Dear Moira, This letter will confirm our telephone conversation withdrawing our request for a conditional use permit to put Purolator Courier on that property located south of 4600 South 134th in Tukwilla. TUKWILA CITY COUNCIL, REGULAR MEETING May 19, 1986 Page 2 PUBLIC HEARING Request from Group W Cable to transfer ownership to Tele- communications Appeal of Planning Commission approval of a Conditional Use Permit for a Truck Terminal at So. 134th Pl. & 47th Ave. So. for Purolator Courier Don Morrison, City Administrator, explained that Group w Cable, Inc. has been sold to TCI Cablevision of Washington. Under the City's Franchise Ordinance a public hearing is required prior to transfer of the franchise. There are three recommendations before Council: (1) The undergrounding be completed on 55th Ave. So., Interurban Ave. between I -5 and I -405 and 58th Ave. So. from So. 142nd to So. 149th; (2) The City be given non - exclusive use of one local access channel on the system and the cable company shall assist the City without charge in preparing and proving the use of a character generated community bulletin board; (3) The holder of the franchise shall be subject to all terms and conditions of the franchise granted by Ordinance No. 1074, 1060 and the one proposed after passage. Mayor Van Dusen declared the Public Hearing open. Gary Hokenson, Washington State General Manager for TCI Cablevision, noted a letter written by Lon Hurd, 3H Cable Communications Consultants concerning the financial ability of TCI with respect to operating cable systems. The issues that have been raised were discussed at last week's Committee of the Whole Meeting and at the Utilities Committee Meeting. Their position is that they will provide service to any area that needs to be served. They will work with the cities that have expressed an interest in community access to find the best way to do it. Attorney Haney said that the letter which was included in the last packet should be made a part of the Public Hearing record. There being no further comments, Mayor Van Dusen closed the Public Hearing. Mayor Van Dusen declared the Public Hearing open on the appeal of the Planning Commission's approval of a Conditional Use Permit for Purolator Courier. The appeal was filed by Lawrence M. Shaw of NorMed Medical Supplies. Attorney Haney explained that this Public Hearing has been continued from May 19, 1986. Council may adopt the findings and conclusions approved by the Planning Commission, change the decision in any way or overturn the decision of the Planning Commission. Lawrence M. Shaw said that the findings generated by the Planning Department and the action taken seem to be in conflict with some of the decisions the Council had made a year ago. This project is behind Far West Paints and across from the Fostoria Park Development. A year ago Council heard an appeal for a Conditional Use Permit. At that time certain conditions were placed on the project. The scope of this new proposal is quite different from the previous one. This is a large facility, a big company and r..nnc company. They have indicated 35 to 60 trucks. They are a national company and represent a large potential operation. He is concerned about the effect this will have on the neighborhood. The reasons for this appeal are: (1) A traffic study has not been done to determine the impact of this facility. Tukwila required NorMed to perform a traffic study for their building. (2) Last spring the City Council did conditionally approve a small truck distribution facility in this area, the scope of the approved facility was much smaller. Additionally, Council imposed a series of conditions on the former faci- lity. (3) NorMed chose to locate their facility in this area based on the Planning Department's assurance that the area would be encouraged to be developed as quality office /warehouse faci- lities. If this decision is upheld a precedent for large truck distribution centers will be established. (4) Purolator is one of the largest trucking companies in the United States providing both overland and air service nationally. This facility is envisioned to become a major hub for the Puget Sound area. Purolator did not feel they could live within the constraints applied under the old application so no constraints were put on them whatsoever. He asked Council to think about what the effect is and consider some constraints, consider what the affect will be on the area and the precedent established. Attorney Haney noted that the Council packet will be Exhibit #1, the site plan, Exhibit #2 and the pictures (photographs) distributed to Council, Exhibit #3. Moira Bradshaw, Planning Department, summarized the proposal. On February 27, 1986, the Planning Commission approved the application of W. Lee Singleton for a truck terminal (Purolator Courier) to be located at So. 134th Street and 47th Ave. South. At that time they accepted Staff's Findings and Conclusions with six conditions. (1) Limit traffic to So. 134th St. north of 47th Ave. So., (2) Exceed landscape code requirements to screen proposed use from surrounding