. 82 -17 -CA - Paint Manufacturing in M -1 Zoning District
INTRODUCTION
Daniel Boone Paints, Inc., acting through its legal counsel, has requested that
the City of Tukwila amend T.M.C. Section 18.40.020 to allow the manufacture,
processing and packaging of paint as a principally- permitted use.in M -1
zone. At this time, paint Manufacturing is permitted in.the.M -2 zone only.
It is the applicant's contention that paint manufacturing is . a non - nuisance
creating activity because its associated environmental impacts are controllable.
FINDINGS
1) T.M.C. 18.42.020 (2) defines the manufacture, processing, assembly or
packaging of chemicals;'paints, dyes, light metals, plastics, rubber,
solvents, soaps, wood and wood by- products, clay, coal, glass, enamels,
textities, fabrics, plaster, agricultural by- products, and animal
products or by- products (no rendering or slaughtering) as permitted uses
in the'M -2 (Heavy Industry) zoning district.
2) According to information supplied by the applicant, the following procedure
is followed in their paint manufacturing method:
"A tank is partially filled with binder, whether it be solvent -
based or water - based, and the proper pigments are then added.
These pigments usually come to the manufacturer in 50 pound bags.
These two components are then mixed to a homogeneous paste under
a high speed mixer, something similar to a kitchen blender, but
on a much larger scale. Then the remaining binder is added and
the mixture thinned, with either water or solvent, to produce
the finished product. The paint is then packaged and sold."
3) The applicants propose to locate their paint manufacturing business at
103 Nelson Place, the site which was formerly occupied by Highway Safety
Products Company which also produced packaged paints, and which is now M -1.
4) Section 18.40.010 (37) of the former zoning code allowed "paint mixing"
as a permitted use in M -1, although manufacturing" was still
classified as an M -2 activity. The code . did not offer a clear distinction
of difference' between "mixing" and "manufacturing."
5) Both Farwest Paint Company and Highway Safety Products Company produced
paint under the old zoning code while in the M -1 zone. While there is
no clear distinction documented in our records, it appears that the
matter of classifying these businesses as "paint mixing" operations was
debated and that they were so defined, thus allowing their presence in
M -1.

FINDINGS - Contd.
6) The present zoning code does not include "paint mixing" as a separate
use and makes no distinction between mixing and manufacturing paint.
7) According to the Tukwila Fire Prevention Bureau, the paint manufacturing
operation proposed by Daniel Boone Paints is classified as a "bulk
plant" as defined in Section 9.104 of the Uniform Fire Code.
8) Under Chapter 9 of the Uniform Building Code, paint manufacturing is to
be considered an H -2 occupancy.
CONCLUSIONS
1) In support of their request to reclassify their business as an M -1 use,
Daniel Boone Paints relies extensively on the argument that at least
two paint producers, either past or present, have used the identical
process Daniel Boone employs to make and package paints in the M -1 zone,
apparently with the City's consent and without significant environmental
degradation.
We cannot accord full value to this argument, however, since the old
controversy surrounding "paint mixing" and "paint manufacturing" has
been rendered moot by the new zoning code which clearly defines the
making and packaging of paint as a heavy- industry use. If we agree that
Farwest Paints was allowed to begin operation as a paint mixer, they
are at best a legal non - conforming use under present zoning laws of the
City. We would also draw the Commission's attention to the fact that
Gaco Western, Inc. has been producing paint and roofing materials in
the City as a bulk -plant for a number of years and has been located
in an M -2 Use District,
• 2) The Fire Department indicates that the manufacture of paint is considered
a hazardous activity with potential for extensive danger to surrounding
land uses in case of fire due to the quantities of flammable materials
present on the site and their combustion characteristics, as evidenced
by their UFC and UBC classification. In fairness to the applicants,
however, it should be noted that Daniel Boone Paints has worked closely
with our Fire Prevention Bureau to satisfy all fire safety and
protection requirements; it is the Fire Marshals opinion that full
compliance with all such standards is feasible in' this 'case, should
the Commission and Council approve the necessary change in land -use
regulation.
3) In many geographic areas of the City, M -1 zones occur immediately
adjacent to established residential neighborhoods, If the proposed
code amendment allowing paint production outright in M -1 is.approved,
a significant portion of the City's population may be exposed to the
potential hazards of paint production, as described by the Fire Department.

