utility - pedestrian bridge crossing the Green River. Enclosed
is a letter from Emily Ray, dated May 19, 1983. Also enclosed
is a copy of my letter of response. I have previously informed
Brad that the City should follow the Department's recommenda-
tion, and I understand from Brad that you will handle the
processsing.

Dear Ms. Ray:
Thank you for your letter of May 19. Please excuse my
delay in responding, but on May 19, I ruptured an Achilles
tendon and I wound up in the hospital.
In accordance with your recommendation, the City of
Tukwila will process an after - the -fact permit for the
utility pedestrian bridge. I would like to point out that
the bridge is the only practical emergency means by which
the water main can be timely replaced. I appreciate your
comments and Mr. Michael Rundlett's earlier advice.
If there are any questions, please contact me or Brad

SUBJECT: Finding of Categorical Exemption
In accordance with the decision of the Tukwila City Council on March 21,
1983'to- declare construction of the Pedestrian. Bridge and Water. Line
Repair an emergency action, the Responsible Official has determined that
the project is categorically exempt from the State Environmental Policy
Act under WAC 197 -10 -180. Timely implementation of the project is
necessary to prevent imminent danger to public health and safety and
immediate threat of serious environmental degradation.

The Shoreline Official of the City of Tukwila has determined that the
construction of the subject project (File No. 83 -6 -CI) within the shore-
lines of the Green River is exempt from the Substantial Development
Permit requirements described in the Shoreline Management Act of 1981,
according to the provisions of WAC 173-14-040 Sections (2) and (4) and
consistent with the purposes established in RCW 90.58.020 and 90.58.050.
The City intends: to proceed with construction of this critical facility
as quickly as possible.
We have enclosed for your review an opinion prepared.by the City
Attorney'•'s Office explaining :in greater detail our finding that this
project satisfies the criteria for Shoreline Permit exemption. Please
direct questions to my attention at 433 -1849.

RE: Shorelines Management Act Exemption for Emergency
Construction of Utility - Pedestrian Bridge for
Repair and Replacement of Water and Sewer Mains
Crossing the Green River
As City attorneys for the City of Tukwila, we are providing
you with our opinion that planned emergency construction of a
utility- pedestrian bridge over the Green River is exempt from
the permit process under the Shorelines Management Act. Our
orinion is based upon our investigation into the history of the
broken water main being replaced, research into the Shorelines
Management Act, and conversations with responsible City
officials and also with Mike Rundlett of the Department of
Ecology.
On January 1, 1983, the City of Tukwila discovered that the
12" water main serving the Southcenter South Complex within the
City of Tukwila had ruptured at some point in its river bottom
crossing of the Green River. This same water main had been
repaired in 1978 for a similar rupture apparently due to
defective materials or defective construction or design.
The City immediately shut off the water main after
discovery of the rupture this year. As an interim measure, the
City obtained water from the City of Kent water supply system
through an 8" water main intertie. This Kent water has been
obtained through an emergency clause in the Kent /Tukwila
intertie Agreement. It is likely that this water source will
not be available by July 1, 1983.

Prior to the 12' water main break, Southcenter South, the
area being served by the ruptured water main, had less than
optimum fire protection from the water flow. The ruptured 12'
water main had been providing at a maximum 3,440 gallons per
minute to an area that required 4,000 gallons per minute of
water. With the shut -off of this water main, the current water
source is probably not providing adequate fire flow capacity to
Southcenter South, where the sprinkler systems were designed to
provide water based upon a greater fire flow. Once the
Kent /Tukwila intertie is no longer available as a source, the
City will be providing even less water for fire protection in
the Southcenter South area. Southcenter South faces a
substantial risk of severe property loss from fire damage, and
this risk will be greatly increased during the summer and after
the loss of the Kent /Tukwila interie water.
The ruptured water main is in a cradle structure at the
river bottom. In the same cradle structure is the City sewer
main serving the Southcenter South area. As earlier noted, the
water main ruptured within this cradle in 1978 and was
repaired. The utility lines within the cradle appear to be of
questionable construction or design. The City has also
attempted to determine whether there are any leaks in the sewer
line which adjoins the ruptured water line. The City believes,
but is uncertain, that there are no leaks in the sewer line
adjoining the ruptured water main. However, because of the
likely inadequate construction or design of the utility lines
under the Green River, and because of the high level of the
Green River making timely underwater repair or replacement a
practically impossible alternative, the City has determined
that the most reasonable alternative is to have the system
cross the Green River on a utility /pedestrian bridge.
If the replacement and repair of the utility lines were not
exempted from the Shorelines Management Act, then the City
would not be able to have water service to Southcenter South in
time to avoid the significantly increasing severe risks of fire
loss and damage to property in Southcenter South.
On March 21, 1983, our office informed the Tukwila City
Council that, in our opinion, repair and replacement of the •
utility lines would fall within one or more exemptions to the
Shorelines Management Act. At the same meeting, the Tukwila
City Council unanimously passed Resolution No. , which
declared an emergency because of the rupture and which
authorized the Mayor and the Public Works Director to take
immediate action to preserve public health, safety and
welfare. A copy of this Resolution is attached. The specific

