28, 1984, approved this conditional use permit application subject to:
1. Site plan alternative No. 3,
2: Incorporating tennis courts or other park use,
3. geview of lighting by the Board of Architectural Review,
4. More easterly location of the reservoir to minimize visual impact,
particularly to the south, and
5. The permit not being construed to impede in any way access of adjacent
property owners to their property.
On July 9, 1984, the appeal period expired for this decision without filing
of an appeal.
This permit will expire on June 28, 1985, unless a building permit is
obtained or an extension is granted by the Planning Commission per Section
18.64.060, Tukwila Municipal Code.

After a review of the Planning staff's report and recommendation, I would like
to say I agree with their recommendation to approve Alternative No. 3 and hope
the Commission will give formal approval to this proposal. However, there is
additional information you should be aware of and consider. The soon to be
published new Tukwila Park and Open Space Plan identifies a current need of
five City tennis courts, and by 1990 six will be needed. In 1986 when the two
lower tennis courts in Tukwila Park are rehabilitated into one court and a
tennis wall /practice court, we will lose one court and will need at least one
and possibly two new courts. The opportunity of developing two courts on top
of the water tank is very good and should be given strong consideration.
Because more information needs to be developed for the site, I do not think it
would be wise to be too design specific concerning fencing, parking, lighting,
hours of use, and landscaping. Approval of a general plan like the plan sub-
mitted would be best with general guidelines added. The Board of Architec-
tural Review should provide specific design review. The Park Commission will
also make a recommendation on user concerns.

AGENDA ITEM
INTRODUCTION
The City of Tukwila is applying for construction of a new reservoir in the North
Hill area to be called the North Hill Reservoir. Recently the City was granted a
short plat (84- 20 -SS) to create a 38,281.89 square foot parcel on which to
construct a 2 million gallon water reservoir implementing the City's long range
plans for increasing water service in the North Hill area. The property is
located at approximately 14953 57th Ave. So. (or at the end of 57th Ave. So. north
of the existing Hampton Heights Apartments and adjacent to the recently approved
Cottages Apartments (J.B. Wright Corp.)).
FINDINGS
1. The subject property is zoned R -1 -12 which requires the proposed water reser-
voir be reviewed and approved as a conditional use (TMC 18.12.050(8)).
Requirements for conditional uses are specified in TMC 18.64, including the
review criteria that must be applied by the Planning Commission per TMC
18.64.050. The Board may approve, modify, or deny the application.
2. The City of Tukwila proposes to construct the reservoir during the period from
1985 to 1987 as part of the City's plans for increasing the water capacity in
the North Hill area in order to alleviate the existing water supply problems
experienced by residents. A new 12" water main will be constructed in the
area and connected to the reservoir.
3. Alternative site plan concepts have been generated, each having different
environmental and visual impacts associated with construction and feasible
site development. The Parks and Recreation Department has indicated that the
site is very desirable for joint usage and development for recreation pur-
poses, particularly tennis courts.
4. The property slopes east to west with an elevation of 265' at the easterly
property line and 216' at the westerly property line. Substantial vegetation
exists on the property, the majority of which is to be removed under either of
the three development concepts. The original owner of the property, residing
at 14951 57th Ave. So., will continue to live on the adjacent property some
147' north of the proposal's northerly property line. Along the southerly
portion of the property is located the recently approved development of the
Cottages Apartments (J.B. Wright Corp.), which site plan indicates the adja-
cent area to bed developed for recreational purposes. Easterly of the subject

property and across 57th Ave. So. is located an existing residence at 14952
57th Ave. So. At this residence the street terminates and connects with the
City trail extending southerly to 152nd Ave. So. West of the subject property
is a large parcel occupied by the residence of 14949 57th Ave. So. Access to
the proposal will occur via one curb cut at the northeasterly corner of the
property.
5. The three alternatives for development of the property are:
1. Alternative one consists of a totally freestanding 30' high steel
round tank located approximately in the center of the property. This
tank is 107 feet in diameter and would be located on a level graded
portion of the property. A 10' access and maintenance road would
encircle the tank and exit the property at the northeast corner.
Necessary grading and excavation would remove essentially 90% of the
existing vegetation and not provide space for recreational develop-
ment. This concept provides inadequate space along the northerly
property line for landscaping and screening of the proposal from the
northerly abutting single family property and residence.
2. Alternative two is essentially the same as alternative number one
except a 117' diameter tank would be sunk into the ground so only the
top approximate one -half (or 15' to 20') would be exposed. This
reduces the amount of grading and excavation on the property, thereby
removing only about 75% to 80% of the existing vegetation. In addi-
tion, the opportunities for landscaping and screening along the
northerly property line is substantially increased and becomes effec-
tive and feasible. However, sufficient space for recreation oppor-
tunities remains insufficient.
3. Alternative three is a reinforced concrete square tank measuring 120'
x 112' proposed to be sunk near the existing grade of the easterly
portion of the property. This minimizes the grading and excavation
necessary for the tank, thereby reducing removal of existing vegeta-
tion to approximately 60% to 75% of the property. However, due to
the proposed construction of two tennis courts atop the reservoir
tank, parking is required along the easterly portion of the property
which necessitates removal of nearly all of the vegetation therein.
Landscape plans for either of the alternatives was not submitted.
6. TMC 18.60.030(2)(E) requires Board of Architectural Review of the proposal.
This review is to be conducted separate from the Planning Commission's review
of the conditional use permit.
7. Staff issued a Final Declaration of Nonsignificance.
8. The Comprehensive Land Use Policy Plan indicates the subject property to be in
an environmentally sensitive area, particularly owing to the slope of the pro-

