CONDITIONAL USE PLANNING DIVISION PLANNING COMMISSION STAFF REPORT AGENDA ITEM IV) B. • 84 -03 -CUP: Cincon Freight Services INTRODUCTION Cincon Freight Services recently occupied the premises at 1151 Andover Park West and was subsequently advised of the need for a Conditional Use Permit. Currently the operation consists of administrative offices, dispatching of trucks and rental warehouse space. Expansion plans include occasional transloading of ocean -going containers on the loading dock and freight use pursuant to railroad car unloading. The existing and future uses qualify as a conditional use. FINDINGS 1) Per the Tukwila Board of Adjustment ruling of May 6, 1982, the proposed Cincon activities are defined as a "truck terminal" (Exhibit B). Pursuant to issued licenses dispatching of trucks per customer orders occurs. Eventually transloading of trailer and /or rail cars will be performed. 2) Tukwila Municipal Code 18.38.040(2) requires conditional use permit review for "truck terminals." TMC 18.64.050 contains criteria for approval of con- ditional uses upon which the Planning Commission may approve, modify or deny the proposal. 3) A Declaration of Non - Significance pursuant to the State Environmental Policy Act was issued for the proposal. CONCLUSIONS 1. TMC 18.64.050(1) specifies: "The proposed use will not be materially detrimental to the public welfare of injurous to the property or improvements in the vicinity of the propo- sed use or in the district in which the subject property is situated." Since the existing development lies within an industrial park, the impacts occurring from the proposal appear as anticipated in the site plan and buildings. Material detriment to others is not evident. Page -2- Planning Commission 84 -03 -CUP February 23, 1984 2. TMC 18.64.050(2) states: RB /RF /blk The proposed use conforms with performance standards of the C -M (Industrial Park) zone required at the time of building permit approval. "The proposed use shall meet or exceed the performance standards that are required in the district it will occupy." 3. TMC 18.64.050(3) requires: �.).. "The proposed development shall be compatible generally with surrounding land use in terms of traffic and pedestrian circulation, building and site design." The proposed development is compatible with existing business, warehouse and transportation related uses in the existing business park and surrounding properties. 4. TMC 18.64.050(4) specifies: "The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan." The proposed use is consistent with the Comprehensive Plan in providing uses appropriate to the C -M zone and a diversity of uses which are supportive of other businesses (Policy 1, page 60; Policy 8, page 62, and Policy 2, page 63, Comprehensive Land Use Policy Plan). 5. TMC 18.64.050(5) requires: "All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located." The proposal lies within the anticipated useage of the complex of buildings and will generate impacts normally associated with such an industrial park. The de -. finition which was adopted by the Board-on 6 May supersedes that con- tained in the memorandum of 4.. October 1978 from Roger Blaylock discusses the Board's prior interpretation of this type of'facility on 21 September 1978:: TRUCK TERMINAL =- Truck•terminal means 'a site or building, or. a tenant space within a butlding.the occupant of which is a holder of a.certificate of public necessity from the Interstate Commerce Commis- sion, the Washington Utilities and Transports= tion Commissibn or a similar agency, and which • exhibits any one of the following characteris tics of use: • - -the business location is a place to receive, pick -up and /.or deliver orders which are placed . by customers. --The business includes the use of, a dispatcher ( with that or any- title) which • directs- the activities of the truck driver. • - -The business location,is used by the truck car - rier to receive•shipments for.transloading, trans- shipping and /or consolidation, or from which portation ensues after transloading, transshipping or deconsolidation, whether or not rolling stock • of the carrier is parked at the location during periods of non -use All businesses meeting this definition, except those located in the M -2 zoning district, will be expected to obtain a Conditional Use Permit prior to beginning operation, and only in those zoning districts where truck.• terminals are recognized as a conditional, use.
