Bellevue, WA 98009 RE: Conditional Use Permit 83 -10 -CUP Dear Sir: Due to present workload in the Planning Department Brad Collins, Planning Director, asked me to formally notify you of the September 22, 1983, Planning Commission decision on this matter. On'that date the Commission'approved a conditional use permit for your radio tower subject to: 1) The conditional use permit is issued for the benefit of McCaw RCC Communications, Inc. and is not transferrable.. The Planning Commission reserves the right to review the conditional use permit on an annual basis and may require cancellation thereof or modification of its terms upon finding of adverse impacts to public safety or health. 2) The plans be revised showing the tower height up to 16' maximum, be screened attractively on three sides, and be approved by the Planning Department prior to conditional use permit issuance. Normally we notify applicants sooner after such decisions, but only until my recent arrival on staff have we begun'to get back on schedule. Please excuse the delay. Chairman Kirsop convened the meeting at 8:08 p.m. Other Commissioners in attendence included Leo Sowinski, Eileen Avery, Joseph Orrico, and Randy Coplen. Brad Collins represented the Plannning Department. APPROVAL OF MINUTES Chairman Kirsop noted that the Allentown Annexation was voted down. PUBLIC HEARING A. Application 83 -10 -CUP, McCaw RCC Communications, Inc. requesting approval of a Conditional Use Permit to construct a low power communications microwave link tower at 760 Andover Park West. Mr. Collins read the staff report for the conditional use permit request. Chairman Kirsop opened the hearing at 8:15 p.m. Lloyd Hawley representing McCaw RCC Communications was present to answer any of the Commission's questions. Dick Kirsop asked why they were going with the antenna at the 12 foot level of a 20 foot tower. Mr. Hawley explained that they need to ensure that the antenna dish stays rigid, well attached, and perfectly lined up with the receiving end at Couger Mountain. He said they could go to a freestanding tower without the guys, but then wouldn't be able to utilize the 42' setback because they would then have to tie on to tip -up walls. Chairman Kirsop questioned if the 20' tower was necessary and will another dish be added on. Mr. Hawley said no. Chairman Kirsop asked if this would be the equipment and relay point. Mr. Hawley explained that they would have a computer terminal that would sit on the proposed location and would be tied into phone lines from all over the Seattle area; the incoming phone lines would be coded into the computer, then converted into microwave frequencies and sent up to the distribution point on Couger Mountain, from there it talks to everywhere in Western Washington. Chairman Kirsop compared it to a small telephone exchange. Page -2- PLANNING COMMISSION MINUTES ` September 22, 1983 Chairman Kirsop stated that in this town (Tukwila) we've been.concerned about screening of air condition equipment and other roof mounted equipment. Mr. Hawley inquired if aesthetics was the concern and suggested the alternative of mounting on the side of the building, but was concerned that because of the other buildings they have to ensure there is a clear shot without too much reflection back into the system. He also suggested a different mount scheme such as a tapered tower freestanding with no guy wires. Mr. Sowinski felt this would be more acceptable. Mr. Hawley discussed screening from Andover Park West and the adjacent building. Mr. Sowinski asked about the possibility of harmonic interference on AM FM. TV or CB between point A and point B. Mr. Hawley explained that the next step would to be licensed by the FCC which would analyze frequency interference, and they are quite extensive on their research. Mr. Sowinski stated that this would usually happen if something went off frequency. Mr. Hawley agreed. Mr. Sowinski asked if they had this pretty -well analyzed. Mr. Hawley said yes, and said they are essentially moving their existing operation from Bellevue to Tukwila. Mr. Orrico said living close to the freeway 'h`e gets CB interference on his TV. Mr. Hawley said Citizen's Band is about 27 megahertz, and the microwave dish is way up in the megahertz; a t.v. antenna would have to be right in the beam path to have interference. Mr. Sowinski noted his concern for the people which may be affected between point A and point B. Mr. Hawley said that Gouger Mountain is one of the biggest communications sites. Mr. Coplen asked if it would be a financial hardship to put a screen around it. Mr. Hawley did not see a problem with that and suggested they could relocate to the tip -up wall, drop the height to 10', and screen on three sides. MR. COPLEN MOVED THAT APPLICATION 83 -10 -CUP BE APPROVED WITH THE FOLLOWING CONDITIONS: Page -3- `PLANNING COMMISSION MINUTES September 22, 1983 1) THE CONDITIONAL USE PERMIT IS ISSUED FOR THE BENEFIT OF MCCAW RCC COMMUNICATIONS, INC. AND IS NOT TRANSFERRABLE. Collins read the staff report requesting approval of sign area increase. Mr. Collins noted that there was a typographical error in the introduction . of the staff report - the exposed building face mounted wall was stated as 121/2' x 24', it should have read the exposed building face mounted wall is :17'1' x 24'. The applicant was not present at the meeting. MR. ORRICO MOVED THAT THE PLANNING COMMISSION APPROVE APPLICATION 83 -15 -SPE, DINING INTERIORS, FOR A 25 SQUARE FOOT SIGN PER EXHIBIT "A" AND "B." MOTION PASSED. Mr. Collins asked that anyone interested in going to the PAW Conference let him know that night so he could sign them up. INTRODUCTION The McCaw RCC Communications, Inc. is request- ing approval of a Conditional Use Permit to install a low power communications microwave link tower at 760 Andover Park West. The antenna for the communications link is to be mounted at the 12 foot level of a 20 foot, guyed tower. The tower will be mounted on the roof of the tenant space. 