VanDusen, Mayor TO: Alan Doerschell Finance Department FROM: Ann Siegenthale Department of Community evelopment RE: Release of Cash Assignment for Ivy Hills Apartments City Receipt No. 6144, 2/28/90 On 2/28/90, the City accepted $2,550 from D.E. Construction as a cash assignment for the Ivy Hills project (receipt #6144). A portion of this amount, $650, was for fireplace work, while the remaining $1,650 was for hydroseeding. Based on information from the general contractor, and Kim Hart's research (on 2/13/91), it appears that the $900 was refunded. However, the remaining $1650 for hydroseeding was never released. Staff conducted a final inspection of the Ivy Hills project on 2/22/91. We conclude that the general contractor has completed hydroseeding as required. Accordingly, this Department authorizes the release of the remaining $1,650 in warranty funds accepted on 2/28/90. cc: File Jerry Hanson, D.E. The planting of Phase Ill and parts of' Phase 11 was done during the dormant season. As warmer weather is upon us, it is important that the new plants and lawn areas be adequately watered. The older plantings also need to be watered, but to the extent that they have had an opportunity to establish themselves over the winter months, they are less delicate than the spring plantings. Headley Assistant Planner City of Tukwila cc: Joe Devish, DJB Acquisitions Jerry Hansen, DE Construction I am in receipt of your letter dated April 25, 1990. Regardng issue # 1 Landscape Materials, destruction and replacement and ordinary maintenance: - The concrete curbs installed on 4/24/90 will provide protection in the future for the landscape materials; however, the damaged materials and weeds in the landscape areas need to be dealt with in a timely manner. - In addition, the landscape materials fronting Interurban Avenue which were impacted by subsequent construction by Public Works must be replaced. It is your responsibility to contact Phil Fraser in the Public Works Department and work out an agreement on the replacement of the materials. - Based on the preceding statements and observations on- site, these issues will not be resolved until these issues are resolved either by completing the actual work or by providing me with a work plan for their accomplishment. Action must be taken by your office before May 11, 1990. - Any relocation of Dumpster Units must be approved by the Planning Department. Do not authorize or accomplish any work concerning these units until you have obtained approval from this Department. Submit plans on or before May 11, 1990. If I can be of any assistance in clarifying these issues, please call 433 -1849. The Contractor (Jerry Hansen of DE Construction) has had a tragedy in his family which has made him unavailable on short notice, however, will respond as quickly as he becomes available. The Owner (Joe Devish of DJB Acquisitions) has responded upon receipt of our correspondence. You call attention to three items: 1) Landscape Materials, destruction and replacement and ordinary maintenance. On 4/24 we installed concrete curbs in front of the parking stalls at the lower level. This was done to eliminate the tenants driving onto the landscape areas. Tecton Landscape Division of Tecton Inc. has entered into an agreement with DJB Acquistions to provide ongoing maintenance and replacement of plant materials and is doing so. We have provided the City of Tukwila with a copy of this agreement. This issue is resolved in our opinion. 2) Dumpster Screening Units. DE Construction has accepted the responsibility for relocation of the unit near U4. The second unit the Owner has agreed to provide a "change order" to make corrections, rPti Iv however, to date have not received the costs tffi involved. We agree that the work will be completed, however, must have all proper documentation including costs prior to approving the start of work. This issue is in the process of being resolved. 3) Metro screening fence paint. By your own statement, this work has been completed and properly painted to match our buildings. • This issue is resolved. Summary of the above indicate that both items #1 and #3 have been completed. Item #2 is contracted for and in the process of completion. We refute any threat of ''violation of City . Municipal Code" and fines relating to. same. The Owner and Contractor have resolved two of the three items, and are resolving the final issue you have addressed in all possible haste. Headley Assistant Planner I reviewed the painting of the fireplace chase enhancers earlier this week and found them to be acceptable. In the process of reviewing them, some issues came to my attention which need to be addressed. The first issue is related to the landscape materials which have been destroyed by vehicles driving over them. I noticed a significant number of damaged plants along the Interurban frontage. Please note that you are required by code to maintain the level of landscape materials indicated on your approved landscape plans. If they are destroyed, they must be replaced with plants of equal size and density. You have two options of dealing with this issue: 1) Install curbing and /or wheel stops to prevent vehicles from driving onto landscape areas; or 2) Replace plants as they are destroyed. The second