REVISED
On February 24, 1983, the existing office development at 13925 Interurban Avenue
South was approved by the Board of architecture Review. Revisions to the develop-
ment were subsequently approved on May 12, 1983. Occupancy of the building
occurred in January of 1984, and the building was sold a few months ago. The new
owners are seeking approval of a revision to the site plan to improve access
. around the building.
FINDINGS
1. The subject property is located at 13925 Interurban Avenue South and is zoned
C -2 (Regional Retail Business).
2. TMC 18.60.030(2)(E) requires Board of Architecture Review approval of the pro-
posal. Per TMC 18.60.070 the Board may approve, modify or deny the proposal
based upon the criteria of TMC 18.60.050 and 18.60.060.
3. The proposed revisions to the site plan exclusively involve the northeasterly
portion of the site where two alternative means of extending access to
Interurban Avenue South are proposed. Alternative A would extend access
around the building to the existing parking lot and driveway to the street
(Exhibit #1). Alternative B would incorporate Alternative A and extend access
across the northerly abutting property to the street (Exhibit #2).The appli-
cant is pursuing purchase of the right of access across and parking on this
property.
4. Landscaping has been established on the site and will require revision to
accommodate the proposal. Alternative B will remove more of the existing
landscaping.
5. Both alternatives comply with City ordinances and regulations, except that
alternative B features parking on adjacent property. If the Board approves
both alternatives, final selection will be left to the applicant pending
purchase of the required portion of the northerly abutting property.

1. In terms of on -site circulation, Alternative B is preferred overall by staff.
This alternative provides two -way vehicular circulation and relatively more
vehicle stacking capacity than the existing single access point. However, the
proposed parking on adjacent property must be resolved with that property
owner per the zoning code.
2. Both alternatives conform to the design review criteria of TMC 18.60.050 and
18.60.060. Adequate landscaping is provided, except perhaps along the north
edge of the proposed northerly access road (Alternative B). Landscaping is
not shown at this location which lies on adjacent private property. Since the
acceptability of the easement remains in negotiation between the property
owners, 5 feet for landscaping should be designated along the northerly side
of ; the easement. The easement becomes in effect the side yard area which TMC
18.52.020 requires be planted with 5 feet of landscaping.
A landscaping plan for this area was not submitted, probably due to the uncer-
tain outcome of negotiations for the easement. Unless the Board wishes to
review the subsequent final landscape plan, staff would recommend staff review
and approval of the plan per a concept approved by the Board. Staff would
recommend a landscape concept of 2 inch caliper trees planted at a 10 foot
spacing with 4 evergreen shrubs planted between the trees. mst PrLs��D�rsT aF

PRELIMINARY RECOMMENDATION
Approval of both alternative site plans subject to:
1. 5 feet of landscaping along the north side of the northerly access road of
Alternative B with 2 inch caliper trees at 20 foot spacing with 2 evergreen
shrubs planted between the trees per review and approval of the Planning
Department.
2. Parking on adjacent property being resolved with the property owner per the
zoning code.
3. Compliance with . pplicable City ordinances and regulations.

INTRODUCTION
Fewel and Associates is requesting Board of
Architectural Review (B.A.R.) approval for a
two story office building to be located across
from Foster Golf Course and within the Inter-
urban Special Review District.
FINDINGS
1. The site is located on the west side of
Interurban Avenue across from Foster Golf
Course on lots 2 and 3 of Tukwila Short
Plat No. 80- 36 -SS.
2. TMC 18.60.030 and 18.60.060 require B.A.R.
for this project for several reasons •
including the site is located north of
1 -405 and east of I -5 and is located in the
Interurban Special Review District.
. The existing single family house and garage on site are proposed to be
demolished.
3. The site is zoned C -2, Regional Retail Business which allows office buildings
as a principally permitted use. On January 19, 1981 the City Council rezoned
this property from R -1 to C -2 by Ordinance No. 1201. Section 3(A) of the
ordinance states that the development should conform to the concept depicted
on Exhibit "B" (SEE, attached).
".5. The proposed office building meets the zoning requirements for basic height,
setback and area regulations.
6. The project indicates. 70 parking spaces will be provided; this is 30 spaces in
excess of the minimum required for the project. 12 stalls or 30% will be
compact cars, and 1 space will be provided for the handicapped near the main
entrance to the building per code.
7. TMC 18.56.060 requires one loading space for an office building of this size.
The site plan does not indicate a loading space.
8. TMC 18.52.020 requires 10 feet of landscaping in the front yard and 5 feet of
landscaping in the side yards. The applicant has met these standards by
placing plantings along the east and north property lines and on the south side
of the building.

