projection of 29,508
(PSCOG 3/84; FAZ 3900).

WHEREAS, the City of Tukwila received an annexation
petition for certain property (described in Section 1) which is
adjacent and contiguous to the City of Tukwila; and
WHEREAS, said petition was in proper form and conformed
to the requirements of the State Annexation Statute; and
WHEREAS, a public hearing was held on said annexation
as required by law; and
WHEREAS, a review board was waived as authorized by law.
NOW, THEREFORE, the City Council of the City of Tukwila
do ordain as follows:
Section 1. The City Council of the City of Tukwila hereby

WE, the undersigned, being the owners of not less than seventy -five percent (75%), in
value (according to the assessed valuation for general taxation), of the real pro-
perty described on Exhibit "A" attached hereto, lying contiguous to the City of
Tukwila, Washington, do hereby petition that such territory be annexed to and made a
part of the City of Tukwila under the provisions of RCW 35A.14.120, et seq., and any
a- mendments thereto, of the State of Washington.
The territory proposed to be annexed is within King County, Washington, and is
described on Exhibit "A," attached hereto.
WHEREFORE, the undersigned respectively petition the Honorable City Council and ask:
(a) That appropriate action be taken to entertain this petition, fixing a date for a
public hearing, causing notice to be published and posted, specifying the time and
place of such hearing, and inviting all persons interested to appear and voice appro-
val or disapproval of such annexation; and

(b) That following such hearing, and subsequent to approval of the King
County Boundary Review Board if such is convened, the City Council determine by
Ordinance that such annexation shall be effective; and that property so annexed shall