issue concerns placement and screening of the dumpster units in the upper lot. Your manager indicated that the refuse company would not pick up trash where the dumpsters were located and they have been moved to facilitate pickup. The relocation and screening changes of the dumpsters must be submitted to the Planning department for approval. The third issue concerns the fence around the Metro odor - scrubber. It should be painted to match your apartments. Jerry Hansen indicated that the fence was installed by Metro at your request to provide screening of the scrubber station and to prevent vehicles from driving over the rockery. You may choose to coordinate maintenance efforts with Metro. These issues must be resolved by April 15, 1990. Please call if you have any ' additional questions. If I am unavailable, please ask for Moira Bradshaw. PHONE N (2061 433.1800 Gary I.. VanDascn, Mayor March 5, 1990 D.E. The bank between building U -4 and the recreation center was hydroseeded just prior to one of the torrential downpours. Much of the seed was washed down the hill, but the bank remained stable. This heavy rain took place prior to the installation and connection to the storm system of the roof downspouts on all of the upper buildings. This area will be re- seeded when weather permits along with other areas planned to have lawn as groundcover. Through the balance of the winter weather, D.E. Construction, Inc. will maintain and repair any damage to the steep embankments on the site that currently are not adequately protected against erosion by hydroseeding or other methods. When weather is conducive to proper germination of seeds, D.E. Construction, Inc. will complete the hydroseeding of the site. Sincerely, tie-st4frirle Jerry Hansen cc. Mayor I have received your letter of December 13, 1989 concerning Ivy Hills Apartments. The issue of the chase enhancers for fireplace chimney units for the apartments must be resolved by Friday December 22, 1989. The purpose of this letter is to inform you of your options should you decide not to comply with the BAR conditions concerning the fireplace chimney screening units. The units were approved and are required by the Board of Architectural Review. They must be installed as noted on the plan unless the BAR reverses the decision or an alternative is presented to the Planning staff and approved. A Certificate of Occupancy for Phase Three involving the upper level of units will not be authorized until you have complied with this condition. You have the option of applying to the BAR for a reversal of its decision. You will need to submit a design review application to the Planning Department for processing. Depending on when your application is received you will be scheduled for the BAR hearing. At this time, we are scheduling applicants for March and have a nearly full agenda. Again, a Certificate of Occupancy will not be apporved until after the hearing resolves the issue and you have complied with the terms of the decision. I will expect a response to this letter by Friday December 22, 1989. Thank you for your prompt attention to this matter. Please call if you have any additional questions. This action is necessary due to the magnitude of cost over run we have and are experiancing on the project. Generally the site is predominantly a fairly steep slope (averaging 45% and maximum of 90%), except for a generally level portion at the southwest and northwest corners of the site (Exhibit A). Apartment units are proposed in two rows running parallel with the property and topography (Exhibit B). The westerly row of buildings will feature basement covered parking, while the upper (westerly) units will feature on grade uncovered parking (Exhibit C). The easterly units will be two stories with basement consisting of a total of 56 dwelling units (Exhibit D). The uphill westerly 48 units will be of a slightly less building mass (Exhibit E ). Landscaping of the site con- sists of perimeter and interior landscaping (Exhibits F & G). A recreation building, pool, sport court and grass play area are featured at the southerly corner of the site (Exhibit 6 & H). The topography of the site constrains access for the easterly units to two points on Interurban Avenue South (Exhibit B). Access to the westerly units is from two points on 56th Avenue South. Directly to the north and across Interurban Avenue South is located the Foster Golf Links Public Golf Course, and directly westerly of the site and across 56th Avenue South is the existing multi - family development of the Terrace Apartments. Interurban Avenue South consists of two lanes in each direction. A single lane in each direction within a 30 -foot right -of -way is improved in 56th Avenue South. Parking for 208 cars is provided including 56 covered parking stalls. For the westerly, or upper, 48 apartment units a total of 96 parking stalls are pro- vided per TMC 18.56.050. For the easterly 56 dwelling units a total of 112 parking stalls are provided. Vehicular connection between the two parking areas is not included in the site plan. The westerly 56 apartment units con- tain 7 one - bedroom units and 49 two - bedroom units. The easterly 48 apartment units are comprised of 24 one - bedroom units and 24 two - bedroom units. Building materials will consists of dark gray or black composition shingle roofs, gray or light blue vinyl siding, white trim and windows, and gray or light blue railings and lattice. Exterior illumination is not indicated on 1 the site plan. 2. Various mutliple family development proposals have been sought on the pro- perty, the latest of which featured a combination of multiple family and offi- ces (81- 12 -W). 