Dear Mr. Beeler:
I have been requested to submit an alternative glass for your approval
on the North Hill Associates Office Building.
The sample included in the Board of Architectural Review has a
daylight exterior reflectivity of 20 %. We would like to substitute
a glass with daylight exterior reflectivity of 24 %, a difference of
4%. This slight increase will provied a significant increase in solar
protection. It will also reduce the annual energy consumption for the
building.
The color of the glass will remain the same as presented for the Board
of Architectural Review.

WHEREAS, the City of Tukwila is a noncharter optional
municipal code city and as such has the power to enter into
agreements to promote the public health, safety and welfare of
its citizens and thereby control the use and development of
property within its jurisdiction, and
WHEREAS, Western Pacific Properties, Inc., hereinafter
referred to as the "Owner" is the owner of certain real prop-
erty located within the City of Tukwila, which is the subject
of this Agreement and which is legally described on Exhibit A
attached hereto and incorporated herein by this reference as if
fully set forth, and
WHEREAS, the Owner is in the process of developing the
said property and has applied for a variance from the 15 foot
front yard landscaping requirement of Section 18.52.020 of the
Tukwila Municipal Code to permit required parking on the prop-
erty, and
WHEREAS, after public hearing on the said variance appli-
cation, the Board of Adjustment on May 3, 1984 determined to
grant a variance to the Owner reducing the required front yard
landscaping by 10 feet on the property, subject to the owners
signing an agreement to landscape five feet of front yard on
the property and to landscape an area of the public right of
way adjacent to the property and lying between the property and
the travelled portion of Southcenter Boulevard, all as shown on
the site plan drawing attached hereto as Exhibit B and incorpo-
rated herein by this reference as if set forth in full, and
WHEREAS, the Owner has indicated its willingness to sign
such an agreement and to perform such landscaping, now, there-
fore,
For and in consideration of the grant of a variance to the
Owner from the front yard landscaping requirement of Section
18.52.020 of the Tukwila Municipal Code by reducing the
required 15 foot front yard landscaping to five feet, the Owner
covenants and agrees as follows:
1. Landscaping on Right of Way. The Owner agrees to land-
scape, at the Owner's expense, that portion of the public
right of way adjacent to the property described on Exhibit
A attached hereto and incorporated herein by this refer-
ence as if set forth in full and generally shown on the
site plan drawing attached hereto as Exhibit "B" and
incorporated herein by this reference as if set forth in
full. The landscaping shall be installed according
to applicable to City standards and according to
plans approved by the City Planning Director. All costs
for the design, installation and inspection of said land-
scaping shall be paid by the Owner.
2. Landscaping Bond. The landscaping performance and
maintenance bond furnished by the Owner in connection with
Owner's construction and installation of landscaping on
the property as part of Owner's development of the same
shall be extended to cover all landscaping installed
by the Owner on the public right of way. Said bonds
shall be in an amount determined by the City Planning
Director to be sufficient to ensure completion and
maintenance of the landscaping.
3. Binding Effect. This Agreement shall be filed and record -
e3 the King County Auditor /Recorder and shall be a
covenant running with the land described on Exhibit A
attached hereto and incorporated herein by reference as if
set forth in full, and shall be binding upon the Owner;
its successors in interest and assigns.
4. Payment of Recording Fees. The Owner agrees to pay all
costs of recording this Agreement.
5. Police Power. Nothing in this Agreement shall be con-
strued to restrict the authority of the City to exercise
its police powers.
6. Enforcement. In addition to any other remedy provided by
law, the City may, at its discretion, maintain a lawsuit
to compel specific performance of the terms and conditions
of this Agreement or to otherwise enforce its provisions,
through injunctive or other relief, and if the City pre-
vails in such action, it shall be entitled to recover all
costs of enforcement, including reasonable attorneys fees.
7. Severability. In the event any section, paragraph, sen-
tence, term or clause of this Agreement conflicts with
applicable law or is found by any court having jurisdic-
tion to be contrary to law, such conflict shall not affect
other sections, paragraphs, sentences, terms or clauses of
this Agreement which can be given affect without the con-
flicting provision and to this end the terms of this
Agreement shall be deemed to be severable, provided, how-
ever, that in the event any section, paragraph, sentence,
term or clause of this Agreement is found to conflict with
applicable law, the City shall have the right to bring the
proposed development back before the Board of Adjustment
for further review and the imposition of appropriate
conditions to ensure that the purposes for which this
Agreement is entered into are in fact accomplished and
the impacts of the proposed development are mitigated.

