Subdued color scheme and weight of the tower shall be included in the building design. 2. Respectf Rick Beeler Associate Planner RB /blk Gary L VanDusen, Mayor CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT IV) A. , DR- 02 -83: Hydrotube at the Pavilion AGENDA ITEM INTRODUCTION The Board of Architectural Review on May 12, 1983, approved the design for the proposed hydrotube at the Pavilion Outlet Center at the northeast corner of Southcenter Parkway and S. 180th St. Since that time, the design of the facility has sufficiently changed to warrant reevaluation by the Board. Therefore, the project is being returned to the Board of Architectural Review for final approval. FINDINGS 1. On May 12, 1983, the Board of Architectural Review approved the design of the Hydrotube facility subject to: When the Hydrotube is vacated or abandoned for other than operational repair . or maintenance for more than 180 days, it shall be dismantled, and that por- tion of the Pavilion building shall be reconstructed to appear as it does today, prior to the building of the Hydrotube. Colors of blue, tourquois, and light grey. 2. On April 26, 1984, the Planning Commission extended the Conditional Use Permit for the project to May 12, 1985, subject to: A. Internal circulation signing program to direct patrons to the southerly parking lot across S. 180th St. be submitted with the building permit application and implemented prior to the issuance of the Certificate of Occupancy. B. A traffic study to evaluate traffic generation and to suggest any addi- tional traffic channelization and signal phasing; the study to be under- taken within three months of occupancy of the facility. C. The Planning Commission shall reserve the right of annual review of the Conditional Use Permit. D. Prior to issuance of construction permits, the applicant shall provide a summary analysis of traffic signal phasing in the vicinity of the Pavilion Outlet Center which will analyze the effects of increased traffic generated by the proposed waterslide activity and which will suggest modi- fications or improvements as needed. 'Page -2- PLANNING COMMISSION DR- 02 -83: Hydrotube May 10, 1984 3. Exhibits A -1 through A -3 are the site plan and building design approved by the Planning Commission in 1983. Attached Exhibit B -1 through B -3 is the revised proposal, created as a result of a different structural analysis and approach to the Hydrotube facility relative to the existing structure of the Pavilion Outlet Center. Building materials were changed to milk - colored fiberglass and some medium green colored metal panels and a metal roof. The internal floor plan, although not a consideration before the Board, reflects the revised approach to the structural system. The system is the result of complying with the original conditions of the Board's design review in 1983, wherein expiration of tenancy would require restoration of the existing building. The applicant relatively recently discovered the original structural system would make compliance with this condition difficult, there- fore, the revised structural system was created to minimally impact the struc- ture of the Pavilion Outlet Center and better support the hydrotubes themselves. 4. TMC 18.60.050 contains the guidelines for the Board of Architectural Review to use in reaching its decision. The Board may approve, modify, or deny the pro- posal based on the record. CONCLUSIONS 1. Relationship of structure to site (TMC 18.60.050(1)): The form of the Hydrotube facility on the Pavilion Outlet Center roof generally relates acceptably to the form established in the previous BAR approval. Of more concern is the impact of the translucent milk - colored fiberglass panels which will form the siding of the exterior of the facility, except for some metal siding and the tubes themselves (Exhibit B -3). The fiberglass panels and the tubes will exude some illumination during the opera- tion of the facility. The overall affect will be of the structure and tubes emitting a glow of white and aquamarine which is dissimilar to the area in terms of building structures and overall appearance and character. Comparatively speaking, the former design appears to relate better to the Pavilion Outlet Center structure in terms of form, materials, and colors, than does the proposal. 2. Relationship of structure and site to adjoining area (TMC 18.60.050(2)): The aforegoing would also increase the amusement or entertainment image the Hydrotube is bringing to the Pavilion Outlet Center. This was of concern to the Planning Commission in last year's deliberation on the design of the faci- lity. The Pavilion Outlet Center is located at the southwesterly corner of the Southcenter business district, therefore, the overall impact of the enter- tainment image may be of less impact than elsewhere. However, the fiberglass panels are a material dissimilar to the exterior panels used on the vast majority of the buildings in the business district. The materials of the hydrotube is not harmonious with adjacent development. 