Variance Criteria TMC 18.72.020(1): CITY OF TUKWILA PLANNING DIVISION BOARD OF ADJUSTMENT STAFF REPORT Bon Marche (Allied Stores) AGENDA ITEM INTRODUCTION The applicant is requesting approval of a 3' variance from TMC 18.52.020 (Landscape Requirements) in order to expand the existing access way along the north side of the existing warehouse facility. FINDINGS 1. The Bon Marche warehouse is located at 17000 Southcenter Parkway in the C -M zone (see Exhibit A). The section of property in question abuts Godfather Pizza's rear parking lot and the undeveloped "Tukwila Pond" property. There is no developed east /west roadway on the property. The auto and truck access is along Southcenter Parkway. 2. The proposed action will remove 200 feet of side yard /landscaping and replace it with pavement to extend the warehouse loading area for increased truck manuverability. A fire hydrant will be removed and replaced approximately 100 feet to the east. A ditch will be filled to bring the paved area up to a uni- form grade. No fencing or structured parking (i.e., gabion wall) will be included). 3. Goods are received from 7:00 a.m. until 3:00 p.m. on weekdays only. The majority of trucks arrive and leave between 7:00 a.m. and 1:00 p.m. "The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located." The variance appears to constitute a special privilege inconsistent with the limitations upon uses of other properties in the vicinity. The section of the property in question abuts a rear parking lot and undeveloped property. At present, the undeveloped property provides an effective landscape buffer. When the adjacent undeveloped property is developed, it is likely that this section of the property will become an access route. Landscaping will be required at that time. Variance Criteria TMC 18.72.020(2): The variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges permitted to other proper- ties in the vicinity and in the zone in which the subject property is located." The variance will directly benefit the property owners by allowing full use of the loading area. It does not, however, appear strictly necessary due to spe- cial circumstances of property size, shape, topography or location. 3. Variance Criteria TMC 18.72.020(3): "The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated." The variance may be materially detrimental to public welfare or injurious to neighboring property. By reducing the earth buffer, trucks will come in closer contact with adjacent property. However, increased paved area will enhance their maneuvering ability and may result in no net change in injury to the property. At present, the buffer is not landscaped. The variance would result in no damage to the underdeveloped Tukwila Pond property. Care must be taken in operating trucks in the north loading area so as to minimize impacts on activities in the rear Godfathers lot. While 11:30 a.m. to 1:00 p.m. is the lunch hour and presumably a time of increased activity at Godfather's Pizza, the Bon Marche says that most truck activity occurs in the morning. A fence may be advisable to screen the parking area from the expanded loading area and minimize any potential impacts. The potential for detrimental impacts to the public welfare and pro- perty in the vicinity is slight and can be mitigated through appropriate truck receiving procedures and operations. 4. Variance Criteria TMC 18.72.020(4): "The authorization of such variance will not adversely affect the implemen- tation of the Comprehensive Land Use Policy Plan." The authorization of this variance would not adversely affect the implemen- tation of the Comprehensive Land Use Policy Plan. Detriment to the public welfare will be very slight. Some question, however, arises relative to the aesthetic effect of reduction of the landscaping strip to 2'. 5. Variance Criteria TMC 18.72.020(5): "The granting of such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by owners of other properties in the same zone or vicinity." tiY•'t I:L "v +•r 1454:41-tr., f . Rl7JlFFl+�ti'�.[ The variance is not necessary to preserve the enjoyment of a substantial pro- perty right of the applicant possessed by the owners of other properties in the same vicinity. The variance actually appears to extend use rights by increasing the property's usable space and decreasing the requried landscaping. Cause for the variance rests largely with the applicant's desires for the increased maneuvering space. 6. As provided in TMC 18.72.010, the Board of Adjustment must find that literal enforcment of the Zoning Ordinance would impose undue hardship on the appli- cant and that the decision will not contravene the public interest. We do not find that either test has been met in this case. Hardship accrues from the applicant's plans, not the physical circumstances of the property. In addi- tion, the public interest may best be served by maintaining the 5' landscaping separation between the properties. RECOMMENDATION Based upon the above, staff recommends denial of the application. Should the Board of Adjustment decide to grant the variance staff recommends the applicant submit a plan for an intensive landscaping screen or solid fence along the subject area of the property.
