85- 62 -SPE: DOMINO'S PIZZA
INTRODUCTION
Domino's Pizza requests a cooperative parking agreement for 15439 53rd South.
The applicant provides fast food pizza delivery and has no in house seating.
Employees of the restaurant will drive their automobiles to deliver pizzas to
houses or businesses. The subject site, however, does not have the minimum
number of parking spaces required for a fast food restaurant. (Exhibit A)
FINDINGS
1. The definition of a fast food restaurant per TMC 18.06.075 means an
establishment whose principal business is the sale of foods...served in
disposable containers...for takeout consumption off the premises.
2. Domino's leases 1500 square feet and per code is required to have thirty
(30) parking spaces - one for every fifty (50) square feet of floor space.
3. The subject site, lot 1 of Tukwila short plat 78- 99 -SS, is developed with
one single story structure. The structure is leased to three other tenants
who are listed in Table 1.

4. Thirty -four parking stalls are available on site and nineteen (19) are
required for the three other tenants (Exhibit B). Fifteen are available for
Domino's; half the required number.
5. Per TMC 18.56.070, Cooperative parking facility, when two or more uses
occupy the same building and cooperatively share an off - street parking faci-
lity, the total parking requirement shall be the sum of the requirements for
the greater of the uses at any one time, or as deemed necessary by the
Planning Commission. All applications for cooperative parking shall be
reviewed and approved by the Planning Commission.

2. Alternative Two: "Greatest sum of the uses"
6. Domino's will hire two full -time and two part -time employees. The applicant
has indicated that 95 percent of the business is delivery and only 5 percent
of the customers pick up their orders. Peak hours for Domino's are between
5:00 p.m. and 8:00 p.m., which would not appear to conflict with the
existing predominant uses (Exhibit B).
7. The parking for the subject structure is located behind the building and the
driveway to the lot slopes upward.
8. The property is zoned C -2, Regional Retail, which permits the proposed use.
CONCLUSIONS
1. Alternative One: "Full code compliance"
With all spaces leased, as in Table 1, the site has a fifteen (15) stall
deficit and therefore is unable to comply with the code. Only fifteen
parking stalls would be available for the restaurant during office hours of
8:00 a.m. to 5:00 p.m.
As stated in TMC 18.56.070, a cooperative parking agreement must reflect
full code compliance for the sum of all tenants open for business at any one
time. Since Domino's is open throughout the day and into the evening, the
site would still have a fifteen stall deficit during the weekday hours.
3. Alternative Three: "Planning Commission discretion"
The Planning Commission may, under the language of TMC 18.56.070, reduce
parking requirements below the greatest sum of the uses when circumstances
warrant. Domino's Pizza is not a typical fast food restaurant. They are
primarily a delivery service and our code has provided cooperative parking
agreements as the only interpretive vehicle available to accommodate the
parking demands for this type of use. Given the number of employees and
type of operation, it would appear that the fifteen available parking spaces
would be sufficient for the operation during its off -peak hours. To alle-
viate potential problems relative to parking identification for any pick -up
customers, an internal informational sign to identify Domino's parking would
be appropriate.
RECOMMENDATION
Based upon the above analysis, the Planning Commission may wish to approve the
request for a cooperative parking agreement for Domino's Pizza subject to the
following conditions.
1. It is understood that this cooperative parking agreement is approved under
this application upon finding by the Planning Commission that such action is

I would like to request the use of a cooperative parking agreement
for the Domino's Pizza store to be located at 15439 53rd South in
Tukwila. As only 5% of our customers will come to the location to
pick up pizzas and the other 95% will be delivered to them at home,
(they order over the telephone) we will not be using or needing the
number of spaces required by the zoning rules. Based on the past
thirty Domino's Pizza stores I have been involved with personally,
the number of customers coming to the location to pick up a pizza,
rather than having it delivered, is under seven . (7):'per full day
operation. Since we are open 1030am to lam, that is approximately
..8 customers needing to park per hour.