9. The two story contemporary style office building is 15,754 square feet.
Building materials are proposed as cedar siding and shingles and recessed
double - glazed windows.
10. Placement of building is in such a manner as to'not disturb the steep slope
which is at the rear of the property. The existing rockery is proposed to be
replaced with a new rockery between the building and the slope.
DISCUSSION
TMC 18.60.050 specifies guidelines to be used by B.A.R. in reviewing applications.
In addition, TMC 18.60.060 states B.A.R. shall use criteria specified in sub-
sections (4) and (5) in its review of projects located in the Interuban Special
Review Area. The following is staff response to each of the guidelines:

Response: The .low and wood exterior complement the beauty of the
natural amenities of the wooded hillside in the rear of the .
property.

Response: While it is the intent of the designer to provide construction
of the park -like setting of the Foster Golf Course across the
street through the proposed design, there are no larger areas
of landscaping around the buildings. The proposed site plan
deviates somewhat from the conceptual plan attached to rezone
Ordinance Number 1201. Although the shared driveway concept is
shown on the proposed site plan, the parking area is no longer
concentrated between the two properties, rather is now proposed
to encompass the proposed building in addition to the area
between the properties. Also, it may contrast with the exterior
treatment of the office building on the adjoining property
immediately to the south.
3. Landbcape and Site Tneainen.
Response: Per the Reciprocal Easement Agreement with Seattle Realty, the
owners of the adjoining property, the applicant proposes to
share access and egress to the parking area with Seattle Realty
through a single driveway to Interurban Avenue. The designer's
intent is to provide a safe and smooth movement onto and off of
Interurban Avenue and provide a continuous flow of traffic around
the building, allowing easy access to the building for pedestrians
with building entrances placed at several locations around the
structure with a minimum of cross traffic.

4. Bu td,in.g Design
Required landscaping on the south side yard has been placed
abutting the building instead of along the south property line,
which falls in the center of the driveway.
Landscaping includes a variety of plants that do well in the
Pacific Northwest including but not limited to rhododendrons,
vine maples, maples, quaking aspens, heavenly bamboo, and ivy.
The applicant is proposing to transplant four maple trees that
presently exist on site to the front yard. Survival rate of
transplanting is generally good, however, the Commission may
wish to impose a survival clause as part of the landscape plan.
The survival clause is a method of developer ensuring the
landscape will survive beyond the first year of transplanting.
If the plant should die before the year's end, the developers
would replace the plant with a comparable plant. Berming the
front yard could further enhance the transition of the project
to the street by partially hiding the parked cars in the lot.
The building will have exterior lighting from the overhang of
the first floor. Exterior lighting fixtures approximately
8 feet tall will be on the north, east and west sides of the
building.
Response: The low profile cedar building extensively uses double glazed
windows in the design. The building will be used exclusively for
office use.

Response: The applicant has indicated that miscellaneous structures and
street furniture are not part of this project.
TMC 18.60.060 Special Review Guidelines for Interurban Special Review Area

Response: The applicant is proposing to transplant four existing maple
trees on the site near the entrance of the driveway from
Interurban Avenue. Whereas it is commendable that he ie'

Response: The design of the site is intended to allow traffic circulation
around the entire building and sharing an access /egress on to
Interurban Avenue with the neighboring property to the south.
An eight (8) foot sidewalk not shown on the site plan will be
required per the Interurban Geometric Study adopted by the
City Council and by Ordinance Number 1233.

