VanDusen, Mayor MEMORANDUM TO: Short Subdivision Committee Members FROM: Moira Carr Bradshaw DATE: May 8, 1986 SUBJECT: May 14, 1986 Committee Meeting, 9:30 a.m. The Committee will meet next Wednesday, May 14, 1986 at 9:30 a.m. in City Hall Conference Room #3 to discuss the following applications: 85- 48= SS`Leonard:I. Schroeter (Ned'Jaber) The applicant has revised the subject application per comments made during review by the Committee in December 1985. The short plat has been revised to show a division of one parcel, approximately 37,812 square feet into Lot 1, which would measure 82.20 feet by 153 feet or 12,576.6 square feet and Lot 2, which would measure 82.18 by + 307 feet or approximately 25,229.26 square feet (Exhibit A). The proposed lots and the setbacks from the existing structure would meet the zoning code requirements of the R -1 -7.2 district. Lot 1 would front on S. 156th Street and Lot 2 would receive access from a proposed twenty (20) foot easement. The easement would run 153 feet along the east property line. The applicant has submitted a letter (Exhibit B) requesting an exception from TMC (Tukwila Municipal Code) 17.24.030. Because of the limited use of easement for Lot 2, staff would recommend that the Committee approve the exception for a 20 foot private access road. King County Department of Health has approved the proposed short plat and septic system (Exhibit C). A plan for the septic drainfield for Lot 1 has also been sub- mitted (Exhibit 0). Based on the above analysis, staff recommends that the committee approve the pro- posed revised application 85- 48 -SS. At the request of the applicant, the meeting was rescheduled. 85 -48 -SS Leonard Schroeter The proposed short plat of the west half of Tract 26 into three residential lots was tabled pending further review and information. Several of the concerns raised were: 1. Fire Department access to Lot 3 from the existing fire hydrant located on South 156th Street. Proposed private access road is 250 feet in length, subdivision code maximum is 200 feet per TMC 17.24.030. 2. Per Chapter 17.32, exceptions from the subdivision code may be granted when undue hardship may be created as a result of strict compliance. An exception shall not be granted unless: a. There are special physical circumstances or conditions affecting said property such that the strict application of the provisions of this code would deprive the applicant of the reasonable use or development of his land; and b. The exception is necessary to insure such property rights and pri- vileges as are enjoyed by other properties in the vicinity and under similar circumstances; and c. The granting of the exception will not be detrimental to the public welfare or injurious to other property in the vicinity. 3. Septic system location and adequacy on the proposed three lots. Further review by staff revealed that King County Board of Health Rules and Regulations Number 3, Section 24.01 effective July 1, 1984, EXHIBITS Short Subdivision Committee December 11, 1985 Page 2 requires a minimum lot size of 12,500 square feet for septic systems. Therefore, based on King County Health requirements the Committee may not wish to approve any lot size less than 12,500 square feet on the subject parcel. To apply for an exception, the subdivider must submit a letter stating substantiating facts and evidence pertinent to the request. The Short Subdivision Committee shall review and decide on the matter. 4. For additional information the attached exhibits have been prepared to show lot and development patterns between South 156th Street and SR 518. CONCLUSION 1. Since the November 14, 1985, meeting, a letter from the applicant requesting an exception from TMC 17.24.030 has not been received. 2. King County Health Department regulations would not permit Lots 1 and 2 as proposed due to the inadequacy of lot size. REVISED RECOMMENDATION Based upon the above information, the Short Subdivision Committee may wish co deny the application as submitted and filed 85- 48 -SS. Mr. Collins asked if the boundary line adjustment would have any impact or result in reason why the resolution of the Flexi -Five problem. Ms. Bradshaw said the Flexi Five building was located on lot 4, as indi- cated on the survey, and by moving the north boundary line of lot 3, south would be involved in the resolution of that problem. Mr. Collins clarified that the action before the board would not be taking that into account. Mr. Collins asked if that would not preclude some movement of boundary line or short subdivision of that property at a later point. Ms. Bradshaw said no because of the excess square footage of the lot. Gordon Pathman, John R. Ewing and Associates, civil engineer for the appli- cant, and Alfred Budinich, owner of the property, were present at the meeting. Mr. Sneva felt a turnaround had been required in the improvement of 57th Avenue South off of Interurban Avenue South. Mr. Pathman felt a turnaround could be dealt with the development of Parcel B. Schroeter Short Plat An approximate 37,812 square foot parcel is proposed to be subdivided into three lots. Lots 1 and 2 would consist of 10,275 square feet each and lot 3 would consist of approximately, 17,262 square feet. The existing lot, the west i of Tract 26, Sunnydale Gardens Div. 1, fronts on South 156th Street on the south and is bordered by State Route 518 on the north. The property is part of a recent annexation to the City of Tukwila commonly referred to as the McMicken Heights area and is zoned with the Tukwila classification of R -1 -7.2 (Single Family Residential). The proposed lots meet the minimum lot area requirement of 7200 square feet. An existing single family struc- ture is located at 4430 South 156th Street, on Lot 1 and would conform to the zoning code yard setback and lot area requirements. Adequate water supply is available from Water District #75 through an existing four inch water main located forty feet from the site. Sanitary sewer service is not available to the property. A perk test by a certified designer has been performed and results appear to be satisfactory ranging from 4 minutes per inch to 10 minutes per inch. 15 minutes per inch is the maximum rate permitted by the King County Department of Health. Final approval of the short plat should be contingent upon a site inspection and approval by the King County Department of Health. Storm drainage improvements and storm sewers are not available in the area. A site inspection by a Public Works engineer revealed that drainage on the subject property is northward towards SR 518 where culverts have been installed by WSDOT along their access road. A fire hydrant is located on the south side of South 156th Street approxi- mately sixty feet from the site. Access to lots 2 and 3 is shown through a twenty foot easement that is two hundred and fifty feet in length. Residential Design standards pursuant to TMC 17.24.030 requires private access roads to be a minimum of 30 feet in width and a maximum of 200 feet in length. A thirty foot easement can be accommodated but would restrict the buildable area of Lot 2 to eighty -five feet by forty -four feet. The proposed easement length of two hundred and fifty feet would seem reasonable given the depth of the existing lot. Based upon the above analysis the Short Subdivision Committee may wish to approve the application subject to: 1. Approval of King County Department of Health of the septic tank system. 2. Revision of survey to show existing septic tank drainfield. 3. Revision of survey to show a thirty foot access and utilities easement. Application 85- 45 -BLA: Budinich The Budinichs' have applied to adjust the boundary lines of five existing lots to create three lots. Proposed Lot A would be 19,808 square feet, Lot B would be 30,000 square feet and Lot 3 would 7,200 square feet. The sub- ject property is zoned R -1 -7.2 (Single Family Residential). All the pro- posed lots would meet the zone's minimum lot area requirement of 7,200 square feet and minimum yard area requirements. A single family structure is existing on proposed Lot A and would meet all the yard and setback requirements of R- 1 -7.2. The boundary line adjustment would adjust lot lines to follow the topographic pattern of the land on the subject parcels. The adjusted line between Lots A & B will eliminate the nonconforming lot lines under the existing structure. Storm, sewer and water are available to serve the subject properties. 57th Avenue South is unimproved and due to its steep slope (approximately twenty -six percent) is unlikely to be developed.
