Obtaining Riverfront Easement From Kaiser Development
Recently I was given a set of plans, a copy of a Developers Agreement,
and a copy of the specs for the Kaiser Development. .In addition to some
minor technical concerns, of which I informed Phil Fraser, I am concerned
that my request to obtain a 20 foot wide riverfront trail easement was
not included in the Developers Agreement. In the past months, I have
responded to both Planning and Public Works that we are planning a trail
along the riverfront and that the easement is needed. I have attended two
developer's meetings with Planning, Public Works and the owner's repre-
sentatives. The latter stated at the second meeting that the desired
easement would be provided in the second phase of development. This is
fine if the.owner.follows through, but why not insure this now with a
condition in•the agreement providing the easement?
It appears to me that during the environment review or while putting together
the Developers'Agreement, the City could have included the requested
easement. Am I wrong? Could we now include such an easement requirement
in the proposed Developers Agreement? If we can, please inform me what
to do and I will do it. If not, what can we do to insure that we will
obtain this easement?
I am not concerned about any possible past errors or who was involved,
I am only concerned about obtaining or insuring that this easement
be obtained. In mid -May, an Administrative Policy (04 -14) was signed
to provide direction for future easement obtainment, but for now I need
some advice and direction for this particular situation.
Please send me a note or perhaps Don Morrison could set up a brief meeting
to see what can be done.

EASEMENT AND MAINTENANCE AGREEMENT
THIS EASEMENT AGREEMENT is made this /1 day of
0,2 /j _ , 1984, between INN VENTURES, IN — a Kansas
corporation ( "Inn Ventures "), and TRI -STAR DEVELOPMENT,
INC., a Washington corporation ( "Tri- Star ").
1. Recitals.
1.1 Tri -Star is the owner of certain real prop-
erty in King County, Washington, legally described on
Exhibit "A" to this Agreement under the heading "Lot 1 ", and
referred to in this Easement Agreement as Lot 1. Inn
Ventures is the owner of adjacent property legally described
on Exhibit "A" to this Agreement under the heading "Lot 2 ",
and referred to in this Easement Agreement as Lot 2.
1.2 This Agreement is being executed by both
parties who each have a right to purchase their described
lots. It is expected that their purchase shall close within
60 days of the date of this Agreement. Upon such closing,
this Agreement shall be recorded simultaneously with the
closing. If either party assigns its purchase rights prior
to closing, its successor will execute this Agreement upon
closing and be bound by all the terms and agreements of its
predecessor as set forth herein.
1.3 The parties wish to develop their respective
properties, wish to provide for certain easements and
agreements in connection therewith and, therefore, agree as
follows:
2. Landscaping and Parking Easement. Tri -Star hereby
grants to Inn Ventures a perpetual exclusive easement for
parking, landscaping, light, air and ventilation over the
property described on Exhibit "B ".
3. Access Easements.
3.1 Grant. Tri -Star hereby grants to Inn
Ventures a perpetual nonexclusive easement for ingress,
egress and utilities over the property described on Exhibit
"C" to this Agreement. Inn Ventures hereby grants to
Tri -Star a perpetual nonexclusive easement for ingress,
egress and utilities over the property described on Exhibit
"D" to this Agreement.
3.2 Construction. Inn Ventures and Tri -Star each
agree to construct improvements on the property owned by
them and burdened by the ingress, egress and utility ease-
ments described in paragraph 3.1. The improvements on each
lot shall consist of a paved driveway suitable for ingress
and egress to both lots. The improvements shall be con-
structed within 60 days from the date of notice from either
party to the other and shall be constructed in accordance
with all applicable legal requirements. If the improvements
are not constructed within the time limits set forth above,
the benefitted owner may construct the improvements at the
burdened owner's expense. If the burdened owner fails to
pay the cost of completing the work within 30 days after
receipt of a billing, the cost of completing the work shall
be a charge and a continuing lien against the burdened
property.
3.3 Maintenance. The owner of the burdened
property shall have the obligation to maintain the improve-
ments covered by the easement and located upon its property
in accordance with applicable government standards and
consistent with generally accepted standards for first -class
commercial and hotel developments. If the burdened owner
fails to perform such maintenance work, the benefitted owner
may perform the work at the burdened owner's expense. If
the burdened owner fails to pay its share of the cost of
completing the work within 30 days after receipt of a
billing, the amount of its share shall be a charge and a
continuing lien against the burdened property.
4. Storm Drain Easement.
4.1 Storm Easement. Inn Ventures hereby grants
to Tri -Star a perpetual nonexclusive easement for use and
maintenance of a storm drainage system across the property
described on Exhibit "E" to this Agreement.
4.2 Construction of Mutual Storm Line. The
construction of storm line under this easement is for that
portion of the storm sewer system used to carry runoff for
both sites as shown on civil engineering plans prepared by
Johnson /Braund Design Group. Inn Ventures and Tri -Star
shall both submit fixed price bids from their respective
contractors for said construction. Engineering overhead and
administrative costs shall then be added to bid prices.
Both parties shall then mutually agree on the bid most
acceptable. Upon mutual agreement of said fixed price bid,
a construction contract shall be mutually executed by both
parties and placed in escrow. Said contract shall have a

fixed price and include specific start and completion dates
acceptable to both parties. Simultaneously with the placing
of the contract in escrow, each party shall pay in escrow
50% of the contract amount. Additionally, escrow instruc-
tions mutually executed by both parties shall be placed in
escrow providing for the money to be dispersed to the
contractor directly from the account, provided that the
storm system is built in accordance with the contract and
has been approved by the City of Tukwila. The
above - referenced escrow shall be opened and monies paid in
simultaneously with the closing of the purchase of Lot 1 and
2 by both parties or at such later date as the agreed and
accepted bid has been contracted for on the date of such
contract. If, for any reason, there is to be a price
adjustment on the contract, both parties agree that within
15 days of notification of price adjustment from the con-
tractor, they will each pay 50% of any additional money
required into the escrow with instructions mutually executed
by both parties as to the dispersement of said monies. If
either party fails to make its payment, the nondefaulting
party shall be permitted to make the payment and shall bill
the defaulting party for its share of that payment. The
amount of that unpaid bill shall be a charge and continuing
lien against the burdened property of the defaulting party
until paid and the defaulting party shall not be permitted
to use the storm system until the bill is paid.
4.3 Maintenance. The storm water drainage
system shall be maintained in accordance with applicable
legal standards and so as to adequately drain Lot 1 and Lot
2. The decision to undertake any maintenance or repair work
may be made by either party. The cost of maintaining the
improvements constructed on the storm drain easement prop-
erty shall be shared equally by the parties. The party
performing the work shall be paid promptly by the other for
its share of the work. If the other fails to pay its share
within 30 days following receipt of a billing, the amount of
its share shall be a continuing lien on its property.
5. Successors and Assigns. This Easement Agreement
shall run with the affected properties and be binding upon
and inure to the benefit of the parties, their heirs,
successors and assigns.
6. Interest, Costs and Attorney's Fees. If any
billing provided for in this Agreement is not paid within 30
days after receipt by the party obligated to pay the same,
the amount of such charge shall bear interest at the prime
rate of Sea -First plus 5 %. Any lien provided for in this
action may be foreclosed in the same manner as a mortgage.

party, or to foreclose a lien provided for in this Agree-
ment, the prevailing party shall be entitled to its court