'Page -3- PLANNING COMMISSION DR- 02 -83: Hydrotube May 10, 1984 RB /blk 3. Landscape and site treatment (TMC 18.60.050(3)): The Hydrotube proposal produces no real increase in demand for landscaping and screening on the site. Exterior illumination of the tubes and hydrotube structure in view of the new translucent fiberglass panels, is more of an issue than during the previous BAR review. The brightness of the facility will increase the visibility of the facility and be more of a design element than was previously approved. The overall affect does not enhance the building design and adjoining landscape. 4. Building design (TMC 18.60.050(4)): The hydrotube structure and tubes are a design and composition which are substantially divergent from the Pavilion Outlet Center facility. Proposed colors and illumination appears to not be harmonious with the existing building, thereby creating substantial contrast and emphasis of the enter- tainment purpose of the Hydrotube. While this was a large concern of staff in review of the original proposal, the concern is increased by the revised largely total translucent appearance of the proposal. 5. TMC 18.60.050(5) relating to miscellaneous structures and street furniture does not appear to apply to the proposal. RECOMMENDATION Based upon the above, staff recommends the. Board of Architectural Review carefully evaluate the increased impact that the revised proposal will produce on the busi- ness community and community at large. At a minimum, staff recommends an alter- native non - translucent or non- opaque siding material be utilized on the hydrotube structure to confine external illumination to the hydrotubes themselves. Furthermore, staff's recommendation is based on the assumption that the existing conditions imposed by the Board of Architectural Review in 1983 continue to apply. HYDROTUBE. VanDusen, Mayor P L A N N I N G C O M M I S S I O N Minutes of the Tukwila Planning Commission regular meeting of April 28, 1983. held on May 12th, 1983. Chairman Kirsop convened the meeting at 8:15 p.m. Other Commissioners in attendance included Mr. Arvidson, Mr. Sowinski, Mrs. Avery and Mr. Knudson. Mr. Coplen was introduced to the Planning Commission as a newly appointed member of the Commission. Mr. Collins, Ms. Berry and Mr. Caughey were present :bon behalf of the Planning Department. APPROVAL OF MINUTES MR. SOWINSKI MOVED THE MINUTES OF MARCH 24, 1983 BE APPROVED. MOTION CARRIED. BOARD OF ARCHITECTURAL REVIEW A. DR -2 -83, Hydrotube at the Pavilion: requesting design approval for.: a hydrotube water slide to be located at the Pavilion Outlet Canter, Southcenter Parkway at South 180th Street. Ms. Berry presented the staff report to the Commission. Chairman Kirsop adjourned the meeting at 8:45 p.m. to the Police Training Room for viewing the two video tapes of the hydrotube located at Eastport Mall in Portland, Oregon. The video films were provided by the applicant and staff. Chairman Kirsop reconvened the meeting at 9:00 p.m. in the City Council Chambers. Keith Vaughan,architect for the project, explained the design of the hydrotube including colors, wind resistance, and metal siding materials. Ms. Berry presented several slides of the existing Pavilion building as viewed from the southwest and north sides. Mr. Collins inquired about method of lighting and provision of a drawing of the south elevation. Mr. Vaughan indicated a preference for moveable lighting avoiding contrast with bright spots on the hydrotube. . Mr. Jon Buttars, Owner of Washington State Franchise for hydrotubes and prin- cipal owner of hydrotube proposed for the Pavilion, expressed favorable agreement with the staff report. Insurance rates have been reduced since the initial hydrotube project. The tenant space lease with the Benaroya Company is for ten (10) years. Eventual goal is to create a water recreation theme indoor park. Initial plan is to use 6,000 square feet, gradually increasing the project size to 9,600 square feet. Visibility of the tubes is a key to the success of the project, similar to the golden arches for McDonald Ham- burgers. PAGE -2- PLANNING COMMISSION( RITES April 28, 1983 Mr. Vaughan explained the effect of artificial and natural light playing on the surface of the tubes creating visual interest. General discussion occurred among the Commissioners regarding' reservations of