single family areas. (3) Prevent lighting spillover and glare onto adjacent pro- perties. (4) Request Public Works to install street signs prohibiting - through truck traffic south of the site and no parking signs along So. 134th Place. (5) The Conditional Use Permit is subject to review at any time. (6) Recommendation to Public Works to prohibit on- street parking on South 134th Street after the street improve- ment is completed. Council Member Morgan arrived at the meeting. Council Member Harris said the City is putting drastic restrictions on this area when all through the business district huge trucks make deliveries all hours of the day and night. We have done nothing to restrict them. We have two large truck terminals off of Interurban Avenue that work day and night, and we have done nothing to restrict them. It is not justice when we restrict a company that is going to have only one truck delivery during the night, and we don't restrict any of the others. This is an area that is ideal ror trucks. Councilman Simpson said that sometime ago Council put restrictions on tractor - trailers going into this area; it was limited to two axle vehicles. If we let the trucking go in between 11:00 and midnight, the other businesses are going to want to do the same. Brad Collins, Planning Director, said that on Conditional Use Permits, they are looking at each use on site specifically. This is one of the reasons for a Conditional Use Permit. We look at each particular use and operation and site specifi- cally. They don't have to all be exactly the same conditions. Council Member Phelps said her concern is that this is the third trucking type facility in this area. Attorney Haney said the more trucking that goes in there, it becomes more difficult to deny a permit. Council President Duffie said that if we have an ordinance or a policy that says you cannot drive an 18 wheeler down a residential street, we must enforce it. Moira Bradshaw, Planner, said that if someone notifies them of a violation, they will go out and do something. Councilman Simpson said he has no problem with Purolator locating there except for the midnight delivery. If we do allow this, he said he would like to see it monitored closely. Attorney Haney recommended that Council Member Morgan listen to the first part of the tape before entering into discussion. Jim Gayther, 4334 So. 133rd St., noted that. in 1977 there were two attempts to put in a trucking terminal in the Fostoria area. At that time there was a lot of concern expressed by the neighbors. He was attempting to talk to one of the people when a truck went by and the conversation was interrupted to the point that you could not be heard. The people adjacent to truck terminals do not even have freedom of speech in their yards. At that time (in 1977) the Washington State Department of Ecology had limits of 50 DB in residential areas and 70 DB in industrial. The amount of DB to interfere with speech in normal tones at three feet is 61 DB, so it was quite excessive. Earlier, an engineering firm made a study and the results were that the noise that would be generated by a truck terminal was far in excess of the 70 DB level. He is concerned about this and is also concerned about the traffic. South 133rd Street is rather soft. When truck traffic passes his property, he can tell if the truck is loaded or not by the vibrations in the ground. Mr. Shaw said if Council affirms the situation, there is a trucking facility closer to the residential area. It is extremely difficult to say no once you have said yes with no conditions. As other facilities move into the area, the whole character of the area begins to change. There will be an understanding that this is an okay area for large trucks. Maybe only have one a night but there is the potet i :' :.. What happens if the operation continues to expand? It is very difficult, once you grant a permit, to do anything about it. You are establishing a major precedent - -he asked Council to think very carefully about this. RE: 85 -49 -CUP: Singleton DATE: March 20, 1986 Council Issues and Options The City Council has received a timely letter of appeal on the Planning Commission approval of a Conditional Use Permit for a truck terminal for Purolator Courier. The City Attorney has stated that appeal of the SEPA Determination in not timely and therefore not a subject of review by the Council. The appellant is Lawrence Shaw, President of Normed Wholesale Medical Supplies and the developer of the recently constructed office /warehouse at 43105 131st Place. The appellant has listed four (4) reasons for the appeal. In response to reason number one, the City required an access study for Normed because of the proximity of their proposed entrance to the 131st Place and 42nd Avenue intersection and the slope of the road between these two points. The Public Works Department feels that visibility and access to the proposed Purolator entrance would be adequate. The second reason for appeal was the inconsistency in truck terminal con- ditions for permits in the area. Two other conditional use permits have been approved in the Fostoria Industrial Park. The first one was for Northwest Imports who was required to limit their hours of operation to 7:00 -6:00 p.m. Monday through Friday and that there be no long -term parking of truc..,, vans or trailers on site. The World Wide Cargo Services permit was also subject to limited hours of operations for truck movement and that vehicles be limited to two axle, non - diesel. The conditions attached to the Purolator Courier permit are as follows: 1. Limit traffic to 134th Place north of 47th Avenue South. 