FOR AND IN CONSIDERATION OF the mutual promises,
covenants, conditions and benefits contained herein and
derived hereunder and for other good and valuable considera-
tion, the receipt of which is hereby acknowledged, the
Grantors do hereby grant, convey and warrant to the Grantee
for the purposes hereinafter set forth an easement under,
across and over 'Parcel A' of certain real property located
in King County, Washington, together with a five (5) foot
wide'right- of paralleling the west margin of the West
Valley Highway in Ring County, which right- of-way is

Legally described as set forth in the description thereof

hereby made a part hereof as 'Exhibit B.' Parcels A and
B shall collectively hereinafter be referred to as the
'Property.'
TO HAVE AND TO HOLD said easement and right -of-
tJ way unto the Grantee and its successors, upon the following
N terms and conditions:
1. Purpose. (a) Grantee shall have the right to
N construct, operate, maintain, repair and replace an under-
ground electric transmission vault (hereinafter referred to
as the 'transmission vault') beneath the surface level of
the above - described Parcel A and any and all necessary
appurtenances thereto including but not limited to under-
ground conduits, cables, commtn,:cation lines, manholes,
switches, transformers and similar facilities; provided,
by WDVo., toast any and all appurtenances which enter or
attach to the transmission vault shall be underground. No
portion of the transmission vault, or any appurtenances
thereto shall extend above the surface of the surrounding
ground elevation.
(b) Grantee shall have the right to construct,
operate, maintain, repair and replace an underground 115
kilavolt power line duct bank (hereinafter referred to as
the 'duct bank') beneath the surface level of the above -
described Parcel I; provided, that the Grantee shall not
construct, operate, maintain, repair or replace said
facilities with • duct bank exceeding the presently in -.
stalled wet bank which consists of tour (41 ducts Of
ix -inch (6 ") diameter P.V.C. pipe as shown on Exhibit "U"
ereto. No portion of the duct bank shall extend above

(c) Following the initial construction of the
ransmission vault and /or duct bank, the Grantee may from
ime to time improve or reconstruct the facilities as it
f y be required; provided, however, that any such improve-
nt or reconstruction shall be subject to the terms and

N editions hereof. All uses of the Property or any portion
hereof except those authorized in this Section 1 are
rohibited.
2. ACCESS. The Grantee shall have the right of
ccess to the Property over and across that portion thereof
mmediately adjacent to the West Valley Highway. Access to
he Property across the real property owned, leased or
ssessed by the Grantors, or any of them, from any other
irection is prohibited; provided, however, that special
ccess permission shall be granted for emergency circum-
Lances. The Grantee shall compensate the Grantors for any
gem to the Property or the Grantors' adjacent real
roperty, or their interests therein, caused by the exercise
f said right of access. The Grantee shall erect and main -

3. OBSTRUCTIONS; LANDSCAPING. Following the
installation of the Grantee's facilities or any part thereof,
the Grantors, or any, of thews, may from time to time under-
take any and all actions necessary to improve the Property
so as to bring it to conformity with the development of and
N improvements on property owned, leased or possessed by the

Grantors, or any of them; provided, however, that the
Grantee may, from time to time, remove trees, bushes or
P■ other obstructions within the Property and may level and
grade the Property to the extent reasonably necessary to
carry out the maintenance, repair, or replacement of the
improvements within the Property; provided, further, that
following any such work by the Grantee, the Grantee shall,
at its sole cost and expense, undertake and complete such
action as may be necessary to restore the Property to the
condition it was in iamediitely prior to such work and so as
to bring the Property into conformity with the development
of and improvements on the surrounding area owned, leased or
possessed by the Grantors, or any of them. Following the
installation of the Grantee's underground facilities, or
after the expiration of one hundred eighty (ISO) days from
the date hereof, whichever shall first occur, the Grantors,
or any of them, may undertake any improvements to the
Landscaping of,the Property and the construction of improve -
masts thereon.
4. GRA!TORS' USE OF PlOPSIlTY. The Grantors, sad
each of them, reserve the right to use the Property for lay

maintain any building or other structure on the Property nor
shall it engage in any digging, tunneling or other con-
struction activity on the Property or immediately adjacent
os to the Property which would unreasonably disturb or endanger

adjacent soil or unearth the Grantee's facilities on the
r Property or endanger the lateral support to said facilities.
The Grantors agree that no blasting shall he done within 15
feet of the Property.
S. INDEMNIFICATION. By accepting and recording
this Easement, the Grantee agrees to indemnify and hold the
Grantors, and each of them, harmless from any and all
claims, expenses (including attorneys' fees), costs, obliga-
tions, liabilities, claims, or damage (including consequen-
tial damage), of any nature whatsoever incurred or which may
be claimed against the Grantors, or any of than and arising
by reason of the Grantee's exercise of rights herein granted;
provided, that the Grantee shall not be responsible to the
Grantors, or any of them, or any of them, for any damages,
claims, obligations or responsibilities resulting from
injuries to any person caused by acts or omissions of the
Grantors, or any of thee.
6. AMNDONMENT. The rights herein granted shall
continue until such tine as the Grantee ceases to use the
Property for a period of one (1) year, in which event this

6. Any alteration of plans for works and structures made subsequent to the filing of an application or the issuance of
permit shall be subject to approval by the director.
7. The director shall be notified by the permittee of the completion of works under this permit in order that he may
make final inspection and give final approval.
8. RCW 86.16.100 provides that the exercise by the state regulatory powers shall not imply or create any liability for
any damages against the state, and the action taken by the department herein shall not "imply or create any liability
for any damages against the state.
9. When necessary to provide for the proper maintenance or operation of the works, structures, or improvements as
authorized herein, the department may issue supplementary orders providing for such.

This Escrow Agreement is for the investment of the retained percentages of the above contract in accordance with
Chapter 38, Laws of 1970, amending RCW 60.28.010, 60.28.020 and 60.28.050.
The Undersigned, Al beri c i Denver Inc. , herein after referred to as the
Contractor, has directed City of Tukwila , hereinafter referred to as
the Public Body, to deliver to you its warrants, checks or drafts which shall be payable to you and the Contractor jointly.
Such warrants, checks or drafts are to be held and disposed of by you in accordance with the following instructions
and upon the terms and conditions hereinafter set forth.
1. Upon delivery to you, warrants, checks or drafts made payable to you and the Contractor jointly shall be endorsed
by you and forwarded for collection. The moneys from all such warrants, checks or drafts received hereunder shall be
used by you to purchase bonds or other securities selected by the Contractor and approved by the Public Body. For the
purpose of each such purchase, you may follow the last written direction received by you from the Contractor, pro -
vided said direction otherwise conforms with the restrictions on investments recited herein. Attached is a list of such
bonds, or other securities approved by the Public Body. Other bonds or securities, except stocks, may be selected by
the Contractor, subject to express written approval of the Public Body.
2. The investments selected by the Contractor, approved by the Public Body and purchased by you must mature on
or prior to the date set for the completion of the contract, including extensions thereof. After the completion date of the
contract. you shall not be required to invest the money held by you and derived from the sale or redemption of matured
investments until authorized to do so by the Contractor and the Public Body, which authorization shall include the com-
pletion date of the extension.
3. When and as interest on the securities held by you pursuant to this agreement accrues and is paid, you shall collect
such interest and forward it to the Contractor at its address designed below unless otherwise directed by the Contractor.