the unscreened tubes, future impact of the project on the neighborhood and impact of structured parking on the design of the Pavilion. Mr. Vaughan suggested the metal supports could be reviewed for design aesthetics, noting it may affect the structure's resistance to wind. Mr. COPLEN MOVED THE PLANNING COMMISSION APPROVE APPLICATION DR -5 -83, CHOOSING THE SUBDUED COLOR SCHEME AND WEIGHT OF THE TOWER, AND STAFF RECOMMENDED CONDITION: WHEN THE HYDROTUBE IS VACATED OR ABANDONED FOR OTHER•THAN OPERATIONAL REPAIR OR MAINTENANCE FOR MORE THAN 180 DAYS, IT SHALL BE DISMANTLED, AND THAT PORTION OF THE PAVILION BUILDING SHALL BE RECONSTRUCTED TO APPEAR AS IT DOES TODAY, PRIOR TO THE BUILDING OF THE HYDROTUBE. Colors were clarified as blue, torquoise and light grey. MOTION CARRIED. Mr. Arvidson explained his reasons for voting no. He is of the opinion that the project is not in concert with the neighboring building design. Mr.,Coplen agreed with Mr. Arvidson and added concern for future long- term image of the area. PUBLIC HEARINGS A. 83 -3 -CUP, Hydrotube Recreation of Washington: requesting approval of a Conditional Use Permit to install an amusement center and commercial recreation including a hydrotube at the Pavilion Outlet Center, Southcenter Parkway at South 180th Street according to TMC 18.64.020(1) and (4). Ms. Berry read the staff report for reconsideration of application 83 -3 -CUP. Hydrotube at the Pavilion. MR. ARVIDSON MOVED THAT APPLICATION 83 -3 -CUP BE REHEARD. MOTION CARRIED. Chairman Kirsop opened the public hearing at 10:05 p.m. Mr. Buttars affirmed that the staff analysis is very fair. Mr. Collins stated that the original staff report presents the issues and alternatives. The final SEPA determination places two conditions on the Declaration of Non - Significance. The design approval conditions would also be valid conditions to place on the conditional use approval. Mr. Chris Brown, traffic engineer for the Pavilion Outlet Center addressed traffic signal issues. ARVIDSON MOVED THE PLANNING COMMISSION APPROVE APPLICATION 83 -3 -CUP, ACCORDING TO EXHIBITS A AND B THEREOF, SUBJECT TO THE FOLLOWING CONDITIONS: 1) THE PLANNING COMMISSION SHALL RESERVE THE RIGHT OF ANNUAL REVIEW OF THE CONDITIONAL USE. PERMIT. 2) PRIOR TO ISSUANCE OF CONSTRUCTION PERMITS, THE APPLICANTS SHALL PROVIDE A SUMMARY ANALYSIS OF TRAFFIC SIGNAL PHASING IN THE VICINITY OF THE PAVILION OUTLET CENTER WHICH WILL ANALYZE THE EFFECTS OF INCREASED TRAFFIC GENERATED BY THE PROPOSED WATERSLIDE ACTIVITY AND WHICH WILL SUGGEST MODIFICATIONS OR IMPROVEMENTS AS NEEDED. B. 83 -5 -CUP, Red Robin Restaurant Amusement Center: requesting approval for video game amusement center in the Red Robin Restaurant located on Southcenter Parkway, according to TMC 18.64.020(1). Ms. Berry read the staff report. Chairman Kirsop opened the public hearing at 10:45 p.m. Hearing no comment from the audience, Chairman Kirsop closed the public hearing at 10:46 p.m. Staff noted that earlier in the meeting Ms. Francie Hayes, manager of the Tukwila Red Robin had been present in the audience. MRS. AVERY MOVED THE PLANNING COMMISSION APPLICATION 83 -5 -CUP TO OPERATE A VIDEO GAME AMUSEMENT CENTER AT THE RED ROBIN RESTAURANT, SUBJECT TO THE FOLLOWING CONDITIONS: 1) BUSINESS HOURS FOR THE VIDEO GAME AMUSEMENT CENTER SHALL COINCIDE WITH RESTAURANT HOURS OF GENERAL PUBLIC ADMITTANCE. 2) THE PLANNING COMMISSION SHALL RESERVE THE RIGHT OF ANNUAL REVIEW OF THE CONDITIONAL USE PERMIT AS APPROVED. Mr. Martin Sandler, developer of the project, explained the street vacation issue which recently came to light via the title report. Mr. Lee Hanson, project architect, addressed sidewalk size for the project. MR. This application is presen- ted in concert with a request for a Conditional Use Permit (CUP) approval and is before the BAR as a condition of environmental assessment under State Environmental Policy Act (SEPA) pro- cedures. The applicant Hydrotube Recreation of Washington, Inc. may have changed their name to Family Recreation, Inc. per the SEPA checklist which was received by the Planning Department at a later date. The project site is located at the Pavilion Outlet Center in the now vacant space adjacent to the Bergman Luggage store. Additionally, a portion of the exposed hydrotube facility will extend above this space and over the roof area of the Bergman's tenant space. The enclosed space contains 9600 square feet of gross floor area. 2. The project includes installation of two enclosed fiberglass tube slides that ' are 411 feet in diameter partially filled with flowing water. They extend from a 56 foot high tower and empty into a swimming pool (411 foot deep) inside the building. Amusement rides may also be available in one end of the pool. The facility also includes dressing rooms and an area for food and entertainment, possibly video games. 