3. Since the proposal lies within the Interurban Special Review District, the BAR must review the proposal per the criteria of TMC 18.60.050 and 18.60.060 (TMC 18.60.030(2)(e)). 4. The proposed Planned Residential Development (PRD) requires approval per the criterial of TMC 18.46.110(4). Page 2 5. The proposal complies with the landscaping and recreation space requirements of TMC 18.52.020 and .060. Preliminary calculations indicate that 20,600 square feet of recration space is required (103 x 200 square feet = 20,600 square feet). Required landscaping areas constitute a total of 19,941 square feet, of which 10%, or 1,994 square feet, may be credited to the recreation space requirement, thereby yielding a 18,606 square feet of recreation space required. The pro- posal provides a total of 34,300 square feet of open fairly level lawn areas, sport court, pool and recreation building. Therefore, the recreation require- ments appear to be met in the proposal. 6. The Environmental Checklist (EPIC - 277 -85) indicates the recommendations of the geotechnical consultant will be followed in the development on this property. A determination of non - significance was issued for the proposal per the state Environment Policy act of 1971, as amended. CONCLUSIONS 1. BAR Criteria TMC 18.60.050 and 18.60.060(4): A. Criteria TMC 18.60.050(1): Relationship of Structure to Site The proposal provides the normal landscaping transition from Interurban Avenue South and 56th Avenue South. Sidwalks will be required along both streets, however, additional pedestrian pathways through and inside the development appear needed except at the southerly portions of the pro- perty and around the recreation building. Walkways or pathways from the upper westerly units to the lower easterly units occur at only three locations. Additional pedestrian linkage should occur due to the reaso- nably anticipated pedestrian usage of the westerly upper units of the recreation facility at the southerly portion of the site and Interurban Avenue South where public transit may be utilized. The parking areas in the proposal run almost the full length of the site with only slight interruption by landscaping along the westerly portions of the site. This design does not appear to "...moderate the visual impact of large paved areas." Therefore, the parking layout should be revised to better minimize this visual impact. Due to the topography of the property, the lower easterly units will be located such that the roofs will be below the existing grade elevation of 56th Avenue South. The roofs of the westerly upper units appear to extend approximately 10 feet above the existing grade elevation of this street. Such location of these buildings on the steeply sloped property is an appropriate site plan considering the westerly abutting properties. The overall visual impact on the easterly abutting public golf course will be the appearance of essentially a continuous wall of development. While this visual image of the multi family units carved into the hillside may appear startling upon initial development of the proposal, maturation of landscaping will substantially reduce this impact over time. This does not appear to be an unreasonable projected impact of the proposal. Page 3 B. Criteria TMC 18.60.050(2): Relationship of Structure and Site to Adjoining Area The proposal appears to present to Interurban Avenue South a design that overall is harmonious in the design, materials and colors. Landscaping which is appropriate to the adjoining properties is provided. A traffic engineering report indicates safe and adequate access to Interurban Avenue South and 56th Avenue South. These streets will adequately accom- modate the increased traffic. However, 56th Avenue South will function near to capacity. C. Criteria TMC 18.60.050(3): Landscape and Site Treatment The final grading of the site appears to essentially clear the site of all existing vegetation. The final grades create some level areas, par- ticularly where landfill is necessary at the southerly corner of the site. The overall impact of grading appears to be .of producing "...an inviting and stable appearance." The landscape plan appears to treat Interurban Avenue South as a formal street via regularly spaced deciduous trees. Due to the desirable vista from the property to the east, a public golf course and Duwamish River environment, landscaping along this street should be compatible with the City's future plans for improvement and landscaping of Interurban Avenue South. Within the site the landscaping appears to soften the overall impact of the buildings and appears to consider the view potential from the westerly uphill units. Exterior lighting details were not provided, thereby preventing review at this time. If the applicant can provide these details or a general description of sufficient detail in the public