4. You are not authorized to deliver to the Contractor all or any part of the securities held by you pursuant to this
agreement (or any moneys derived from the sale of such securities, or the negotiation of the Public Body's warrants)
except in accordance with written instructions from the Public Body. Compliance with such instructions shall relieve
you of any further liability related thereto.
5. In the event the Public Body orders you to do so in writing, you shall, within thirty -five (35) days of receipt of such
order, reconvert into money the securities held by you pursuant to this agreement and return such money together with
any other moneys held by you, hereunder, to the Public Body.
6. The Contractor agrees to pay you for your services hereunder compensation in accordance with your published
schedule of Escrow Fees - Public Works Contracts. Payments of all fees shall be the sole responsibility of the Contractor
and shall not be deducted from any property placed with you pursuant to this agreement until and unless the Public
Body directs the release to the Contractor of the securities and moneys held hereunder whereupon you shall be granted
a first lien upon such property released and shall be entitled to reimburse yourself from such property for the entire
amount of your fees as provided for herein above. In the event that you are made a party to any litigation with respect
to the property held by you hereunder, or in the event that the conditions of this escrow are not promptly fulfilled or
that you are required to render any service not provided for in these instructions, or that there is any assignment of
the interests of this escrow or any modification hereof, you shall be entitled to reasonable compensation for such extra-
ordinary services from the Contractor and reimbursement from the Contractor for all costs and expenses, • including at-
torney fees occasioned by such default, delay, controversy or litigation.
7. This agreement shall not be binding until executed by the Contractor and the Public Body and accepted by you.
8. This instrument contains the entire agreement between you, the Contractor and the Public Body with respect to
this escrow and you are not a party to nor bound by any instrument or agreement other than this; you shall not be re-
quired to take notice of any default or any other matter, nor be bound by nor required to give notice or demand, nor
required to take any action whatever except as herein expressly provided; you shall not be liable for any loss or damage
not caused by your own negligence or willfull misconduct.
9. The foregoing provisions shall be binding upon the assigns, successors, personal representatives and heirs of the
parties hereto.

In researching the files, our findings conclude the following:
L.I.D. #7, for the purpose of providing water mains in the vicinity of
your development, received participation through your property
ownership by past participation for public mains through L.I.D. #7.
Therefore, special connection charges are waived by your participation
for water mains.
Search of the City's files finds no like participation for sewer
mains. Enclosed is my October 30, 1984 letter for Brock Residence
Inn which indicates that for your development (reference Phase II) a
$15,826.15 special assessment charge will be against your development
for special connection charges for sewers. This special assessment
is due at the time of application for the Sanitary Side Sewer Permit.
Requested as part of your application is presentation of the cost of
the proposed public 8 inch sanitary sewer main to be built jointly by

4. Sanitary Side Sewer Permit - (Permit Fee: $170.00 Regular Connection
Charge, per building, plus Special Connection Charge as described in
October 30, 1984 letter to Greg A. Diener in the Amount of $15,826.15) -
As stated above, waiver to part or all of this special connection charge
may be provided to credit for proposed 8 inch Sanitary Sewer Main
through request of developer at the time of application for the Sanitary
Side Sewer Permit. All Sanitary Side Sewers shall be provided at a
minimum slope of 2% and a cleanout provided at the exit of the building
at all horizontal and vertical bends and junctions. Any special back
charge agreements between Brock Residence Inn and this development shall
be on file with the City prior to the short plat separating the
properties.
5. Storm Drain - (Permit Fee: $25.00) - All pipe under paved areas (from
catch basin to catch) shall be corrugated metal pipe, Class 14
Galvanized Steel /Aluminum coated Aluminum. All storm drain pipe shall
be provided with a minimum of 12 inches of cover throughout and shall be
of Class "B" Bedding and not Class "C" as described in Note 7 under
Construction Notes on sheet C -3. A joint agreement for connection and
maintenance between developments shall be provided, as part of the
permit application, allowing the storm system to enter into the Brock
Residence Inn storm system and proceed directly to the Green River.
6. Domestic Water Meter - (Deposit for Installation /Regular Connection
Charge per meter: One inch: $1,040.00 per meter) - Special Connection
Charges have been met by past participation of the property through
L.I.D. #7.
The City will install the services from the private main /fire line
(prior to the sprinkler vault) to and including the meter; the developer
is responsible for providing the services from the meter to the each
unit. The difference in the final cost for manpower, labor and equip-
ment by City forces will be deducted /billed from this deposit fee
These meters are located in the public right -of -way; the City Water
Department (Dave Grage: 433 -1863) may, at his discretion, determine the
final location of meters.
7. Curbcuts /Access /Sidewalk Permit - (Permit Fee: $25.00) - Driveway aprons,
sidewalks, handicapped ramps, curb gutters shall be per the City's Standard
Plans and Ordinance #1233. The agreements reached for the development of
the sidewalk shall be per my October 30, 1984 letter to Brock Residence
Inn and per the attached November 6, 1984 letter for the Brock
Residence Inn Development.
8. Flood Zone Control Permit - (Permit Fee: $50.00) - This development
shall apply for City's Flood Zone Control Permit and meet same require-
ments as Brock Residence Inn per past correspondence. Also, develop-
ment shall apply for D.O.E. Flood Zone Control Permit and provide this
executed agreement as part of this permit application.

As a condition of the short plat, it is understood that both parties
may receive credit for the construction of the Sanitary Sewer Main
against this special connection charge. As I stated to Greg Dienier
of Brock last week, any special arrangements for back changing sewer
main construction costs shall be on file with the City prior to the
short plat occuring.
The Public Works Department has reviewed your plans and approved Plan
Sheets C -1, C -2 & C -3 per the following comments and conditions:
1. Prior to issuance of any Utility Permits, authorization for release of
these permits shall be provided by the Planning Director and the Building
Official. Also, prior to issuance of any permits the Fire Marshall
shall have approved the Fire Loop Sprinkler Vault /Hydrant protection
for the development.
2. Private Fire Loop - (Permit Fee: $25.00) - The new fire loop from the
City's existing main in SR 181 to The Sprinkler Vault shall be covered
by this permit. The fire system from the sprinkler vault and hydrant
assembly is inspected solely through the Fire Marshall.
The Fire Marshall in his review of October 9, 1984, requested that all
undergrounding and overhead sprinkler pipe plans inside and including
the vault shall be submitted to the Washington State Rating bureau for
approval. He then stipulated that the Tukwila Fire Department shall
recieve these Rating Bureau approved plans and the T.F.D. shall
approve these these plans prior to the development beginning construc-
tion. All site plans fire protection systems shall be in place and
operational before and during building construction. Test requirements
will include visual inspection, hydrostatic tests, and flushing (purety
test with the Tukwila Water Department).
Included in the Fire Marshall's review is the requirement for an addi-
tional hydrant covering the back side of the proposed building. A
satisfactory agreement shall be arrived at via the Developer and the
Fire Marshall with regards to hydrant coverage of the back side of the
development prior to issuance of this permit.
If this agreement includes generation of additional hydrants before
sprinkler vaults then Public Works requests six sets of these approved
plans through the Fire Marshall and Rating Bureau for Public Works
review and approval prior to their installation (systems outside of
sprinkler vaults only). All fire mains shall be Class 52 ductle iron
pipe and 8 inches in diameter.
3. Private Sanitary Sewer Main - (Permit Fee: $25.00) - The Private
Sanitary Sewer Main shall be built to public standards, in Class "B"
Bedding throughout. This Private Sanitary Sewer Main shall remain pri-
vate. The private main shall have a manhole structure provided a the
location of the cleanout shown on the plans (i.e. = 23.38) and the
cleanout shall be relocated to just outside the building structure on
the side sewer line. On sheet C -3, the proposed "8 inch Sanitary by
Attached is the 10/5/84 letter to Lawrence S. Braun for the Brock Residence
Inn. This adjacent development letter indicates the joint easement requirements
for the various permits identified in this letter. The same requirements as
provided under the permits identified in the 10/5/84 letter for mutual agreement
shall become part of the application for your utility permits.
If you have any questions regarding this matter, please do not hesitate to call

9. Landscape Irrigation - if appropriate - (Permit Fee: $25.00) - It is the
sole responsibility of the owner /or his engineers to assure the the coor-
dination of these utilities plans has been accomplished by the landscaping
design, as landscape plans have not been submitted as part of this plan
review. If irrigation is required for the landscaping plans, requested is a
submittal of 4 sets landscape irrigation plans to Public Works for review
and approval which include an overlay of all utilities. Included in these
plans, a backflow prevention device shall be noted: "or DHS approved ".

