urged approval of the variance application.
Further discussion followed regarding configuration of the existing and
proposed driveways.
The public hearing was closed at 8:26 p.m. The chairman then requested
that the Board find whether each variance criterion has been satisfied.
Mr. Caughey, for the record, explained tht the Davis Case cited in Mr.
Bauch's comment was not a variance, but an administrative exception. The
difference is quantitative in the case of an exception versus a question of
proving hardship in a variance proceeding.

The Board discussed the appropriateness of limiting the period of validity for
which the variance may remain in effect before construction must begin.
Mr. Caughey requested that if the variance is granted, the front yard
setback be set at 23.5' instead of 19.5' as indicated on Exhibit "A ", to
comply as closely as possible with the concept of minimum degree of variance
approval.

Mr. Bauch noted that his appearance before the Board tonight does not
violate the appearance of fairness concept according to his discussions with
the City Attorney.

limit for a previously- approved front yard setback variance for a
single - family zoned lot on 59th Avenue So.
Mark Caughey summarized the principal content of the staff report.
Timothy O'Brien was present on behalf of the application; he explained
the need for additional time to secure financing of his proposed
construction. He reiterated that he is serious about building on this site
as soon as circumstances allow.
Mr. Caughey suggested that since the delay in construction is occasioned by

BACKGROUND
At its meeting of 5 March 1982 the
Board of Adjustment granted a
variance from TMC 18.12.080, reduc-
ing the front yard setback for a
proposed single - family lot on 59th
Avenue South from 30' to 12'. The
Board also imposed a one -year time
limit for construction to begin lest
the variance expire. Due to various
circumstances described in Mr.
O'Brien's attached letter, construc-
tion will not be started within the
one year time - limit; therefore, he
requests an indefinite time extension
for the variance approval.
81 -8 -V: O'Brien Setback Variance
1) Consistency with TMC 18.72.020 which provides:
DISCUSSION
In reviewing the record of the 5
March proceedings, it appears that the Board imposed the one -year time
limit for two reasons:
"A variance shall become void after the expiration of one year or
longer period as specified at the time of the board of adjustment
action, if no building permit has been issued in accordance with
the plans for which such variance was authorized, except that the
board of adjustment may extend the period of variance authorization
without public hearing upon a finding that there has been no basic
change in pertinent conditions surrounding the property since the
time of the original approval."
2) Desire of the Board to limit the approved variance to the exclusive
use of the original applicant.
Staff has researched the latter point with the City Attorney and discovered
that in fact a variance once granted becomes a vested property right. Un-
like a permit conditioned to expire with a change of ownership, a variance
runs with the land and passes with the land to a subsequent purchaser (Fox
v. Shriver - Allison Co. 28 Ohio App 2d 175 and Nuckles V. Allen 250 SC 123).
You may wish to bear this point in mind as you consider Mr. O'Brien's
petition for a time extension.

On March 5,. 1981 tke Board of Adjustlent reached a unaniaoua
vote ,decision 4A.favor.of.my variance application. The de
cision reduced the front yard setback requirement from 30
to •12!, for .a tingle family .home, thus allowing me to build
on this property.
Attached to the variance approval came a note which.indicated
that construction must - -begin on or before March 5, 1982,
otherwise the variance approval was to expire. This amend
ment to the approval was designed no that the variance could
be by me at that time and not go with the property in
the- future if sold. However, since that time the economic
conditions have tightened th`4 available construction money-
to-approximate/Y22%. I thii'k. moat of the board will agree
this is not an interest rate that promotes sound construction.
So, at this time .I hope the,'board will grant an indefinite
attention of the one year time limit.to construction. The
extension if the board wishes could include some wordage so
as only to allow myself the v ariance . This will allow me to
build` this project when conditionarare more favorable.

Chairman Richard Goe called the meeting to order at 8:09 p.m. in the
City Hall Council Chambers. All members were present except Ms.
Aitmayer who, by unanimous vote of the Board, was excused from this
meeting.