meeting, final review and approval of the exterior illumination could be deferred to the Planning Department. D. Criteria TMC 18.60.050(4): Building Design The proposed buildings are compatible in scale with existing commercial, multi family residential and single family residential development in the area, of which multiple family residential predominates the westerly area of the property and the golf course and commercial development dominates the more easterly areas of the property. The design components of the individual buildings display "...good proportions and relationship to one another." The colors chosen of the, dark __gray__or _bl_a_ck_roof,__gray or light blue vinyl siding, white trim and white lattice and railings, and white window trim are "harmonious" with each other. Details of exterior illumination were not provided, but should be "harmonious" with the pro- posed building design. Sufficient "variety and detail" in terms of building form and massing is provided on the site between the upper westerly units and the lower easterly units. The two types of units are dissimilar. Perhaps the major criticism of the lower easterly units is the essentially straight line of the same design with a great deal of regularity without significant interruption. This could present a mono- tonous appearance to Interurban Avenue South and the public golf course facility. Page 4 E. Criteria TMC 18.60.050(5): Miscellaneous Structure and Street Furniture Dumpster locations indicated on the proposal are enclosed on three sides by an unspecified fence. The design, composition and colors of this fence should be discussed for determination of their acceptability. F. Criteria TMC 18.60.060(4)(a): Proposed development design should be sen- sitive to the natural amenities of the area The essentially repetitive pattern of the proposed units in the develop- ment and the essentially uninterrupted large linear parking areas are questionably "sensitive" to the easterly public golf course facility and the Duwamish River environment. Breaking up the units, particularly of the easterly lower level, and varying the spacing between the buildings will reduce the overall visual impact of the development. Further enhancing this image would be exploring landscaping areas for significant contribution to the interruption of the site plan. G. Criteria TMC 18.60.060(4)(b): Proposed development use should demonstrate due regard for the use and enjoyment of public recreational areas and facilities As mentioned in the previous finding the repetitive, monotonous plan of the property imposes upon the easterly public golf course facility. The aforementioned recommendations will substantially reduce this impact. H. Criteria TMC 18.60.060(4)(c): Proposed development should provide for safe and convenient on site pedestrian circulation Since vehicular access from the easterly lower level and Interurban Avenue South is prevented to and from the upper westerly units, the con- venience and normally anticipated access to and from these uphill units is precluded. In addition, the proposal contains minimal pedestrian linkages between the upper and lower units and to Interurban Avenue. I. Criteria TMC 18.60.060(4)(d): Proposed property use should be compatible with neighboring uses and complimentary to the district in which it is located The location of the proposed buildings and the landscaping provided pro- duces overall general compatibility with "neighboring uses" which are relative to the westerly existing multi family development. However, the repetitive nature of the site plan raises the the question of com- patibility with the easterly public golf course facility and Duwamish River environment. Otherwise the proposal is "...complimentary to the district..." of the C -2 and R -3 zone. The development reflects the nor- mally expected and experienced development within these zones, par- ticularly in the situation of the narrow trapazoidial configuration of the subject site. Page 5 C J. Criteria TMC 18.60.060(4)(e): Proposed development should seek to mini- mize significant adverse environmental impacts The major environmental impacts associated with this proposal is the grading of the property which includes total disruption of existing vege- tation. The soils consultant has indicated that this presents no problem for development as long as their recommendations are followed. The applicant has indicated these recommendations will be followed thereby minimizing the environmental impact. In addition, the impact of cir- culation and access to and from the property, particularly 56th Avenue South, during the normal daily activities of the uphill westerly units presents concerns to staff relative to impacts on adjacent streets. The optimum solution would be to provide total access of the units to Interurban Avenue South. However, topography precludes this alternative. K. Criteria TMC 18.60.060(4)(f): Proposed development should demonstrate due regard for significant historical features in the area As mentioned earlier, the development should be more sensitive to the Foster Golf Course facility which represents an "historical feature" to the community. *=Planned Residential Development Criteria TMC 18.46.110(4) A. Criteria (TMC 18.46.110(4)(A): Suitability of