SHIMATSU REZONE II COMPREHENSIVE PLAN AMENDMENT
COMPREHENSIVE LAND USE AMENDMENT
WHEREAS, a Declaration of Environmental Non - Significance
was granted by the City's SEPA responsible official on 21 September 1981
under City File EPIC - 172 -81.
WHEREAS, said Declaration of Mon - Signficance pertains only
to the legislative act of rezoning and reserves the City's option to
conduct separate environmental review for any project proposed subsequent
to the grant of rezone, and
WHEREAS, the Tukwila Planning Commission conducted a public
hearing on said rezone application on 24 September 1981 and resulted in
their recommendation of approval with one stipulation, and
WHEREAS, the City Council has duly considered the environmental
significance of the proposed rezone action, the recommendations of
the Planning Commission and the analysis by staff of site design and land
use issues associated with the proposed rezone.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASH-
INGTON, ORDAINS AS FOLLOWS:
Section 1: The real property which is the subject of this
ordinance is described in the attached legal description (Exhibit A) and
is shown on the attached zoning plat (Exhibit B).
Section 2: After reviewing the documents contained in Plan-
ning Department Master File 81 -31 -R, and having heard information presen-
ted by the property owner's representative, members of the public and the
Planning Commission, the City Council makes the following findings of fact:
A) The real property which is the subject of this rezone
request is described in Exhibit A, and is presently
zoned R -1 -7.2
C) The proposed rezone action will not be injurious to
peace, safety, health or general welfare of the community,
nor detrimental to property value in the immediate vicinity.

Section 3: Based on these findings.of fact, the Council makes
the following conclusions and conditions relating to and restricting use of
the subject property:
A) Commercial development of this site shall be limited to a depth
of 250 feet from the west margin of Southcenter Parkway, with no
cutting above toe -of- slope. Toe -of -slope shall be defined as
elevation 25' M.S.L.D. as it existed on 1 September 1981. No
disturbance of existing contour or vegetation above elevation
30' is permitted.
B) Development of this site shall proceed as generally- described on
Exhibit "C" of this application. The Board or Architectural
Review shall analyze site, architecture and landscaping.details
prior to issuance of.building permits.
C) Applicant shall post a performance bond to insure restoration
of the site's contour below elevation 25' and to reseed with
ground cover in the event that the development is not com-
pleted.

BACKGROUND
On November 3, 1981, the City Council
adopted Ordinance #1237 rezoning a por-
tion of the Mikami (Shimatsu) family farm
and homesite from R -1 to C -2 with the
stipulation contained in Section 3 (D)
that the minimum building setback dis-
tance from any property line shall be
twenty -five (25) feet. On January 28,
1981, Island Construction Company, repre-
senting the property owner and the site's
developer -of- record, drafted the attached
fetter requesting that the setback stipu-
lation be deleted. We shall attempt to
clarify the purpose of their request in
this report.
SHIMATSU REZONE ORDINANCE AMENDMENT
The 25' setback distance as now required resulted from a recommendation of the
project soils engineer in their letter of September 9, 1981 that surcharge
material placed to prepare the site so that structures could be supported on
conventional shallow foundations extend at least twenty -five (25) feet beyond
outside building lines. During the Planning Commission's Public Hearing on
the Mikami - Shimatsu rezone, this soils surcharge recommendation was translated
into a minimum building setback distance from any property line to ensure that
no portion of the surchage would encroach on surrounding property lines. The
applicants have now abandoned their intent to surchage the site in favor of a
treated pile foundation system not requiring placement of fill. The applicants
now believe that the need for the twenty -five foot setback requirement has been
obviated and request that Section 3 (D) of Ordinance #1237 be amended to reduce
or eliminate the extraordinary setback standard.
The project site plan as approved by the Board of Architectural Review indi-
cates that the twenty -five foot setback will be met or exceeded at all points
with the exception of the northwest corner of the building situated about twenty
feet from the the westerly site boundary. While the record is not completely
clear, it seems that the Planning Commission's intent in "locking in" the
twenty -five foot setback distance as a condition of zoning approval was moti-
vated equally by site - aesthetic considerations as well as the soils engineering
problem discussed above.