Response: Staff feels the proposed office project will fit in with
neighboring uses and be complementary to the C -2 district.

Response: An environmental analysis of the site will be conducted as part
of the review of the building permit.

Response: The Comprehensive Historic Sites Map indicates this area
as the site of numerous small coal mine shafts which operated
at the turn of the century. Elimination of any of these
abandoned mine shafts is probably in the interst of public
safety.

Response: The shared diveway along the south side yard prevents landscaping
in this area, hence the applicant has relocated the plantings
along the south side of the building.
RECOMMENDATION
Staff recommends approval of application DR -1 -83 according to exhibits A,B,C,D,E,F
and G, subject to the following conditions:
1. Grading of slopes and installation of rockeries or retainment walls are subject
to approval by the Public Works Department. No cuts into the bank are
authorized without review and approval by the Planning Department.
2. Existing trees proposed for transplanting on site area subject to a one
year survival agreement signed by the developer.
3. The parking plan is revised to indicate a loading stall.
4. Exterior lighting specifications are subject to approval by the Police Department`
for safety reasons. v

W I T N E S S E T H :
PROPERTY USE AND DEVELOPMENT AGREEMENT
THIS INSTRUMENT, executed this 21 of b .e K. ,
1983, in favor of the CITY OF TUKWILA, a municipal corporation
( "City "), by FEWEL - McAVOY & ASSOCIATES, INC., an Oregon
corporation ( "Fewel "):
WHEREAS:
A. Fewel seeks to construct a building on the property
located at 13925 Interurban Avenue South, Tukwila, Washington.
The legal description of that property is attached hereto as
Exhibit 1.
B. To construct the building as planned, three trees
located on that property, which are estimated to be
approximately 20 feet high and 4 -6 inches in diameter, must be
relocated.
C. If provision is not made for the protection of said
trees, Fewel would probably be unable to obtain from the City
the necessary authorization to proceed with Fewel's project, and
D. Fewel will provide for the preservation of said three
trees, in consideration of the City's permitting Fewel upon
date of this agreement to proceed with its construction project
so long as all other lawful permit requirements have been met.

NOW, THEREFORE, Fewel hereby covenants, bargains and agrees
on behalf of itself, its successors and assigns that the
property shall be developed and used in accordance with the
following terms and conditions:
1. Fewel will either (1) relocate the three trees at
issue to a location on the site, or (2) replace those trees by
planting trees of a size and quality satisfactory to the City
upon the site.
2. If alternative (1) from paragraph 1, above, is
selected, and the three trees in question are relocated, Fewel
agrees that should they, or any of them, die within one year of
the date of relocation, they will be replaced at Fewel's sole
cost and expense with trees satisfactory to the City.
- 3. This Agreement shall be recorded in the records of the
Department of Records and Elections for King County,
Washington, and the covenants herein shall be deemed to attach
to and run with the land and shall be binding upon Fewel, its
successors and assigns.
4. The City may institute and prosecute any proceedings
at law or equity to enforce this Agreement and may seek, in
addition to the usual remedies available at law, specific
performance. The prevailing party in any such action shall be
entitled to recover its reasonable attorney fees from the other
party.

Today we received the attached bond from Fewel & Associates allegedly
according to your instructions. Please verify.
Furthermore, Mike Fewel informed me the subcontractor cannot begin the
restoration work until after the first week in January 1984.' He
accordingly related a January 15, 1984 deadline to be impossible and
requested at least until the end of January. This sounds reasonable..
By the time you review this•(Wednesday) staff should have completed all o
the necessary review to issue the Certificate of Occupancy, except for