3. Access to the hydrotube space will be provided directly through the interior mall concourse during regular hours. A direct exterior doorway on the west side of the building will be open for later evening and weekend hours when the mall is normally closed. 4. This portion of the site is zoned C -2 allowing commercial recreation /amusement centers by Conditional Use Permit.(CUP). (SEE, staff report 83 -3 -CUP) • 5. The front portion of the Pavilion Outlet Center is 25 feet in height. The proposed tower of the Hydrotube is about 56 feet in height, or 31 feet higher than the front portion of the Pavilion building. No additional bulk or landscape requirements are expected to be imposed by the proposed addition of the Hydro- tube. 6. Building materials for the project include fiberglass, metal siding and metal supports. The tubes are made of a blue translucent fiberglass with joints at approximately 6 foot intervals, supported by metal struts. The joints are flanged portions of the fiberglass tube sections joined together by metal bolts with fiberous gasket material in between. The tower and penthouse where the tubes enter the Pavilion are proposed to have metal siding. The penthouse is proposed to be a light yellow similar to the portion of the Pavilion Out- let Center. DISCUSSION TMC 18.60.050 specifies guidelines to be used by BAR in evaluating design proposals. The following is the staff response to each of the guidelines. 1. Re•Ca .i:on o h.ip o 6 Sttactate. to Site • Response: The design of the proposed hydrotube will change the image of the Pavilion Outlet Center. The,Pavilion is located on a large corner site, setback off of two arterial streets, with a parking lot separating the building from the streets. The Pavilion Outlet Center currently two portions of the building with different . architectural styles. The proposed hydrotube structural elements will introduce another prominent architectural design to the Pavilion site. The hydrotube's structural elements are large organic forms which are highly suggestive of motion; this design will contrast dramaticailZ with the more stationary, rectilinear masse of the Pavilion Outlet Center. 2. Rthx.ti.on4hJp o f St/Lactate and Site to Adjoining Anea Response: The Pavilion is located some distance from existing business• development sites on its westerly and southerly exposures. On the north and east sides, the Pavilion is adjoined by low - profile structures which have little or no direct window access toward the Pavilion. However, the introduction of the hydrotube as an unscreened addition will increase substantially public per- ception of the center's prominence, especially from the southerly and westerly street scape and the developable air -space in the immediately surrounding vicinity. It is exactly this result that the project designer intends to achieve both through the . unique configuration of the hydrotube's physical design and through its intended activity appeal. In order to evaluate the proposed hydrotube design, it should be examined in the context of its neighborhood setting. In a 1967 design study, Professor Kevin Lynch identified the presence. of activity Modes or visual /activity focal points as one of the elements needed for a vital and interesting community form. The focal point or node concept can be created in a number of ways, one of which is the introduction of a visual form or type of activity which is so unusual relative to its surroundings that it becomes a memorable image in the minds of'its observers. It is p bable that the unique appearance of the hydrotube will quickly cause the Pavilion to assume the identity. of a community activity node Jiy expanding the retail orientation of the" business district to include an entertainment environment. It will also become a memorab e, visual focus which calls attention to itself, to the Pavilion, and to the general southwest geographic. sector of the Tukwila commercial community. 