RECOMMENDATION
The applicant's suggestion that Ordinance #1237 Section 3 (D) be deleted and
that the normal C -2 rear setback distance of ten feet be allowed (TMC 18.28.
060 (a)) is not adequate to ensure protection of the adjoining hillside wood-
lands. We recommend, however, that the reduced figure of twenty feet be dis-
cussed as a reasonable compromise alternative. Should such a change meet with
Council approval, we request that the City Attorney prepare an appropriate
ordinance of amendment.

INTRODUCTION
The applicants are requesting approval
of a change of zoning classification
from R -1 to C -2 for 3.4 acres adjoining
the west edge of Southcenter Parkway.
The intent of this rezone is to allow
construction of a retail commercial
center similar in character and scale
of the Parkway Square development
across the parkway. However, the com-
mercial: project itself will require
more extensive environmental investiga-
tion before it is presented to the Board
of Architectural Review. Thus, the
Planning Commission is requested to act
only on the rezone legislative action
at this time.

FINDINGS
1) The subject rezone area is currently
Zoning Ordinance #251.
The rezone area is designated for "Commercial" uses on the Comprehensive
Land Use Plan.
3) A waiver from the Environmental sensitivity development restrictions of
the Comprehensive Plan was granted by the City Council on 15 September
1981. The following stipulations were attached to the Council approval
action:
a) Commercial development of this site shall be limited to a depth
of 250 feet from the west margin of Southcenter Parkway, with no
cutting above toe -of- slope. Toe -of -slope shall be defined as
elevation 25' M.S.L.D. as it existed on 1 September 1981. No
disturbance of existing contour or vegetation above elevation 30'
is permitted.
Development of this site shall proceed as generally- described on
Exhibit "C" of this application. The Board of Architectural Review
shall analyze site, architecture and landscaping details prior to
issuance of building permits.

The Planning Commission, in its Draft #4 zoning text and map, recommends
continuation of R -1 -7.2 uses on this site, with R -1 -12 use above the
steep westerly toe -of- slope.
5) The westerly portion of the rezone area above elevation 25' is steep
and heavily- wooded. The remainder of the site is relatively -flat and
marshy and rests 2 -4 feet below adjoining street level.
6) A Declaration of Environmental Non - Significance was granted on 21
September 1981 for the legislative act of rezone only. The City reserves
the right to require a separate environmental assessment for any pro-
ject proposed subsequent to the grant of rezone.
7) The property immediately- adjoining this site on the south (Wendy's
Restaurant) was rezoned to C -2 for a depth of 250' from the west margin
of Southcenter Parkway on 20 April 1981 by Ordinance 1210.
CONCLUSIONS
1) Commercial use of the rezone area is consistent with the Comprehensive
Plan. The Comp. Plan. recommends that "Commercial" uses extend all
the way up the slope to the I -5 margin. Staff questions the wisdom of
the Comp. Plan. in this instance, and believes that the Commission's
"Draft #4" recommendation of large -lot residential zoning above the toe -
of -slope is more in keeping with the environmental sensitivity of the
land.
2) The proposed C -2 rezone classification is inconsistent with the Commis-
sion's Draft #4 recommendation of R -1 -7.2 zoning west of Southcenter
Parkway. However, we believe that the higher- intensity use - category is
justified, due to the established commercial /industrial character of
surrounding land -uses, the accessibility of the site to the "business -
arterial" street system of the Southcenter area, and the precedent
"Wendy's" rezone case which established the allowable limit of commercial
zoning west of the parkway.
3) Approval action to intensify use of the rezone area will have negligible
environmental consequences. However, we anticipate that its subsequent
use as a retail - commercial complex may have serious environmental con-
sequences on traffic safety, air quality and the City's storm drainage
network. Therefore, actual review of the project should be undertaken
by the Board of Architectural Review once the environmental investigation
process is complete.
RECOMMENDATION
Staff recommends that the Planning Commission recommend to the City Council
that the Shimatsu Rezone. Application 81- 31 -R,as described on Exhibit "A ",
and as depicted on Exhibit "B ", be approved for reclassification from R -1 -7.2
to C- 2,'subject to conditions as follow:
1) Any project proposed on this site subsequent to City Council approval
of the subject rezone action shall require Board of Architectural
Review of site, architecture and landscaping details prior to issuance
of building permits. Building setback distances may be increased be-
yond those shown on Exhibit "C" if necessary to implement recommenda-
tions of the project soils engineer.