CONCLUSIONS - Contd.
4) Staff has consulted with the Regional Technical Services Office of
the U. S. Environmental Protection Agency in an effort to ascertain
the relative degree of environmental risk posed by paint manufacturing
operations. A copy of an EPA Development Document pertaining to
measurement and control of effluent products from paint production as
a point- source degradation of ground and surface -water quality is to be
furnished to staff, and is expected to substantiate the hazardous nature
thereof. While we are not suggesting that Daniel Boone Paints will
become a pollutor if allowed to operate in the City, we do believe
the EPA's findings relative to water quality impacts confirm the
wisdom of the City's current classification of paint manufacturing as a
heavy- industry use.
5) Staff has also attempted to understand the potential human health hazards
of paint manufacturing by contacting the Washington Industrial Safety
and Health Administration. The administrator with whom we spoke indicates
that the most prevalent worker - exposure complaints are received in regard
to noise and levels of solvent- vapor. (WISHA pointed out, by the
way, that Daniel Boone Paints' track - record in worker - health protection
is very favorable.) In order to control on -site solvent- vapor, it is
common practice to ventilate to the atmosphere, resulting in potentially -
detectable solvent odors off -site, if appropriate "scrubbers" are not
used or malfunction. (It should be noted that although 11ISHA receives
air quality complaints from the general public, their jurisdiction
does not extend beyond the site of point- source; off -site jurisdiction
rests with E.P.A. or PSAPCA). The administrator noted that some of the
powdered pigments used in paint production, such as cadmium oxide or
lead chromate used by Highway Safety Products Company in the past to make
yellow traffic paint, can be toxic in sufficient air -borne concentrations.
Again, we are not suggesting that Daniel Boone Paints, if allowed to
operate in the City, will be careless in the handling of raw materials
potentially hazardous to the health of their employees or to the health
of persons occupying surrounding lands; in fact, their experience in
Seattle indicates to the contrary. We do suggest that the WISHA findings
confirm the environmental hazards to health and air quality associated with
paint manufacturing, lending further credence to the classification of
this industry as an M -2 use,
RECOMMENDATION
Staff is aware that the reclassification of paint manufacturing as an M -1 use
will allow Daniel Boone Paints to begin operation at 103 Nelson Place. We
are also convinced that they probably would be a good neighbor to our community.
Unfortunately, the same code amendment which would help the applicant will
also open a substantial portion of the community up to the impacts of paint
manufacturing as we have'described them herein. We believe that the zoning
code's current classification of paint manufacturing•as an M -2 use is
appropriate for two reasons:
1) The potential environmental hazardsare buffeted by the geographic
isolation of M -2 use areas from more sensitive land use districts
such as low- density residential.

RECOMMENDATION - Contd.
2) The relatively scarce quantity of M -2 zoned lands in the City assures
that the community will be protected from inordinately high
concentrations of M- 2..business activities and their cumulative
environmental hazards.
Staff recommends, therefore, that the Planning Commission recommend to the
City Council "Do Not Pass" on Application 82 -17 -CA and that no change be
made to T.M.C. 18.40.020 or T.M.C, 18.42.020(2).

My name is William W. Boone. My current address is 1401
Dexter Avenue No., Seattle, Washington 98109, and I am the
president of Daniel Boone Paints, Inc. ( "Daniel Boone "). I
appear before you on behalf of Daniel Boone regarding its re-
quest for a Zoning Code Amendment change which would allow the
manufacture, processing and /or packaging of paints within M -1
zoned areas of The City of Tukwila.
Daniel Boone was formed by myself and my father in June,
1958. It has been at :the current location since that period of
time. Our present lease runs out at the end of this year.
STATEMENT -1
FACTUAL BACKGROUND OF PURCHASE OF
PROPERTY AT 103 NELSON PLACE, CITY OF TUKWILA
For some time I was aware as president of Daniel Boone that
our current facilities did not have adequate capacity to effec-
tively compete in our paint business. As a result, for many
years I have been keeping aware of any potential to purchase or
lease a facility which would have more adequate capacity for
our paint business. In early 1980, I became aware of property
at 103 Nelson Place, Tukwila, which was operated at that time
by Gerald Rieker doing business as Highway Safety Products,
Inc. In negotiating with Mr. Rieker, I became aware of these
facilities which included substantial underground storage and
paint mixing facilities which had been constructed, with all
required City approvals, in 1977. This property and related
facilities were ideal for what Daniel Boone needed to be more
competitive in the paint business. I was further aware at that
time that Mr. Rieker had operated as a paint manufacturer
within the City of Tukwila for many years, at least since 1974.
In June, 1980 I signed a Real Estate Purchase and Sale
Agreement with Mr. and Mrs. Rieker for the purchase of the

property and. related •facilities. The purchase price was
approximately Two Hundred Ninety Thousand Dollars ($290,000).

In addition, Daniel Boone Lint approximately Thirty Thousand
Dollars ($30,40 for paint equipment which was installed on
the property.
Thereafter, the closing of the sale was delayed because of
the bankruptcy of Mr. and Mrs. Rieker and other complexities
involved in the transfer of title. The sale finally closed in
July, 1981.
Despite this delayed closing, I made multiple contacts with
appropriate City officials about the property beginning as
early as May, 1980. To the best of my recollection, the fol-
lowing contacts were made:
1. Approximately in May, 1980 I met with Jim Hoel and
Doug Gibbs, both of the Tukwila Fire Department regarding the
property. These gentlemen told me at that time that there were
multiple additions to the sprinkler system which would be re-
quired as a condition to a paint manufacturing business being
operated on the property.
2. Approximately in June, 1980, Mr. Al Piepper of the
City of Tukwila, Building Department Manager made a tour of the
facility with me. At that time, he advised me of several
building structures. which Mr. Rieker had apparently constructed
without an authorized building permit. Mr. Piepper told me
that those structures would have to be removed as well as
significant repairs or demolition made to a 2,800 square foot
shed which was built with a permit but which had substantial
structural damage.
STATEMENT -3
3. On multiple occasions through June of 1982 I have had
contacts with Fire Department personnel concerning additions to
the facility requested by that department.
By July, 1982 I had complied with all requests by the City
of Tukwila representatives mentioned above. While the sprin-
kler system has not yet been completed because of a strike with
the Pipefitters Union, we have awarded a contract to W.A.
Bottling Company and we anticipate the work to be completed in
the near future. I estimate approximately Twenty -Six Thousand
Dollars ($26,000) was incurred by Daniel Boone because of this
work.
Having finally arranged to make all requested changes, and
in anticipation of my lease running out at the Seattle prem-
ises, I applied for a business license from the City of Tukwila
in early July, 1982. It was my intent at that time to transfer
all Daniel Boone painting operations to the Nelson Street
address. I was informed shortly thereafter, that I could not
obtain the business license because paint manufacturing was not
an allowable use within an M -1 zone I was, of course, deeply
upset given the nature of the obligation which I had assumed
for purchase of the facilities and the costs incurred for the
upgrading of such facilities at the request of various city
personnel.
By letter dated August 2, 1982, the City of Tukwila's
attorney confirmed to our attorneys that the license could not