COOPERATIVE PARKING AGREEMENT
THIS INSTRUMENT, executed this date in favor of the CITY OF TUKWILA,
a municipal corporation (herein call "CITY "), by the undersigned
owners of the within described property (herein call "OWNERS)
and Valerie A Cavanagh owner of Pizza Link, Ltd. db.aDomino's Pizza, and a
tenant herein described property (herein called'Dominos'Pizza).
Witnessth
WHEREAS, Owners are persons owning a fee simple and /or having a
substantial beneficial interest in certain real property (herein
called the "PROPERTY ") which is more particularly described in
Exhibit 1 attached hereto and incorporated herein by reference; and
WHEREAS, Dominos Pizza is a tenant of a portion of the PROPERTY;
and
WHEREAS, pursuant to Chapter 18.56 of the Zoning Code of the City
of Tukwila, Dominos Pizza has petitioned the TUKWILA PLANNING
COMMISSION for approval of a cooperative parking facility located
at the PROPERTY; and
WHEREAS, the TUKWILA PLANNING COMMISSION is willing to grant the
petition for a cooperative parking facility subject to execution
and recording of an agreement with the CITY pertaining to certain
uses of the PROPERTY in the interest of public safety and health;
NOW THEREFORE, OWNERS and Dominos Pizza hereby covenant , bargain
and agree on behalf of themselves their heirs, successors and
assigns, that the PROPERTY will be used subject to the following
therms and conditions:
1. Total on -site arrangement of parking spaces shall be as described
on the site plan. (Exhibit 2)
2. Dominos Pizza be limited to an occupancy load of persons
and parking spaces between and , through
3. Special promotional events within the PROPERTY which
delete from service available parking shall not be allowed during
periods of simultaneous operation of all other tenants of the
PROPERTY. Special promotional events may be scheduled only when
adequate parking is available.

4. It is understoo that the cooperative parking facility is
approved under this application upon finding by the PLANNING
COMMISSION that such action is taken in the public interest. The
COMMISSION reserves the right to review this cooperative parking
facility agreement annually and may require cancellation thereof
or modification of its terms upon finding of adverse impacts to
public safety or health.
5. The terms of the cooperative parking facility agreement approved
shall be set forth in a formal instrument which shall be recorded
with King County Department of ELECTIONS AND Records, and shall
run with the land, prior to issuance of the final certificate of
occupancy for DOMINO'S PIZZA.
6. This agreement may be amended or modified by agreement between
the OWNERS and the city: provided such amended agreement shall be
approved by the TUKWILA PLANNING COMMISSION after written notice
of of property owners within three hundred (300) feet of the PROPERTY.
7. Nothing in this agreement shall prevent the TUKWILA CITY COUNCIL
from making such further amendments to the Zoning Code as it may
deem necessary in the public interest. Nothing in this agreement
shall prevent the application to the PROPERTY of future amendments
to the Zoning Code, if otherwise applicable.
8. This agreement is made for the benefit of the City. The City
may institute and prosecute any proceedings at law or in equity
to enforce this Agreement, including injunctive relief. The City
shall be entitled to recover from owner Valerie A. Cavanagh attorney
fees and costs for any action commenced pursuant to this Agreement.
9. If any change is made to the above descripted tenants or
complementary tenant mix and such change effects the parking approved
by the planning commission on ,1985 (a copy of which
is attached in exhibit 3 and incorporated herein by reference) so
as to create a need for additional parking, the Tukwila Planning
Department staff may request the Tukwila Planning Commission to
review the Cooperative Parking Facility, and the Tukwila Planning
Commission may require cancellation thereof or modification of its
terms upon finding of adverse impact to public safety or health.
10. In the event any covenant, condition or restriction hereinabove
contained, or any portion therpof, is invalid or void, such
invalidity or voidness shall in no way affect the covenant, condition

letter from Richard Hall, Colonial II, concerning truck traffic in that
area.

necessity for the cooperative parking agreement.
MR. COPLEN MOVED TO APPROVE DOMINO'S PIZZA, APPLICATION 85- 62 -SPE, SUBJECT
TO THE FINDINGS AND CONCLUSIONS OF THE STAFF REPORT, WITH THE FOLLOWING