CONCLUSIONS
1) It is the consensus of the Planning Commission that the higher -

establish the allowable limit of commercial zoning west of the park-
way.

Any pipe line constructed by Grantee, its successors or assigns, across lands under cultivation at the

The terms, conditions, and provisions of this grant or any contract resulting from the exercise thereof

At your request we have completed our review of the revised
building layout with respect to the geotechnical aspects of the
project. At present it is planned to construct two buildings along
the western half of the project area with finished floor elevations
at 26.0. We understand that you now plan to support the buildings on
pressure treated timber piles rather than on a preloaded structural
fill as.had been previously planned. To achieve the planned site
grades, up to eight feet of fill will be placed over the project
area.
Discussion
Based on information presented in the referenced report we
believe that the alternate foundation design using end bearing timber
piles is appropriate for building support. Hence, certain criteria
for structural fill placement and surcharge fills in building areas
• no longer apply. Our previous recommendations had called for the
placement of fill twenty -five (25) feet beyond building lines to
reduce the influence of settlements of fill placed in adjacent areas
during future development. Since it is now planned to place fills
only to raise the present grade, and not to preload the site,
settlement of these fills can be expected to be independent of the
buildings and pile foundations.
In conclusion, we feel that since the building foundations will
be pile supported, it is not necessary to extend the fills twenty -
five (25) feet beyond building perimeters. Construction documents
should be amended accordingly.

DISCUSSIONS OF THE SITE PLAN:
2. A trafic study, or an updated study of the Wendys' traffic study.
From
city for the purposes of providing an eight foot wide walkway
or sidewalk along South Center Parkway. The existing area
now is only seven feet wide. In lieu of dedicating the one foot,
the owners may elect to provide an easement to the city. Mark
Caughey will investigate to see which approach will be necessary.,
will be required. Mark Caughey will provide a copy to Hayden
Island, Inc.
3. The car access from the street will require ten foot concrete aprons.
4. Mark Caughey will research and let us know if we have to hold -
the 25 foot set back from the rear property line, or whether
we can reduce it as we have shown on our site plan in the northwest
corner. (We have reduced it down to about fifteen feet). •
5. There is no specific landscaping width required for the side yards;
however adequate screening will be required. This will be.reviewed
when we submit our landscape plan.

.6. The street accesses can be wider than 30 ft., measured at the
property line.
7. Our building sign should be shown on the architectural drawings
for design review and can be reviewed at that time for compliance
with the code.
8. The parking layout was discussed, and the size of the parking
spaces as called for in the zoning ordinance may not overhang
the minimum requirements for setbacks or landscaping along
the east side; however the curbs may be pulled back to provide
bumpers or stops for the cars as required. A
9. Availability of site utilities was discussed and the developers
indicated that there is an existing agreement between the city
and the property owners in which the city agreed to provide
certain utility service to the property in exchange for a
15 foot utility easement. A copy of the agreement was given
to Phil Frazier who agreed to investigate the matter. The
question of availability of utilities was therefore delayed
pending'a decision on the city's responsibilities.
10. Sanitary sewer requirements were discussed and it was stated
that private side sewers must maintain ea minimum of 2% slope
and may be constructed of P.V.C. provided that minimum cover
is maintained. Sanitary sewers in the public right -of -way
may flow at 1.0% min., provided that a min. 2 ft. per sec.
velocity be maintained. It was proposed that a sanitary
sewer pump station be constructed inside the building per the
requirements of the King Co. Dept. of Public Health,(Uniform
Plumbing Code), and the State Dept. of Ecology.