3. Landscape and Site Tneajment Response: The hydrotube will not affect the existing landscape of the Pavilion, nor add any more requirements. Staff feels that the exterior effects of lighting the hydrotube may be a key feature In the design of the project and should be given iven adequate attent2ol - during the review. The method of lighting, however, was not included in the design application, and no staff response can therefore be offered•at this time. 4. BuUding Design Response: The design of the hydrotube is intended to interject a recreation/ amusement attraction to the general public and calls attention . to itself and the center as a whole. The hydrotube attracts attention by use of colors, materials, texture, lights and lines that contrast with the existing building. The design of this portion of the Pavilion is presently a less assuming, low- profile, earth -tone building and is assumed to remain unchanged except for the addition of the unenclosec_drotube structures on the roof of the existing building. The blue fiberglass tubes introduce the concept of motion or activity as water and riders move downwards into the building from the tower. The fiberglass tubes at their highest point stand approximately 23 feet above the existing roofline, from which they slope gradually downward, winding their way into the penthouse and enter the Pavilion building. The horizontal distance of the tubes are approximately 62 feet on the north and south sides and 73 feet on the west and east. The nature of the fiberglass tubes will appear to change the visual appearance of the tubes according to the amount of natural and artificial light playing on tube surfaces. The tubes are supported by metal struts in several locations. The struts draw attention vertically and support the tubes at joints that are spaced every six feet or so. The tower also draws one's eyes upward, as it is tall and narrow.. The height of the tower is approximately 56 feet or 51/2 stories =a:id doubles the height of this portion of the Pavilion. Specifically, it exceeds the height of the two story existing portion of the Pavilion by about 31 feet or 3 stories. The tower is about 15 feet wide on the'east and west sides and approximately 9 feet . wide on the north and south sides. The north side has a 4. foot extension in the upper segment of the tower from which the hydrotube extends from the tower. The exterior wall of the tower is proposed to have horizontal metal siding painted white or light grey. The tower metal trim and roof are proposed to be in blue tones, alternately the roof may be a warm grey. A logo may be requested in the design of the tower at a later date, per the sign code and property agreement. The penthouse is proposed to be a low•;.rectangular box where the tubes enter the building. It will have a yellow metal siding, designed to match the appearance of the rear portion of the Pavilion. The bright colors (applicant's choice X11) and metalic textures contrast with the subdued colors and textures of the Pavilion and nearby buildings. 5. CONCLUSIONS The design approach suggested in this application is clearly divergent fr4n�the� traditi al materials and relationships of space and mass which characterize much of t e.existing r an form of the City's commercial sector. As we have pointed out, the project is likely to create a popular activity Mode within an area which has no present point of public focus such'as the Christensen Greenbelt Trail on the east edge of the business sector. While the emerge of a prominent and accessible activity %ode may be viewed as a positive influence on the competitive economic vitality of the south end retail district, the Commission must judge whether the cost of achieving that obie_., cti_ve is too high in terms of the proiect's intensive and dominant visual impact on the streetscape. Resolution of this dilemma, in spite of whatever theorical guidance we can offer, remains a "judgment call" in . which the Commission must discharge its task as official arbiter of community., taste. The Board of Architectural Review has the responsibility.of TMC 18.60.030 to approve, approve with conditions, or deny the plans submitted using the aforementioned guidelines. STAFF RECOMMENDATION Staff's opinion is that the design of the hydrotube will have a definite visual, jmpact in the commercia district. It is intentionally designed to be prominent and will become a local landmark to some degree. In its consideration, Board of .Architectural Review should give careful study to the design of the project especially to the elevation plans for each, side of the Pavilion materials, colors -and lighting techniques in terms of general community values and particular iBpacts an tie commercial environment of Southcenter Parkwa . A number of conditions could be placed on design approval, 'ut most involve a high degree of community value judgment. Staff does recommend at least one condition: 1. When the hydrotube is vacated or abandoned for other than operation repair or maintenance for more than 180 days, it shall be dismantled, and that portion.