Minutes of the May 23, 1985, Planning Commission meeting.
Chairman Knudson called the meeting to order at 7:45 p.m. Other
Commissioners present were Mr. Coplen, Mr. Kirsop, Mr. Orrico, and Mr.
Larson. Representing staff were Rick Beeler and Becky Kent, Planning
Department.
APPROVAL OF MINUTES
MR. COPLEN MOVED TO APPROVE THE MINUTES OF THE MAY 9, 1985, PLANNING
COMMISSION MEETING. MR. ORRICO SECONDED THE MOTION, WHICH PASSED
UNANIMOUSLY.
OTHER
The City Attorney briefing was postponed to the June 13, 1985, Planning
Commission meeting.
BOARD OF ARCHITECTURAL REVIEW
A. DR- 08 -85: Western Pacific Properties, requesting approval of
plans for a 3 -story office building located at 5800 Southcenter
Boulevard (continuance of May 9, 1985, meeting).
Nancy O'Brien, representing the applicant, submitted an elevation drawing
for the Board's review.
The meeting was recessed to go outside and view the screening samples pro-
vided by the applicant.
The meeting was reconvened.
MR. ORRICO MOVED TO APPROVE APPLICATION DR- 08 -85, WESTERN PACIFIC
PROPERTIES, ACCORDING TO THE FOLLOWING FIVE CONDITIONS:
1. IMPROVED PEDESTRIAN SIDEWALK ACCESS INTO THE SITE FROM SOUTHCENTER
BOULEVARD ALONG THE WEST SIDE.

B. DR -09 -85 and 85 -18 -CUP: Metro, requesting approval of a park -and-
ride lot for 260 to 300 automobiles north of the intersection of
Interurban Ave. So. and 52nd Ave. So.
Chairman Knudson stepped down for this item.
Mr. Beeler summarized the staff report.
Don Pierce, Police Chief for the City of Tukwila, was concerned with juris-
dicational problems and suggested annexation to the City of Tukwila. He
recommended low growing plants for the landscaping to promote better visa -
bility and security on the site.
Larry Ellington, METRO, described the project and responded to staff's
recommendations in the staff report.
Chairman Kirsop opened the public hearing for application 85 -18 -CUP, incor-
porating testimony heard on application DR- 09 -85.
Chairman Kirsop closed the public hearing.
The Commission reviewed the preliminary recommendations.
MR. ORRICO MOVED TO APPROVE APPLICATION DR- 09 -85, METRO, FOR APPROVAL OF A
PARK AND RIDE LOT WITH THE FOLLOWING CONDITIONS:
1. REVISION OF THE LANDSCAPING PLAN TO INCLUDE LOW PROFILE SHRUBS AND 2"
CALIPER DECIDUOUS TREES PER REVIEW AND APPROVAL OF THE PLANNING AND
POLICE DEPARTMENTS.
2. PLACEMENT OF THE TRANSIT SHELTER STATIONS TO 8i FEET FROM THE PROPERTY
LINES OR APPROVAL OF A VARIANCE FROM THE BOARD OF ADJUSTMENT.

The Commission discussed the types of samples and information they would
like the applicant to submit.