be issued without amendment of the zoning code to allow manu-
facture of paints as a permitted use within a M -1 zone. The
request before you tonight was and is made as a result of that
decision.
DESCRIPTION OF PAINT MANUFACTURING
Paint manufacturing is a classic light industrial use which
should be permitted in a M -1 light industrial district. The
manufacturing and processing of paint which has been done at
the Nelson Street facility for many years prior and which I
desire to continue, does not involve any adverse activity in
terms of air pollution, water pollution, noise, vibration,
glare, or odor.
Paint is defined as a mechanical mixture or dispersion of
pigments or powders, usually opague, with an adhesive liquid or
medium. Paint, in various respects, has been around for thou-
sands of years, but only until 50 years ago has paint produc-
tion changed radically. Currently paint manufacturers rely on
their suppliers to obtain finished raw materials. The various
grades of raw materials.now determine the quality of the re-
sultant paint:
The steps in paint manufacturing are relatively simple and
straightforward. A tank is partially filled with binder,
whether it be solvent -based or water - based, and the proper
pigments are then added. These pigments usually come to the

manufacturer in 50 pound bags. These two components are then
mixed to a homogeneous paste under a high speed mixer, some-
thing similar to a kitchen blender, but on a much larger
scale. Then the remaining binder is added and the mixture
thinned, with either water or solvent, to produce the finished
product. The paint is then packaged and sold.
Since everything which enters this batch process remains
there, there are no wasteful by- products to cause pollution.
Any residues which remains from tank cleaning is saved and
added to the next batch production of the same paint.
The main ingredients in paint are binders, pigments, and
solvents. Binders can be oil based, similar to linseed oil, or
water based latex, similar to common white glue. Pigments are
mainly natural iron oxides, clays, talcs, silicas (sand), and
titanuim dioxide, an inert pigment to obtain white. Solvents
are either the commonly obtained thinners or water. The proper
combination of these materials produce the majority of paints
made today. Although the number of formulations are countless
and oftentimes very complex, the actual manufacture of paint is
relatively simple, safe, and clean process.
• I understand that the principle purpose of the M -1 light
industrial district. is to allow multiple usages which do not
involve air pollution,, water pollution, or excessive noise,
vibration, glare or odor. None of the activities involved in

the paint manufacturer as described above would be contrary to
any of these purposes.
I believe that the purpose of the M -1 Light Industrial Dis-
trict would be served by recognizing the manufacturing, pro-
cessing, and /or packaging of paints within the M -1 District.
Other Uses permited within a M -1 zone include the manufacture
of foods, the manufacture of pharmaceuticals, cosmetics and
drugs, the manufacture of bags, brushes, clay, glass, paper,
issues involving printing and publishing and the manufacturing
of previously prepared metals and plastics, including stamping,
dying, shearing and punching of metal.
I believe the manufacturing of paint has equal or less
impact in the context of air pollution, water pollution, noise,
vibration, glare and odor than any of such permitted uses.
CONCLUSION
This will give you my thoughts concerning the request of
Daniel .Boone for the Code Amendment change. To my thinking,
all we are asking is the right to operate a business within
your City which has been operated for many years in the past
and continues'to be operated today. The Nelson Street property
was purchased by Daniel Boone because this property and related
facilities would allow us become more competitive in our busi-
ness. Except for the changes requested by City personnel, we

are in a position to commence our business without any changes
to these facilities. They are ideal for what we need.
I would most appreciate your recommendation to the City
Council that our request for a zoning code amendment be

The City is aware of the necessity for your client to
obtain a business license for the manufacture of paints
at 103 Nelson Place in Tukwila. We are also aware of
the Court of Appeals decision in the J & B Development
Co. v. King County case. Nevertheless, is the
City's position that it cannot issue a business license
as requested. A business license could be issued for
any permitted use in an M -1 zone, such as warehouse storage
and wholesale and retail distribution.
Pursuant to the provisions of the new zoning code of the
City which became effective on May 4, 1982, the manufacture
of paint is not a permitted use in land designated as M -1.
As a result, the City cannot issue a business license to
your client unless either of the following steps are taken:
1. Daniel Boone Paints, Inc. seeks and obtains
a rezone of its property from M -1 to M -2; or
2. The text of the zoning code is amended to permit
the manufacture of paints as a permitted use in the M -1
zoning category.

If your client elects to have the property rezoned,
the appropriate forms may be obtained from the City's
Planning Department. If it wishes to seek to have the
zoning code text amended, I would suggest that you
draft the appropriate proposed.language and submit it
to Mr. Lionel C. Bohrer, President of the Tukwila City
Council, for consideration. Council procedures provide
that the matter could then be submitted to the appro-
priate Council committee for a recommendation. If
the Council decides to consider the proposed change in
text, the proposal then be sent to the Planning
Commission for a recommendation. The matter would then
be returned to the Council for action.
Either of the procedures described above will require
at least one public hearing.