• of the Pavilion building shall be reconstructed to. appear as it does today, prior to building the hydrotube. CVB /blk aril 28, 1983 CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT AGENDA ITEM IV) A. • 83 -3 -CUP Hydrotube at the Pavilion Since your decision to approve application 83 -3 -CUP at the March 24, 1983 meeting, the record of proceedings has been reviewed at some length by the Mayor, City Attorney, other city officials and the applicant. The Chairman of the Planning Commission and the applicant have agreed to place Application 83 -3 -CUP back on the agenda for reconsideration at the discretion of the Planning Commission. The City Attorney identified two areas of procedural concern which could potentially invalidate the Commission's prior decision; these concerns are: A) Conditional Use Permit /Design Review: Criteria three of the conditional use permit standards requires the Planning Commission to find that a proposed development is compatible generally with surrounding land uses in terms of traffic /pedestrian circulation and building /site design. Because of the inseparable relationship of design and use issues present in this application, it is the City Attorney's opinion that the B.A.R. and conditional use applications should have been reviewed on the same evening and not considered separately as was done. In fact, the City Attorney feels that design review should actually precede the matter of conditional use; therefore, the agenda for April 28th places the design review aspect of the hydrotube before re- hearing of the use permit. B) Environmental Review: In its initial review of the hydrotube proposal, the responsible official determined that this project was categorically- exempt. The City Attorney has indicated, however, that a categorical exemption is inappropriate and that the Planning Commission should have had the benefit of a threshold analysis prior to its decision at the March 24th meeting. Accordingly, a SEPA Checklist has been provided by the applicants and is currently under review. The result of that review and final threshold determination will be available to the Commission at the April meeting. For these reasons, therefore, the administration has serious concerns about the CUP approval decision made in March and has negotiated an agreement with the applicant to rehear application 83 -3 -CUP at the April 28th Planning Commission meeting following Board of Architectural Review action on the hydrotube proposal. As this procedure is somewhat unusual, the City Attorney and Planning Director suggest that the Commission take the following steps when the hydrotube CUP agenda item is reached: 1) Determine if the Commission wishes to re -hear the conditional use permit request. While it is the Commission's prerogative to decline re-hearing and allow .their March 24th decision to stand, it is likely that the administration will appeal that decision to the City Council. Any matter relevant to the use permit criteria may be raised by the public, the applicant or individual Commissioners, including items of concern noted in the re- introduced March 24th staff report. 4) At'the close of the public hearing, the Commission should then follow its regular procedures.of debate and arrive at a decision on the conditional use application. Staff urges the Commission to proceed with the rehearing as requested by the . Mayor and City Attorney so that any cloud of irregularity overshadowing the prior action on this matter may be removed. Mr. Joel Benoliel, attorney for the Benaroya Company introduced Mr. John Butters, operator of the Hydrotube facility and Mr. Keith. Vaughan, project architect. Mr. Benoliel requested the meeting be moved to the Police Training Room to view a video tape of the hydrotube facility located in Portland, Oregon. Chairman Kirsop agreed to the request. The meeting was moved to the Police Training room as requested by Mr. Benoliel. The meeting reconvened with a slide show presentation by Mr. Vaughan in the City Chambers. The slides illustrated the facility's interior, locker room, tower, entry, etc. f Page -2- PLANNING COMMISSION N, '1TES March 24, 1983 Mrs. Avery arrived. Mr. Benoliel explained the receptive position of the landlord and neighboring tenants at the Pavilion to the hydrotube. He feels that in all matters including health and safety the hydrotube will be an asset to the Pavilion. Mr.