Dear George:
Rick Beeler has reviewed with me the background and details surrounding
your appeal application. I don't normally become involved in this type
of issue, but he raised the issue of the need to take another look at our
definition of a truck terminal. This would require review by myself and
the City Council.
Our intent is not to hold up your operation in any way pending the
revision of the definition. Therefore, I concur with Mr. Beeler's
recommendation that your business does not after all fit the definition
of a truck terminal but in fact is a commercial service. Accordingly,
the appeal issue is moot, and he has issued the Planning Department's
approval 'of your business license.
Your clarification of some of the problems with our definition is
appreciated and is being incorporated into our review. The end product
will no doubt more accurately reflect the policy of the City.

Truck Terminal Definition
MEMORANDUM
The Air Cargo Services appeal has focused the attention of staff on the.
existing definition of a "Truck Terminal" made by the Board of Adjustment
on May 6, 1982 (attached). At least two other small trucking operations
which marginally fit the definition have been required to acquire a
conditional use permit from the Planning Commission in the past several
months. Together these businesses indicate another look at the definition
may be appropriate at this time.
Since the trucking industry is regulated by the Washington Utilities and
Transportation Commissiog,as indicated in the existing definition, staff
contacted the local office of the Commission. They discovered the
"certificate of public necessity" referenced in and a pivotal part of
the definition is actually issued only for busses and garbage trucks.
Other trucking operations require other types of permits or registrations.
Therefore, this portion of the definition needs to be updated.
A change in the definition requires the policy decision of how extensive
of regulation of trucking operations the City Council wishes to impose.
Substitute wording for the above mentioned "certificate" can take several
directions. I'm unsure of what direction should be taken, but I feel
confident that the City Council and /or the administration should do
more research and analysis toward the end of preparing a Zoning Code
definition or amending the existing definition of a truck terminal.
Therefore, I wanted to express my assurance that while the Air Cargo
Services appeal is no longer an issue, staff will continue to work on
refining the definition. At some time in the future staff may be
bringing a revision of some form or another for your review. We will
be keeping you informed of progress.

MEMORANDUM
The only item on this meeting's agenda is an appeal of an administrative
determination which has been resolved in favor of the appellant. Therefore,
there is no need to meet on this item.
Attached is a memorandum from the Mayor regarding the "truck terminal" ..
issue that fastered the appeal. Although the appeal has been resolved, we
will continue to work on refining the definition.

I appreciate the time you spent with me on the phone yesterday
concerning your August 17, letter. As I mentioned, we disagree
with our business being classified under code TMC 18.40.040(2)
Truck Terminal.
Air Cargo Services, Inc. DBA Flite Time is an air freight
forwarder. Nearly ninety per cent (90X) of our total revenue is
derived from providing a service. While we do own a few
vehicles, they are not a necessity to our business. We can and do
contract out the local pick up /delivery segments of airfreight
shipments. As I explained, many times we are not even physically
involved with the airfreight shipments, ie, shipments from
Chicago direct to Anchorage, New York to San Francisco, etc. We
spend more on communications costs than we do on vehicle costs.
The times we are physically involved with freight is incidental
and subordinate to the primary service we provide; the control of
airfreight movements via air forwarding expertise and
communication.
Mr. Clute previously explained that we have no permit or
certificate from the Interstate Commerce Commission, Washington
Utilities and Transportation Commission, or similiar agency.
Therefore, we feel we belong not in the Truck Terminal
classification, but under the M -1 code TMC 18.40.020(13)
Commercial, Professional and Business Offices, and Services.
Mr. Beeler, please use this letter as our appeal to the Board of
Adjustment for a hearing a soon as possible. Thank you again for
your assistance, and please call me at 433 -5661 if there are any
other requirements we should fulfill.

Dear George:
The City Attorney advised me that a •conditional use permit is required
before your business license can be approved. Enclosed are the required
forms.
Basically the reasoning is that your business is either:
1. An outright permitted use;
2. An accessory use;
3. A conditional use; or
4. Not allowed.
Our rending of the M -1 zone (that in which you are located) regulations
places your business as either a conditional use (truck terminal) or not
allowed. Logically, therefore, our preference is to pursue the conditional
use.
Other—options are available. The Zoning Code can be revised or you can
file an appeal to the Board of Adjustment. The former takes a considerable
amount of time. The latter could be heard on October 4, 1984. A con-
ditional use permit could be heard, after filing the required documents on
September 27, 1984.
If you decide on the conditional use permit the enclosed must be filed with
the Planning Department by August 30, 1984, to be heard on September 27,
1984. An appeal to the Board of Adjustment must be filed by September 6,
1984, to be heard on October 4, 1984. Either of these two actions will
suspend your business license application pending the final outcome.

As I stated in our recent phone conversation a conditional use application
is apparently required for your business. Your explanation of'your
operation indicates it is a truck terminal as defined by the Board of
Adjustment.
However, your point that the definition does not apply, since you have
no permit or certificate from the Interstate Commerce Commission or
similar agency, is being pursued with the City Attorney. Upon receiving
a response I will call you.
In the meantime I will not send you a conditional use application until
it is firmly established one is needed.

MEMORANDUM.
This memo•is sent to you on behalf of the Tukwila Board of.Adjustment
following their meeting of 6 May 1982 at which the.definition add . inter-
pretation of Truck Terminals within the city was modified. The de-
finition which was adopted by the. Board on 6 May supersedes that con -
tained in the memorandum of 4 October 1978 from Roger Blaylock which
discusses the Board's prior interpretation of this type of'facility
on 21 September 1978::
TRUCK TERMINAL -- Truck'terminal means 'a site or building, or a
tenant space within a building • the occupant of
which is a holder of a certificate of public
necessity from the Interstate Commerce Commis-
sion, the Washington Utilities and Transporta-
tion Commission or a similar agency, and which
exhibits any one of the following characteris-
tics of use; '
- -the business location is a place to receive,
pick -up and /or deliver orders which are placed
by customers.
- -The business includes the use of a dispatcher
(.functioning with that or any-other title) which
directs the activities of the truck driver.
- -The business location,is used by the truck car-
rier to receive shipments for.transloading, trans-
shi ppi ng and /or consolidation, or from which
portation ensues after transloading, transshipping
or deconsol idati whether or not rolling stock •
of the carrier is parked at the location during
periods of non -uses
'Ail businesses meeting this definition, except those located in the M -2
zoning dfstrict, will be expected to obtain a Conditional Use Permit prior
to beginning operation, and only in those zoning districts where truck••
terminals are recognized as a conditional use.
