February 23, 1984 approved your Conditional Use Permit for expansion of the
existing Southcenter Day Care facility. This action is final on March 5,
1984 due to the 14 day appeal period of Tukwila Municipal Code Section
18.90.020.

INTRODUCTION
The Southcenter Day Care facility began
operation in the existing building a few
months prior to adoption of the existing
Zoning Code in 1982. Approximately one -
half of the building was involved in the
day care center. Due to increased demand
for this type of facility in the commer-
cial and industrial area the applicant
desires to expand the facility into the
entire building. In order for the expan-
sion to occur a conditional use permit
must be approved by the Planning
Commission pursuant to TMC 18.64.
FINDINGS
1. Daycare facilities are not explicitly mentioned in the City Zoning code. The
existing C -M zoning of the property does not include as a permitted or
accessory use a day care facility, but TMC 18.38.040(3) incorporates general
conditional uses pursuant to TMC Chapter 18.64. Examination of the latter
chapter reveals that TMC 18.64.020(15) includes the conditional uses mentioned
in other zoning districts, including "preschool" (TMC 18.12.050), a con-
ditional use in the R -1 zoning district. Staff, therefore, has interpreted
these portions of the Zoning Code collectively to mean that a day care faci-
lity is comparitively closest to a preschool, and therefore is permitted as a
conditional use in the C -M zoning district pursuant to approval by the
Planning Commission (TMC 18.64.040).
2. TMC 18.64.050 contains criteria the Planning Commission must apply to review
of the conditional use permit. The Commission may approve, modify, or deny the
application based thereon.
3. Southcenter Day Care facilities expansion to the entire building includes
expansion of the playground area on the westerly side of the building.
Similar to the existing playground, fencing will totally inclose the outdoor
playground area and play equipment. Other external modifications of the
building is not proposed.

4. A Declaration of Non - Significance pursuant to the State Environmental Policy
Act was issued for the proposal.
5. During the operation of the facility since 1982 staff recalls no complaints
being filed pursuant to the operation.
6. The Comprehensive Land Use Policy Plan, Commerce and Industry section, con-
tains the following:
Policy 1, page 60: Encourage the grouping of uses which will mutually or
economically benefit each other or provide necessary services.
Policy 8, page 62: Encourage a diversity of business uses to promote
maximum occupancy.
Policy 2, page 63: Encourage uses which are supportive to industrial and
warehouse uses to locate in or near such activities.
Policy 4, page 63: Discourage any changes from industrial or warehousing
land uses unless there is reasonable provision for parking demannd.
Policy 6, page 64: Encourage and promote the location and labor inten-
sive industries in the City.
Policy 1, page 64: Encourage uses which are supportive to retail areas
to strategically locate in or near those areas.
CONCLUSIONS
1. The proposal conforms to the Comprehensive Land Use Policy Plan in providing a
service necessary to the employees of adjoining industrial, commercial,
office, office areas (TMC 18.64.050(4)). Adequate parking is available on the
site for the patrons dropping off and picking -up their children. This is an
unusual business use in the area and is supportive of those surrounding uses.
2. The proposal will not be materially detrimental to the public welfare or
injurious to other properties, since impacts and the use is confined to the
building and the playground area and patrons coming to and from the
proposal.(TMC 18.64.050(1)). As stated previously, complaints have not been
registered regarding the day care facility and the noise generated by the
children.
3. The Southcenter Day Care facility conforms to the development requirements of
the C -M district in effect at the time the building was constructed (TMC
18.64.050(1)).
4. The day care facility has been demonstrated to date to be compatible with the
surrounding land uses, traffic and pedestrian circulation, and building and
site designs (TMC 18.64.050(3)). Patrons dropping off or picking up their
children will normally visit the site during off peak traffic periods for
workers in the area. The existing building and site plan will not be modified
pursuant to the expansion of the day care use.

5. The utdoor playground for the children is fenced for their safety and the
appl cant has attested to scheduling outdoor play periods to conform to normal
busi ess breaks or lunch hours to mitigate noise impacts. It appears the
impa t upon the proposal by surrounding development and greatly more intense
comm rcial and industrial uses has been minimal and within public health stan-
dard and state regulations governing day care centers.
RECOMMEN ATION
Staff re ommends the application be approved as submitted.
