The Tukwila Planning Commission approved the Conditional Use Permit for the Southcenter Mall .video game center at their regular July meeting, subject tothe:following conditions: 1) Installation of the ten-unit bicycle rack at the south entry to the mall, the type and placement .of which are subject to Police Department approval. 2) Business hours for the video game amusement center shall coincide with business hours for Southcenter Mall. 3) The video game amusement center shall be staffed by an . 'on- premise manager or floor supervisior at all times the facility is open for business. 4) The Planning Commission shall reserve the right of an- nual review of the Conditional Use Permit as approved. The Planning Commission may modify or revoke the Condi- tional Use Permit as provided in Seciton 18.64.070 of the Tukwila Municipal Code if substantial public safety impacts resulting from operation of the video amusement center are found. Now that the Conditional Use Permit has been approved by the Planning Commission, a business license may be authorized by the City Clerk's Office. AGENDA ITEM INTRODUCTION CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT . 82 -10 -CUP: Southcenter Mall Video Game Center Southcenter Corporation is requesting conditional use permit approval to operate a video game amusement center within the mall in the tenant space formerly occupied by a retail sound equipment distributor adjacent to the north side of Lucky Supermarket. FINDINGS: 1) TMC 18.64.020(1) requires conditional use permit review of any proposed operation of an "amusement center." 2) The proposed video amusement center will occupy about 1700 square feet and Will include approximately 50 devices. 3). An environmental assessment has resulted.in a finding by the responsible official that no significant impacts are anticipated. The Police Department has noted, however, that the video game center will most likely increase demand for, public safety services. CONCLUSIONS TMC 18.6,4.050 specifies criteria to be followed by the Planning Commission in approving a conditional use permit request. Our conclusions follow each. restatement of the criteria: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property of improvements in the vicinity of the proposed use or in the district in which the subject property is situated; Conclusion: Any detrimental impacts will mostly likely be confined to the mall and should not affect the community at large. (_21 The proposed use shall meet or exceed the performance standards that are required in the district it will occupy; Conclusion: The proposed use will conform with all performance standards of the C -P (Planned Business Center) zoning district. ( The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; MC/blk C Conclusion: As an internal tenant space, the use should have no identi- fiable effect on traffic and circulation at Southcenter, with one possible exception: The youthful age -group which will be attracted to the video arcade may make extensive use of bicycles as a means of travelling to the mall. The Police Department suggests'that a lockable bicycle rack near the south entrance to the mall next to Lucky's will help prevent bicycles from being left haphazardly on the sidewalk, and wi ll. discourage incidences of bike theft. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. Conclusion: The proposed use does not conflict with the provisions of the Comprehensive Plan. (5) A ZZ measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. Conclusion: To minimize the potential adverse effects of the video game center upon the mall and upon the wider community, the following measures are suggested: 1) Business hours of the video game center shall coincide with those of Southcenter Mall as a whole. 2) An on- premise manager or floor supervisor shall be on duty at all times the video game center is open. RECOMMENDATION Staff recommends approval of application 82 -10 -CUP to operate a video game amusement center at Southcenter Mall subject to the following conditions: • 1) Installation of a five -unit bicycle rack at the south entry to the mall, the type and placement of which are subject to Police Department approval. Business hours for the video game amusement center shall coincide with business hours for Southcenter Mall. 3) The video game amusement center shall be staffed by an on- premise manager or floor supervisor at all times the facility is open for business. 4) The Planning Commission shall reserve the right of annual review of the conditional use permit as approved.