RE: Fewel Office Building, Interurban Avenue South
DR -1 -83
During an inspection of this building site on December 14, 1983
it was discovered that an additional access to Interurban Avenue
South was recently constructed contradictory to approval plans.
Since then several conversations have occurred with Mike Eisenbacher
regarding how to resolve this violation of the plans approved by
the Board of Architectural Review (T.M.C. Sections 18.60.030 and
18.60.060).
This letter is formal notification that this violation exists
(T.M:C. Section 18.96.100) and is subject to penalties of T.M.C.
Section 18.96.110. The northerly access to Interurban Avenue South
has not been approved by the Board of Architectural Review and /or
applicable City departments. Therefore, the situation must be
immediately rectified per approval plans or a performance bond
submitted for removal of asphalt and curbing and installation of
approved landscaping, sprinkler system, curbing and parking striping.
Bob Carlton has contacted me already regarding bonding requirements.
By the time you receive this letter a bond will probably have been
submitted and perhaps the Certificate of Occupancy issued. The
purpose of this letter is to place you on notice of the violation as .
required by T.M.C. Section 18.96.100. Whether or not action against
the bond will be taken will be determined by further staff review per
T.M.C. Section 18.96.080. Perhaps this also will have been established
prior to your receipt.of this letter.

PROPERTY USE AND DEVELOPMENT AGREEMENT
This Agreement is entered into this day of
1983, by and between the City of Tukwila, Washington (. "City "),
and Fewel - McAvoy & Associates, Inc., an Oregon corporation
( "Fewel "), with reference to the following facts:
1. Fewel seeks to construct a building on the property
located at 13925 Interurban Avenue South, Tukwila, Washington.
The legal description of that property is attached hereto as
Exhibit 1.
2. To construct the building as planned, three trees
located on that property, which are estimated to be approxi
mately 100 feet high. and 30 -40 inches in diameter, must be
relocated.
3. If provision is not made for the protection of those
three trees, it is anticipated that Fewel would be unable'to
obtain from the City the necessary authorizations to proceed
with Fewel's project.
4. City and Fewel seek to reach an agreement providing
for the preservation of those three trees, in consideration
of the City permitting Fewel, at this point, to proceed with
its construction project.
Agreement
In consideration of the above recitals, Fewel, on behalf
of itself, its heirs, successors and assigns, and the City,
hereby agree as follows:
1. The above recitations are true and correct.
2. Fewel agrees that it will either (1) relocate the
three trees at issue to a site selected by the City, or
(2) replace those three trees by planting trees of a size
and quality satisfactory to the City at a site specified by
the City within the Tukwila city limits.
3. If Alternative (1) from Paragraph 2, above, is selected,
and the three trees in question are relocated, Fewel agrees that
should they, or any of them, die within two years of the date of
relocation, they will be replaced at Fewel's sole cost and
expense with trees satisfactory to the City.
4. This Agreement shall be recorded in the records of the
Department of Records and Elections for King County, Washington,
and the covenants herein shall be deemed to attach to and run
with the land and shall•be binding upon Fewel, its successors
and assigns.
5. The City may institute and prosecute any proceedings
at law or equity to enforce this Agreement and may seek, in
addition to the usual remedies available at law, specific per-
formance. The prevailing party in any such action shall be
entitled to recover its reasonable attorneys' fees from the
other party.

At the regular April 1983 Tukwila Planning Commission meeting held on
May 12, 1983, the Board of Architectural Review approved your revised
application DR-1-83 for an office building to be located on the west
side of Interurban Avenue across from Foster Golf Course on Lots 2 and
3 of Tukwila Short Plat No. 80 -36 -SS according to Exhibits A, B, C, D,
E, F and G, subject to the following conditions:
1. Grading of slopes and installation of rockeries or retainment walls
are subject to approval by the Public Works Department. No cuts
into the bank are authorized without review and approval by the
Planning Department.
2. Existing trees proposed for transplanting on site are subject to a
one year survival agreement signed by the developer.
3. The parking plan is revised to indicate a loading stall.
4. Exterior lighting specifications are subject to approval by the
Police Department for safety reasons.
5. A sidewalk is provided per the Interurban Geometric Study and Ordinance

1983. held on May 12th, 1983.
Chairman Kirsop convened the meeting at 8:15 p.m. Other Commissioners in
attendance included Mr. Arvidson, Mr. Sowinski, Mrs. Avery and Mr. Knudson.
Mr. Coplen was introduced to the Planning Commission as a newly appointed
member of the Commission. Mr. Collins, Ms. Berry and Mr. Caughey were
present :ton behalf of the Planning Department.
APPROVAL OF MINUTES

