ORDINANCE NO. ��' '7 / CERTIFIED COPY CITY of IUKW AN ORDINANCE OF THE CITY OF TUKWILA, WASHING- TON, ANNEXING CERTAIN REAL PROPERTY COMMONLY KNOWN AS THE 51ST AVENUE SOUTH ANNEXATION TO SAID CITY PURSUANT TO THE PETITION METHOD SET FORTH IN RCW CHAPTER 35A.14; REQUIRING SAID PROPERTY TO BE ASSESSED AND TAXED AT THE SAME RATE AND BASIS AS OTHER PROPERTY WITHIN SAID CITY; AND FIXING THE EFFECTIVE DATE OF ANNEXATION. WHEREAS, the City Council, •at its regular public meeting of April 2, 1984, held a public hearing for the pur- pose of considering a petition for annexation of certain property hereinafter described, and at the conclusion of said hearing having determined that the property commonly known as t he 51st Avenue South Annexation more particularly described; in Exhibit A, attached hereto and incorporated in full by this reference, which property is contiguous to the existing corporate limits of the City, and is a logical extension .of the City limits, should be annexed to the City, subject to approval by the King County Boundary Review Board, or waiver of the Board's jurisdiction, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section The territory commonly known as the 51st Avenue South Annexation, more particularly described on Ex- hibit A, attached hereto and incorporated in full by this reference, should be, and is made a part of the City of Tuk- wila, subject to approval of said annexation by the King County Boundary Review Board or waiver of jurisdiction of the Board. . Section 2 Pursuant to the terms of the annexation petition, all property within the territory annexed hereby shall be assessed and taxed at the same rate and on the same basis as property within the City, includinc assessments or taxes in payment of any bonds issued or debts contracted prior to or existing as of the date of annexation. Section 3. The territory annexed hereby shall become a part of the City of Tukwila, and this ordinance shall take effect and be in full force upon the date of approval of the annexation by the King County Boundary Review Board, the date upon which approval is deemed to have occurred pursuant to -RCW 36.93.100, or upon the date of waiver of juridiction of said Board to act upon the annexation, whichever first oc- curs. The current population of this 3.48 acre parcel is approximately 26 residents. There is a population density of 7.5 residents per acre and an average assessed valuation of $60,000 per residential property. B. The area is single family residences along the western boundary of Tukwila. The area lies approximately * mile from the southwest inter- section of I -405 and I -5. As yet, there are no significant anticipated changes in land use. C. 1. The area lies within Tukwila's comprehensive planning area. Tukwila's Comprehensive Plan was adopted by ordinance on March 16, 1982. 2. Tukwila has no franchise in the area. It does not anticipate requesting a franchise amendment to cover the area in the near future. 3. The current Highline Community Plan designates the area as single family (King County zoning = RS 7200). Possible changes to the Highline Community Plan currently under consideration do not directly affect the proposed annexation area. 6. The property is within a local sewer service area in the King County Sewerage General Plan, adopted 1/15/79 by Ordinance #4035. D. The topography slopes somewhat downward from north to south. It lies within the lower Green River Drainage Basin. E. The projected population growth of the area is likely to be negligeable as the area is designated for low- density single family and is deve- loped accordingly. The proposal lies within Census Tract #283 which had a 1980 population of 2903. The estimated 1981, 1982 and 1983 population of CT 283 was 2888, 2882 and 2869, respectively. Future projections are not available as this area has been combined with nine other census tracts to form the Riverton Forecast Area Zone (FAZ). The City of Tukwila had a 1980 population of 3505 with the 1990 projec- tion of 4001 (PSCOG 3/84; FAZ 3900). Total Tukwila employment was 20,930 in 1980 with a 1990 projection of 29,508 (PSCOG 3/84; FAZ 3900). F. Upon annexation, the City of Tukwila would be responsible for the area's police and fire protection. Police protection would come from the Tukwila Police Department at 6200 Southcenter Boulevard. Fire pro- tection would be based in the Tukwila Fire Department at 444 Andover Park East. Tukwila would also take' over road and storm sewer main- tenance. Maintenance service would be provided from the City Shops at 600 Minkler Boulevard. No problems are anticipated in serving the area. 2. Please see C.3. a. Various parks including the Foster Golf Links are located 2 -3 miles away. H. 1. Present "municipal" services available to this area are: a) Val Vue Sewer District provides sewer service; b) Fire District #24 provides fire protection; c) Water District #75 provides water; and d) King County provides street maintenance, emergency and admi- nistrative services. At present, King County provides police patrols for the west side of 51st Avenue South. Tukwila patrols the east side of the street. Storm sewer facilities consist of surface drainage and culverts in existing rights -of -way. Water is provided to the properties by Water District #75 through a 4" line on 51st Avenue S., and a 6" line on 164th Street. Sanitary sewer is provided by the Val Vue District in an 8" line in 51st Avenue S., and S. 164th St. 3. Present costs of City services are described by the following, including a comparison with existing service district rates. For each 100 cubic feet in excess of the 500 cubic feet allowed for the minimum charge, the rate shall be fifty cents per 100 cubic feet. City of Tukwila Sewer Rates 1) Residential Service: A flat rate of $5.20 per month for each single - family residence shall be charged. 2) Multiple Dwelling: The rate of $5.20 per month for the first dwelling unit and $4.70 for each additional unit shall be charged. 3) Commercial and Industrial: A flat rate of $6.20 per 900 cubic feet or less of water usage shall be charged. The rate of sewage service on premises using more than 900 cubic feet of water per month shall be 52 (t per additional 100 cubic feet. 4) Penalty Charge: 50 ct per month on sewer accounts more than 30 days in arrears. Metro Rates The City -Metro charges as required by the Agreement for Sewage Disposal between the Municipality of Metropolitan Seattle and the City of Tukwila is set at the sum of $7.00 per residential customer and $7.00 per residential customer equivalents (900 cubic feet equal one residential equivalent) for multiple dwelling and commericial /industrial accounts (1984 rates for METRO). The current locat( of community faciities servE the area include: 1) the Tukwila Ci � Hall and Police Station located approximately one mile to the northeast; 2) the fire station located approximately 2 miles to the east; 3) the Tukwila Library located approximately 1 mile to the northeast; 4) the Tukwila Community Center located approximately 1 mile to the north. Various parks including the Foster Golf Links are located 2 -3 miles away. H. 1. Present "municipal" services available to this area are: a) Val Vue Sewer District provides sewer service; b) Fire District #24 provides fire protection; c) Water District #75 provides water; and d) King County provides street maintenance, emergency and admi- nistrative services. At present, King County provides police patrols for the west side of 51st Avenue South. Tukwila patrols the east side of the street.