the site area for the pro- posed development Existing topography of the site lends itself to the proposed site plan which for the most part works well with the slopes. Soil conditions sup- port the development. Surrounding streets will handle resulting traffic. Adjacent land uses and zoning are compatible or already exist in a semi - compatible situation. B. Criteria (TMC 18.46.110(4)(B): Requirements of the subdivision code for the proposed development Subdivision of the property is not proposed. C. Criteria (TMC 18.46.110(4)(C): Reasons for density bonuses as listed in Section 18.46.070: A density bonus was not requested. The total density permitted is 111 units, but 104 units are proposed. D. Criteria (TMC 18.46.110(4)(D): Adverse environmental impacts have been mitigated: A determination of non - significance was issued for the proposal on the basis of finding no significant environmental impacts. Staff's review of submitted environmental information indicated the recommendations of the soils enginer and traffic engineer will be followed to reduce any rela- tive impacts of the proposal. However, at some time the City may have to consider appropriate improvement of 56th Ave. So. to improve its traffic carrying capacity. Page 6 C The proposal complies with this chapter. E. Criteria (TMC 18.46.110(4)(E): Compliance of the proposed PRO to the provisions of this chapter: F. Criteria (TMC 18.46.110(4)(F): Time limitations, if any, for the entire development and specified stages: Two stages of development of the property are proposed. Phase one, the easterly units, will be constructed this year. Phase two will follow in 1986. 3. Planned Residential Development Purpose: TMC 18.46.010: A. Purpose TMC 18.46.010(1): Promote the retention of significant features of the natural environment, including topography, vegetation, waterways and views: Existing topography is essentially preserved in overall form by the pro- posal. However, the little existing vegetation is to be removed. Perhaps some of the few existing trees can be saved, but these need to be located on the site plan to facilitate this determination. B. Purpose TMC 18.46.010(2): Encourage a variety and mixture of housing types: The proposal includes one and two bedroom apartments within two building designs. This questionably represents "variety and mixture." C. Purpose TMC 18.46.010(3): Encourage maximum efficiency in the layout of streets, utility networks, and other public improvements: The site plan is an efficient design of vehicular circulation responsive to existing conditions. Utility plans were not provided, but the site plan facilitates efficient planning of this location. D. Purpose TMC 18.46.010(4): Create and /or preserve useable open space for the enjoyment of the occupants and the general public. A significant amount of open space and recreation area is provided on the site for the tenants of the development. At least 34,380 sq. ft. is useable for recreation purposes. Additional area is designated as open space. While the "general public" may not have access to the proposal, the public will enjoy viewing the amenities. CONSTRUCTION, INC. NOV 27 1989 t. . • Enclosed herewith is an elevation of the east face of building U -3, at the top of the hill behind the lower buildings. This is the side seen from Interurban Avenue. The crawl space beneath the upper buildings will be partially visible through the spaces between the lower buildings. This particular building is the worst case in terms of the height of the crawl space. The two buildings to the north of U -3 have much less height, and the building to the south has a different foundation system that allows the crawl space to be conventionally framed and sided. We propose to install cedar latticework between the columns, and from the grade beam level to the underside of the first floor as illustrated on the attached drawing. The lattice will be painted to match the siding color of the buildings. From an architectural standpoint, this ties in with the lattice railings on the west face of each of the lower and upper buildings. From a practical standpoint, it will not allow people access to the crawl space area, yet will allow the necessary air circulation beneath the buildings. There will also be 1/4" mesh hardware cloth behind the lattice to prevent the accumulation of debris beneath the building. If you have any questions, please contact me. I respectfully request your approval of the foregoing design change. 3425 E. The letter was regarding a memo written to you by Moira Carr Bradshaw, and included a copy of a letter written to me by George Casady, the owner's representative on this project. At the same time this letter was being delivered to you, another member of the Planning Department, Molly Headley, appeared on the site and indicated to one of our supervisory personnel, Brad Adams, that the Planning Department had additional concerns that they wanted to discuss. In my letter I requested your cooperation in resolving some apparent misunderstandings about various aspects of the project that are under your jurisdiction, and requested a meeting be arranged as quickly as possible. To date I have had no response to my letter. Valuable time is being wasted by your lack of a prompt response. To