•Benoliel stated parking is a key item to the project and must be kept at a retail parking ratio of 2.5 per 1000 g.f.a., in light that a substantial portion business is after regular shopping hours and during regular hours most hydrotube users come in automobiles shared with family members who will be shopping; a type of cooperative parking.. Mr. Butters explained this location will be one of several in the King County area. In terms of safety, the hydrotube should be able to withstand most elements including earthquakes and extreme temperatures, however may be susceptible to wind danger. Mr. Butters stated there are 26 hydrotubes operating in this country. The hydrotube in Portland, Oregon is'the only one located in a shopping mall. In addition, nine hydrotubes are under construction, all in malls. Mr. Butters distributed to the Planning Commissioners a brochure illustrating the hydrotube. Most of the water slides are on land and outside a mall location. Financial reasons favor locating in .a mall (i.e., parking, security, lighting, consumers). The unknown variable is the long term liability. Several hydrotubes have been in operation for four years and appear to be doing well. Mr. Butters read a letter dated March 23, 1983 into the record from Mr. Arthur Bock, Eastport Plaza Mall Manager, stating the hydrotube has not created a parking problem at the Eastport Mall. Mr. Vaughan explained that the design will take into account potential water problems including steam, slick surface and pooling of water. Mr. Caughey stated an environmental review will address visual impacts on the hydrotube.. Mr. Kirsop stated that these questions of size of site and 'surrounding warehouses, etc. were dismissed in the staff report. Mr. Caughey said these issues would be addressed in the design review next month. The environmental checklist will be completed by the regular April Planning Commission meeting. Mr. Caughey explained the shallow depth of the pool, presence of lifeguards, steam problem or lack of, dressing rooms, dress code and swimming rules. Mr. Benoliel stated the bicycle rack at the Pavilion has had little use, but could be added to as demand dictates. Demographics of the area encourages the kids to ride there in the family car.while other family members shop. Chairman Kirsop said the parking ratio could be tested fora year at which time could be reviewed and amended. 'p -�- PLANNING COMMISSION 1CTITES March 24, 1983 Mr. Caughey said the Commission has two choices to consider: 1) approve the C.U.P. with the two staff recommended conditions accepting the parking ratio as retail at 2.5 per 1000 g.f.a., or 2) open the issue of parking classification to something other than retail such as public assembly thus amending the off -site parking C.U.P. Either option could be reviewed in one year. Discussion followed regarding the parking classification of the hydrotube. Hearing no further input from the audience Chairman Kirsop closed the public hearing at 9:35 p.m: A.consensus vote was taken regarding preferred parking classifications including retail, public assembly and public facility. The Commission was divided on all three classifications.. The Commission felt the hydrotube activity is similar." to a roller skating rink or bowling alley. Mr. Butters reviewed the traffic generated by the hydrotube in Portland recognizing the marketing strategy aimed at bringing in people during the less popular hours such as Sunday and Saturday mornings. Last year the highest sales day had 1300 tickets sold in a twelve (12) hour period or about 1170 individuals buying tickets f twelve hours Q 97.5 people per hour, assuming four people per car equals 24 parking spaces each hour. . Several of the Commissioners expressed that they are less concerned with traffic impacts as they are with visual impacts which will be addressed • through design review next month. MR. Whereas the existing street does not.have an established finished grade with associated storm drain and whereas certain underground utility sys- tems are not installed nor designed and whereas the width of said street has not been established and whereas the existing right -of -way is not sufficient; therefore, the sidewalk construction in connection with this .building permit is not required at this time. This letter agreement provides that at such time as the above conditions have been eliminated as a condition for the staying of the sidewalk construction, the propert owner at such time shall be given notice to construct said sidewalk in accordance with plans and specifications provided by the property owner and in compliance with the then, current City standards. Said sidewalk shall be constructed within ninety (90) days of notice delivered to the then property owner. The permits for said construction shall be required at that time. This letter is in reply" to your request for additional information describing those spaces ancillary to the Pool, .Deck, Hallway and Change Rooms, and Office areas in this project. The Food and Observation area will be set up with chairs and either small tables or counters for people to sit and enjoy snacks while they watch the riders of the Hydrotube splash down in the pool on behind the glass wall in