Minutes of the January 23, 1986, Planning Commission meeting.
Chairman Knudson called the meeting to order at 8:05 p.m. Other
Commissioners present were Mr. Sowinski, Mr. Larson, and Mr. Kirsop.
Representing staff were Rick Beeler, Moira Bradshaw, and Becky Kent,
Planning Department.
APPROVAL OF MINUTES
MR. KIRSOP MOVED TO APPROVE THE MINUTES OF THE DECEMBER 19, 1985, PLANNING
COMMISSION MEETING AS CORRECTED, AND THE DECEMBER 12, 1985 MEETING. MR.
SOWINSKI SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY.
PUBLIC HEARINGS
A. 85 -40 -CUP: W. Lee Singleton, requesting approval of a truck ter-
minal located at approximately S. 134th Street and 47th Avenue
South.
Chairman Knudson opened the public hearing.
Ms. Bradshaw summarized the staff report and entered Exhibit D, photographs
of the site and surrounding area into the record.
Lee Singleton, applicant„ 159 Western Avenue West, Seattle, WA., recapped
discussion of the December 19, 1985, meeting. He said that they would be
willing to limit truck traffic to non residential streets one truck trip
per day, five days a week, hours of truck operation from 12:00 p.m. to
10:U0 p.m., and one trip per van a day, and add landscaping and screening.
Bill Turner, 13435 40th Avenue South, Seattle, WA, was concerned with traf-
fic, the warehousing of other goods from other companies and the use of
residential streets.
Mark Beckmel, 13371 48th Avenue South, was concerned that the roads were
not adequate, noise problems, the number of vehicles and refrigeration
vehicles used in the operation, and drainage.

Joanne Poirier 13405 42nd Avenue South, was concerned with the inadequacy
of the streets, flooding, road size, devaluation of surrounding properties,
noise and traffic.
Chairman Knudson closed the public hearing.
The Commission discussed enforcement of the restriction on hours of opera-
tion for truck terminals. They felt the operation was more compatible than
some of the other operations in the vicinity.
MR. KIRSOP MOVED TO ACCEPT THE STAFF'S FINDINGS AND CONCLUSIONS AND APPROVE
THE CONDITIONAL USE PERMIT SUBJECT TO THE FOLLOWING CONDITIONS:
1. LIMIT TRAFFIC TO SOUTH 134th STREET NORTH OF 47th AVENUE SOUTH.
2. EXCEED LANDSCAPE CODE REQUIREMENTS TO SCREEN PROPOSED USE FROM
SURROUNDING SINGLE FAMILY AREAS.
3. PREVENT LIGHTING SPILLOVER AND GLARE ONTO ADJACENT PROPERTIES.
4. THERE BE DEDICATION OF 15 FEET OF RIGHT -OF -WAY ON EACH SIDE OF SOUTH
134th STREET BETWEEN THE ACCESS POINT OF THE NORTHWEST EDGE OF THE SITE
TO 47th AVENUE SOUTH, AND THAT AN LID BE ENTERED INTO TO SOLVE THE
DRAINAGE AND STREET UPGRADE.
Jerry McLees spoke out of order and said the 50 foot building setback from
the zoning ordinance would be violated.
Chairman Knudson clarified that the public hearing had already been closed.
Mr. Beeler clarified the motion.
Jim Haney, City Attorney, felt there may be a difficulty with recommen-
dation 4.
Motion died for lack of second.
Chairman Knudson reopened the hearing to allow Mrs. Poirier to add some
additional comments then again closed the public hearing.
MR. LARSON MOVED TO CONTINUE THE APPLICATION 85 -49 -CUP TO FEBRUARY 26,
1986, AT 5:00 P.M., AT TUKWILA CITY HALL, TO ALLOW A VISIT TO THE SITE AND
RECONTINUE TO THE FEBRUARY 27, 1986, REGULAR MEETING. MR. SOWINSKI
SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY.
The Commission discussed the night's agenda and polled the applicants for
impacts of continuance to the next regular meeting.