The Tukwila Municipal Code requires that each structure shall be
separately sewered. Therefore, either the sewer main shall be
extended and including manholes for the last reach (with 8"
diameter pipe, manholes at every 300' and /or at bends); or,
separate sanitary side sewers shall be shown to the private mains.
. Private Sanitary Sewer Main Permit - (Permit Fee: $25.00) - The 's
issues involving additional private mains shall be resolved as
described in item 4 above prior to issuance of this permit. A
copy of the joint agreement by which the private mains shall be
operated and maintained shall be provided for the City's review
and approval prior to the issuance of any sewer permit. The pri-

sheet C4 dated 10/19/84 - latest revision, for Brock's
Residence Inn water service. Final acceptance is subject
to final field inspection by a representative of this
department and the following conditions:
1. Adequacy of water supply shall be determined by
flow test and fire flow calculations shall meet I.S.O.
schedule as a minimum (for test building 412 worst case).
2. Thrust blocks are required behind fire hydrants.
3. A sprinkler pit (vault) is required to be installed
to meet NFPA 24 requirements housing; 0.S.& Y Check
Valve, D.S.H.S. approved back -flow check valve, Post,.
Indicator Valve and Fire Department Connection with flange
check valve. (see attached)
4. The fire department is to be contacted to witness
the following test on all underground piping except domestic:

Enclosed are six (6) copies of the revised civil design plans for
Tukwila Park. In accordance with our meeting of November 7, 1984, we
have made revisions and additions as discussed.
We contacted Mr. Jerry Creek of King County's Department of Public
Works who referred us to Sam Jennings of Surface Water
Management. Mr. Jennings indicted that the flood plain data is based
on the U.S.G.S. elevation datum which is the mean sea level. He also
indicated that the flood elevation of the Green River is 24.9 for the
10 -year storm through the 500 -year storm. As noted on our plans, our
bench mark datum information is based on the old NGS bench mark which
later became part of the U.S.G.S. bench mark network. This is the
same bench mark that the W.S.D.O.T. is using.
We were not able to find the bench mark referenced on the plans for
Brock Residence Inn. However, we checked elevations on existing catch
basin grates which agreed with their measurements by + 0.01 feet.

Dear Sirs:
Public Works Department has reviewed and approved the subject plan submit-
tal. These plan resubmittals and new submittals are approved per all of .
the conditions outlined in my attached 10/5/84 letter, and the additional
criteria which is applied below as follows:
1. The resubmitted plans have been corrected per the notes reviewed by
Public Works on 10/22/84 on the side of the 10/5/84 letter (attached).
(Note: the attached comments referred to are on the left side of the
sheet only.)
2. The Department of Ecolo gy, in their October 12, 1984 letter, has
issued a Flood Zone Control Permit (Permit #1- 5594 -2). This represents
the first of two (2) Flood Zone Permits that are issued for your deve-
lopment, the second (2) being from the City. Therefore, required from
this development is application for a Flood Zone Control Permit from
the City per the following criteria:
A. City's Flood Zone Control Permit shall be provided to meet all con-
ditions in the DOE Flood Zone Control Permit and the requirements
of King County Surface Water Management Division.
B. All dike areas adjacent to the river shall be provided at two (2)
feet above the 100 year flood elevation and be provided with
material approved through King County. Surface Water Management
Division (contact Jerry Creek).

C. The reference plans shall be submitted to King County Surface Water
Management for review and approval and the conditions by which King
County review and approval is provided shall become part of the
conditions for this permit.
King County Surface Water Management shall be notified of the datum
and reference elevation the developer is using to establish his
grades and approve this datum and referenced elevations prior to
- construction (in writing). The conditions of construction of the
dike area and elevation datum approvals shall be provided to the
City of Tukwila as part of this permit application.
D. King County Surface Water Management shall be notified at the time
of construction and an inspector be made available for review and
approval of final as -built construction.
E. Final rip - rapping of the storm drain outfall shall be per the
. requirements of King County Surface Water Management and the
City's inspector.
Per the meeting of 10/23/84 with the adjacent development WSDOT and
City officials, the following developer requirements were identified: The
requirements for development of SR 181 (the public amenities in SR 181) are
to be funded in the following fashion: a) The private development shall
provide the curb /gutter, sidewalk and utility relocations in public R/W in
SR 181 from the north end of the property to and including the 55 foot curb
radius onto Strander Boulevard; the private development will provide the
curb and gutter sidewalk utility locations from the 55 foot foot radius
return in Strander Boulevard to the west on Strander Boulevard to the end
of the property. b) The State will provide the drainage at their expense
in SR 181 and into Strander Boulevard as part of the WSDOT overlay project
in May 1985. c) The City and the State will fund the cost of the pavement
section for the new right turn lane in SR 181 from the north property line
to and around and including the 55 foot curb radius (from existing roadway
to new curb /gutteronly). d) The private development will provide the funds
(150% in escrow account to the City) for the cost of the sidewalk, curb &
gutter and utility relocations from the north end of the property to and
including the 55 foot curb radius, so that the City and the State may
construct this portion of the street improvement through a State overlay
project inM.ay 1985; the developer will provide the remaining sidewalk in
Strander Boulevard, from the 55 foot curb radius, as part of the original
private development.
The City Engineer at the 10/24/84 meeting approved the left -in- left -out/
right -in- right -out access for the development for the Strander Boulevard
access. Terry Gibson of Centrac Engineers reviewed and approved this
right -turn in and out, left turn in and out access in Strander Boulevard
without any additional channelization at this time or signing public or
private is appropriate and will provide adequate access (see attached
10/26/84 Report, Terry Gibson). The City'Engineer indicated that, in the
future, through public projects, Strander Boulevard and SR 181 be rechan-
neled and resignaled when the need arises.

Gentlemen:

At your request during the meeting on October 23rd attended by representatives
from the City of Tukwila, WSDOT, Johnson - Braund, Pac -Tech, CDA and Centrac, I
have prepared this letter summarizing our discussions and resolution of
traffic access for the proposed joint development at the NW corner of Strander
Boulevard and SR -181. The following summarizes the access issues, schedule of
improvements, and impacts on Strander and SR -181:
1) Existing channelization and raised island on Strander would not be
modified initially, or when the developed site is opened to traffic.
Installation of the new southbound right -turn lane on SR -181 will
improve LOS from E to C/D at the Strander /SR -181, such that the second
left -turn lane on the Strander approach to SR -181 (planned improvement
by City) is not mandatory at the present time.
2) Full left -turn and right -turn access can be provided at the proposed
Strander driveway and the existing Steak and Ale driveway since the
centerlines of both driveways are aligned and the existing two -way
left -turn lane will not be modified initially.
3) The traffic sign to restrict the left -turn egress movement during the PM
peak -hour (4 -5:00 PM) at the Strander driveway would not be installed by
the developer as proposed. This left -turn exit and crossover to the
right -turn lane would be difficult to accomplish at times, but the
motorist can safely negotiate it since the two -way left -turn lane can be
utilized.
4) When the dual left -turn lanes on the Strander approach to SR -181 is
deemed necessary by the City of Tukwila, or when the Strander /SR -181
intersection is reconstructed to implement the extension of Strander to
27th Avenue in Renton, the access provided at the Strander driveway (to
the new development) may be restricted to right turn in /out movements.

