At its regular meeting of 6 April 1981, the Tukwila City Council author-
ized the administration to prepare a letter indicating the City's con-
currence with the proposed reconfiguration of tax lot parcels in the
Parkway Plaza West development, per the attached Exhibit B. Accordingly,
you may proceed with negotiations on this matter at the Assessor's Office
with no objection from the City of Tukwila. We do wish to note, however,
that this action does not constitute _am form of land use or subdivision
approval.

In response to your letter of February 10, 1981, it is our belief based
on discussions with the King County Assessor's office that the proposed
tax lot reconfiguration should not have any measurable impact on the
City's property tax receipts.
The only real effect of the proposal is to put into one separate tax
lot all of the undeveloped hillside land which is currently divided
between three other tax parcels. It is assumed that the Assessor's
evaluation now takes into account the percentage of each such parcel
which is not developed because of the slope. Putting all of this land
into one parcel for tax purposes should not affect the total of the
real estate taxes assessed or paid for Parkway Plaza West.

At the City Council Committee -of- the -Whole meeting last night the matter of
city approval for reconfigured tax lots in the Parkway Plaza West complex was
referred to the Sub - Committee on Personnel and Finance. The Sub - Committee's
task is to research the fiscal impacts upon the City resulting from the proposed
change of tax lot boundaries. To assist the committee's work, therefore, we re-
quest that you supply to us a written quantitative analysis of the affect of the
proposed tax lot reconfiguration on the City's property tax receipts, When this
information has been studied by the Sub - Committee, they will offer a recommenda-
tion to the full Council to approve or deny the letter of concurrence.

SUBJECT: Parkway Plaza West Tax Lot Configuration (81- 6 -SPE)
This matter is a formal advisory transmittal from the Planning Department based on
a request from the Benaroya Company to modify the configuration of tax lot divisions
of Parkway Plaza West.
Let me explain the circumstances which bring this matter before the Council:
A) The Boeing Company, is principal tenant of Parkway Plaza West, and by lease -
agreement assumes the property tax liabilities for the office -tower site
and related parking area, as well as the undeveloped hillsides to the west.
B) No longer wishing to pay taxes on land they will never use, Boeing has asked
the Benaroya Company to arrange with the County Assessor to "divide off" the
hillside area as a seperate tax -lot and relieve them of its cost.
C) Representatives of the Benaroya Company have conferred with King County
authorities who have agreed to realign the tax -lots of Parkway Plaza West as
shown on Exhibit "B ", provided that the City of Tukwila give its written
approval thereto.
D) The Benaroya Company has asked the Planning Dept. for written approval. Af-
ter discussing the matter with the Acting Finance Director, it is her opinion
that dividing off the hillside area from the office parcel may have the af-
fect of slightly- reducing city tax revenue receipts. Thus, City Concurrence
in this matter is vital.
Normally, neither the Council nor the staff would get involved in the matter of
shaping property tax parcels. However, as the county has requested our consultation,
and as the proposed tax lot boundary adjustment can potentially influence city income,
staff recommends that the Finance /Personnel Sub- Committee be directed to study this
matter more thoroughly and then report back a recommendation to the full Council.

The Tukwila City Council Committee of the Whole Meeting was called
back to order by Council President Van Dusen, with Council Members
present as previously listed.
Mark Caughey, Acting Planning Director, said the Benaroya Company
has asked to modify the configuration of tax lot divisions of Parkway
Plaza West. The Boeing Company is the principal tenant of Parkway
Plaza West and by lease agreement assumes the property tax liabilities
for the site as well as the undeveloped hillsides to the west. They
do not wish to pay taxes on land they will never use so have asked

King County authorities have agreed to realign the tax -lots provided
the City of Tukwila will give its written approval. The Acting
Finance Director states that by dividing off the hillside area
from the office parcel it may have the effect of slightly reducing
city tax revenue receipts. Staff recommendation is that the matter
be referred to the Finance and Personnel Committee for study and
that they report back a recommendation to the Council.

LOT CONFIGURATION BE REFERRED TO THE FINANCE AND PERSONNEL COMMITTEE.

Mark Caughey, Acting Planning Director, said he had asked the
Benaroya Company if they would give the City the hillside for a trail.
Mark Caughey, Acting Planning Director, stated Schneider /Nilsen
Development is seeking to build the same building they have built on
the east side of Interurban Avenue on the proposed rezone site.
However, it is necessary to encroach upon the R -4 portion of the
site in order to provide a sufficiently sized surface parking area.
Since the R -4 zoning district does not allow commercial parking as
a permitted use, the rezone to C -1 is requested.
The Planning Commission reviewed the proposed rezone application
and recommended approval of the rezone action, but did not review
the proposed office project. The area affected by the rezone
application, as well as the entire project site, is bisected by
an existing city pedestrian trail. Relocation of the existing trail
system and vacation of a portion of the existing right -of -way would
be subject to Council approval. Review of the project itself will
depend on prior Council approval of a street vacation petition and
subject rezone. The western boundary of the rezone area extends
approximately to the 50' contour level. While this boundary is
acceptable for geographic purposes, development or related disturbance
above the 30' contour level would violate objective 3, policy 1, of the
"Natural Environment" section of the Comprehensive Plan discouraging
disturbance of slopes exeeding 20 %.
The Staff recommendation is that the Council affirm the Planning
Commission recommendation of approval of the Schneider /Nilsen rezone
according to following stipulations: (1) Any project proposed on this
site subsequent to Council approval of the subject rezone action
shall require BAR approval of site, architecture and landscaping
details prior to issuance of building permits. (2) The property
owner shall record a deed restriction running with the land
providing that no disturbance of existing contour or vegetation
above elevation 30' shall occur as a result of adjacent development
activity, except as necessary to maintain the existing Tukwila trail
system, with costs to be borne by the property owner.