AGENDA ITEM •
INTRODUCTION
Western Pacific Properties, Inc., proposes a fifteen thousand square foot, three
story building at 5800 Southcenter Boulevard. The Board of Architecture Review is
required to review the proposal.
FINDINGS
1. Per 18.60.030(2)(C)and(D), the BAR shall have authority to review the proposed
development because the building is in excess of ten thousand square feet in a
P -0 district and is located north of I -405 and east of 1 -5.
2. Relative to the criteria of TMC 18.60.050, and per TMC 18.60.070, the BAR may
approve, deny or modify the proposal.
3. The applicant, Western Pacific Properties, Inc., received a rezone of the sub-
ject property from RMH Multiple- Residence High Density to P -0 Professional
Office effective December 31, 1984 (Ordinance #1339).
4. The applicant requested a variance from TMC 18.52.020 relative to the fifteen
foot front yard landscaping requirement (15 feet required, 5 feet proposed).
The site plan submitted for 84 -10 -V showed parking in all but five feet of the
fifteen foot front yard landscape area. In lieu of the remaining ten feet of
required front yard landscape strip, the requested variance was granted sub-
ject to a recorded agreement with the City of Tukwila. The applicant is
responsible for landscaping and maintaining the Southcenter Boulevard right -
of -way adjacent to the subject property with a landscaping plan to be approved
by the Planning Director.
5. Ingress and egress were major concerns discussed during the rezone process of
the subject site. A twenty -five foot utilities easement runs along the west
side of the site and a thirty foot utilities and access easement runs along
the east side. The City stipulated that the easternmost access point would be
right in, right out only and that an additional full ingress and egress point
providing joint access for adjacent properties would be mutually developed at
the west end of the site.

CONCLUSIONS
1. TMC 18.60.050(1) Relationship of Structure to Site
The proposed three story structure is located on the northwest corner of the
site. The one required loading space is located adjacent to the refuse area
in the northeast corner of the site. The dumpster is shown adequately
screened with a six foot high wood fence.
Pedestrian access to the site should be improved with an extension of the
existing sidewalk into the site along the internal vehicular circulation
system.
The minimum number of required parking spaces, including one handicapped
space, appropriately located, are being provided along the east and south
sides of the property.
2. TMC 18.60.050(2) Relationship of Structure and Site to Adjoining Area
A hillside and retaining wall are located at the north and east sides of the
subject property. The Arco Mini Mart is located to the west. Other adjacent
properties are undeveloped and are zoned for high and low density multiple
family.
Because of the structure's location at the toe of a hill and the existence of
multiple dwellings on the hillside above the site, consideration should be
given to the rooftop's appearance. The architect has indicated that no
apparatus are proposed for the rooftop.
The orientation of the building is in a southeasterly direction, appropriately
positioned toward Southcenter Boulevard and the view of Mt. Rainier.
3. TMC 18.60.050(3) Landscape and Site Treatment
The proposed site plan appears adequate. Sufficient screening is shown for
the parking areas. The caliper of the trees along the Southcenter Boulevard
right -of -way, however, should be increased to a minimum of four inches to
strengthen the Southcenter Boulevard axis and to increase the degree of
landscaping appropriate for the site.
4. TMC 18.60.050(4) Building Design
The modern, three story structure would have a curtain wall exterior with 20
percent maximum reflective glass. The typical glass box design has been
relieved somewhat by varying the building setbacks of the east and south
walls.

The Police Department has responded that the potential glare from the building
will probably be minor due to the setback of the building from Southcenter
Boulevard. In addition, the building's distance from the signaled intersec-
tion of Southcenter Boulevard and the S Line Bridge should be far enough to
alleviate any traffic hazards due to possible glare.
The average height of the east, west and south sides is 38 feet and 25 feet on
the north side. The overall average building height measures thirty -four feet
nine inches which does not exceed the maximum building height limit of thirty -
five feet.
The applicant should provide greater detail and rationale for the proposed sun
screens shown along the west and south corners of the structure.
Three exterior lighting fixtures have been located around the exterior of the
parking areas. The design of the fixture is shown in Exhibit D and is com-
patible with the architectural concept of the site. Maximum height is pro -.
posed for 20 feet. The proposed lighting should not extend beyond the limits
of the site or reflect above the site into the multiple family area. Approval
of an occupancy permit will be conditioned on the effectiveness and contain-
ment of the lighting on the site.
PRELIMINARY RECOMMENDATION
Based on the above staff recommends approval of the site plan subject to:
1. Improved pedestrian sidewalk access into the site from Southcenter
Boulevard.
2. Four inch caliper trees along Southcenter Boulevard.
3. Review and approval by the Board of Architecture Review of proposed sun
screens.