front of them. There is no cooking planned for the refreshments beyond a rotating hotdog or other slow cooking device which requires no special ventilation. There will be no dishwashing on the premises as all food will be prepackaged and served in disposable containers. It will be a soft drink, hotdog and popcorn operation. There will be no admission charge and is intended to serve parents of the young- er riders and shoppers who wish to take a respite from shopping by watching an unusual recreation activity. The entertainment area is to have up to 60 video games or other entertainment devices ,and is intended to be used by people waiting to enter the ride area after buying tickets or while . waiting for the ride home. The Kiddie Rides area is intended to be used by children too small to ride the Hydrotube; the younger brothers or sisters of riders. There is a 48 inch height requirement which must be met by all riders who are not accompanied on the ride by a parent. The rides are approximately 7 feet in diameter and will accommodate 5 to 6 children at a time. The space will only allow installation of 3 or 4 rides so the capacity cannot exceed 15 to 20 children at maximum use. The Future Expansion area has no use planned at present and the City would have to be informed of any plan to use it. The future use would be some kind of water oriented 'ride or rides which have not been designed yet. The space 0 Mr. Beeler Page two 27 February 1984 exists due to the tube configuration required to keep the Hydrotube equipment from encroaching into the 10 foot setback from the top of the roof slope re- quired in the Zoning Ordinance. The area north of the pool is occupied by the tubes as they descend through the space. Only maintenance people will be allowed to enter that space west of line R and north of line 9. A note of explanation regarding how these facilities operate is in order at this point. As a policy matter, the Hydrotube operators stop admitting riders to the Change Rooms or the Pool /Deck /Stair area after the line of riders waiting to enter the tubes extends to the bottom of the stairway. That policy creates a theoret- ical maximum of 82 people in the ride area at any time. The number is derived by assuming one person per step and two on each landing not including the top landing. The proctor at the top of the stair regulates the flow of people by permitting entry to the tube so that the area at the bottom is clear when the current rider reaches the pool. These policies have been derived through experi- ence and, while not absolute, give a good idea of the number of people present and their flow through the ride when it is operating at full capacity. I hope this is sufficient to permit you to expedite the checking of this project as a lot of time has passed since the application for permit and my clients are naturally anxious. I received today the copy of the proceedings of the Hearing where the Planning Commission approved the Conditional. Use Permit. My concern is that it appears that additional requirements are being added to the permit at this time and I wish to carefully document the circumstances at each stage of the project for my clients so they understand clearly what is required of them and which agency is making each requirement. The space contains 9,600 square feet of floor area. This involves installation of a small indoor swimming pool and two large, enclosed fiberglass tubes or slides. Patrons will purchase tickets entitling them to ride the Hydrotube, through a series of curves and slopes, eventually exiting in the swimming pool. Initial review by the Planning Director and staff indicated that this proposed activity could be construed as an "amusement center" as used in Title 18.64.020(1) of the Zoning Code. Therefore, establishment of this use would require a conditional use permit under the criteria listed under Title 18.64.050. In addition, construction of the tubes and an enclosed staircase tower through which patrons climb to the top of the tube, will modify the appearance of a portion of the building exterior. Therefore, this is also an application for approval of the proposed exterior modifications by the Board of Architectural Review as required by Title 18.60, under the guidelines established by Title 18.60.050 of the Zoning Code. Due to the unusual nature of the proposed use and the unique character of the proposed exterior modifications, there will be available at the time of the public hearing a videotape showing a similar existing installation in a Portland, Oregon, shopping center. There will also be sufficient slides or other photographs so the Planning Commission will have a clear perception of this activity.
