HomeMy WebLinkAboutPermit 83-18-V - DOUBLETREE - SIGN VARIANCE83-18-v 16500 southcenter parkway doubletree plaza sign AGENDA ITEM CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT .83 -18 -V Doub.letree.Plaza Hotel November 3, 1983 INTRODUCTION The Doubletree Plaza Hotel has applied for a variance from Tukwila Municipal Code 19.32.140(A) and 19.32.190(A) to replace the logo, which was removed as a condition of relocating the Doubletree Plaza Hotel letter sign that was approved by the Planning Commission May 26, 1983. The logo is proposed to be located at the north end of the top of the west face of the hotel building and constitutes a separate, second sign on the west building face. The total sign area exceeds that permitted for commercial zones but could be approved by the Planning Commission upon application. FINDINGS 1) The existing sign on the west building face measures approximately 160 square feet; total sign area for the westerly face according to Table 1 of TMC 19.32.140(A) is 150 square feet, unless approved by the Planning Commission. 2) The exposed building face of the Doubletree Plaza Hotel is setback 295 feet from the property line; the required setback for this building in the C -P zone is 75 feet. 3) TMC 19.32.140(A) provides that the sign areas in Table 1 may be increased no more than 50% for each doubling of the required minimum setback for the wall upon which a particular sign is to be placed; in this case the Planning Commission may approve a sign up to 370 square feet. 4) Per TMC 19.32.190(A) each hotel shall be permitted one,(1) building face mounted sign on each building face of the hotel, which sign shall contain only the hotel name and /or logo. One face mounted sign already exists on the west face, and one sign exists on the north face. 5) The applicants desire to replace the logo as a separate, second sign on the upper west face of the hotel, in conflict with the limitation in TMC 19.32.190(A) of one sign per each building face of the hotel. CRITERIA FOR GRANTING A VARIANCE The following are responses by the applicant and staff to each criteria that must be met prior to granting a variance from the Sign Code. The variance as approved shall not constitute .a grant of special privilege which is inconsistent with the intent of this sign code nor which contravenes the limitation on use of property specified by the zoning classification in which this property is located. Applicant Response: The logo was removed so the sign could be installed. The sign and logo closer together may have met technical approval of the code, but adding the logo to the wall meets the spirit and intent of the code. Staff Response: The intent of TMC 19.32.190(A) is to specifically limit the number of signs on a given building face to only one, except for a restaurant operation which is permitted a second sign on the same building face. B. That the variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. Applicant Response: The hotel is the largest commercial building in the area with many traditional signs. The hotel requires additional recognition as a special place of business. Staff Response: TMC 19.32.190 provides for additional recognition of hotels, but the applicant has not presented special circumstances of physical hardship denying it use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. C. That the granting of the variance will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity and in the zone in which the subject property is located. Applicant Response: The logo will add to the appearance of the hotel signs as is the intent of the code. It will not be overbearing to the visual senses of the passing public. Staff Response: The granting of the variance will not be materially detrimental or injurious except as precedent for future requests;incongruous with the purposes of the Sign Code. D. That the special conditions and circumstances prompting the variance request do not result from the action of the applicant. Applicant Response: A choice was made to have the sign placed at its present location and logo removed, but subsequent analysis is that the logo enhances the visual impact of the building and balances with the sign. Staff Response: At the time of the sign permit application and Planning Commission review in May, 1982, the applicant was informed that the logo and Doubletree Plaza Hotel letter sign could be combined into a single sign which the Planning Commission may approve. The applicant can still make an application to modify the existing sign to incorporate the logo into a single sign. Page -3- . 83 -18 -V Doubletree Pla( Hotel Board of Adjustment November 3, 1983 E. That the variance .as.granted represents the least amount of deviation from prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. Applicant Response: The sign and logo are slightly larger than maximum requirements; if closer together, may meet the requirement of the code. The suggested placement makes better balance. Staff Response: Even though the variance as requested would represent a. minimum deviation from prescribed regulations, granting it is not consistent with the stated intent of the Sign Code. F. That granting of the variance shall result in greater convenience to the public in identifying the business location for which a sign code variance is sought. Applicant Response: The DOUBLETREE logo is becoming a nationally recognized symbol. Staff Response: Incorporating the logo into the signage of the hotel may result in greater convenience to the public in identifying the business location. G. That the granting of the variance will not constitute a public nuisance or adversely affect the.publi'c safety. Applicant Response: Visually more pleasing to passing public without harsh distraction. Staff Response: The granting of the variance should not constitute a public nuisance or adversely affect the public safety except as precedent for future. requests incongruous with the purposes of the Sign Code. CONCLUSION The application does not meet all the criteria necessary for granting a variance from TMC 19.32.190(A). The applicant does not need a variance from TMC 19.32.140(A) to increase the existing sign by 102 square feet for the logo, but can make application to the Planning Commission as prescribed in the same section of the Sign Code.
