This letter is to formally notify you that March 23, 1984 the Planning Commission approved your Conditional Use Permit for the earth satellite antenna as proposed with the following conditions: 1). Installation of cedar slats in the cyclone or other site obscuring material around or in the fence to form a site screen. 2) Certification that the microwave transmissions will not interfere with adjacent properties radio and /or t.v. reception. 3) The Conditional Use Permit is issued for the benefit of the Boeing Military Aircraft Company or its corporate subsidiaries and is not transferrable. The Planning Commission shall reserve the right to review the Conditional Use Permit on an annual basis to ensiure compliance with the terms herein. 4) In the emergency power equipment such as a gasoline power generator shall be installed in an enclosed structure so as to control noise propagation. 5) Control of any emitted radiation of any measurable frequency or wave length shall be maintained within safe limits as established: for this type of facility. This action is final on March 5, 1984 due to the appeal period specified in Tukwila.Municipal Code Section 18.90.020. If you have any questions please contact me at 433-1845. To facilitate operations the • proposes to install an earth satellite transmitting and receiving antenna in the existing parking lot southwesterly of the existing building. The C -2 zone in which the property is located does not include as a permitted use this antenna, but stipulates radio /television towers are conditional uses (TMC Section 18.64.020(11)), which appears closest to the proposed satellite antenna. The antenna encompasses an area of 36' x 62' n a fence enclosure and is approximately 14 feet in height. Approval of conditional uses fall within the jurisdiction of the Planning Commission (Section 18.64.040 TMC). FINDINGS 1. TMC 18.64.050 contains the criteria the Planning Commission is required to use to review the conditional use application. The Planning Commission may approve, approve with conditions, or deny the application. 2. On February 21, 1984, a Declaration of Non - Significance was issued for the proposal. 3. Per the requirements of TMC Chapter 18.92 the public hearing notice and publi- cation requirements were met. 4. The subject site known as the Park.. Plaza building is exclusively utilized by the Boeing M rplane Company. T�`' '. has moved to this location and proposes to utilize an earth satellite antenna. Allegedly this is desirable location for clear transmission and reception via the earth satellite to the Edwards Air Force Base. The transmissions from the proposed antenna consists of microwave emissions which based on submitted environmental information are well within the adopted federal standard safety levels. Because of the upward) direciton of the beam generated to and from the earth satellite, exposure to the human population is minimal, and much less than currently experienced from television and f.m. radio broadcasts. 6. The existing Parkway Plaza building footprint consists of 24,239 square feet to which is proposed to be added the earth satellite antenna and fenced area of 2,232 square feet. Currently, 1,062 parking stalls are located on the pro- perty, however the earth satellite antenna facility will displace 18 of those stalls resulting in a net of 1,044 parking stalls. The original building per- mit required only 962 parking stalls, therefore the deletion of 18 parking stalls to accomodate .the antenna would be acceptable in terms of meeting the parking requirement in affect at this time the building permit was issued for this building. 7. Applicable policies of the City of Tukwila Comprehensive Land Use Policy Plan are: Natural Environment Policy 2, page 24: Encourage the use of live vegetation in development of landscape plans. Policy 2, page 26: Preserve the views of hillsid'e.residents. Commerce and Industry Policy 1, page 60: Encourage the grouping of uses which will mutually and economically benefit each other or provide necessary services. Policy 3, page 61: Encourage aesthetic building: and site design in working and trading areas. Policy 4, page 61: Encourage the use of live landscaping of all develop- ments. Policy 7, page 62: Promote adequate provisions for parking for all land uses. Policy 1, page 62: Discourage the location of hazardous industries or those emitting pollutants in excess of acceptable standards. CONCLUSIONS 1. TMC Section 18.64.050(1) requires: "The proposed use will not be materially detrimental to the public welf are or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated." ' Page3 • Planning Commission ; * .. 84 -02 -CUP: Boeing Company February 23, 1984 Submitted environmental information indicates that microwave transmissions generated by the antenna will not be harmful to the general public on adjacent properties or patrons of the Parkway Plaza Building. Perhaps the only questionable area of environmental impact would be the disturbance to surrounding properties, e.g., radios, television antennas, and /or other receiving apparatus. This is not addressed in the environmental review and should be by the applicant in the public hearing. However, there does not appear to be a material detriment accruing to the public or other properties in the vicinity as a result of the installation of this proposed antenna. 