Centrac pointed out that retaining the left -turn inbound movement at the
Strander driveway was the primary concern of the developer, and this
critical access could be retained when the dual left -turn improvement is
made as long as continuous traffic curbing is not installed along
Strander as part of the improvement. Allowing this left -turn into the
Strander driveway would not affect the safety or level -of- service at the
Strander /SR -181 intersection.
) The proposed joint access driveway at SR -181 would permit full access
(left and right -turns in and out) on a permanent basis and should not
create significant turning conflicts with existing driveways to Andy's
Tukwila Diner to the north and south. This driveway would handle
approximately 75% of the peak -hour traffic to /from the development.
Centrac Associates has reviewed the proposed site plans for the subject joint
development as to access and circulation issues. Some minor comments on the
plans were transmitted to CDA/Pac -Tech and Johnson - Braund after the meeting to
make them consistent with the recommended street /access improvements in our
traffic.report. One discrepancy noted at the meeting was that the right -of-
way centerline for SR -181 is 5.5' east of the existing road centerline. All
parties agreed to a revised street section, including a new 12.5' right -turn
lane, curb and gutter, and an 8' sidewalk with back of sidewalk on the new
right -of -way line (54' from right -of -way centerline).

certifying that the proposed water system is adequate for their insurance purposes.
This, I believe, satifies your request to have written approval of the water system
by the insurance underwriter. Mr. Doug Gibbs of the Fire Department has approved
this same proposal verbally. If there is any further action required on our part
please let me know.
Also included is an estimate of the sanitary sewer special assessment. As I
calculate this assessment there will be no charge per se to the Brock Residence Inn
site. Per our previous discussions I understand that we may use our cost of
construction of public sewer to reduce the assessment of special charge against

convenience.

Public Works Department has reviewed and approved the subject plan submit-
tal. These plan resubmittals and new submittals are approved per all of
the conditions outlined in my attached 10/5/84 letter, and the additional
criteria which is applied below as follows:
1. The resubmitted plans have been corrected per the notes reviewed by
Public Works on 10/22/84 on the side of the 10/5/84 letter (attached).
(Note: the attached comments referred to are on the left side of the
sheet only.)
2. The Department of Ecolo gy, in their October 12, 1984 letter, has
issued a Flood Zone Control Permit (Permit #1- 5594 -2). This represents
the first of two (2) Flood Zone Permits that are issued for your deve-
lopment, the second (2) being from the City. Therefore, required from
this development is application for a Flood Zone Control Permit from
the City per the following criteria:
A. City's Flood Zone Control Permit shall be provided to meet all con-
ditions in the DOE Flood Zone Control Permit and the requirements
of King County Surface Water Management Division.
B. All dike areas adjacent to the river shall be provided at two (2)
feet above the 100 year flood elevation and be provided with
material approved through King County. Surface Water Management
Division (contact Jerry Creek).

C. The reference plans shall be submitted to King County Surface Water
Management for review and approval and the conditions by which King
County review and approval is provided shall become part of the
conditions for this permit.
King County Surface Water Management shall be notified of the datum
and reference elevation the developer is using to establish his
grades and approve this datum and referenced elevations prior to
construction (in writing). The conditions of construction of the
dike area and elevation datum approvals shall be provided to the
City of Tukwila as part of this permit application.
D. King County Surface Water Management shall be notified at the time
of construction and an inspector be made available for review and
approval of final as -built construction.
E. Final rip- rapping of the storm drain outfall shall be per the
. requirements of King County Surface Water Management and the
City's inspector.
Per the meeting of 10/23/84 with the adjacent development WSDOT and
City officials, the following developer requirements were identified: The
requirements for development of SR 181 (the public amenities in SR 181) are
to be funded in the following fashion: a) The private development shall
provide the curb /gutter, sidewalk and utility relocations in public R/W in
SR 181 from the north end of the property to and including the 55 foot curb
radius onto Strander Boulevard; the private development will provide the
curb and gutter sidewalk utility locations from the 55 foot foot radius
return in Strander Boulevard to the west on Strander Boulevard to the end
of the property. b) The State will provide the drainage at their expense
in SR 181 and into Strander Boulevard as part of the WSDOT overlay project
in May 1985. c) The City and the State will fund the cost of the pavement
section for the new right turn lane in SR 181 from the north property line
to and around and including the 55 foot curb radius (from existing roadway
to new curb/gutteronly). d) The private development will provide the funds
(150% in escrow account to the City) for the cost of the sidewalk, curb &
gutter and utility relocations from the north end of the property to and
including the 55 foot curb radius, so that the City and the State may
construct this portion of the street improvement through a State overlay
project inM.ay 1985; the developer will provide the remaining sidewalk in
Strander Boulevard, from the 55 foot curb radius, as part of the original
private development.
The City Engineer at the 10/24/84 meeting approved the left -in- left -out/
right -in- right -out access for the development for the Strander Boulevard
access. Terry Gibson of Centrac Engineers reviewed and approved this
right -turn in and out, left turn in and out access in Strander Boulevard
without any additional channelization at this time or signing public or
private is appropriate and will provide adequate access (see attached
10/26/84 Report, Terry Gibson). The City Engineer indicated that, in the
future, through public projects, Strander Boulevard and SR 181 be rechan-
neled and resignaled when the need arises.

In researching the files, our findings include the following:
L.I.D. #7, for the purpose of providing water mains in the vicinity of
your development, received participation through your property
ownership by past participation in the development of public mains for
the City through L.I.D. #7, special water connection charges are
waived for water.
Search of the City's files finds no like participation for sewer
mains. Therefore, the development will be required to pay special
connection charges beyond the regular connection fees for connection
into the City's sewer system.
The Public Works Department has reviewed your plans and approved plan
sheets C- 1,2,3,4,7, &8 per the following comments: Prior to issuance of any
utility permits, authorization for release shall be provided by the
Planning Director and Building Official.
Twenty -four hours prior to your contractor beginning his work, the contrac-
tor shall apply for and obtain the following permit as conditioned in this

Per sheet C -3 only one side sewer is shown for building clusters.
The Tukwila Municipal Code requires that each structure shall be
separately sewered. Therefore, either the sewer main shall be
extended and including manholes for the last reach (with 8"
diameter pipe, manholes at every 300' and /or at bends); or,
separate sanitary side sewers shall be shown to the private mains.
Private Sanitary Sewer Main Permit - (Permit Fee: $25.00) - The'
issues involving additional private mains shall be resolved as
described in item 4 above prior to issuance of this permit. A
copy of the joint agreement by which the private mains shall be
operated and maintained shall be provided for the City's review
and approval prior to the issuance of any sewer permit. The pri-
vate sanitary sewer main permit application shall be accompanied
by the appropriate easements for the main two adjacent properties.

of pipe from the existing Sewer manhole at rim elevation 26.04

tial future turnover to the City of Tukwila. The final authority•
for acceptance of this facility is tha City Council. To meet the
City's requirement the following shall be provided:
This facility shall be built of concrete, with the piping
material placed in Class "B" bedding. Also the existing
manhole shall be rechanneled accordingly to accommodate the
system and additional channelization shall be provided and a
new concrete manhole per the City's requirements. The appli-
cation for the permit shall include the executed easement to
the City of Tukwila for maintenance, monitoring, replacement
and repair of this proposed facility.