B. 85 -61 -R: McLees Zoning Amendment, requesting an M -1 Light
Industrial classification for 4526 S. 135th Street, which is pro-
posed to be annexed to the City of Tukwila.
Ms. Bradshaw summarized the staff reports and submitted Exhibit D, pho-
tographs of the site and vicinity, to the Commission.
Bill Turner, 13435 40th Avenue South, was in favor of a buffer zone between
the residential area and industrial area, rather than industrial next to
residential.
Joanne Poirier, 13405 42nd Avenue South, suggested a buffer zone.
Jerry McLees, applicant, summarized his request for M -1 zoning, and
landscaping and buffering of the site. He said there would be no access
from Macadam Road (South 135th Street), but from South 134th Street.
Chairman Knudson closed the public hearing.
MR. SOWINSKI MOVED TO RECOMMEND APPROVAL OF M -1 ZONING TO THE COUNCIL, AND
ACCEPT STAFF'S FINDINGS AND CONCLUSIONS. MR. KIRSOP SECONDED THE MOTION,
WHICH PASSED UNANIMOUSLY.
MR. SOWINSKI MOVED TO RECESS FOR 5 MINUTES. Mr. KIRSOP SECONDED THE
MOTION, WHICH PASSED UNANIMOUSLY.
The Commission reconvened at 10:30 p.m.

BOARD OF ARCHITECTURAL REVIEW
A. DR- 01 -84: Windmark Homes, requesting approval of plans for 66
multiple family units on a 3.85 acre site on the northerly and
southerly sides of Sunwood Boulevard west of 62nd Avenue South and
south of the existing Sunwood development.
Mr. Beeler summarized the staff report with the following corrections:
Under Finding 6 it was clarified that the landscaping calculations were
revised from 14,350 square feet to 12,000 square feet of recreation
space provided, which is 49 square feet less than required.

George Kresovich, of Hillis, Cairncross, Clark and Martin, 403 Columbia
Street, Seattle, WA 98104, represented the applicant. He summarized the
history of the application and reviewed his letter of January 14, 1986,
summarizing his revisions to the project.
John Lane, Architect and Planner, 115 West Denny Way, Seattle, WA,
described the project and reviewed the changes made from previous plans,
including compatibility with other structures, carports and trash enclo-
sures, lighting, recreational facilities, recreation areas, and the height
of the buildings.
Steven Shea, Landscape Architect, 2021 Minor East, Seattle, WA 98102,
reviewed the landscape plan, the types of trees and vegetation provided,
and the proposed pathway.
Mr. Beeler clarified that the color rendering provided was the same as
Exhibit 2B in the staff report.
Mr. Kresovich repeated a comment made by Dick Taylor before the City
Council on July 16, 1985 regarding the building height. He felt the
building height would comply with what Mr. Taylor had been informed. He
requested that the Board review the project in light of their efforts to
comply with the Zoning Code requirements.

Mr. Hard requested that the Board recommend to the responsible official
that a new environmental checklist be provided.
Mr. Kresovich maintained the intention of the project to be condominiums.
The Board discussed road maintenance of Sunwood Boulevard and what would be
necessary to bring it up to City standards.
Mr. Beeler said he felt comfortable with the plans relative to the criteria
in the Zoning Code, that the type of construction normally isn't specified,
and conceptual plans early on had placed buildings in almost the same loca-
tion as projected during the previous rezone of the property. He said the
Responsible Official hadn't seen anything in the revised plans to substan-
tiate reopening the environmental review.

Ref; concerning 85- 62 -SPE Domino's Pizza
There is no semi -truck turnaround on the property
and there have been deliveries of equiptment and supplies
to that business with semi - trucks. In fairness I should say
that there have been problems for deliveries to other
businesses on the property. As of now semi - trucks have to
use my property to turn around and back up the street to
make deliveries. I have had too much past damage to sprinkler .
systems, cement pads and curbs to permit semi - trucks on
my property.
Also I have to clean up my lot in the mornings from
people parking and eat fast foods and drinking beer. I sure
don't need additional cleanup problems.
Please take these concerns into your consideration.