date we have no definitive statement from your department clearly stating any objections to the work. We only have a copy of Ms. Bradshaw's memo to you and Ms. Headley's comments. We do not feel that these constitute formal notice to us as to what corrective action we must take, if any, to satisfy the requirements of the City of Tukwila with regard to the Planning Department. We are willing to cooperate with you to resolve any problems, but we need to have a clear understanding of the problems. We have a right to either your approval of the Phase I (as defined by the Building Department) portion of the project or a written list of corrective items. We, therefore, hereby formally request and demand your approval of the Phase I portion of the project, or if any portions are unacceptable, we further request and demand you express such non - conforming items in writing to us. In response to your letter, I have, under separate cover, provided a copy of Ordinance No 1369, complete with exhibits A and B of the supporting staff comments between the "original" developer and the City of Tukwila. As you know, the people who are represented as the "Project Owners" have taken over this project after it had stalled and construction had been stopped. In so doing, they have secured your services, and attempted to correct and complete the project work. The Owners feel that it is important for the City of Tukwila to understand their position on the staff report items and address an answer to the questions or suggestions they have raised. The staff report addresses three "fundamental deviations" from the approved design review condition, including color of buildings, siding used, and window and door changes. Color of buildings was selected prior to new Ownership, however, a review of the color of the buildings at the time of take -over revealed a strong concern by the City. This concern was addressed quickly upon re -start of the Project and color selection was favorably commented on by the City. In any event, the Owners see no adverse affect to the City in the resulting colors, and intend to use the same colors on the upper units. In reviewing the "staff report" which prompted the Ordinance, the City staff approved vinyl siding reluctantly, and with the condition that proof be provided to the Fire Inspector that no toxic fumes would 1B TRAC TEL No .206 -938 -0508 Sep 18:n 10:02 No .002 P.04 IVY RILLS APARTMENTS CITY OF TUKWILA PLANNING DEPARTMENT STAFF REPORT RESPONSE result from their burning. The Architect feels that such proof could not be secured and therefore, the decision to change was made. Both the Architect and Owner fee]. that no adverse affect to the City exists because of the change. Window and Doors as shown on plans differ somewhat from the installed units. The Owner has checked with the Architect to determine what affect, if any, such a change might have on the project. Doors installed are not wood decorative doors, nor do they have a half circle window in them. Actual doors installed are steel insulated doors, which the Architect feels are better, more efficient, and provides greater safety than a decorative wood door. Sizes of windows do differ, in some locations, from those .shown on the plans. The cause of this difference comes from the approved trusses used on the project. Again, the Architect feels that the design has not been compromised. The Owner cannot see an adverse affect from this Architect approved change to the City of Tukwila. The above represents the Owners response to the staff report, and indicate their view that in all three findings which were represented as "fundamental deviations" , no apparent impact to the City of Tukwila exists, the changes do not cause an additional threat to life, health or safety, and in some cases, the changes have improved the property. The staff report goes on to make suggestion to the City relating to the Project work. Those suggestions, and the Owners responses are as follows; 1. Irrigate the entire project. This requirement was not are item included in the ordinance no. 1369 and is not budgeted or fundable at this time. In addition, the Owners have a contract for Management and maintenance of the Project site, which includes plant maintenance. Another concern relates to the "sloped" condition of the majority of the project greenspace. Plantings have been carefully selected, installed, and are being maintained, along with considerable expense in stabilization of those sloped areas. In developing a "sloped area" plan, the City has insisted upon the use of a Geo Engineer, who has established the means and methods of stabilizing the sloped areas. Water continues to seep from the sloped areas. Adding water to this condition via an irrigation system has never been part of the stabilizing plan, and could cause less stability, in the case of a failure within a automatic watering system. The Owners believe that the existing landscape plan, which was approved and permitted, is the plan they would expect to be installed. This includes provisions for watering, but does not include an irrigation system (as such). The Owner agrees with the City, and directs the Contractor to complete this work, as per the approved plans, and in the locations shown on the approved plans. The dumpster located between L3 and L4 must he re- located due to the Metro easement. 