AGENDA ITEM INTRODUCTION Overoad Container Service Corp. recently occupied warehouse space at 569 Strander Blvd. and began a trucking operation. Per notification by staff the applicant submitted a conditional use permit application for review by the Planning Commission. FINDINGS 1. The subject property is located in the Andover Park Industrial Park and deve- loped in a combination of warehouses and offices. Existing zoning on the pro- perty is C -M (Industrial Park). Access from the property is by way of Strander Blvd. adjacent to the Green River. 2. Overoad dispatches interstate owner - operator trucks which haul containers from various parts of the United States to the Sea Land export terminal in Seattle. Overoad does not own and operate any trucks of its own. The drivers mostly come to the Overoad location to pick -up paperwork for their assignments for delivery of empty containers after departing the Sea Land facility. Some hauling within the Puget Sound area is also done with some temporary storage in the warehouse area being leased. For the most part trucking activity occurs throughout the United States. 3. TMC 18.38.040(2) lists "truck terminals" as conditional uses requiring Planning Commission approval per TMC 18.64. The Board of Adjustment, on September 21, 1978, adopted the following definition for a "truck terminal ": Truck terminal means a site or building, or a tenant space within a building the occupant of which is the holder of a certificate of public necessity from the Interstate Commerce Commission, the Washington Utilities and Transportation Commission, or a similar agency, and which exhibits any one of the following characteristics of use: The business location is a place to receive, pick -up and /or deliver orders which are placed by customers. The business includes the use of dispatcher (functioning with that or any other title) which directs the activities of the truck driver. June 28, 1984 The business location is used by the truck carrier to receive ship- ments for transloading, transhipping, and /or consolidation, or from which transportation ensues after transloading, transhipping or deconsolidation, whether or not rolling stock of the carrier is parked at the location during periods of non -use. 4. Per the criteria of TMC 18.64.050 the Planning Commission may grant, modify or deny the application. The applicant bears the burden of proof the application conforms to this criteria. 5. The subject property, particularly the area of the subject use, is dominated by trucking operations of various tenants. Warehouse buildings are constructed with many loading bays and internal offices, characteristic of the applicant's type of operation. 6. The Comprehensive Land Use Policy Plan indicates the subject property to be commercial with special development considerations due primarily to the close proximity of the Green River. Additional development of the property is not proposed, therefore a building permit is not required, only the requested business license. 7. The City issued a Final Declaration of Nonsignificance for the proposal. CONCLUSIONS 1. Material detriment or injury to the property or other properties in the vici- nity appears to likely not be occurring at this time and /or not occur as a result of the proposal (TMC 18.64.050(1)). The circulation system and impro- vements in the Andover Park complex were designed and constructed to accommo- date and facilitate heavy truck movements of the type included in the proposal. Additional improvements are not proposed. 2. Since construction is not proposed beyond that which exists, the performance standards of the existing C -M zone are met (TMC 18.64.050(2)). 3. The existing circulation system in the Andover Park complex is conducive to the proposed trucking operation and provides for adequate traffic and pedestrian circulation (TMC 18.64.050(3)). 4. The proposal complies with the Comprehensive Land Use Policy Plan in providing a service which i s compatible with the surrounding land uses and not a detri- ment to the public health, safety and welfare, and i of i l l i ng of the existing business park. The proposal is "functionally convenient" to Strander Blvd. and subsequent access to major freeways. 5. Impacts of the Andover Business Park development upon the area were assessed at the time of development of the property. The applicant is not increasing those impacts. Trucks are not parked overnight on the property and do not arrive in concentrations which could create traffic problems in the Andover Park (TMC 18.64.050(5)). n:?e= rlilLnfifa:a�M?Y�•�iiia ri:;•¢aiuu Page -3- Planning Commission 84 -23 -CUP: Overoad Container Service, Inc. June 28, 1984 RECOMMENDATION Based on the above staff recommends approval of the application. NOTICE. OF TIME LIMIT - TMC 18.64.060 The conditional use permit shall automatically expire one year of the date of Planning Commission approval unless a building permit is obtained and shall expire within two years unless substantial construction is completed. Extensions of these deadlines may be requested of the Planning Commission subject to demonstra- tion of extraordinary circumstances or conditions not known or foreseeable at the time the original application was granted. NOTICE.OF RIGHT OF APPEAL - TMC 18.90.020 Any party aggrieved by the decision of the Planning Commission may appeal said decision to the City Council by filing a written appeal to the City Clerk within 10 days of said decision. The appeal shall state the reasons for the appeal. The City Council may hold a public hearing and may affirm, modify or deny the Planning Commission's decision.