exemptions which we believe are applicable are those described
in RCW 90.58.030(e)(i) and (ii). See also, WAC 173 -14- 040(2)
and (4).
Subsequent to the passage of this Resolution, I have had
follow up discussions with Mr. Rundlett. Furthermore, City
officials have dealt with the Redmond office of the Department
of Ecology. Attached is a copy of the Flood Control Zone
Permit No. 1- 5350 -2 issued by the Department of Ecology. Also
attached is a copy of the Flood Control Zone application dated
March 25, 1983.
The utility /pedestrian bridge will be constructed over the
Green River in an area where the Green River is diked.
Construction of the utility /pedestrian bridge for replacement
and repair of the water and sewer mains would not only avoid
the substantial probability of property damage in the event of
any fire in Southcenter South, but will also fulfill the
objectives of the Shoreline Management Act, as will be
described further.
In addition to determining that the construction is within
the exemptions of the Shoreline Management Act, we have
reviewed the objectives and purposes of the Act. RCW 90.58.020
and RCW 90.58.900 require that the objectives and purposes for
the act be given full effect in its interpretation. We believe
that the Act's objectives have been advanced by the particular
emergency construction as follows:
1. The paramount statewide interest is to maximize
the public's opportunity to enjoy the physical and aesthetic
qualities of natural shorelines of the State' and 'to minimize,
insofar as practical, any resultant damage to the ecology and
environment of the shoreline area and any interference with the
public's use of the water ". The design of the bridge provides
an opportunity for substantially more people to enjoy this
particular shoreline of the Green River. Any construction
damage is anticipated to be temporary and less than any
repeated drudging and altering of . the river bottom necessitated
by replacement or repair of the existing river bottom utility
facility and cradle.
2. The emergency construction will be of a wooden
bridge which would add aesthetically to the river environment
in contrast to the stark diking along the particular stretch of
the river involved. The natural character of the Green River
has already been altered greatly by the extensive diking for
flood protection at this particular location. The addition of

a wooden bridge will return a more natural perspective to the
Green River.
3. Previous efforts to repair the underwater utility
pipelines have resulted in no long term benefit. Repeated
anticipated dredging and pipe replacement under the river has
potential high adverse impacts upon the shoreline. The
replacement facility will provide the long term benefits both
financially and ecologically.
4. The use of the resources of the shoreline will be
enhanced by a wooden bridge that gives access to members of the
public using the Christensen Greenbelt Trail, which runs along
a lengthy stretch of the Green River. The replacement bridge
will also connect Tukwila's portion of the Green River trail
with the trails south and east of the Green River. The City of
Tukwila's Christensen Greenbelt Trail is a vital link in a
chain of trails within the Green River Valley. This trail has
been described as objectives by the Tukwila Park and Open Space
Program 1976 -81, the proposed current draft of the Tukwila Park
and Open Space Plan, the King County General Bicycle Plan
(adopted in 1976), the King County Green River Study performed
by Jones & Jones in 1979, the Washington State Green River
Acquisition Program, the State's Interagency for Outdoor
Recreation, and the City of Tukwila's Comprehensive Land Use
Policy Plan. Also, the utility bridge will protect the
shoreline ecology by removing the need to rely upon
questionable river bottom pipelines.
5. The proposed construction increases public
recreational opportunities. The bridge will enhance both
active recreational use of the trail, such as jogging and
bicycling, as well as recreational use of the shorelines, such
as sightseeing or fishing.
If there are any questions, please do not hesitate to
contact this office, the City of Tukwila's Public Works
Director, Byron Sneva (433- 1855), or the Planning Director,
Brad Collins (433 - 1846). Mr. Rundlett has suggested that the
City consider processing an "after the fact" permit. Although
we do not feel that such a procedure is required, we would be .
happy to discuss further the suggestion.

3. No work shall be permitted in the wetted perimeter of the channel
without a State Fisheries Hydraulics Permit. '
A thirty foot, continuous, access for maintenance is to be maintained
along both banks of the Green River in the area of the bridge
approaches.