INTRODUCTION
This Memorandum is submitted in support of the Application
of Daniel Boone Paints, Inc. ( "Daniel Boone ") for a Zoning Code

areas, this Application should be forwarded to the City Council
with a favorable recommendation for the requested Code Amend-
ment.
FACTUAL BACKGROUND
Daniel Boone is a family company which was formed by Bill
Boone and his father in June, 1958. It has operated at 1401
Dexter Avenue North in Seattle since that time. Its current
lease expires at the end of the calendar year.
In June, 1980 Daniel Boone signed an Earnest Money Agree-
ment for the purchase of property and related paint facilities
at 103 Nelson Place, Tukwila. The purchase price of the prop-
erty was Two Hundred Ninety Thousand Dollars ($290,000) and, in
addition, Daniel Boone paid approximately Thirty Thousand Dol-
lars ($30,000) for paint equipment which had been installed by
the prior owner. The prior owner of the property and paint
facilities, Mr. Rieker, had been operating as a paint manu-
facturer for many years, at least since 1974. Daniel Boone
intended to conduct the identical processing activities that
the City had allowed at the property prior to its purchase.
Prior to the closing of this purchase and thereafter, Bill
Boone had many contacts with both Tukwila Fire Department and

Building Department personnel. These contacts resulted in
directions from the City regarding installation of a sprinkler
system as a condition to operation of the paint processing
business at the facility, as well as the removal of multiple
building structures on the property which had been apparently
constructed by the prior owner without an authorized building
permit. Daniel Boone complied with all requests of the City,
at an expense in excess of Twenty -Six Thousand Dollars
($26,000).
In early July, 1982 Daniel Boone applied for a business
license. It was the intent of Daniel Boone to transfer all of
its operations to the Nelson Street address in order to be more
competitive in its operations. The license was denied on the
basis that paint manufacturing was not allowable use within M -1
zoned areas of the City. The Nelson Street property has been
vacant for over two years.
ARGUMENT
Paint Manufacturing Should Be
an Allowable Use Within M -1 Zone.
The purpose of the M -1 District -light industry is set forth
in TMC § 18.40.010:
The purpose of this district is to divide area appro-
priate for light industrial uses which are non -
nuisance activities in terms of air and water pollu-
tion, noise, vibration, glare, and odor.

The Code then allows multiple, specific uses within the M -1
District, including manufacture of foods, manufacture of phar-
maceuticals, including cosmetics and drugs, manufacture of
canvas, clay, clothing, furniture, glass, paper, and plastics as
well as other "similar and compatible uses of a light industrial
character."
The statement of William Boone submitted to the Planning Com-
mission identifies in some detail the activities involved in
paint processing. None of the activities involve any nuisance in
terms of air or water pollution, noise, vibration, glare, or
odor. Indeed, many of the activities involved in express allow-
able uses within the M -1 District are more adverse than activi-
ties involved in paint processing.
Daniel Boone submits, therefore, that the requested Code
Amendment is merely a reflection that paint processing is a light
industrial use which should be permitted within M -1 zoned areas
of the City of Tukwila.
Paint Processing Has Been Allowed
Within the City of Tukwila for Many Years.
The staff report submitted to the Planning Commission con-
cedes that paint processing has been allowed in M -1 zoned areas
for many years. As the staff report indicates, paint manufactur-
ing has been classified as an M -2 activity under previous zoning

codes of the City even though "paint mixing" was an allowable use
within an M -1 zone. The staff report states in part:
Both Farwest Paint Company and Highway Safety Products
Company [the prior owner of the Nelson Street Facil-
ity] produced paint under the old zoning code while in
the M -1 zone. While there is no clear distinction
documented in our records, it appears that the matter
of classifying these businesses as "paint mixing"
operations was debated and that they were so defined,
thus allowing the presence in M -1. (Emphasis added.)
The conclusion of the staff report regarding a "debate" and
the conclusion that Farwest Paint Company and Highway Safety
Products Company were "paint mixing" operations as distinguished
from paint manufacturing operations is without any factual foun-
dation in the record. Daniel Boone has reviewed all Planning
Department records relating to both businesses and it is clear
from such records that the City was aware that both businesses
were conducting paint processing activities and, indeed, that the
City encouraged and permitted such express use.
Copies of these documents will be submitted to the Planning
Commission for their review at the time of this Hearing. The
following are several examples.
In March, 1977 Highway Safety Products Company applied for a
building permit for the installation of underground tanks. The
nature of the business stated in such application was "manu-
factures and distributors of highway - related products." In the
Environmental Checklist submitted with such application, Highway

Safety Products Company stated that it was involved in a "manu-
facturing expansion." Concerning the proposed land use, there is
a comment on the Environmental Checklist by the City staff that
the proposal:
"will change use of property somewhat."
No further explanation or comment regarding the proposed land use
was given by the staff. On March 30, 1977, the City filed a
final Declaration that this construction and related operation
had no adverse impact upon the environment.
In April, 1977 Farwest Paint Manufacturing Company submitted
an Environmental Checklist for a comparable installation of
underground tanks. The checklist indicated that there would be
no pollution in terms of air, water, noise, or light and glare.
The City took no objection to such statements. Further, the
checklist stated very clearly that the construction involved:
installation of five (5) each three (3) thousand gal-
lon tanks and one (1) six (6) thousand tank.
The nature of this activity together with the name of the owner
" Farwest Paint Manufacturing Company" established the nature of
the proposed operations. In May, 1977 the City filed a Declara-
tion that this construction and related operations had no adverse
impact upon the environment.