BOARD OF ARCHITECTURAL REVIEW
.A. DR -2 -83, Hydrotube at the Pavilion: requesting design approval for:.
a hydrotube water slide to be located at the Pavilion Outlet Centex',
Southcenter Parkway at South 180th Street.
Ms. Berry presented the staff report to the Commission.
Chairman Kirsop adjourned the meeting at 8:45 p.m. to the Police Training Room
for viewing the two video tapes of the hydrotube located at Eastport Mall in
Portland, Oregon. The video films were provided by the applicant and staff.
Chairman Kirsop reconvened the meeting at 9:00 p.m. in the City Council Chambers.
Keith Vaughan,architect for the project, explained the design of the hydrotube
including colors, wind resistance, and metal siding materials.
Ms. Berry presented several slides of the existing Pavilion building as viewed
from the south,west and north sides.
Mr. Collins inquired about method of lighting and provision of a drawing of the
south elevation. Mr. Vaughan indicated a preference for moveable lighting
avoiding contrast with bright spots on the hydrotube. .
Mr. Jon Buttars, Owner of Washington State Franchise for hydrotubes and prin-
cipal owner of hydrotube proposed for the Pavilion, expressed favorable
agreement with the staff report. Insurance rates have been reduced since the
initial hydrotube project. The tenant space lease with the Benaroya Company is
for ten (10) years. Eventual goal is to create a water recreation theme
indoor park. Initial plan is to use 6,000 square feet, gradually increasing
the project size to 9,600 square feet. Visibility of the tubes is a key to
the success of the project, similar to the golden arches for McDonald Ham-
burgers.

Mr. Vaughan explained the effect of artificial and natural light playing
on the surface of the tubes creating visual interest.
General discussion occurred among the Commissioners regarding reservations
of the unscreened tubes, future impact of the project on the neighborhood
and impact of structured parking on the design of the Pavilion.
Mr. Vaughan suggested the metal supports could be reviewed for design
aesthetics, noting it may affect the structure's resistance to wind.
Mr. COPLEN MOVED THE PLANNING COMMISSION APPROVE APPLICATION DR -5 -83,
CHOOSING THE SUBDUED COLOR SCHEME AND WEIGHT OF THE TOWER, AND STAFF
RECOMMENDED CONDITION:
WHEN THE HYDROTUBE IS VACATED OR ABANDONED FOR OTHER.THAN OPERATIONAL
REPAIR OR MAINTENANCE FOR MORE THAN 180 DAYS, IT SHALL BE DISMANTLED,
AND THAT PORTION OF THE PAVILION BUILDING SHALL BE RECONSTRUCTED TO
. APPEAR AS IT DOES TODAY, PRIOR TO THE BUILDING OF THE HYDROTUBE.

SUBJECT: Fewel Associates Development Permit
4 April 1983
In response to your transmittal of 29 March 1983 regarding Planning Department
concerns with the content of your Building Permit Application, the following
its have yet to be resolved satisfactorily:
A) Landscape Survival /Replacement Agreement
- The draft letter dated 20 March 1983 signed by Hansen, Hansen and Johnson
does not adequately protect the public interest in this matter. What
we are seeking is a formal recorded agreement, executed by the property
owner and running with the land. A draft agreement should be prepared
by legal counsel and forwarded to our office for review by the City Attorney.
B) Rockery Structural Safety Analysis
- The detail drawing supplied is not sufficient; we need a complete
quantitative analysis of the rockery as proposed in order to be certain
of its structural integrity. Technical guidance on this matter may be
obtained from Phil Fraser in our Public Works Department (433 - 1856).
Site Plan Vis -a -Vis S. 139th. Street
- As the revised site plan: indicates, that portion of South 139th Street
lying westerly of Interurban Avenue is still a right -of -way. In its
present form, the site plan is inconsistent with zoning requirements and
with the plan approved in concept by the Board of Architectural Review.
To proceed with further action on your application, we see two options
available to you:
- One: Reactivate the formal application for vacation of South
139th ,Street and if the vacation effort is successful,
return site plan to original configuration.
- Two: Redesign the site layout to provide appropriate setbacks,
driveways and landscape berms accommodating the continued
presence of South 139th Street. This option will most likely
require reassessment by the Board of Architectural Review.