2. TMC Section 18.64.050(2) stipulates: "The proposed use shall meet or exceed the performance standards that are required in the. district it will occupy err." The subject property is zoned C -2 (TMC Chapter 18.30). Most pertinent is the requirement of TMC Section 18.52.040(2) that outdoor storage be screened by au . 8' high screen of plant material between the storage area and adjacent streets . , and properties. While the antenna is not not technically an outside storage area, these provisions appear to appropriately applied to the proposal rela- tive to the screening of.the approximate 34' high antenna from adjacent pro- perties and the general public. The submitted landscape and site plan indicates the proposal includes installation of two evergreen trees approxima- tely 20' to 25' high in planter areas on the Satsterly portion.of the proposed antenna fence enclosure. Additional landscaping is not proposed on other por- tions of the perimeter of the antenna cyclone fence enclosure. It would appear reasonable that additional landscaping material should be required along the southerly portion of the fence to provide additional screening beyond existing landscaping on the southerly portion of the existing parking • lot in order to effectively reduce the visual impact of the 34' antenna on the southerly abutting retail use property. 3. TMC Section 18.64.050(3) states: "The proposed development shall be compatible generally with the surrounding landuses in terms of traffic and pedestrian circulation, building and site design." The existing Parkway Plaza building development is very compatible with the surrounding land uses and pedestrian and traffic circulation. Furthermore, the development is one of the most noteworthy and aesthetically pleasing buildings and site developments in the area Installation of additional landscaping along the southerly portion of the antenna cyclone fence would further enhance the compatibility of the existing development with the adja- cent properties. 4. TMC Section 18.64.050(4) states: "The proposed use shall be in keeping with the goals and policies of.the Comprehensive Land Use Policy Plan." Page 4 Planning Commission ( 84 -02 -CUP: Boeing Compny February 23, 1984 The aforementioned policies of the Comprehensive Plan would indicate general compatibility of the existing development. Existing topography and location of the proposed development in the interior of the property preserves existing views from the westerly hillside properties and does not on reasonably intrude on the visual perceptions of the general public using the adjacent properties and streets. The two proposed live evergreen trees should be supplemented with additional landscaping along the southerly portion of the fence to provide additional screening to enhance the visual design of the site. This antenna is a reasonably expected extension of the Boeing Airplane Company Military Aircraft Division. 5. TMC Section 18.64.050(5) requires: "All measures have been taken to minimize the adverse impacts that the proposed use may have on the area in which it is located." Sufficient information has supplied by the applicant to indicate the microwave transmission and reception will not adversely impact the public health, safety and welfare. The antenna will be directed skyward at an angle which will further mitigate any concerns for microwave impacts upon the human population. The other major impact associated with the development is the reduction of the 18 parking stalls on the property.' The Casa Lupita restaurant on the southeastern portion of the property, containing 53 parking stalls, was approved in 1979 by the Board of Architectural Review. The Simon's restaurant on the northeastern portion of the property was also approved by the Board of Architectural Review in 1979.-n the vicinity of these restaurants parking dif- ficulties have been experienced, particularly during lunch hour peak parking demand. Since the Boeing office building will continue to maintain more than the required number of parking stalls, the 18 stall reduction does not appear to be an unreasonable or unanticipated. impact, nor will the reduction adver- sely effect existing parking agreements. RECOMMENDATIONS Staff recommends approval of the application as submitted subject to: 1. Installation of additional landscaping along the southerly portion of the cyclone fence surrounding the antenna. 2. Installation.of cedar slats in the cyclone fence or other site obscuring material around or in the fence to form a site screen. 3. Certification that the microwave transmissions will not interfere with adja- cent properties' radio and /or t.v. reception. 4. The conditional use permit is issued for the benefit of the Boeing &com e r cfial Airplane Company or its corporate subsidiaries and is not transferrable.