The City's current determination that Daniel Boone's opera-
tion does involve a potential nuisance- creating activity is con-
trary to the City's prior determination regarding the construc-
tion of the underground tanks at both Daniel Boone's facility and
Farwest Paint Manufacturing Company's facility. Given this
history of acquiescences and express authorization, Daniel Boone
submits that it would be patently unfair and illegal to now pre-
vent it from continuing the identical paint operations at the
Nelson Street facility which have been conducted for at least
five or more years in the past.
Daniel Boone Has Complied With All City Requests
And Has A Vested Right to Conduct Its
Business at the Nelson Street Facility.
Daniel Boone purchased the Nelson Street Facility in order to
continue the identical paint operations which had been conducted
by the former owner. The purchase price included the land for
some Two Hundred Ninety Thousand Dollars ($290,000) and the pur-
chase of painting equipment which had been installed by the prior
owner for approximately Thirty Thousand Dollars ($30,000). In
addition, Daniel Boone has expended approximately Twenty -Six
Thousand Dollars ($26,000) at the direction of various City per-
sonnel for sprinkler systems and demolition of several structures
on the property.

At the time of this purchase, the Applicable Zoning Code
allowed paint mixing as an allowable use within M -1 zoned areas.
The Tukwila Comprehensive Zoning Ordinance, § 18.40.010(37)
allowed: [s]pray painting or paint mixing.
Effective April 20, 1982, the new Zoning Code does not allow
paint mixing activities as an express allowable use. Because
this change was made after Daniel Boone had purchased the prop-
erty in reliance that paint processing could be continued as it
had been in the past, Daniel Boone submits that it has a vested
right to continue the use of the Nelson Street facility which the
City had allowed under TMC § 18.40.010(37).
The City staff recognizes the good faith of Daniel Boone's
efforts to conduct its paint processing activities within the
City:
"In fairness to the applicants, however, it should be
noted that Daniel Boone Paints has worked closely with
our fire prevention bureau to satisfy all fire safety
and protection requirements; it is the Fire Marshall's
opinion that full compliance with all such standards
is feasible in this case, should the commission or the
council approve necessary change in land -use regula-
tion.
"(WISHA pointed out, by the way, that Daniel Boone
Paints' track - record in working - health protection is
very favorable.)

"Again, we are not suggesting that Daniel Boone
Paints, if allowed to operate in the City, will be
careless in the handling of raw materials potentially
hazardous to the health of their employees or to the
health of persons occupying surrounding lands; in
fact, their experience in Seattle indicates to the
contrary.
"Staff is aware that the reclassification of paint
manufacturing as a M -1 use will allow Daniel Boone
Paints to begin operation at 103 Nelson Place. We are
also convinced that they will be a good neighbor to
our community."
Given the nature of these findings, together with the prior
history of the City of Tukwila allowing paint processing within
M -1 zoned areas, and the City's direction to Daniel Boone requir-
ing modifications to its property at substantial expense, it is
submitted that the Planning Commission and City Council should
allow Daniel Boone to operate its paint processing operations at
the Nelson Street facility.
Daniel Boone Should Be Allowed to Commence
Operations at the Nelson Street Facility And Alternatives
to Requested Code Amendment Can Be Considered
It is apparent that the staff, while concluding that the
Application should be denied, was nevertheless sympathetic to the
hardship imposed upon Daniel Boone if it is not allowed to con-
duct its business at the Nelson Street facility. The financial

consequences of the City of Tukwila's not allowing Daniel Boone
to conduct its business is devastating.
The staff report conclusion is based in large part on the
potential impact of allowing other paint manufacturers to conduct
business within M -1 zoned areas. The staff report recommendation
concludes, in part:
"Staff is aware that the reclassification of paint
manufacturing as a M -1 use will allow Daniel Boone
Paints to begin operation at 103 Nelson Place. We are
also convinced that they will probably be a good
neighbor to our community. Unfortunately, the same
code amendment which would help the applicant will
also open a substantial portion of the community up to
the impacts of paint manufacturing as we have de-
scribed herein. We believe that the zoning code's
current classification of paint manufacturing as M -2
use is appropriate . . . ."
Daniel Boone disputes the ultimate conclusion that its paint
processing does involve any significant adverse impact in terms
of air, water, noise, vibration, glare or odor. Nevertheless,
the important issue before Daniel Boone is not how the code is
amended but rather that it is amended in such a manner as to
allow its operations to commence at the Nelson Street Facility.
In this regard, Daniel Boone Paints would suggest, as a
potential alternative, that paint manufacturing be allowed as a
conditional use within the M -1 District in the event the Planning
Commission or the City Council does not desire to allow such use
as a permitted use. This should satisfy any concern of the
Planning Commission because appropriate conditions could be

applied on a case by case basis. Based upon the staff comments
in its report, as well as several meetings which Daniel Boone has
had with the staff, it appears that Daniel Boone could comply
with any reasonable condition applied to its Business License.
Further alternatives, including a Code Amendment to allow
"paint mixing" within M -1 zoned areas or a potential classifica-
tion of paint manufacturing as an unclassified use would be ac-
ceptable if it would result in Daniel Boone commencing its opera-
tions at the Nelson Street Facility.
Daniel Boone is willing to discuss any of these alternatives,
or others, at the Hearing.
CONCLUSION
It is critical that Daniel Boone Paints be allowed to com-
mence its operations as soon as possible. The impact of the
City's not allowing Daniel Boone Paints to commence its business
in the near future will be financially devastating to the company.
The Nelson Street facility has now been vacant for approxi-
mately two years. Substantial work has been done at the request
of the City and at substantial expense to Daniel Boone. Daniel
Boone wishes to contribute and be a good citzen to the City of
Tukwila. The request of Code Amendment change or some alter-
native which would allow commencement by Daniel Boone of its

