Regular Meeting
Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council to order and led the audience in the Pledge of
Allegiance.

the handicapped door openers run over the proposed amount,

Attorney Colgrove read an ordinance of the City of Tukwila,
Washington, adding a new section 8.06.015, creating the
crime of leaving minor children in unattended vehicle, and
providing for an effective date.

1535 BE ADOPTED AS READ.*
Councilmember Harris felt the ordinance is not stringent
enough.

Attorney Colgrove read a resolution of the City of Tukwila,
Washington, rejecting all bids for a street paving machine.

Ross Earnst reported that after discussion with administra-
tion it was decided that small patching jobs can still be
done by the maintenance crew and that the City could contract
for large projects. It is recommended that all bids be
rejected. *MOTION FAILED.

Street Construction.
Attorney Colgrove read a resolution of the City of Tukwila,
Washington, rejecting all bids for 51st Avenue South Street
Construction.

RESOLUTION BE ADOPTED AS READ.*
Ross Earnst Public Works Director, explained that five bids
were received for the 51st Avenue Street Project. It has
been recommended that all bids be rejected and that the pro-
ject be rebid next spring to avoid construction during winter
months. The bid of Zulvaga Construction (the low bidder)
has been thoroughly reviewed. There is a question about
trench excavation safety systems. The RCW says that the cost
of trench safety systems shall not be considered as inciden-
tal to any other contract item and any attempt to include it
as an incidental cost is prohibited. Mr. Zulvago has indi-
cated that he has included the shoring and cribbing of
trenches in other items and will now provide those at "zero"
cost. On his proposal, the contractor bid "zero" on two
items. It was determined at first that the bid was non
responsive because of the "zero" bids. There is no legal
opinion on this. During this review process one month of
construction has been lost. Now it becomes a gamble because
of weather. This project includes storm water system,
undergrounding of power sidewalks curbs and gutters. The
specifications call for 120 days of construction with shut
downs allowed for bad weather.
Mr. Dave Zulvaga, owner of the company, 652 S.W. 143rd,
Seattle, said he is prepared to provide shoring at no addi-
tional cost. Zero is a legal number. The State Statute was
written to get conformity for the owners. This is not a big
item. As far as weather, if we didn't act because of fear of
rain we might not get anything done. We have the month of
October to put in the pipe. It is not uncommon in this state
to shut down because of freezing weather. Mr. Zulvaga said
he has used the bid "zero" on other projects and been awarded
the bid. The only reason a possible challenge has been
brought up is because the zero was used for trench shoring.
Councilmember Robertson said he would vote against the reso-
lution for several reasons: 1. Mr. Zulvaga bid in good
faith. 2. Weather is always a risk. This street is fairly
flat. 3. The City plans to do South 160th next year. Doing
both streets the same season would leave no way to get down
the hill to Southcenter.
Councilmember Bauch said he would vote to reject the bid,
there can be problems with the weather. The citizens will
have to dig the ditches for the underground power lines this
time of year.
Councilmember Hernandez said that postponing this any longer
is going to cost additional money.
*MOTION FAILED WITH BAUCH VOTING YES.

LOW BID OF D.A. ZULVAGA CONSTRUCTION CO. IN THE AMOUNT OF
$431,240.35 FOR CONSTRUCTION OF THE 51st AVENUE STREET

John McFarland, City Administrator, explained that the City
is currently leasing approximately 2,400 square feet of
office space in the 6300 Building. We need to increase that
approximately 10,600 square feet to accommodate the expansion
of the Engineering functions, the one -stop permit center and
the Planning and Building Department. Investigation was done
on seven different buildings, and it is expensive. The
building next door seems to fit our needs the best and there
is no travel time to worry about. We are planning to lease
one -half of the first floor and 2,000 square on the second
floor. This is part of the pre- annexation supplemental
budget. No tenant improvements will be started until after
the contract is signed.

REFERRED TO THE COMMUNITY AFFAIRS COMMITTEE AND THEN BACK TO
THE COMMITTEE OF THE WHOLE. MOTION CARRIED WITH BAUCH VOTING
NO.
Don Williams, Parks and Recreation Director, reported that in
November there will be a King County Bond Issue for green-
belts and open space on the ballot. There are 116 projects
for a total bond issue of $117,640,000. Out of the 116 pro-
jects, five plus the Interurban Avenue Trail are in Tukwila.
John McFarland, City Administrator, reported that he is
contacting the City of Renton to see if they are interested
in contracting with Tukwila for animal control. King county
is not furnishing effective service.
