VanDusen, Mayor May 22, 1986 I have reviewed your situation with staff and find no power where I can intercede on your behalf. You do have the right to appeal or approach the City Council with any problem that is of a concern to the City or its citizens. I must first tell you that they will be unable to deal with a direct appeal of the Board of Architectural Review (BAR) decision at this time, but they could listen to the problems which you feel exist with the City in running your business. The paying of fees and applying for BAR review does not in anyway fulfill all the necessary requirements to obtain approval for a structure in the Interurban Special Review District. The Board, independent of staff, found your plan incompatible with the surrounding area. Since 1982, when the Interurban District was first established for special review of any new structures, the BAR has attempted to establish a level of standards to be met by all new development. They adopted finding and conclusions on your request of which you were sent a copy. It is also my understanding that you have not completed the building permit process for the storage structure approved by the BAR. A structure was built without appropriate BAR approval or building permit and is currently being reviewed after the fact. It is my recommendation that you complete all necessary permit requirements for the storage building and remove the illegal sales office structure. If you feel it is necessary to have an office for your business, it must meet the BAR design criteria and you must obtain the Board's approval before construction. The purpose of the meetings was to discus the two remaining structures on your property that do not have building permits. The storage structure has received BAR approval and Tom does have a copy of the building permit application for the structure. He requested some addi- tion plans including a cross section and two sets of copies from you to resume the plan check and permit process. Regarding your car sales office, your appeal of the BAR decision to not approve the sales office was not timely. You stated that you would be developing the front portion of your property with a full scale development and that you would like to meet with the ORC this month. While the City looks forward to assisting you in the development of your property, the current structure does not meet BAR criteria, has not received a building permit, and cannot be considered a temporary structure until you have actually received a building permit. You must remove the office structure within fifteen (15) days. You have received a letter from the City Attorney dated March 3, 1986, regarding code violations on your property. If the structure is not removed within the timeframe specified above, the attorney will be asked to prosecute. I have just returned from a three week business & holiday trip to read your letter today.: I hope I am still in time to appeal the decision of the Board of Architec- tural Review. I have sold Building "B" and I'm waiting to have the owner pick it up any day now. Buildings A's are both smaller then the 120 sq. ft. minimum requiring a building permit and I believe it was a mistake on my part to include them in this application. Had they been the only buildings under question, I don't believe that they would even have been at issue. How- ever, I would agree to sell both storage sheds to help settle this matter. Building "C" is needed as it presently serves as my sales office for our car dealership "Royal Sales & Rentals Inc." Should your board require ' that I dress up or plant a hedge around the building, I am prepared to do so. If that is not possible, then I would like guidelines as to what type of building would be approved for my car dealership sales office. As you know, I have spent considerable time and monetary expense to pursue this matter. On a practical business approach, the costs have exceeded the value of the building in question. VanDusen CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 85- 41 -DR: LEONARD RIVERO AGENDA ITEM Introduction The applicant is proposing to relocate a single story workshop, which is currently located in the Shoreline area (within forty feet of the mean high water mark of the Green River) to the location indicated in Exhibit A along Interurban Avenue South in front of the Hometel buildings. Findings 1. The applicant's structure is sixteen feet by twenty -four feet, with half inch painted plywood walls, four three by six sliding glass windows (two on each side), a flat roof and one six foot by eight foot roll up door. The use of the structure is for car repair and painting, which is a permitted use in the C -2, Regional Retail Business zone. 2. According to the UBC, the proposed development meets the definition of struc- ture and building and may not be exempt because the roof area exceeds 120 square feet per Chapter 4, Sections 403 and 420, and Chapter 3, Section 301(b). The Uniform Fire Code also applies. 3. The address of the subject property is 14800 Interurban Avenue South; therefore, the structure requires Board of Architectural Review, per TMC 18.60.030(2)(E) relative to the criteria of TMC 18.60.050. Per TMC 18.60.070, the BAR may approve, deny or modify the proposal based on that criteria. 4. Per TMC 18.60.060(2), the structure lies within the Interurban Special Review District and must also be reviewed relative to the criteria of TMC 18.60.060(4). 