My name is William W. Boone. My current business address
is 1401 Dexter Avenue No., Seattle, Washington 98109, and I am
the president of Daniel Boone Paints, Inc. ( "Daniel Boone "). I
appear before you on behalf of Daniel Boone regarding its re-
quest for a Zoning Code Amendment which would allow the manu-
facturing, processing and /or packaging of paints within M -1
zoned areas of the City of Tukwila.
Daniel Boone was formed by myself and my father in June,
1958. It has been at the current location since that time.
Our present lease runs out at the end of this year.
FACTUAL BACKGROUND OF PURCHASE OF
PROPERTY AT 103 NELSON PLACE, CITY OF TUKWILA
For some time I was aware as president of Daniel Boone that
our current facilities did not have adequate capacity to effec-
tively compete in the paint business. As a result, for many
years I have been keeping aware of any potential to purchase or
lease a facility which would provide more adequate capacity for
our paint business. In early 1980, I became aware of property
at 103 Nelson Place, Tukwila, which was operated at that time
by Gerald Rieker doing business as Highway Safety Products,
Inc. In negotiating with Mr. Rieker, I learned that the prop-
erty included substantial underground storage and paint mixing
facilities which had been constructed, with all required City
approvals, in 1977. This property and related facilities were
ideal for what Daniel Boone needed to be more competitive in
the paint business. I was further aware at that time that Mr.
Rieker had operated as a paint manufacturer within the City of
Tukwila for many years, at least since 1974.
In June, 1980 I signed a Real Estate Purchase and Sale
Agreement with Mr. and Mrs. Rieker for the purchase of the
property and related facilities. The purchase price was
approximately Two Hundred Ninety Thousand Dollars ($290,000).

In addition, Daniel Boone paid approximately Thirty Thousand
Dollars (30,000) for paint equipment which was installed on
the property.
Thereafter, the closing of the sale was delayed because of
the bankruptcy of Mr. and Mrs. Rieker and other complexities
involved in the transfer of title. The sale finally closed in
July, 1981.
Despite this delayed closing, I made multiple contacts with
appropriate City officials about the property beginning as
early as May, 1980. To the best of my recollection, the fol-
lowing contacts were made:
1. In May, 1980 I met with Jim Hoel and Doug Gibbs, both
of the Tukwila Fire Department, regarding the property. These
gentlemen told me at that time that there were multiple addi-
tions to the sprinkler system which would be required as a
condition to a paint manufacturing business being operated on
the property.
2. In June, 1980, Mr. Al Piepper of the City of Tukwila,
Building Department Manager, made a tour of the property with
me. At that time, he advised me of several building structures
which Mr. Rieker had apparently constructed without an author-
ized building permit. Mr. Piepper told me that those struc-
tures would have to be removed as well as significant repairs

or demolition made to a 2,800 square foot shed which was built
with a permit but which had substantial structural damage.
3. On multiple occasions through June of 1982 I have had
contacts with Fire Department personnel concerning additions to
the facility requested by that department.
By July, 1982 I had complied with all requests by the City
of Tukwila representatives mentioned above. While the sprin-
kler system has not yet been completed because of a strike with
the Pipefitters Union, we have awarded a contract to W.A.
Bottling Company and anticipate the work to be completed in the
near future. I estimate approximately Twenty -Six Thousand Dol-
lars ($26,000) was incurred by Daniel Boone because of this
work.
Having finally arranged to make all requested changes, and
in anticipation of the lease expiring at the Seattle prem-
ises, I applied for a business license from the City of Tukwila
in early July, 1982. It was my intent at that time to transfer
all Daniel Boone painting operations to the Nelson Street
address. I was informed shortly thereafter that I could not
obtain the business license because paint manufacturing was not
an allowable use within an M -1 zone. I was, of course, deeply
upset given the nature of the obligation which I had assumed
for purchase of the facilities and the costs incurred for the

upgrading of such facilities at the request of various City
personnel.
By letter dated August 2, 1982, the City of Tukwila's
attorney confirmed to our attorneys that the license could not
be issued without amendment of the zoning code to allow manu-
facture of paints as a permitted use within an M -1 zone. The
request before you tonight was and is made as a result of that
decision.
DESCRIPTION OF PAINT MANUFACTURING
Paint manufacturing is a classic light industrial use which
should be permitted within an M -1 light industrial district.
The manufacturing and processing of paint, which had occurred
at the Nelson Street facility for many years prior and which I
desire to continue, does not involve any adverse activity in
terms of air pollution, water pollution, noise, vibration,
glare, or odor.
Paint is defined as a mechanical mixture or dispersion of
pigments or powders, usually opaque, with an adhesive liquid or
medium. Paint, in various respects, has been around for thou-
sands of years, but only until 50 years ago has paint produc-
tion changed radically. Currently paint manufacturers rely on
their suppliers to obtain finished raw materials. The various
grades of raw materials now determine the quality of the re-
sultant paint.
The steps in paint manufacturing are relatively simple and
straightforward. A tank is partially filled with binder,
whether it be solvent -based or water - based, and the proper
pigments are then added. These pigments usually come to the
manufacturer in 50 -pound bags. These two components are then
mixed to a homogeneous paste under a high speed mixer; some-
thing similar to a kitchen blender but on a much larger scale.
Then the remaining binder is added and the mixture thinned,
with either water or solvent, to produce the finished product.
The paint is then packaged and sold.
Since everything which enters this batch process remains
there, there are no wasteful by- products to cause pollution.
Any residues which remain from tank cleaning are saved and
added to the next batch production of the same paint.
The main ingredients in paint are binders, pigments, and
solvents. Binders can be oil based, similar to linseed oil, or
water -based latex, similar to common white glue. Pigments are
mainly natural iron oxides, clays, talcs, silicas (sand), and
titanuim dioxide, an inert pigment to obtain white. Solvents
are either the commonly obtained thinners or water. The proper
combination of these materials produces the majority of paints
made today. Although the number of formulations are countless