A knock -out and 8" stub to the west shall be provided in the
manhole structure (rim elevation 26.04) at the invert of the
incoming private sewer main. Upon construction of this faci-
lity and permit sign- off following documents shall be pro-
vided to the City for consideration for turnover as a public

and Tukwila Retail Center
Gentlemen:

ASSOCIATES
At your request during the meeting on October 23rd attended by representatives
from the City of Tukwila, WSDOT, Johnson - Braund, Pac -Tech, CDA and Centrac, I
have prepared this letter summarizing our discussions and resolution of
traffic access for the proposed joint development at the NW corner of Strander
Boulevard and SR -181. The following summarizes the access issues, schedule of
improvements, and impacts on Strander and SR -181:
1) Existing channelization and raised island on Strander would not be
modified initially, or when the developed site is opened to traffic.
Installation of the new southbound right -turn lane on SR -181 will
improve LOS from E to C/D at the Strander /SR -181, such that the second
left -turn lane on the Strander approach to SR -181 (planned improvement
by City) is not mandatory at the present time.
2) Full left -turn and right -turn access can be provided at the proposed
Strander driveway and the existing Steak and Ale driveway since the
centerlines of both driveways are aligned and the existing two -way
left -turn lane will not be modified initially.
3) The traffic sign to restrict the left -turn egress movement during the PM
peak -hour (4 -5 :00 PM) at the Strander driveway would not be installed by
the developer as proposed. This left -turn exit and crossover to the
right -turn lane would be difficult to accomplish at times, but the
motorist can safely negotiate it since the two -way left -turn lane can be
utilized.
4) When the dual left -turn lanes on the Strander approach to SR -181 is
deemed necessary by the City of Tukwila, or when the Strander /SR -181
intersection is reconstructed to implement the extension of Strander to
27th Avenue in Renton, the access provided at the Strander driveway (to
the new development) may be restricted to right turn in /out movements.
ALASKA IDAHO OREGON UTAH WASHINGTON WYOMING
5) Centrac pointed out that retaining the left -turn inbound movement at the
Strander driveway was the primary concern of the developer, and this
critical access could be retained when the dual left -turn improvement is
made as long as continuous traffic curbing is not installed along
Strander as part of the improvement. Allowing this left -turn into the
Strander driveway would not affect the safety or level -of- service at the
Strander /SR -181 intersection.
6) The proposed joint access driveway at SR -181 would permit full access
(left and right -turns in and out) on a permanent basis and should not
create significant turning conflicts with existing driveways to Andy's
Tukwila Diner to the north and south. This driveway would handle
approximately 75% of the peak -hour traffic to /from the development.
Centrac Associates has reviewed the proposed site plans for the subject joint
development as to access and circulation issues. Some minor comments on the
plans were transmitted to CDA /Pac -Tech and Johnson - Braund after the meeting to
make them consistent with the recommended street /access improvements in our
traffic report. One discrepancy noted at the meeting was that the right -of-
way centerline for SR -181 is 5.5' east of the existing road centerline. All
parties agreed to a revised street section, including a new 12.5' right -turn
lane, curb and gutter, and an 8' sidewalk with back of sidewalk on the new
right -of -way line (54' from right -of -way centerline).
If you have any questions on this letter of resolution for street access to
the Brock /retail development, please let us know.

subject to the following being provided prior to final approval:

During my review of the Environmental Checklist Form you may recall I
ocjected to the development group using the title "Tukwila Park" for their
project. If they chose not to commonly call this retail project by this name,
then please disregard this memo. If they plan to use this title on site and
in everyday use then I formally request they be required to bhange the name.
I have discussed this concern with City Attorney Larry Martin and he
states the city has the right to require a name change if it is for the welfare
and safety of the public. I wrote a memo to the Fire and Police Chiefs asking
them if the retail project using the same name as the park would be a problem.
Police Chief Pierce states he believes it will be a problem. Fire Chief
Crawley states he does not believe it will cause a problem. Copies of their
responses are attached.
In addition to public safety concerns, I believe the public may experience
some confusion when two facilities have the same name. I recommend that "Tukwila
Park" as a name for a retail facility not be allowed.

SUBJECT: Proposed Development Project Titled "TUKWILA PARK"
This week I reviewed an Environment Checklist Form for a retail development
complex: at Interurban Avenue South and Strander Boulevard called
"Tukwila Park." I have no problem with the proposed project except its
name. I have asked the Planning staff to be aware that the City operates
less than a mile away the City -owned "Tukwila Park."
It is my opinion that two facilities with identical names in close proximity
may cause some confusion to the public. I would like to know if the name
"Tukwila Park" is allowed to be used for the retail development site, do
you think this would cause some confusion for your personnel and possible
delay of providing emergency services? Do you see any other problems
caused by the duplicate names?
I discussed this with our City Attorney and he informs me that we can
require the name to be changed if it is for the general welfare of the
public. I do-not like to be "big brother" in such detail, but I do believe
we may have some valid concerns.
Please let me know by October 9 of your opinion.
With the number of parks in the City with the general identifyer of
" Tukwila Park " it seems to be of little impact on the Fire Department.
I. might be appropriate to clearly identify all the parks in a way to •
allow people using them to realize they are in a place other than "
Tukwila Park " such as Foster Park, Bi -Cent. Park, etc.
Emergency situations are called in based upon address or business name
rarely by retail center name, such as Southcenter, Parkway Plaza, etc.

In researching the files, our findings include the following:
L.I.D. #7, for the purpose of providing water mains in the .vicinity of
your development, received participation through your property
ownership by past participation in the development of public mains for
the City through L.I.D. #7, special water connection charges are
waived for water.
Search of the City's files finds no like participation for sewer
mains. Therefore, the development . will be required to pay special
connection charges beyond the regular connection fees for connection
into the City's sewer system.
The Public Works Department has reviewed your plans and approved plan'
sheets C- 1,2,3,4,7, &8 per the following comments: Prior to issuance of any
utility permits, authorization for release shall be provided by the
Planning Director and Building Official.
Twenty -four hours prior to your contractor beginning his work, the contrac-
tor shall apply for and obtain the following permit as conditioned in this
letter:
1. Private Fire Loop - (Permit Fee: $25.00) - This new fire loop
main connecting into Strander Blvd. and SR -181 shall remain
private. All fire loop mains shall be Class 52 ductle iron pipe.
All public or Private mains shall be a minimum of 8" in diameter.
An addition( gate valve shall be provided, Strander Blvd. just
after the tap; also additional gate valves shall be provided per
the City's Standard Hydrant Plan, between three and ten feet from
each hydrant. All hydrants and hydrants assemblies shall be pro-
vided per the City's Standard Plan- ,The final locations of
hydrants are the responsibility of the Tukwila Fire Department,
Fire Marshall, (Fire Marshall - Doug Gibbs - Phone: 433 - 1859).
Blocking shall be provided at all hydrants, stubs, bends and
junctions, including blocking provided at the junctions of the
City main with the new fire loop in SR 181 and Strander Blvd.
The existing fire hydrant in SR 181 shall be relocated behind the
new sidewalk.
On Plan Sheet C -7 -Item 8, the drive entrance detail denotes
fog- tight, 17" x 18" box - shall be changed to #2 meter box - 17i"
x 28 -5/8" x 12".
The private water loop, gate valves, blocking and hydrants shall
be approved by the Tukwila Fire Department and the Insurance
;: Underwriters prior to its construction (this is the sole respon-
; of the contractor /or owner).
Tapping the City's main shall be wet taps (Dave Grage -- 433 - 1863).
.':An' agreement from the owner for the property shall accompany the
application for this water fire -loop /private main permit indi-
cating how this private fire -loop is to be maintained hereafter.
2. Domestic Water Meters - (deposit for installation /regular
connection charge per meter: one inch = $1,040; one and one -half
inch = $1,550; two inch = $2,550). Special connection charges
have been met by past participation of the property to L.I.D. #7:1
Each structure shall be separately metered. The City will install
the services from the private mains /fire -loop to and including the
meter; the developer is responsible providing the services from
the meter to each unit. The difference in the final cost by City
forces will be deducted /billed from the deposits for the meters.
Applications for water meter permits shall be accompanied by a
general easement document, approved by the City and executed by
the developer and recorded through King County which allows City
personnel to inter upon the property for the purpose of main-
taining, monitoring, repairing and /or replacing water meters and
services (from the private main to the meter).
Final Location of the meters and services may be relocated in the
field at the discretion of the City Inspector - (Dave Grage -- Phone:
433 - 1863).
3. Curb - Cuts /Access /Sidewalk Permit - (Permit Fee: $25.00)
Driveway Aprons, sidewalks, handicapped ramps, curbs /gutters shall
be per the City's Standard Plans (Ordinance #1233). As part of