THE 8 JANUARY 1981 MEETING AS PUBLISHED. PASSED UNANIMOUSLY.
ELECTION OF OFFICERS'
Mr. Caughey noted that the Board's procedural by -laws require election
of officers at the first regular meeting of the new year. Following
the parliamentary process of nomination and election, therefore, the
board selected the following officers for the 1981 calender year:

PUBLIC HEARING
Application 81 -8 -V - (Timothy O'Brien) Requesting variance approval
from TMC Section 18.12.080 to reduce the front yard setback from 30'
to 12' for a proposed single- family home.
Mark Caughey presented the staff report. He then explained the set-
back relationship depicted on application exhibit "B". The setback
line as requested would be 12' from property line, and 20' from the
edge of curb as 59th Ave. is reconstructed.

Chairman Goe opened the public hearing at 8:19 p.m.
Timothy O'Brien, applicant, explained the topographic constraints which
necessitate the variance action, and described the understanding he has
with the resident to the south whose carport encroaches on his property.
In response to Mr. Duffie's inquiry, Gary Van Dusen, resident to the
south of the applicant's property, explained that the carport is not at
issue, and that he is favorable to the proposed variance.
Mark Caughey explained the rationale for the staff's recommended set-
back limits, citing staff's opinion that the subject property plus the
two sites to the south should be viewed as a unit for purposes of
establishing a consistent setback standard.
Mr. O'Brien displayed the house construction drawings, demonstrating
that only a portion of the enclosed garage would not conform to the
staff's proposed setback limit.
In reference to the "Quackenbush" variance discussed in the staff report,
Mr. Goe stated his recollection that the principal reason for the
Board's approval of that application had to do with sewer service con -
traints,'less than with lot topography.
Hal Resloch, resident in the vicinity, indicated he had received notice
of the public hearing, and indicated his support for the proposed vari-
ance.
Regarding the staff's comment on tree preservation, Mr. O'Brien stated
his intent to retain the formal "Christmas Tree ", but asked that he be
allowed to accomplish that purpose without "dripling" restrictions. Mrs.
Regel commented that the proposed staff condition is probably inapprop-
riate.
Chairman Goe closed the public hearing at 8:56 p.m.; he asked staff to
read each variance criteria from TMC 18.72, and that the Board then
vote in the affirmative if the criterium is satisfied:

in Conference Room #3 to discuss this matter.

In this case, the maximum 30' depth
4) The site is wooded with small -trunk deciduous trees, and one large conifer
which was decorated in former years as the community Christmas tree.
5) The existing residence to the south is set -back 13.5' from the 59th Ave. right -
of -way line, to the front on the unenclosed parch. The setback distance to the
enclosed front wall of the house is 18 feet.
6) In June, 1979, the Board of Adjustment approved a reduced front -yard setback (15')
for the undeveloped site south of the aforemention.:existing house.. However,the
project was not constructed and the Board's action has expired.
7) TMC 18.60.080 authorizes the Board of Adjustment to modify the front yard require-
ment if either of the following two circumstances prevail:

1. "where the frontage upon the same block is occupied or partially occupied
by a building or buildings with front yards, some or all of which are of
less depth than required by this title" or
2. "where the topography of the ground is such as to make compliance with the
front yard requirements impractical"
CONCLUSIONS
1) Low- intensity, Single - family residential useage of the site is advocate both by
existing zoning and the City's comprehensive plan, due to the limited useable
building area resulting from extreme topography. Modification of the front yard
setback would allow construction of a home on flatter westerly portion of the
site without extensive excavation and sophisticated engineering beyond that which
is normally required for the conventional home.
2) Nearby lots on the same slope have front yards that do not meet the requirements
of TMC 18.12.080. Therefore, they enjoy privileges that new residences could
not have under the provisions of the Tukwila Municipal Code without relief from
the Board of Adjustment.
3) The applicant's intent to preserve the former City "Christmas Tree" will be
better - served by controlling the shape of the proposed residence, than by modi-