3. Install chimney wind soreens. The Owner agrees with the City, and directs the Contractor to complete this work, as per the approved plans. 4, Install 30 X 60 Basketball Court. The .plans presently call for grassed play area, fenced. Additional activity facilities provided within the "recreation" area include swimming pool, indoor spa, sauna, weight and fitness center, game room and equipment and lounge. In addition to the indoor and pool spaces, a large grass area is to be provided for lawn games, lounging and childrens play area. The Owners feel that this agreed upon facility, which is reflected on the approved plans, is adequate for the use intended, and no further improvements are necessary to meet the needs of the tenants. b. Install steps in hillside for access to upper area: The Owners agree that access between areas is necessary, and direct the Contractor to seek out the best location and design to accomplish said access. 6. Compensation for Changes. The Owners feel no compensation is justified, especially where no negative impacts have been realized. As pointed out above, the changes made on this project have been made with Architectural approval, and with the specific intention of providing the completed facility without compromising the concept developed and approved by Designer and the City. In some cases, such as siding and doors, the change has added to the safety and efficiency of the Project. This request addresses an interest in "adding to" the approved landscape plan. The Owners feel that the Landscape plan was approved and issued properly and that no additional changes should be necessary. Additionally, the Owners of the Project feel that they have consistently encouraged, financed and issued policy .decisions directed at meeting the intent of the original Owners agreements with the City of Tukwila. The resulting structures are consistent with work of this type, and do meet every requirement established in negotiations with City of Tukwila staff, and are in agreement with City Ordinance. A careful review with the design professionals involved in the project revealed the same attitude, that the intents that were agreed upon and the concepts established in the design have been closely adhered to. dr IVY HILLS APARTMENTS gr CITY OF TUKWILA'g,+ =LANN ING DEPARTMENT STAFF E'ORT RESPONSE It is the Owners intention (and wish) to maintain the best possible relationship with the City of Tukwila. In so doing, the Owners have attempted to work with the City to resolve the unfortunate condition the project was in a year ago. It should be made clear however, there are no monies available to add to the Project. The Owners request that you make their opinions known to the City of Tukwila as soon as possible. Occupancy on this project was expected on August 1, 1989 and it is presently September 15. Delays of this type, which involve posturing and continuous re- evaluation have cost the Owners a considerable amount of money. If there are serious threats to safety presented, they continue to demand that all participants of the Project respond and correct the problems, however, if Occupancy is being withheld simply to try to attach additional user fees, they object strongly. In every way, the Owner is pleased with the appearance of the project, and appreciates your attention to these details. Yours very truly; JOB TRAC' INC. George M. AGENDA ITEM CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 85- 29 -PRD, DR- 13 -85: GROUP FIVE INTRODUCTION A ten - building, 104 unit apartment complex is proposed to be constructed in two phases by Group Five along the westerly side of Interurban Avenue between what would be 137th and 139th Avenue South. The 4.55 acre parcel is zoned C -2 (Regional Retail Business) on the westerly half of the site and R -3 (Multi Family Residential) along the easterly half of the site. The proposal requires approval of a Planned Residential Development and the Board of Architectural Review and the property lies in the Interurban Special Review District. FINDINGS 1. Generally the site is predominantly a fairly steep slope (averaging 45% and maximum of 90 %), except for a generally level portion at the southwest and northwest corners of the site (Exhibit A). A recreation building, pool, sport court and grass play area are featured at the southerly corner of the site (Exhibit B & H). The topography of the site constrains access for the easterly units to two points on Interurban Avenue South (Exhibit B). Access to the westerly units is from two points on 56th Avenue South. Directly to the north and across Interurban Avenue South is located the Foster Golf Links Public Golf Course, and directly westerly of the site and across 56th Avenue South is the existing multi- family development of the Terrace Apartments. Vehicular connection between the two parking Page -2- c.. Planning Commission 85 -29 -PRD, DR- 13 -85: GROUP FIVE August 22, 1985 areas is not included in the site plan. Exterior illumination is not indicated on the site plan. 5. The proposal complies with the landscaping and recreation space requirements of TMC 18.52.020 and .060. Preliminary calculations indicate that 20,600 square feet of recration space is required (103 x 200 square feet = 20,600 square 'feet). Required landscaping areas constitute a total of 19,941 square feet, of which 10 %, or 1,994 square feet, may be credited to the recreation space requirement, thereby yielding a 18,606 square feet of recreation space required. The pro- posal provides a total of 34,300 square feet of open fairly level lawn areas, sport court, pool and recreation building. Therefore, the recreation require- ments appear to be met in the proposal. 