STAFF REPORT
AGENDA ITEM IV) E. : DR- 08 -85: WESTERN PACIFIC PROPERTIES, INC.
INTRODUCTION
Western Pacific Properties, Inc., proposes a fifteen thousand square foot, three
story building at 5800 Southcenter Boulevard. The Board of Architecture Review is
required to review the proposal.
FINDINGS
1. Per 18.60.030(2)(C)and(D), the BAR shall have authority to review the proposed
development because the building is in excess of ten thousand square feet in a
P -0 district and is located north of I -405 and east of I -5.
2. Relative to the criteria of TMC 18.60.050, and per TMC 18.60.070, the BAR may
approve, deny or modify the proposal.
3. The applicant, Western Pacific Properties, Inc., received a rezone of the sub-
ject property from RMH Multiple- Residence High Density to P -0 Professional
Office effective December 31, 1984 (Ordinance #1339).
4. The applicant requested a variance from TMC 18.52.020 relative to the fifteen
foot front yard landscaping requirement (15 feet required, 10 feet proposed).
The site plan submitted for 84 -10 -V showed parking in all but five feet of the
fifteen foot front yard landscape area. In lieu of the remaining ten feet of
required front yard landscape strip, the requested variance was granted sub-
ject to an agreement (Exhibit A) with the City of Tukwila. The applicant
would be responsible for landscaping the Southcenter Boulevard right of way
adjacent to the subject property with a landscaping plan to be approved by the
Planning Director. To date this agreement has not been completed.
5. Ingress and egress were major concerns discussed during the rezone process of
the subject site. A twenty -five foot utilities easement runs along the west
side of the site and a thirty foot utilities and access easement runs along
the east side. The City stipulated that the easternmost access point would be
right in, right out only and that an additional full ingress and egress point
providing joint access for adjacent properties would be mutually developed at
the west end of the site.

CONCLUSIONS
1. TMC 18.60.050(1) Relationship of Structure to Site
The proposed three story structure is located on the northwest corner of the
site. The one required loading space is located adjacent to the refuse area
in the northeast corner of the site. The dumpster is shown adequately
screened with a six foot high wood fence.
Pedestrian access to the site should be improved with an extension of the
existing sidewalk into the site along the internal vehicular circulation
system.
The minimum number of required parking spaces, including one handicapped
space, appropriately located, are being provided along the west and south
sides of the property.
2. TMC 18.60.050(2) Relationship of Structure and Site to Adjoining Area
A hillside and retaining wall are located at the north and east ends of the
subject property. The Arco Mini Mart exists to the west. Other adjacent
properties are undeveloped and are zoned for high and low density multiple
family.
Because of the structure's location at the toe of a hill and the existence of
multiple dwellings on the hillside above the site, consideration should be
given to the treatment and /or existence of rooftop appurtenances. The issue
has not been addressed on the site plans and should be adequately treated
prior to final approval.
The orientation of the building is in a southeasterly direction, appropriately
positioned toward Southcenter Boulevard and the view of Mt. Rainier.
3. TMC 18.60.050(3) Landscape and Site Treatment
The proposed site plan appears adequate. Sufficient screening is shown for
the parking areas. The caliper of the trees along the Southcenter Boulevard
right of way, however, should be increased to a minimum of four inches to
strengthen the Southcenter Boulevard axis and to increase the degree of
landscaping appropriate for the site.
4. TMC 18.60.050(4) Building Design
The modern, three story structure would have a curtain wall exterior with 20
percent maximum reflective glass. The typical glass box design has been
relieved somewhat by varying the building setbacks of the east and south
walls.

The applicant should provide greater detail and rationale for the proposed sun
screens shown along the west and south corners of the structure.
As mentioned earlier, any rooftop apparatus should be screened from overhead
view.
Three exterior lighting fixtures have been located around the exterior of the
parking areas. The overall design of the fixture is needed to determine its
compatibility with the architectural concept of the site. Height and type of
lighting should also be specified to determine its effectiveness.
PRELIMINARY RECOMMENDATION
Based on the above staff recommends approval of the site plan subject to:
1. Improve pedestrian sidewalk access into the site from Southcenter
Boulevard.
2. Submittal of screening of rooftop apparatus for review and approval of
the Board of Architecture Review.
3. Four inch caliper trees being planted along Southcenter Boulevard.
4. Design of proposed sun screens being submitted for review and approval of
the Board of Architecture Review.
5. Submittal of design of lighting fixtures for review and approval of the
Board of Architecture Review.
6. Submittal of signed agreement to landscape the public right of way.