2. Exceed landscape code requirements to screen the proposed use from the surrounding single family areas. 3. Prevent light spillover and glare onto adjacent properties. 4. Forward to the Department of Public Works the recommendation of No Truck Traffic" and "No Parking" signs at appropriate points along 134th Place. 5. Reason number four contends that the proposed scope of the project is . misleading and that the information given by the applicant is not a correct portrayal of the intended use of the site. In response, the Planning Commission can only act on the information that is given in signed docu- ments and testimony. The conditional use section of the zoning code pro- vides for the revocation of a permit when obtained by deception or misleading representations. As I understand it, this facility, is envisioned to become a major hub for the Puget Sound area. I believe the indicated scope in the application is the tip of the iceberg as . the facility reaches full operation. This area is a small nitch of Tukwila between residential areas and the S -599 and I -5 freeways. It is a fragile area that can be developed nicely or can be allowed to become a traffic congested hodge podge. Any person aggrieved by the decision of the Planning Commission, may appeal that decision to the City Council. The appeal shall be made in writing to the City Clerk within ten days of the Planning Commission decision and shall state the reasons for the appeal. The City Council shall affirm, deny or modify the decision of the Planning Commission within ninety days of the filing of the appeal. The CUP shall automatically expire one year after the date it was granted, February 26, 1987, unless a building permit conforming to plans for which the CUP was granted is obtained within that period of time. A CUP shall automatically expire unless substantial construction of the proposed deve- lopment is completed within two years from the date the CUP was granted by the Planning Commission. The Planning Commission may authorize a longer period for a CUP, if appropriate for the project. The Planning Commission may grant a single renewal of the CUP if the party seeking the renewal can Mr. W. Lee Singlet March 4, 1986 Page 2 ort demonstrate extraordinary circumstances or conditions not known or fore- seeable, at the time the original application for a CUP was granted, which would not warrant such a renewal. No hearing is required for a renewal of aCUP. The Planning Commission may revoke or modify your CUP for any one or more of the following grounds: 1. That the approval was obtained by deception, fraud, or other inten- tional and misleading representations; 2. That the use for which such approval was granted has been abandoned; 3. That the use for which such approval was granted has at any time ceased for a period of one year or more; 4.' That the permit granted is being exercised contrary to the terms or conditions of such approval or'in violation of any statute, resolution, code, law or regulations; or 5. That the use for which the approval was granted was so exercised as to be detrimental to the public health or safety. Any aggrieved party may petition the Planning Commission in writing to ini- tiate revocation or modification proceedings. PUBLIC HEARINGS A. 85 -49 -CUP: Singleton, requesting approval of truck terminal located at approximately South 134th Street and 47th Avenue South. Mr. McKenna stated that he had listened to the January 23, 1986, meeting tapes and viewed all the exhibits. Mr. Larson stated that he listened to the December 19, 1985, meeting tapes and viewed all the exhibits. Mr. Coplen was unable to vote on this application because he was not in attendance at all the previous meetings. However, he requested to remain and participate in the discussion. Being no objection from the audience, he remained. Lee Singleton, 159 Western Avenue West, Seattle, WA, concurred and approved with the staff report. The Commission discussed drainage and traffic circulation. Mr. Singleton said Purolator Courier had no objection to the limitation of hours of operation and the limitation to traffic on certain streets and that conditions of the CUP would be part of their lease. The Planning Commission opened the meeting and departed from Tukwila City Hall at 5:00 p.m. to view the subject site and surrounding area. Ms. Bradshaw approached the site from the west via Southcenter Boulevard, north on 51st Avenue South /Macadam Road, 48th Avenue South and South 134th Place, noting the zoning and comprehensive land use designations