5. The current use of the site is the Hometel which has a total of eight -nine units in eleven two -story structures with an accessory office. To the south of the site is office use, to the west are multiple family units and commer- cial uses, and to the north are single family units. F^ 85- 41 -DR: Leonard River(' October 24, 1985 Page 2 Conclusions 1. TMC 18.60.050(1): Relationship of Structure to Site: The proposed location for the structure is an approximate 60 foot wide expanse of lawn that stretches along Interurban Avenue South for five hundred and fifty -two feet. Three existing birch trees in the northern quarter of the parcel would be the setting for the workshop. Another structure, not subject to the building code is situated adjacent to the birch trees. TMC 18.60.050(2): Relationship of Structure and Site to Adjoining Areas The subject structure is unique because it will be the first development of the strip of land adjacent to Interurban Avenue South, commonly known as the Puget Sound Power and Light Co. right -of -way. All existing development on the river side of Interurban is setback the width of the right -of -way, except for the 14900 Office building directly south of the subject property. The site and structure are therefore highly visible and in a prominent loca- tion. Planned improvements to Interurban Avenue South, vacation of Maule Avenue and redevelopment along the Avenue will eventually change the look of the streetscape. The improvements to Interurban Avenue will require twenty - feet of additional right -of -way along the east side. The front yard setback requirement in the C -2 zone is twenty feet. Therefore, the structure should be setback forty feet from the front property line to assure conformance with the code and adequate setback for future improvements. TMC 18.60.050(3): Landscape and Site Treatment The use of the structure is for utilitarian purposes and it has been designed accordingly. For this reason and because it is situated in a highly visible area along a major corridor of the city, landscaping should be used to comple- tely screen the structure. The existing birch trees do not provide sufficient density. Evergreen shrubs along the three sides of the structure is suggested to screen the portable storage building which sits on concrete blocks. TMC 18.60.050(4): Building Design The size of the workshop is of less scale than permanent neighboring develop- ments. The structure has a flat roof with no overhang. The windows have no sills or visually interuptive components. The criteria specifies that eva- luation should be based on "quality" of design and relationship to surroun- dings. The plywood sides are painted a neutral grey with white trim on windows and roll up door. Modification of the structure appears necessary to meet the criteria. 85- 41 -DR: Leonard River October 24, 1985 Page 3 2. TMC 18.60.060(4): Special Review Guidelines for Interurban Special Review Area A. Proposed development design should be sensitive to the natural amenities of the area. B. Proposed development use should demonstrate due regard for the use and enjoyment of public recreational areas and facilities. The proposed utilitarian design is less aesthetically pleasing than is poten- tial. The plans for the Interurban corridor show a pedestrian pathway and bicycle path which will be a major amenity in itself and will link two major recreational amenities. Therefore, the design should be revised to be more compatible with these improvements. C. Proposed development should provide for safe and convenient on -site pedestrian circulation. The proposed development is not intended for public use and has not provided on -site pedestrian circulation. D. Proposed property use should be compatible with neighboring uses and complementary to the district in which it is located. The use of the structure is for car repair and painting, and general workshop. The immediate vicinity has primarily residential and office /commercial character, although Interurban Avenue also accommodates light industrial uses north of the subject area in the M -1 district. E. Proposed development should seek to minimize significant adverse environ- mental impacts. F. Proposed development should demonstrate due regard for significant historical features in the area. A Determination of Non Significance has been issued for the proposed develop- ment. Recommendation Based upon the above the staff recommends that the applicant revise his plans to meet the following conditions and that the final plans be brought to the next BAR meeting for final approval: 1. Setback of structure to forty feet from property line. 2. Landscape the north, south and east sides of the structure with an evergreen hedge. 85- 41 -DR: Leonard River` October 24, 1985 Page 4 3. Approval of the structure by Building and Fire Departments. 4. Revision of the design of the building to be more aesthetically pleasing. EI/A 77 A 1 1 L EXHIBIT C EXHIBIT CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 85- 41 -DR: LEONARD RIVERO AGENDA ITEM INTRODUCTION On October 24, 1985, the Board of Architectural Review reviewed the application of Leonard Rivero for one storage shed located in front of the Hometel at 14800 Interurban Avenue South. The Board made a motion to continue discussion of the application to its next regularly scheduled meeting to allow the applicant time to improve the design of the shed. Subsequent to the Board's initial discussion of the application, the applicant decided that it would be judicious to request review of all the unapproved sheds located on his property. FINDINGS 1. The applicant has submitted a revised site plan which shows five storage sheds of various sizes and designs. (Exhibit A). 2. Along with the revised site plan, the applicant submitted revised elevations of the shed which was reviewed at the October 24, 1985 meeting. Improvements include shutters attached to the two side windows and facia along the sides of the structure. Evergreen hedges are also shown on the west and east eleva- tions. (Exhibit B). This structure is hereafter referred to as Shed B. 3. Four additional sheds have been indicated on the revised site plan. Three are to be located in front, on the Puget Power right -of -way. There are two sheds identified as "A" and one shed "C" to be located adjacent to Shed B. The fourth additional building is located behind a tall evergreen hedge adjacent to the Hometel buildings and is referred to as Shed D. 4. Storage buildings "A" are two similar structures measuring eight feet by twelve feet each. The structures sit on concrete blocks, measure eight feet in height, have a single doorway on the south elevation, contain no windows, and have flat roofs. The sheds are currently painted white. (Exhibit C). 