Thii easement shall be a covenant running with the land and
shall be binding on the successors, heirs and assigns of both
parties hereto.
As part of the consideration for the granting of this easement,
Grantee expressly covenants and agrees with grantor as follows,
1. As a part of the construction and improvement of South center
Parkway (57th Avenue South), Grantee agrees to construct at
its cost and expense an extension of the ten inch water main
now located on the east side of'said street to extend the same
westerly across said street to the margin of the property
owned and retained by Grantor near the north boundary of the
Matt Mikami.property. Grantee further agrees to extend the
crossing of said water main at some other location on said
street in accordance with its comprehensive plan to the end
that an ultimate tying in of the system will occur between
the properties on the west side of said street and the
properties on the east side of said street within the city .

2. Grantee agrees as part of the construction and improvement
of South Center Parkway (57th Avenue South) to extend the
.existing twelve (12) inch sanitary sewer line now located on
the easterly side of said street to the westerly side of said
street at or near the southerly boundary of the property of.

3. .Grantee agrees to construct as part of the development and
improvement of South Center Parkway (57th Avenue South) a
12" storm drainage line within the ear ^ment area herein
granted, extending from the northerly margin of Grantor's
property southerly to the southerly margin of Grantor's
property. Grantee agrees to also construct five 12" tie -in
lines extending such drainage easterly across South renter
Parkway (57th Avenue South) to the'storm drainage line
paralleling South Center Parkway on the east side thereof
and to take and convey the waters emanating from oronerties
of the Grantor and properties to the west of Grantor to the
further storm drainage lines of Grantee and ultimately to
deposit the same in the Green River. Such storm drairaae
line shall be at no cost or expense to Grantor, extent as.
Grantor may be assessed under the local improvement district
formed by Grantee to develop improve and construct South
Center Parkway. The storm drainage line installed along
the west side of South Center Parkway shall be of the nor-
forated pine type to pick up ground water emanating from
said property and shall be further connected to the exist-
ing four box ditches and four tile lines now located on the
property of Grantors and as hereafter staked and located
by Grantors at the time of the commencement of construction
of the improvement of South Canter Parkway and the storm
drainage line herein described.
4. Grantee assures Grantor that the present•grade level of
South Center Parkway will not vary more than 18" to 36"
higher than the existing grade of the street now improved
upon the right of way of South Center Parkway. Grantee

further assures to Grantor adequate access to such improved
street at existing driveways of Grantor's property as well
as continued access during the period,of construction, with
the exception of the times during which actual paving of
said right of way is being accomplished. '
S. Grantee assures Grantor the right to lay and develop future
utility lines within such fifteen foot right of way as here-
in granted to Grantee for the purpose of serving the proper -
ties of Grantor with the necessary sanitary sewer, water,
underground power and other and similar utilities necessary
for the future service of Grantor's property.
6. Grantee assures Grantor that existina septic tank drainage
fields now serving residences located on portions of Grantor's
Dioperty will be replaced, extended and maintained in as good
condition as they are now, such renlacements or extensions to
be'located in areas of the property retained by erantors and
in accordance with the desires of Grantors.
7. Grantee agrees to extend a 3/4 inch water line connection
from the east side of South Center Parkway to the west side
of South Center Parkway to serve the residence of /Civet* Mikami, provided that Kiyoto Mikami will pay to Grantee the
.usual meter and connection charges provided by the ordinances
of Grantee at such time as Kiyoto Mikami shall avail himself
of a connection to the said line.

any further charges for the extension of such
lines, City agrees to construct as part of the
development and improvement of South Center
Parkway (57th Avenue South) a 12" storm drainage
line within the easement area herein granted,
extending from the Northerly margin of Grantor's
property Southerly to the Southerly margin of
Grantor's property. Grantee agrees to also
construct five 12 tie -in -lines extending such
drainage Easterly across South Center Parkway
(57th Avenue South) to the storm drainage line
paralleling South Center Parkway on the East
side thereof.