6. The Environmental Checklist (EPIC- 277 -85) indicates the recommendations of the geotechnical consultant will be followed in the development on this property. Walkways or pathways from the upper westerly units to the lower easterly units occur at only three Page -3- Planning Commission 85- 29 -PRD, DR- 13 -85: GROUP FIVE August 22, 1985 locations. B. The overall impact of grading appears to be of producing "...an inviting and stable appearance." The landscape plan appears to treat Interurban Avenue South as a formal street via regularly spaced deciduous trees. Due to the desirable vista from the property to the east, a public golf course and Duwamish River environment, landscaping along this street should be compatible with the Page -4- Planning Commission 85- 29 -PRD, DR- 13 -85: GROUP FIVE August 22, 1985 _t. .... .. t... „ r._ ... Vi:'. .. ... .n ..i. s+.. .. ... . .. fi t...- . + v .r .':l,. , .':1 , {•.. City's future plans for improvement and landscaping of Interurban Avenue South. The design components of the individual buildings display "...good proportions and relationship to one another." The colors chosen of the dark gray or black roof, gray or light blue vinyl siding, white trim and white lattice and railings, and white window trim are "harmonious" with each other. E. Page -5- Planning Commission 85- 29 -PRD, DR- 13 -85: August 22, 1985 GROUP FIVE G. J. K. Criteria TMC 18.60.060(4)(f): Proposed development should demonstrate due regard for significant historical features in the area Page -6- - Planning Commission 85- 29 -PRD, DR- 13 -85: GROUP FIVE August 22, 1985 As mentioned earlier, the development should be more sensitive to the Foster Golf Course facility which represents an "historical feature" to the community. 2. Planned Residential Development Criteria TMC 18.46.110(4) A. C. Criteria (TMC 18.46.110(4)(C): Reasons for density bonuses as listed in Section 18.46.070: A density bonus of 27 units is requested along the westerly R -3 zoned portion of the property. This 63,383 square foot area is permitted 21 units per TMC 18.50.020 but 48 units is proposed - an increase of 229 %. TMC 18.46.070 permits only a 20% density increase, or a total of 25 units provided the criteria of TMC 18.46.070(3) are met. This criteria requires a "...variety of housing types..." (TMC 18.46.070(3)(A)), but the proposal provides only two different types and designs. Essentially all of the little existing "natural vegetatin" will be removed which contradicts retention of at least 15 %, per TMC 18.46.070 (3)(B). Existing "views" and site topography is taken advantage of (TMC 18.46.070(3)(C)). Automobile and pedestiran circulation is largely separated (TMC 18.46.070(3)(D)). Overall, the development conforms to the Comprehensive Land Use Policy Plan (TMC 18.46.070(3)(E)). The "public benefit" being derived is not clear, however (TMC 18.46.070(3)(F)). Therefore, existing information appears to indicate the density increase is not supported to be in compliance with the cri- teria. D. Criteria (TMC 18.46.110(4)(D): Adverse environmental impacts have been mitigated: A determination of non - significance was issued for the proposal on the basis of finding no significant environmental impacts. Staff's review of submitted environmental information indicated the recommendations of the Page -7- . Planning Commission 85 -29 -PRD, DR- 13 -85: GROUP FIVE August 22, 1985 soils enginer and traffic engineer will be followed to reduce any rela- tive impacts of the proposal. However, at some time the City may have to consider appropriate improvement of 56th Ave. So. to improve its traffic carrying capacity. E. Criteria (TMC 18.46.110(4)(E): Compliance of the proposed PRD to the provisions of this chapter: Except for the proposed density in the westerly row of units, the pro- posal complies with this chapter. F. Page -8 -._ Planning Commission 85- 29 -PRD, DR- 13 -85: GROUP FIVE August 22, 1985 (PC.GRPFVE,PC.GRPFVE3) (5A.2) '. ' } PRELIMINARY RECOMMENDATION Based on the above, staff preliminarily recommends that the Board of Architectural Review and Planning Commission approve the plan subject to: 1. Revision of the site plan to include: A. Diversifying the building designs and locations to create a less monoto- nous visual image and a diversity of designs. B. Provision of additional pedestrian linkages between 56th Avenue South, and Interurban Avenue South throughout the proposal. C. Reduction of density on the westerly portion to 21 units. 2. Submission of a lighting plan and fixture details. 3. Location of existing substantial trees on the site plan, and modification of the site plan to retain some of these trees. 4. The landscaping plan include vegetation of sufficient size to accomplish the criteria and conclusions contained herein.