perty, existing vegetation and view from the valley floor. Attached Exhibit
E, contains the applicable portions of the Land Use Policy Plan.
CONCLUSIONS
1. Material detriment to the public welfare may occur relative to view obstruc-
tion on or from the subject property through alternatives one and two. The
30' height of the tank in alternative one will produce a substantial visual
impact upon the neighborhood in terms of view obstruction and the charcter
that exists. Alternative two produces less visual impact, however, the
character of the neighborhood continues to be impacted by the incursion of a
round steel tank. Alternative three produces the least impact on the neigh-
borhood and provides the greater recreation potential of benefit to the
general public.
Injury to property in the area will occur mostly in terms of the aforemen-
tioned visual impact and alteration of the existing character of the neigh-
borhood. Alternative three appears to present the least injury and most
opportunity for neighborhood enjoyment of a recreation facility capitalizing
on joint usage of the property.
Therefore, it appears that alternative three will produce the least material
detriment and injury (TMC 18.64.050(1)).
2. Either alternative appears to comply with the site and setback regulations of
TMC 18.50. However, alternatives one and two appear to be the traditional
approaches to water reservoir siting and construction which do not "...exceed
the performance standards..." of the R -1 -12 zoning district. These alter-
natives make no provision for joint usage by recreational facilities and pro-
vide a utilitarian approach to the water reservoir project. Alternative three
appears to exceed the single family zoning requirements and traditional
approaches to water reservoir construction and siting in that recreational
usages for the neighborhood are provided in addition to increased oppor-
tunities for building setbacks and a non - utilitarian image for the project.
Appropriately screened by vegetation and /or fencing the water reservoir could
be difficult to distinguish from a public park facility for serving the
recreational needs of the neighborhood (TMC 18.64.050(2)).
3. The neighborhood consists of varying densities of single family development,
however, the character is predominantly low key especially at this terminus of
57th Ave. So. Traffic circulation is light and a City trail connects the ter-
minus of 57th Ave. So to 152nd Ave. So. The three alternatives appear to be
compatible with the neighborhood, except the utilitarian design of alter-
natives one and two seem to contrast with the building design and site design
of existing residential development. Alternative three is more compatible
with the existing neighborhood character and represents an enhancement of the
potential recreational and pedestrian usage of the facility (Section TMC
18.64.050(3)).

4. The Comprehensive Land Use Policy Plan indicates the wooded hillside should be
preserved as much as possible with development discouraged in steep slope
areas. Views are indicated to be preserved as well as the quality of
hillside landform. Furthermore, recreation facilities are desired, main-
taining the scenic condition of the hillside.
Alternatives one and two appear to comply less with the Comprehensive Plan
than alternative three. The latter provides for recreational joint usage of
the property while minimizing visual impact upon the neighborhood. In addi-
tion, opportunities for preservation of the existing vegetation and enhan-
cement by supplemental landscaping material is increased. The resulting form
of the concrete reservoir tank will be more in keeping with the existing
character of the hillside (TMC 18.64.050(4)).
The potential adverse impacts of a water reservoir located on the subject
property appear largely minimized by alternative three as compared to the
other alternatives (TMC 18.64.050(5)). Visually the structure featuring ten-
nis courts is significantly more compatible with the existing neighborhood
character in design of existing structures and represents a desirable and
appropriate parks and recreation joint usage of the property and facility.
Additional landscaping must be provided to increase visual buffering of the
facility from the adjacent properties and descrease the visibility of the
westerly portion of the reservoir tank from the westerly properties and valley
floor.
RECOMMENDATION
Based upon the above findings and conclusions, staff recommends approval of
Alternative No. 3 the application subject to submission of a final landscaping
plan, eternal illumination plan and hours of operation for review and approval by
the Board of Architectural Review.
NOTICE OF TIME LIMIT - TMC 18.64.060
The conditional use permit shall automatically expire one year of the date of
Planning Commission approval unless a building permit is obtained and shall expire
within two years unless substantial construction is completed. Extensions of
these deadlines may be requested of the Planning Commission subject to demonstra-
tion of extraordinary circumstances or conditions not known or foreseeable at the
time the original application was granted.
NOTICE OF RIGHT OF APPEAL - TMC 18.90 -020
Any party aggrieved by the decision of the Planning Commission may appeal said
decision to the City Council by filing a written appeal to the City Clerk within
10 days of said decision. The appeal shall state the reasons for the appeal. The
City Council may hold a public hearing and may affirm, modify or deny the Planning
Commission's decision.