the permit Clication for curb - cut /access /L the developer
shall provide the transfer of right -of -way documents, executed by
the owner for the ENTIRE strip of right -of -way for the right turn
lane and sidewalk adjacent to the West Valley Highway for the
sidewalk and right turn lane for both Phase I and Phase II deve-
lopments. Upon the City's review and approval of this document,
the developer shall be required (prior to the permit sign off) to
have this right -a -way document recorded to run with the land.
Also, accompanying the permit application shall be a joint access
agreement between the two developments for the joint use access at
SR 181 and Southcenter Blvd.
It is recognized by this permit that only a temporary access for
left turn in- out /right turn in -out from Strander Blvd. is allowed
at this time. The City reserves the right to review this access
at any time in the future to reduce its usage to right - turn -in and
right- turn -out. Therefore, by the granting of this permit the
City only provide permanent recognition to the limits granted all
permitees for right - turn -in and right- turn -out for the access in
Strander Blvd.
A handicapped ramp shall be provided crossing Strander at the
intersection of Strander Blvd. and SR 181 at a field location per
the City Inspector (Sally Heye -- 433 - 1854). Existing light stan-
dards in the sidewalk shall be relocated behind the sidewalk.
The 6' x 8' underground vault shown on the plan C -2 on SR 181
shall be modified and /or relocated to accommodate the new curb and
gutter sidewalk system.
On Sheet C -7, detail #4 boring and casing profile for storm -
expansion joints shall be provided on either side of all driveway
aprons to the sidewalk system.
Finally, the two develoments shall submit in wri ti.ng,, on. .the ti „ ng
and commitment by both ownerships for the providing of the right
turn and /sidewalk right -of -way in SR 181 and accomplishing the
sidewalk /curb and gutter and requirements for providing the pave-
ment in the right -of -way to the City for review and approval prior
to application for the curb - cuts /access /sidewalk permit.
4. Sanitary Side Sewer Permits - (Permit Fee: $170.00 regular connec-
tion charge (per building),; plus special connection charge to be
calculated at time of permit application.)
All sanitary side wewer shall be a minimum of 6" in diameter; a
minimum of 36" cover /PVC; at a 2% minimum grade; and be provided
in Class "B" bedding throughout. All sanitary side sewers shall
have cleanouts at the point at which they leave each building
structure at vertical and /or horizontal bends. Sanitary sewer
shall be either concrete or PVC (schedule40, minimum).

Per sheet C( only one side sewer is shown �. building clusters.
The Tukwila Municipal Code requires that each structure shall be
separately sewered. Therefore, either the sewer main shall be
extended and including manholes for the last reach (with 8"
diameter pipe, manholes/at every. 300' and /or at bends); or,
separate sanitary side sewers shall be shown to the private mains.
5. Private Sanitary Sewer Main Permit - (Permit Fee: $25.00) - The
issues involving additional private mains shall be resolved as
described in item 4 above prior to issuance of this permit. A
copy of the joint agreement by which the private mains shall be
operated and maintained shall be provided for the City's review
and approval prior to the issuance of any sewer permit. The pri-
vate sanitary sewer main permit application shall be accompanied
by the appropriate easements for the main two adjacent properties.
The private mains (which are to remain private) shall be completed
and inspected prior to application for the sanitary side sewer
permits for individual structures.
All private sanitary manholes shall be channeled. A detail for
channelization of a typical sanitary sewer manhole shall be pro-
vided for the City's review and approval.prior to beginning the
work. Sewer mains shall be provided in Class "B" bedding
throughout.
6. Public Sanitary Sewer Main - Permit Fee: $25.00) - That portion
of pipe from the existing Sewer manhole at rim elevation 26.04
including the pipe from the existing manhole to the first manhole
and including the manhole is proposed to be developed for poten-
tial future turnover to the City of Tukwila. The final authority
for acceptance of this facility is the City Council. To meet the
City's requirement the following shall be provided:
This facility shall be built of concrete, with the piping
material placed in Class "B" bedding. Also the existing
manhole shall be rechanneled accordingly to accommodate the
system and additional channelization shall be provided and a
new concrete manhole per the City's requirements. T:he appli-
cation for the permit shall include the executed easement to
the City of Tukwila for maintenance, monitoring, replacement
and repair of this proposed facility.
A knock -out and 8" stub to the west shall be provided in the
manhole structure (rim elevation 26.04) at the invert of the
incoming private sewer main. Upon construction of this faci-
lity and permit sign-off, the following documents shall be pro-
vided to the City for consideration for turnover as a public
system: a) As -Built Drawing. b) Copy of Approve Easement
recorded with King County. c) List of Materials /Costs. d)
Bill of Sale. e) request for turnover to the City.
7. Storm Drain - (Permit Fee: $25.00) - All pipe under paved areas
(from catch basin to catch basin)shall be corrugated metal pipe, Class

with hydraulic grade line profile) and demonstrate no negative
impact to the existing storm drain system at Strander Blvd. and SR
181 by this private connection into the 12" road pavement on the
south side of Strander Blvd.
As part of main J /T /A underneath Strander Blvd, required is the
filling with grout of the 18" diameter steel sleeve. The drain
under Strander Blvd. shall be sized to accommodate both Phase I
and Phase II Developments.
8. Landscape Irrigation - (if appropriate) - It is the sole respon-
sibility of the owner and /or his engineers to assure that coor-
dination of these utility plans has been accomplished by the
landscaping designs, as the landscape plans have not been sub-
mitted as part of this plan review. If irrigation is required for
the landscaping plans, requested is a submittal of four sets of
landscape irrigation plans to Public Works for review and appro-
val which include an overlay of all utilities. Included in these
plans, backflow pervention devices shall be noted: "or DSHS
approved"
It shall be noted that the necessary precautions are to be taken including
utility call ups working in the public right -of -way of Strander Blvd. and
SR 181, and coordination with WSDOT while working in SR -181.
This plan review does not cover availability or review of franchise utili-
ties. This task remains the sole responsibility of the owner. If you have
any questions regarding any of the matters covered throughout this letter
please do not hesitate to call me at 433 -1856.

