HomeMy WebLinkAboutPermit 84-22-CUP - DOUBLETREE - EVENT CONDITIONAL USE84-22-cup 16500 southcenter parkway DOUBLETREE EVENT CONDITIONAL USE PLAZA FESTIVAL CONDITIONAL USE PLANNING DIVISION PLANNING COMMISSION STAFF REPORT IV) C. : 84-22-CUP: Doubletree Plaza Arts and Crafts Festival AGENDA ITEM INTRODUCTION On July 4, 1984, the Doubletree Plaza Hotel proposes to hold an arts and craft fair and small carnival. Entertainment events will be conducted inside the hotel. An arts and crafts sale, merry -go- round, pony rides, putting contest and helicopter rides will be located in the hotel parking lot and lawn area. FINDINGS 1. The subject property is located in the C -P zone (TMC 18.34) which permits a wide variety of retail uses and shopping centers. The proposed 4th of July celebration falls within a "festival" and /or "carnival" of TMC 18.64.020(1) thereby requiring conditional use permit approval by the Planning Commission per TMC 18.64.040 subject to the criteria of TMC 18.64.050. The Planning Commission may approve, modify, or deny the application. 2. TMC 18.64.020(1) and the definitional portion of the Zoning Code (TMC 18.04) do not define a "festival." Therefore, upon advise of the City Attorney, the standard defintion in the dictionary was applied, which indicated a "festival" to be: "A time of celebration marked by special observances...an occasion devoted to festive community observances often held annually to celebrate the anniversary of a notable person or event..." The proposed celebration on the 4th of July, our nation's independence holi- day, falls within this definition. Therefore, a conditional use permit is required of the applicant. 3. The Doubletree Plaza Hotel parking lot contains a double row of parking stalls adjacent to the westerly portion of the building which the hotel feels will accommodate the features of the celebration without unduly restricting their parking. The hotel asserts that parking permission has been given by adjacent property owners to accomodate any overflow parking demand. It is also asserted that the event being held on a national holiday has in the past experienced less than normal demand for parking in the area due to fewer busi- nesses being open. 4. A helicopter will take off and land on the north lawn portion of the property. A golf putting contest will also be held on this lawn area, scheduled to not conflict with the helicopter rides. CONCLUSIONS 1. Material detriment or injury to other properties or improvements in the area is not likely to occur as a result of the proposal (TMC 18.64.050(1)). The festival is confined to the Doubletree Plaza Hotel property, except for the helicopter rides which will fly over the central business district (CBD). This will not produce any material detriment or injury to the public welfare provided the federal, state and local safety and health regulations are met relative to the equipment and its use. 2. The proposal is an exception to the normally permitted uses and development standards of the C -P zone. However, the festival's confinement to the center of the property essentially meets the standards of the zone (TMC 18.64.050(2)). 3. Due to the holiday on which the festival will be held, it is anticipated that minimal traffic will exist in this area of the central business district. However, the Police Department lacks experience of such festivals in the CBD to be able to predict the overall impact on traffic circulation. It's antici- pated that many of the businesses in the CBD will be closed that day, thereby reducing the overall traffic and produce alteration of the peak traffic demands usually experienced on a weekday in the CBD (TMC 18.64.050(3)). To insure control of parking and vehicular circulation on the site, a person should be available to perform this control as needed. 4. The Comprehensive Land Use Policy Plan largely does not address the proposed use. However, one of the policies for the commercial area is to promote retail activities (Policy 4, Page 65). In addition, the Comprehensive Plan incourages preservation of public health, safety and welfare. Provided ampli- cable federal, state, and local health and safety regulations are met, the proposal will implement the Comprehensive Plan (TMC 18.64.050(4)). 5. As long as the aforementioned health and safety regulations are complied with the potential impacts upon the CBD and adjacent properties appears to be mini- mized (TMC 18.64.050(5)). Assurance of this compliance may actually rest with the Tukwila Police Department, but this is not certain due to the City's lack of experience with this kind of festival. RECOMMENDATION Based upon the above staff recommends the application be approved subject to: 1.