1. The proposed site is zoned C -M (Industrial Park). The communications tower requires a Conditional Use Permit according to TMC 18.64.020(11). it C2 c.M i c-M .5• "Y try 0. The maximum height of the proposed tower is 40 feet and is consistent with the zoning height regulations which allow basic height for this area of town to be 115 feet. Ma 4. A Declaration of Non - Significance under provisions of the State Environmental Policy Act has been granted by the responsible official for this project. CONCLUSIONS TMC 18.64.050 specifies the criteria to be used by the Planning Commission in evaluating a Conditional Use Permit; staff response to each criteria.is as follows: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is . situated; RESPONSE: The applicant has assured staff that the proposed project will not have adverse affect on humans, fauna or flora. The proposed project's radio frequency radiation (RFR) also known as nonionizing electro- magnetic radiation is similar to those of AM, FM and TV broadcast bands and CB communication's frequencies. August 25, 1983 (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy; RESPONSE: The proposed project is consistent with the established light - industrial use characteristics of the Andover Industrial Park area. (3) RECOMMENDATION CVB /blk attachments The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; RESPONSE: The proposed communications center is unmanned and will have no impact on traffic circulation. The tower is proposed to be set back away from all edges of the building by a minimum of 42 feet. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan; RESPONSE: The Comprehensive Land Use Policy Plan is basically silent in regard to communication facilities, however it does encourage uses which are supportive to existing industrial uses: A. Allow for the location of new commercial and industrial areas and the expansion of existing ones when this expansion is compatible with surrounding land uses and not detrimental to the public welfare. (Commerce /Industry Objective 1, Policy 1). B. Encourage uses which are supportive to industrial and warehouse uses to locate in or near such activities. (Commerce /Industry Objective 2, Policy 2). (5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. RESPONSE: As far as staff can determine there should be no adverse impacts associated with this project.. Staff recommends approval of application 83 -10 -CUP for installation and use of a communications tower as depicted in the attached exhibits, and subject to the following condition: 1. The Conditional Use Permit is issued for the benefit of McCaw RCC Communications, Inc. and is not transferrable. The Planning Commission reserves the right to review. the Conditional Use Permit on an annual basis and may require cancella- tion thereof or.modifitation of its terms upon finding of adverse impacts to public safety or health. McCAW RCC COMMUNICATIONS, INC. provides paging, Mobile Telephone and answering services in several western states, including Washington. Our proposed location at 760 Andover Way ;Jest, Tukwila is to accommodate our Technical Center operations. These operations are primarily directed to support and maintain the Western Washington portion of our communications system. Presently, our central computer system, that controls and operates the largest paging system in Washington, is located in our•Corporate building in Bellevue, This computer communicates to the control point located on Cougar Mountain, Issaquah, WA via the low -power bi- directional communications path operated on 2126.800 MHz frequency. Due to rapid company growth, we now find it necessary to relocate this central computer system and its required communications link. We have decided to consolidate our technical staff and co- locate the computer and link with them. The benefits of having the technical expertise located immediately with the "heart" of a technical system are obvious. The antenna for the communications link is to be mounted at the 12 foot level of a 20 foot, guyed tower. This tower will be mounted on the roof of our proposed lease space. Please see the scale sketch, Tower Guying Scheme, for the location of the tower. The tower will be set back from the east edge of the building by 42 feet. In summary, our application for a Conditional Use Permit is merely to relocate an existing, operating system to our proposed new location in Tukwila.