SUBJECT: Meeting of October 11, 1984
The Committee will meet next Thursday, October 11th, at 2:00 p.m. in City
Hall Conference Room #3 to discuss the following application:
84- 31 -SS: Brock Residence Inn and Tukwila Park Short Plat
This property consisting of 6.67 acres is located at the northwest corner
of Strander Blvd. and West Valley Highway. Pursuant to the building permit
applications for development of the Brock Residence Inn and Tukwila Park
retail /office development, subdivision of the property is proposed of two
lots. Lot 1 (Tukwila Park) consists of 2.10 acres and easements for
ingress and egress, parking, landscaping, air, light, ventilation, utili-
ties, and dedication of additional right -of -way on West Valley Highway.
Lot 2 (Brock Residence Inn) contains 4.4 acres, an ingress and egress ease-
ment, and dedication of right -of -way along West Valley Highway. In total,
.13 acres of property is required by the Public Works Department to be
dedicated for additional right -of -way along the Highway.
The site plan for the Brock Residence Inn development includes parking
along the northerly and westerly perimeter of the Tukwila Park development.
Therefore, easements for landscaping, parking, air, light, and ventilation
are being created to permit parking on Lot 1. Single access points exist
on West Valley Highway and Strander Blvd., creating a need for exchange of
ingress and egrees easements as proposed. Utilities to accomplish the two
developments require easements for the benefit of each other which have not
been finalized at the date of this writing. However, on this date the
Public Works Department met with the parties involved in both developments
to resolve the easements for utilities. These easements will be requested
to be available prior to final approval of the subdivision. This is the
principle issue surrounding this application.
Tukwila Municipal Code Section 17.08.070 requires the Short Subdivision
Committee find the following are provided:

A. Adequate water supply;
B. Adequate method of sewage disposal;
C. Storm drainage improvements and storm sewers;
D. Fire hydrants;
E. Adequate access to all parcels. Streets, alley, and sidewalk
improvements may be required by the Short Subdivision Committee;
and
F. Provision for appropriate deed, dedication, and /or easements.
The Public Works Department has determined that adequate utilities are
available to the project (water, sewer, storm drainage) however the on -site
location of these utilities and consequential easements remain to be
resolved. Adequate access is available along West Valley Highway and
Strander Blvd. as provided by the reciprocal ingress /egress easements.
Appropriate dedication as required by the Public Works Department of right -
of -way along West Valley Highway is included in the proposal, however
remaining to be resolved is the timing of improvement of sidewalks and off -
site improvements along the Highway and Strander Blvd. Convenants and
restrictions were not submitted and may not be proposed in the applica-
tion. All of the easements to facilitate the proposed developments on the
property have not been submitted as of the date of this writing.
Communication with the applicant separately or via this memorandum requests
submittal of all of the easements and any convenents or restrictions that
will be required to accomodate development on the two lots.
It is recommended that the Short Subidivision Committee approve the short
plat subject to the Public Works Department review and approval of all
easements, dedications, convenants, restrictions and other required encum-
berances on lots 1 and 2 prior to final signing of the short plat cer-
tificate. A further recommended condition for approval of the proposal is
that off -site improvements along West Valley Highway and Strander Blvd.,
per review and approval of the Public Works Department, be installed prior
to the City's final inspections of building permits for either of the pro-
posed developments.
Based on these two conditions, staff finds the proposal conforms to Section
17.08.070 of the Tukwila Municipal Code.

This letter is a follow up to our meeting of September 25, 1984. You
indicated you would set up with Mike Hess (Tukwila Park) a joint meeting
with City staff to resolve outstanding issues in this application.
We look forward to meeting with you, the principals involved, to bring
concensus to this application in order to begin processing. The passage
of time produces more impact on the respective developments' time tables
due to the three weeks necessary to process the short plat. As I have
mentioned many times, building permits cannot be issued until after the
short plat is approved and recorded.
Please call me at 433 -1847 when arrangements have been made. I will
then coordinate with other City staff members, particularly the Public
works Department.
In addition your architect offered to send roof plans and exterior
"combustibles" plans to the Building Official. This should be done
quickly.

This letter is an application for Planning Commission consideration of a
cooperative parking facility pursuant to Title 18.56.070. The facility is to be
located on the north side of Strander Boulevard and on the west side of Interurban
Avenue. Cooperative parking is proposed between a Retail Shopping Center and an
Executive Suite Hotel (site plans attached).
The basis for this request is as follows:
1. Proposed Facilities:
An application for a building permit is on file with the City on behalf of Inn
Ventures to construct a 144 unit executive suite hotel together with a
"gatehouse" building, cabana, swimming pool, sport court, off - street parking
and utilities.
An application for a building permit will be filed this week on behalf of Tri-
Star Development to construct a 29,071 sq. ft. retail shopping center
together with off - street parking and utilities.
These two facilities are intended to be constructed at the same time and will
share driveway accesses at Interurban Avenue and at Strander Boulevard.
2. Parking Space Analysis:
According to Planning Department analysis the Brock Residence Inn is
required to provide 160 parking stalls. This requirement breaks down as
follows:

Board Room Parking 7.5 Stalls
Office Parking 2.5 Stalls
"Restaurant" Parking 6 Stalls

According to Planning Staff Analysis the Tukwila Park Retail Center is
required to provide 73 parking stalls.
As indicated by the attached site plans, the applicant is proposing to provide
150 parking stalls on the Brock Residence Inn site and 91 parking stalls on the
Tukwila Park Shopping Center site or a total of 241 parking stalls. This total
would be 8 stalls above that required by Code.
3. Justification of Cooperative Facility:
It is apparent from the attached site plans that these parking lots will
effectively operate as cooperative parking facilities. The parking lots are in
close proximity to each other, they share common vehicular access and the
shopping center has been designed to facilitate pedestrian access through the
center of the site; thereby interconnecting the two parking areas. As a
result, the literal requirements of the zoning code lead to an excess of
parking area over that actually needed.
The actual parking load is a function of each use within the proposed project.
a. The retail stored in the Tukwila Parking Shopping Center will maintain
normal hours of operation. It is anticipated that most shops will not
open before 9:00 a.m. and most shops will close between 6:00 p.m. and
9:00 p.m.
b. Although the Brock Residence Inn will operate 24 hours per day, the
parking demand does not begin until guests start to check -in or return
from their business meetings during day. As a result, the hotel parking
is virtually unoccupied until around 4 p.m. and does not fill up until
around 10 p.m. when all guests have checked -in (assuming 100%
occupancy).
c. The requirement for office parking relates to the needs of hotel staff
and hotel guests. The hotel staff consists of administrative and
housekeeping. These personnel work a normal business day with the
exception of a desk clerk. Some of the office space is available to the
hotel guests for business purposes. Typically, this space would be
utilized to conduct a meeting. As with the hotel staff, this activity
would occur during the business day when demand on the hotel parking
is low.
d. The "restaurant" is actually a minimum size kitchen intended to prepare
complimentary continental breakfasts for guests only. As such, this
activity should not create any additional demand for parking.
Formalized seating for this service is not provided and a room key must
be presented. Breakfast service is not available for purchase. In
addition, this is an early morning activity which is completed prior to
the start of normal hours of operation for the shopping center.

It is apparent from this analysis that based on the actual parking requirements ample .
parking stalls will be provided by the proposal. This is primarily due to the fact that the
demand for hotel parking increases after business hours and diminishes again before
business hours.
This request appears to us to be a reasonable application of the zoning code provision for
cooperative parking. We are hopeful that the Planning Commission will agree.