and oftentimes very complex, the actual manufacture of paint is
a relatively simple, safe, and clean process.
I understand that the principle purpose of the M -1 Light
Industrial District is to allow multiple usages which do not
involve air pollution, water pollution, or excessive noise,
vibration, glare or odor. None of the activities involved in
the paint manufactur as described above would be contrary to
any of these purposes.
I believe that the purpose of the M -1 Light Industrial Dis-
trict would be served by recognizing the manufacturing, pro-
cessing, and /or packaging of paints within the M -1 District.
Other uses permited within a M -1 zone include the manufacture
of foods, the manufacture of pharmaceuticals, cosmetics and
drugs, the manufacture of bags, brushes, clay, glass, paper,
industries involving printing and publishing and the manu-
facturing of previously prepared metals and plastics, including
stamping, dying, shearing and punching of metal.
I believe the manufacturing of paint has equal or less
impact in the context of air pollution, water pollution, noise,
vibration, glare and odor than any of such permitted uses.
CONCLUSION
This will give you my thoughts concerning the request of
Daniel Boone for the Code Amendment. To my thinking, all we

are asking is the right to operate a business within your City
a type of business which has already been operating for many
years and continues to operate today. The Nelson Street prop-
erty was purchased by Daniel Boone because this property and
related facilities would allow us become more competitive in
our business. Except for the changes requested by City per-
sonnel, we are in a position to commence our business without
any changes to these facilities.

reference to efforts by Daniel Boone Paints to obtain a busi-
ness license for the manufacture of paints at 103 Nelson Place,
Tukwila.
Daniel Boone Paints purchased the property located at 103
Nelson Place on July 15, 1981, from John S. Woodhouse, trustee
in bankruptcy for Gerald L. and Patricia L. Rieker doing busi-
ness as Highway Safety Products, Inc. As you know, the Riekers
had operated Highway Safety Products, a paint manufacturing
business at the above address for several years pursuant to
several permits issued by the City of Tukwila. For your ease
of reference, copies of the following documents relative to
Highway Safety Products are enclosed for your review:
1. Application for Building Permit dated March 23, 1977.
The application recites the following description of work:
"install underground tanks and construct paint factory in
existing building." The nature of the business is stated to be
"manufacturers and distributors of highway- related products."
2. Environmental Checklist, dated March 29, 1977, to
accompany the Application for Building Permit. The name of the
proposal is stated as "manufacturing expansion." (Page 1,

7. Voluminous Fire Department records evidencing several
inspections by the Tukwila Fire Department of the pemises as
owned by Highway Safety Company, Inc.
8. Building Record for 103 Nelson Place, showing permits
issued for underground tanks and storage building.
Our client has already had several contacts with City
officials concerning the operation of his business at the above
location, including:
(a) Meeting on or about May 1980 with Jim Hoel, Fire
Marshall, and Doug Gibbs, Fire Department Inspector, concerning
required additions to the sprinkler system.
(b) Meeting on or about June 1980 with Al Pieper,
Building Department Manager. Mr. Pieper toured the facility,
and instructed our client to remove to remove certain buildings
which had been built without permits or which had undergone
structural damage. These requests have been followed, at con-
siderable time and expense to our client.
(c) Several meetings with Fire Department officials,
most recently in June, 1982 with Ted Fear, at the premises.
The result of the meetings has been the award of a contract to
W.A. Botting Company for installation of a sprinkler system.
Finally, we are enclosing copies of documents concerning
Far West Paint Manufacturing Company, including:
(1) Environmental Checklist, dated
April 29, 1977 for the installation of underground
tanks (Page 1, item 5 and 6) and requiring no rezone
(Page 1, item 9) or land use changes (Page 5, item 8);
and
(2) Declaration of Nonsignificance dated
May 3, 1977 by Kjell Stoknes, Director, Office of

As you can see, this business competitor of our client has been
consistently allowed to operate a paint manufacturing business
within the City in an area zoned identically to our client's
property.
As you can see from the above, there is an extensive
history of use of the premises located at 103 Nelson as a paint
manufacturing facility. Equally extensive is the history of
contacts between the City of Tukwila and the owner immediately
prior to Daniel Boone Paints, evidencing an awareness by City
officials of this use. Moreover, there has been a developing
history of direct contacts between City officials and Daniel
Boone Paints concerning the operation of a paint manufacturing
facility at that location. Throughout this entire period,
there has been an underlying acknowledgment by City officials
that the location is suitable for a paint manufacturing busi-
ness. As you know, there is also a parallel set of approvals
given to Far West Paint Manufacturing Company, another paint
manufacturing company also operating in an area zoned iden-
tically to our client's property.
In light of the City's long history of allowance of paint
manufacturing within the M -1 zone, and in light of the reliance
by Daniel Boone Paints upon that course of action by the City,
we believe that the City, as a matter of fairness, is now
estopped from denying Daniel Boone Paints a business license
for the operation of a paint manufacturing business at the
above described location. In this regard, we are aware of J &
B Development Co. v. King County, 29 Wash. App. 942 (1981), in
which it was held that a county could be liable for negligent
enforcement of its building and zoning codes. We believe that
the City is estopped in this case, by virtue of its treatment
of Highway Safety Products, Far West Paints, and Daniel Boone
Paints, from denying Daniel Boone Paints a business license to
operate its business at 103 Nelson.
We wish to avoid any further legal action in this matter.
Our client only wishes to utilize his property as it has been
previously operated. Our client has evidenced a desire to
cooperate with the City and we look forward to conducting busi-
ness with your City.