5. Building C has an eight foot by fifteen foot six -inch floor plan and is pro- posed to be used as an office building for Royal Sales, a used auto dealership. The structure sits on concrete blocks, has two windows on the south elevation, a door on the east elevation, and a pitched roof. The struc- ture is painted a khaki color with beige trim and has a shingle roof. (Exhibit D). 85- '1 -DR: LEONARD RI\ 3 Dec:mber 19, 1985 Pag 2 CON LUSIONS 6. Shed D will be used for storage, sits on concrete blocks, has two windows located on the west elevation, and has a single door on the south elevation. The structure measures fourteen feet and has a pitched roof. The color of the shed is an unobtrusive forest green with cream trim. (Exhibit E). 7. The proposed uses of the structures will be accessory storage for the Hometel and for Royal Sales, a used car dealership, both of which are permitted uses in the C -2, Regional Retail Business zone. 8. The structures must be reviewed by the BAR per TMC 18.60.030(2)(E) and TMC 18.60.060(2) relative to the criteria of TMC 18.60.050 and TMC 18.60.060(4). 9. Per TMC 18.60.070 the BAR may approve, deny or modify the proposal based on the criteria. 1. TMC 18.60.050(1): Relationship of Structure to Site: The proposed locations of four of the five sheds are on the expanse of lawn that was formerly the Puget Sound Power and Light Co. right -of -way. It seems inharmonious for the property owner to locate numerous small storage struc- tures on highly visible property in front of the Hometel along Interurban Avenue South. As accessory structures they should. be integrated into the site plan of the Hometel development and its structures. The siting of the struc- tures does not provide a desirable transition with the streetscape nor are they in scale with the other structures on the site. The location of Shed D behind the tall evergreen hedge and adjacent to the Hometel buildings seems more appropriate because of its use as an accessory structure for the motel. TMC 18.60.050(2): Relationship of Structure and Site to Adjoining Areas Shed C, to be used as an office, is located approximately twenty -four feet from the property line. The improvement of Interurban Avenue will require an additional twelve feet of right -of -way at this point. The design phase of the roadway improvements will be finished in the near future and right -of -way acquisition funds are in the 1986 budget. It would therefore seem appropriate to set back the dealership office thirty -two feet. Interurban Avenue South is a heavily traveled and highly visible arterial which is a gateway to Tukwila. Gradually development of properties along the arterial have set the tone of quality and appropriate commercial design. The scale of the proposed structures A - C is not in harmony with the design, mass, and size of buildings being developed along Interurban. 85- 41 -DR: LEONARD RIV(.J December 19, 1985 Page 3 TMC 18.60.050(3): Landscape and Site Treatment As indicated on the original site plan three mature birch trees are located in the subject area on the property. Some additional evergreen hedges have been indicated on the east and west elevations of Shed B. While it is appropriate for the applicant to use the existing vegetation to provide a screen, the trees are deciduous and would only be effective when the trees have foliage in the summer. Landscaping around Sheds A and C is not shown and should be required due to the utilitarian design of the structures. The specific number and type of materials to be used to provide a landscape screen would be necessary to analyze its effectiveness as a screen for all four of the structures. TMC 18.60.050(4): Building Design The purpose of the BAR is to encourage well- designed developments that are creative and harmonious with other development. The proposed structures, located along Interurban Avenue would not be in scale or harmonious with their surroundings. The four proposed buildings A - C do not relate to each other, to the existing development on the site, or to neighboring developments. The criteria specifies that evaluation should be based on "quality" of design and relationship to surroundings. Overall the image created is of a disconnected collection of storage sheds which are not in context with the Hometel, Interurban Avenue South, and the community. 2. The planned bike and pedestrian paths will be major ame- nities in themselves and will link two major recreational amenities north and south of the site -- Foster Links Golf Course and Fort Dent Park. The design of the structures B and A for accessory storage for the Hometel and the design of the commercial structure C for an office for a used car dealership do not demonstrate sensitivity to these amenities. The current location of the two Sheds A, and Shed B is along the edge of the river bank which is not permitted and is not in keeping with the river environment of the Green River The location of Shed D is integrated with the overall design of the parcel and is screened from both the river and Interurban Avenue, but still appears out of character with the Hometel, Interurban Avenue South and surrounding development. Richard Nichols, David Kehle, Architects, described the proposed project and noted that concrete block would be used rather than concrete tilt -up. Mr. Kirsop asked what type of tenants there would be. Mr. Nichols indicated there would be a sole proprietor and the use would be distribution of rubberized o'rings and gasket materials. Leonard Carlos Rivero, applicant, said he was prepared to abide by all recommendations made. He questioned the recommendation of the 40' setback requirement. Mr. Collins described the future Interurban Avenue improvements and the setback requirement that was from a design point of view. Byron Sneva, Public Works Director, gave further details on the planned improvements for Interurban Avenue. Mr. Rivero indicated that he would be willing to comply with the Building Department requirements and location of the structure. Mr. Kirsop asked how long the structure had been there. Mr. Rivero said since December, 1984. Mr. Kirsop asked about other structures on the site.
