The Short Subdivision Committee, at its meeting on Thursday, November 14,
tabled further discussion of Leonard Schroeter's proposed short plat
85 -48 -SS to Thursday, November 21. At the request of the applicant, the
meeting was rescheduled.
85 -48 -SS Leonard Schroeter
The proposed short plat of the west half of Tract 26 into three residential
lots was tabled pending further review and information. Several of the
concerns raised were:
1. Fire Department access to Lot 3 from the existing fire hydrant located
on South 156th Street. Proposed private access road is 250 feet in
length, subdivision code maximum is 200 feet per TMC 17.24.030.
2. Per Chapter 17.32, exceptions from the subdivision code may be granted
when undue hardship may be created as a result of strict compliance.
An exception shall not be granted unless:
a. There are special physical circumstances or conditions affecting
said property such that the strict application of the provisions
of this code would deprive the applicant of the reasonable use or
development of his land; and
b. The exception is necessary to insure such property rights and pri-
vileges as are enjoyed by other properties in the vicinity and
under similar circumstances; and
c. The granting of the exception will not be detrimental to the
public welfare or injurious to other property in the vicinity.
3. Septic system location and adequacy on the proposed three lots.
Further review by staff revealed that King County Board of Health Rules
and Regulations Number 3, Section 24.01 effective July 1, 1984,

To apply for an exception, the subdivider must submit a letter stating
substantiating facts and evidence pertinent to the request. The Short
Subdivision Committee shall review and decide on the matter.
requires a minimum lot size of 12,500 square feet for septic systems.
Therefore, based on King County Health requirements the Committee may
not wish to approve any lot size less than 12,500 square feet on the
subject parcel.
4. For additional information the attached exhibits have been prepared to
show lot and development patterns between South 156th Street and SR
518.
CONCLUSION
1. Since the November 14, 1985, meeting, a letter from the applicant
requesting an exception from TMC 17.24.030 has not been received.
2. King County Health Department regulations would not permit Lots 1 and 2
as proposed due to the inadequacy of lot size.
REVISED RECOMMENDATION
Based upon the above information, the Short Subdivision Committee may wish
co deny the application as submitted and filed 85- 48 -SS.

The proposed boundary line adjustment is to create a 3 acre parcel to be
described as the Meader Donation Claim No. 24. The subject property is
currently a portion of Meader Donation Claim No. 4. An existing south pro -
perty line is proposed to be adjusted northward approximately seventy -six
(16) feet.
The property is located in the southeast corner of the intersection of West
Valley Highway and South 158th Street and is zoned C -2 (Regional Retail).
A forty -six by twenty -nine foot structure was constructed on the site in
1962. The setbacks indicated on the building permit are seventeen feet
front, seventy to eighty -four feet side yards and twenty feet rear yard.
Prior to final approval of the proposed boundary line adjustment, the
existing structure and setbacks from proposed property lines should be
indicated on the survey. C -2 zoning requires a minimum setback of ten feet
from side property lines.
Sewer and water are available to serve the property.
The Short Subdivision Committee may wish to approve the proposed boundary
line adjustment subject to verification on the survey that the existing
structure meets the C -2 minimum setback requirements.

85- 46 -BLA: Robert Storseth
The applicant is proposing to reduce the width of an existing non - exclusive
ingress /egress and utilities easement from fifty (50) feet to forty (40)
feet. The subject easement is located within Lot 3 of Tukwila Short Plat
79- 26 -SS.
Chapter 17.28.050, Minimum Standards for Commercial /Industrial Subdivision,
allows private access roads to be a minimum width of forty (40) feet.
The subject easement provides access to Lots 1, 2, and 3. Lot 1 contains 3
multi- tenant structures, Lot 2 contains 1 structure (World Tire), and Lot 3
will contain two structures with dual access off South 134th Street and the
private easement.
Exhibit A shows the existing utilities in the easement. Storm lines are
located outside the proposed reduced easement width; therefore, the
description of the easement should be revised to allow fifty (50) feet for
utilities and forty (40) feet for ingress /egress.
According to plans on file with the City for the subject easement improve-
ment, paving width is twenty -eight feet and would be located with the pro-
posed reduced width.
The easement was originally approved subject to a sixty (60) foot diameter
cul -de -sac being constructed at the terminus of the easement, but paving
and a circular traffic pattern has been established in the area (Fostoria
Industrial Park).
Because the easement was created to provide access for Lots 1 and 2, the
approval of each lot's property owner should be obtained.
Based on the above information, the Short subdivision Committee may wish to
approve the application subject to:
1. A revision of the easement descriptions to maintain fifty (50)
feet for utilities and reduce the ingress /egress easement to forty
(40) feet.
2. Approval from property owners of Lot 1 and Lot 2.

for; provided that such constructing, repairing, altering, cr recon-
structing of said Seer Main shall be accomplished in such a manner
that the private improvements existing in this right- of-way shall not
be disturbed or destroyed, or in the event they are disturbed or
destroyed, they will be replaced in as good a condition as they were
immediately before the property was entered upon by the Grantee.

Water Dept. R /W; thence northerly a distance of 925 feet to
the south margin of S. 158th St.; thence easterly a distance
of 10 feet along the southerly martin of S. 158th St. to
the point of beginning. Situated in a portion of Henry
Meador Donation Claim 146, Section 24,.being in area 9,250 sq. ft.
Said grant is made upon the following terms and conditions:
1. The Water Company shall pay unto Nelsen as and in consideration
for said easement grant the sum of Six Thousand Nine Hundred Thirty
Seven and 50/100 Dollars ($6,937.0), having been mutually determined
at a rate of seventy five cents ($.75) per square foot, that is one-
half (1/2) of the fair market value, per square foot, of the land
subject to said easement grant, atl of the date of this instrument.
2. Payment of said consideration - the due date of periodic
payments and the specific amount of such payments - shall be made to
Nelsen at such times and in such amounts as may be mutually agreed
upon by the parties hereto. Provided, that until said consideration
shall have been paid in full to Nelsen by the Water Company, this
instrument shall be unrecorded, and the original hereof, together
with any and all executed copies hereof, shall remain sin possession

6. The access points recited at paragraphs 3 6 4 above shall be
the sole points of access to and the aforedescribed easement
area available to the Water Company for maintenance and /or meter reading

6. The Water Company shall have no right to store vehicles,
maintenance supplies, or other equipment, upon the aforedescribed
easement area; vehicles, maintenance supplies, or other equipment
shall be permitted upon the aforedescribed easement area, only
during the actual construction, maintenance or repair of the water line
within the easement area.
7. There is hereby specifically reserved unto Nelsen full use
and enjoyment of the aforedescribed easement area not inconsistent
with the easement rights hereby granted; provided, Nelsen shall not
construct any permanent structures or buildings, in whole or in part,
upon the aforedescribed easement area excluding existing garsgp thereat.
8. The Water Company agrees to hold and save Nelsen harmless
from any and all damages to the property or persons of third parties
r ising from its use of the easement hereby granted, and the Water
Company further agrees to pay any damage or damages which may arise
to the aforedescribed eaement area or property of Nelsen contiguous
thereto through the use, occupation, and possession of the rights
herein granted to the Water Company.
