Please excuse my delay in responding, but on May 19, I ruptured an Achilles tendon and I wound up in the hospital. In accordance with your recommendation, the City of Tukwila will process an after - the -fact permit for the utility pedestrian bridge. I would like to point out that the bridge is the only practical emergency means by which the water main can be timely replaced. I appreciate your comments and Mr. Michael Rundlett's earlier advice. I appreciate the care with which you explained your views on the relationship of the proposed project to the requirements of the Shoreline Management Act. In my view, the replacement of the water main can be exempted either as normal maintenance and repair under RCW 90.58.030(3)(i) or as an emergency under RCW 90.58.030(3)(iii). Due to the re- location intended, I would have preferred to see the City of Tukwila process a permit for this work. Mr. Michael Rundlett of my staff advised you some time ago that this was the desirable course of action. In retrospect, ample time for processing a permit was available. The utility- pedestrian bridge, however, clearly meets the criteria for substantial development, and a permit should be processed.