and city and site boundaries. The Commission viewed the site, observing the drainage, streets, boundary lines and transportation access points to the area. Mr. Kirsop joined the group at the site. The Commission proceeded to 4310 South 131st Place, Normed Industrial Park, then south along 42nd Avenue South /135th St.,then onto Interurban Avenue South via South 133rd Street. They observed the transportation system of the area and circled the surrounding area again. Mr. Kirsop departed the group from the site. The Commission returned to Tukwila City Hall. Bill Turner, 13435 40th Avenue South, Seattle, WA, was concerned with traf- fic, the warehousing of other goods from other companies and the use of residential streets. Mark Beckmel, 13371 48th Avenue South, was concerned that the roads were not adequate, noise problems, the number of vehicles and refrigeration vehicles used in the operation, and drainage. AGENDA ITEM CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 85 -49 -CUP: W. LEE SINGLETON (Addendum) INTRODUCTION Since the December 19, 1985 Planning Commission meeting, staff has requested addi- tional definitive information on Purolator's operation. The Commission, at its last meeting, requested a special meeting at the subject site. Due to the requirements of notifying property owners, posting the property and publishing notice of the special meeting, and the City Attorney's advice against field meetings, the staff has made available photos of the site and has a van ready to transport the commissioners to the site this evening if they wish. Discussion while away from the tape recorder and the public, however, would be prohibited. FINDINGS 1. According to the applicant, Purolator would be relocating to the site from an existing facility in the metropolitan area. They have a routine delivery via a semi - tractor trailer truck that arrives from Portland, Oregon around 11:00 p.m. and then leaves approximately one hour later. 2. The applicant has verified that there will be seventy (70) vans making one N/ trip in and one trip out. However, the City has had public comment that dispu- tes this facet of the proposed operation. 3. South 134th Place is currently a narrow street. Existing right -of -way would allow a maximum of thirty (30) feet of paving with easements for sidewalks. 4. The City's Comprehensive Plan designation of the area south of 48th Avenue South and east of 42nd Avenue South is low density residential. 5. On January 24, 1985, the Planning Commission approved a Conditional Use Permit for a truck terminal facility at 4475 South 134th Street for Northwest Import subject to limitation of operating hours from 7 :00 a.m. to 6:00 p.m., Monday through Friday, and that there be no long -term parking of trucks, vans, or trailers on site. On June 3, 1985, the City Council approved a CUP for a truck terminal facility at 4477 South 134th Place for World Wide Cargo Services (Profit Freight) sub- ject to limited hours of operation from 6:00 a.m. to 6:00 p.m. Monday through 85-49-CUP: W. LEE S 1NGLJN January 23, 1986 Page 2 • Friday only for the movement of trucks, and that vehicles operated be limited to two axle, non - diesel vehicles. 6. At the October 7, 1985 Council meeting, a complaint was voiced concerning World Wide Cargo Services. World Wide Cargo was contacted by Staff and City patrol supervisors were notified to report violations. The staff has not received any other notice of violations. 7. Per TMC 18.64.070, the Planning Commission may revoke or modify a conditional use permit. Such revocation or modification shall be made on any one or more of the following grounds: O That the approval was obtained by deception, fraud, or other intentional and misleading representations. O That the use for which such approval was granted has been abandoned. O That the use for which such approval was granted has at any time ceased for a period of one year or more. O That the permit granted is being exercised contrary to the terms or con- ditions of such approval or in violation of any statute, resolution, code, law or regulations. O That the use for which the approval was granted was so exercised as to be detrimental to the public health or safety. Any aggrieved party may petition the planning commission in writing to ini- tiate revocation or modification proceedings. Before a conditional use permit may be revoked or modified, a public hearing shall be held. Procedures concerning notice, reporting and appeals shall be the same as required by this chapter for the initial consideration of a con- ditional use permit application. CONCLUSION The comprehensive plan designation and the vehicle trip information generated by the applicant would indicate that existing right -of -way would be sufficient to serve the area. RECOMMENDATION Based upon the findings and conclusions of the staff report dated December 19, 1985 and the additonal findings and conclusion contained herein, the Planning Commission may wish to approve the conditional use permit subject to the following conditions: 1. LEE SINGLETON INTRODUCTION W. Lee Singleton requests a conditional use permit for a truck terminal at the northeast corner of the intersection of 47th Avenue South and South 134th Street. The applicant is proposing to construct a 23,000 square foot structure to be occupied by the Purolator Courier Corp. which requires a conditional use permit. FINDINGS 1. The proposed structure is to be occupied by Purolator Courier for the distri- bution of mail and small packages to Seattle, Tacoma, Bellevue and surrounding areas. 