Regarding: Relocation of Tenant
Gentlemen:
Hansen Hansen & Johnson
The house located on the property now owned by Fewel and Associates
is currently being rented. The terms of the Rental Agreement state
that the landlord shall give 30 -day notice for the tenant to move.
This will be done at such time as necessary to allow for const-
ruction of the new building.
Fewel and Associates is also looking at the possibility of re-
locating the house to a new site in the City of Tukwila, and
allowing the tenant to purchase the house and new property at
a rate comparable to the rent that the tenant is currently paying.
In the event that the house cannot be moved, Fewel & Associates
intends to make every possible effort to help the tenant locate
housing within the City of Tukwila.

Regarding: Landscape Relocation For
Fewel & Associates Office Building
Gentlemen:
This letter is in response to the B.A.R. recommendation for a
one -year tree relocation survival replacement Agreement. The
Owner of the Fewel office building agrees to provide replacement
of the existing landscaping, shown on the attached landscape plan,
Sheet L -1, in the event that said landscaping should not survive
one -year after being transplanted. Such replacement shall be of
comparable quality, size and type as the original plant materials.
The landscape work shall be performed by Olympic Landscaping of
Tacoma, who provides a standard one -year survival contract for
all plant materials. He also has provided in his work, the re-
location of said existing trees and replacement of them in the
event that they should not survive.

Dear Mr. Mills:
At the regular Tukwila Planning Commission meeting February 24, 1983, the
Board of Architectural Review approved your application for an office building
to be located on the west side of Interurban Avenue across from Foster Golf
Course .on Lots 2 and 3 of Tukwila Short Plat No. 80 -36 -SS according to
Exhibits A, B, C, D, E, F and G, subject to the following conditions:
1. Grading of slopes and installation of rockeries or retainment walls are
subject to approval by the Public Works Department. No cuts into the
bank are authorized without review and approval by the Planning Department.
2. Existing trees proposed for transplanting on site are subject to a one
year survival agreement signed by the developer.
3. The parking plan is revised to indicate a loading stall.
4. Exterior lighting specifications are subject to approval by the Police
Department for safety reasons.
5. A sidewalk is provided per the Interurban Geometric. Study and Ordinance
1233.

The following is a response to Section 18.60.060 of the Tukwila
Zoning Code entitled "Special Review Guidelines of Interurban
Special Review Area ". The comments have been referenced in
sequence as they appear in subsection (4) "Special Review
Guidelines To All Proposed Development ".
A) The proposed project would not take away from the
beauty of the natural amenities in the area. The
project does respect this beauty by providing a
design that conforms with the natural surroundings
through the use of a low profile and wood exterior.
B) The new development will be directly across from
the Foster Golf Course. The proposed design and
landscaping would provide a continuation of the
park -like setting of this recreational area. It
is the intent of the designer to add to the beauty
of the area and not to detract from it.
C) The parking, walks, and landscaping for the pro-
posed development have been designed to create ease
of pedestrian and traffic flaw. Parking areas sur-
round the building to provide a continuous flow of
traffic into the site, around the building, and
finally back out to Interurban Avenue. This
design allows easy access to the building for ped-
estrians with building entrances placed at several
locations around the structure with a minimum of
cross, traffic.

D) The proposed structure is strictly for office use.
This makes it compatible with the existing C -2
Zone of the site. The nearby uses are also C -2,
creating an area amiable to commercial use.
E) The project will have very insignificant environ-
mental impact to the area. The office use would
not produce any harmful effects to the quality of
the surrounding area. The building will actually
bring benefit to the area by increasing commerce
and improtant trade to the area.
F) The use of, wood is an important part of the design
in that it makes the building compatible with the
existing designs in the area. The use of natural
materials also provides a transition from the stret
to the building and to the natural vegetation of the
of the slope behind it.