This firm represents Daniel Boone Paints, Inc. The
City of Tukwila, through Mr. Larry Hard's letter of August 2,
1982, recently confirmed its unwillingness to issue a business
license to our client for the manufacture of paint products at
103 Nelson Place in the city of Tukwila. A copy of Mr. Hard's
letter is enclosed herein for your information.
This decision creates severe problems with my client,
which purchased this property from a former paint manufacturer
who had operated in the city at least since 1972. Further, we
are aware of at least one other paint manufacturer within the
city in an identically zoned area.
We appreciate that this is not the time to argue the
merits of this proposed change. We believe that you will find,
however, that the manufacturer of paint is not a heavy industrial
use. There are no significant pollutants added to the air. There
is no heavy equipment utilized in this operation, no significant
noise, no significant odor and no discharge of pollutants to the
ground, any water source or sewer system. In short, our client's
operation is a classic light industrial use which has previously
been permitted by the City for years within the M -1 zone.
With this in mind, and representing that we can provide
significant testimonial and document evidence establishing the
fairness and propriety of this requested change, we request that
the City of Tukwila formally amend its zoning code to allow the
following as a specific use with an M -1 zone: the manufacturing,
processing and /or packaging of paints.

1. Per UFC Sec. 10.113, "At every required exit
doorway, and wherever otherwise required to
clearly indicate the direction of egress, an
exit sign with letters at least 6 inches high
and readily distinguishable shall be maintained ".
2. All sprinkler drawings shall be prepared by
companies licensed to perform this type of work.
Drawings shall first be approved by the Wash-
ington Survey &.Rating Bureau, then by the Tukwila
Fire Dept. No work shall commence without approved
.drawings.
I strongly suggest that Highway Safety

Highway Safety Products Environmental Questionnaire
After reviewing your concerns on the Environmental Questionnaire for Highway
Safety Products, I called the plant manager, Mr. Chet Clipse. According to
Mr. Clipse the facilities proposed will not increase water consumption due
to the fact that it is a "mixing" process only and will involve only the
chemicals and substances in the underground tanks. Also,.according to Mr.
Clipse, no discharge from the process will enter sanitary sewers. He states
.that there will be "no discharge" from the operation, except for a "bad batch"
which will be placed in an empty underground storage tank. This "bad batch"
will be pumped out at a later time and disposed of.
For your information, the Planning Division is recommending a negative
declaration on the proposal.

Dear Planning Commission Members:
We are writing to you on behalf of one of our members, Daniel
Boone Paints. As a Chamber we usually address general issues
rather than perform tasks of specific advocacy for our members,
however, when unusual situations arise which.merit our attenion
we do provide input and assistance. The matter of Daniel Boone
Paints' business license is such a situation.
Daniel Boone Paints is an employer who will provide jobs in our
community. In these economic times, we must be acutely aware of
our obligations to help business foster and prosper.,. This should
be a major factor in your decision, in that an adverse decision
would drive this business away from -our town. We don't believe
any of us really want this.'
Daniel Boone Paints acted quite responsibly in seeking'to locate
its business in Tukwila. It sought the.advice and counsel of
both the Fire and Building Departments to comply with all
necessary rules. No one at the time informed them that a zoning .
change was pending!
Daniel Boone Paints proposes a facility that is not offensive to
our community. The Planning Department recognizes this in .the
staff report to you. However, because of the fear of unknown
future problems, it is reasoned we should turn away Daniel Boone
Paints. We urge you not to proceed on this basis. We should all
work to foster business and.at the same time control it so it
does not impose unwarranted health, safety and environmental
problems to our community..
We are of the opinion that paint mixing, processing,
distribution, and sales, such as Daniel Boone Paints proposes,
should be allowed in our M -1 Zone, if not outright then by a
Conditional Use Permit. It is unfortunate the word

"manufacturing" has been used, because in our opinion Daniel
Boone Paints is actually mixing and processing paint, not
manufacturing paint. We believe that manufacturing goes to the
making of the ingredients for the paint and Daniel Boone Paints
does not do this. It also should be noted that Daniel Boone
Paints is in the business of— distribution of other paints and
also makes sales of paint to the general public. If the staff is
of the opinion that the town should have more control to protect
the community in some future situation, a Conditional Use Permit
will give them a handle on it. An outright ban, however, is
unwarranted and unnecessary.
One thing that should be kept in mind is that not only will this
business provide jobs and property tax revenues to the town, it
will also contribute sales tax revenues.
One of the primary concerns with the new zoning code was that
neither the City or the community wanted to create non - conforming
uses. We believe that if the Planning Commission and the City. •
Council had been aware. of Daniel Boone Paints' problem at the
time, they would have worked with Daniel Boone Paints so they
would have fit into the new code.'
One last point is the vested rights issue. We are not lawyers,
however, we feel there is at least a moral and ethical reason why
Daniel Boone Paints should be accommodated. They commenced
alterations of the facilities and installation of fire protection •
systems under the direction of the Building and Fire Departments
prior t� the new zoning code and were not made aware .of that
code. Did they not legally vest their rights? And if they did
not, in a technical legal sense, do we not as a community at
least have a moral and ethical 'obligation to them?
.Thank you for your attention to our comments. We hope you look
favorably upon Daniel Boone Paints remaining a part of our
community.