2. The Board of Adjustment, at its May 6, 1982 meeting defined a truck terminal (Exhibit A). The proposed facility would exhibit each of the three (3) characteristics indicative of a truck terminal -- the location would be a place to receive, pick -up and deliver orders placed by customers, would include the use of a dispatcher, and would be used to receive shipments for transloading and consolidation. 3. The subject property is zoned M -1 (Light Industrial) which allows truck ter- minals as a Conditional Use. 4. TMC 18.64.050 contains criteria for review of conditional uses, upon which the Planning Commission may approve, deny or modify the proposal. 5. The property is designated light industrial on the Comprehensive Land Use Plan Map. 6. The subject property is currently occupied by several sheds to be demolished. The Purolator development will occupy the western half of the site. 7. The applicant has a purchase option for the single family structure at 13347 47th Avenue South. 8. The employee automobiles will generate approximately thirty -five trips per day. Seventy (70) delivery vans will generate two trips a day (one trip out /one trip in). The peak time for deliveries is at 9:00 a.m. and the late afternoon, Monday through Friday. Loading and unloading of the vans will 1 85 -49 -CUP: W. LEE SING ON December 19, 1985 Page 2 occur inside the structure. One large delivery would be made at midnight by a tractor trailer at the dock high doors off of 134th Street. 9. North and northwest of the subject parcel are light industrial uses such as Farwest Paints, Fostoria Industrial Park, and Starrow Enterprises. Single family residences are located south and southwest of the site. SR -599 is located along the east property line. 10. A determination of non significance has been issued for the proposed con- ditional use. CONCLUSIONS 1. Criteria TMC 18.64.050(1): The proposed use will not be materially detrimen- tal to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The proposed use will be located in a predominately light industrial neigh- borhood. Because of adjacent single family residences primarily south of the subject property, truck and van traffic should be limited to 134th Street north of 47th Avenue South. Except for the one midnight delivery the hours of operation will be between 9:00 a.m. and late afternoon Monday through Friday. Loading of the vans will occur inside the structure. Two dock high loading doors are located off of South 134th Street to accommodate the large midnight deliver. Any form of lighting on site should be prevented from any spillover or glare onto adjacent properties. 2. Criteria TMC 18.64.050(2): The proposed use shall meet or exceed the perfor- mance standards that are required in the district it will occupy. The proposed development will at least meet all the standards required in the M -1 district since it will be a new structure and subject to current codes. The development will exceed the landscape requirements in order to screen the single family residence located north of 47th Avenue South adjacent to the subject parcel. 3. Criteria TMC 18.64.050(3): The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The proposed development will be compatible with the surrounding light industrial uses. The surrounding single family uses will be somewhat screened by the landscaping requirement. Traffic circulation should be restricted to 134th Street north of 47th Avenue South to prevent increased traffic volumes in single family neighborhoods. 4. Criteria TMC 18.64.050(4): The proposed use shall be in keeping with the goals and policies of the comprehensive land use policy plan. 85 -49 -CUP: W. Policy 4 (p.61) Encourage the use of live landscaping in all develop- ments. Policy 5 (p.61) Promote renovation of areas which are not aestheti- cally pleasing. Objective 2 (p. 62) Provide adequate opportunity for industrial and ware- house uses. The proposal conforms with these portions of the Comprehensive Plan. 5. Criteria TMC 18.64.050(5): All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The following three proposed conditions should minimize the possible adverse impacts which the proposed use may have on the area. 1. Limit traffic to 134th Street north of 47th Avenue South. 2. Exceed landscape code requirements to screen proposed use from surrounding single family areas. 3. Prevent lighting spillover and glare onto adjacent properties. RECOMMENDATION Based upon the above Findings and Conclusions, staff preliminarily recommends that the Planning Commission approve the subject Conditional Use Permit, subject to the following conditions: 1.
