The meeting was called to order at 8:11 p.m. by Acting Chairperson Wendy Morgan. All Board members except Mr. Goe were present. Staff representative present was Mark Caughey, Associate Planner. APPROVAL OF MINUTES MOVED BY MR. DUFFIE, WITH MRS. REGEL'S SECOND, TO APPROVE THE MINUTES OF THE 9 JULY 1981 MEETING. Mrs. Altmayer requested that the names of dissenting voters be recorded in the minutes when formal votes of the Board are noted. NEW BUSINESS A) Application 81 -35 -SPE: Leslie N. Davis - requesting approval of exception to the front yard setback requirements of the R -1 zoning district, as provided in the Tukwila Municipal Code Section 18.60.080. Property located at 16660 53rd Ave. South in McMieken Heights. In response to Ms. Morgan's inquiry, staff noted that the City Attorney has voided all testimony and conclusions resulting from the Board's meeting on this matter on 12 November 1981. Mr. Caughey presented the staff report and cover memorandum of 25 November 1981. He also explained the difference between an "exception" and a "variance" as one of consistency vs physical hardship. Mr. & Mrs. Davis and Richard Kirsop were present on behalf of the application. In response to Mr. Duffie, Mr. Kirsop explained that he has no objection to the proposed reduction in required front setback distance. MOVED BY MR. DUFFIE, WITH MRS. ALTMAYER'S SECOND, TO GRANT THE ADMINISTRATIVE SETBACK EXCEPTION DESCRIBED IN APPLICATION 81 -35 -SPE AS REQUESTED. Page -2- Board of Adjustment' 3 December 1981 Prior to the vote, Mrs. Altmayer suggested that the facts and findings discussed at the voided 12 November 1981 meeting be included in the present record. Ms. Morgan stated that the focus of discussion at that time was whether or not the proposed setback distance of 20' was in keeping with established setbacks in that neighborhood. MOTION CARRIED 4 -0. OTHER BUSINESS After discussion, it was the consensus of the Board that the staff must insure that graphic material included in the packets be of legible quality. In response to Ms. Morgan, Mr. Caughey explained that the 12 November meeting was voided because not all Board members had been informed of a meeting on that date, nor had notification of such an extraordinary meeting been given to the press as is required by law. It was the consensus of the Board that the communications procedures suggested in the staff memorandum of 24 November 1981 be followed in hopes of alleviating future confusion about meeting dates and staff report requirements. Mrs. Regel requested also that communications not be left at herd door, but that they should be mailed. Regarding the expiring terms of office, Mr. Caughey reported that the Mayor will attempt to fill the positions during the month of January. The Board requested the City Clerk to re -check the record to be certain that the expiration dates are accurate. After reviewing the record of these proceedings, however, the City Attorney has concluded that several irregularities occured in the meeting notification process. The attorney has advised us, there- fore, that it is necessary to re -hear the Davis application at the board's regular December meeting. The staff report as submitted at the last meeting is enclosed once again for your reference. • AGENDA ITEM • CITY OF TUKWILA PLANNING DIVISION INTRODUCTION The applicant is seeking relief through the Board of Adjustment to reduce the front yard setback requirement affecting the addi- tion of a garage to an existing single- family home in McMicken Heights. This request is not a variance application; thus, .134 the six criteria of TMC 18.72 are not applicable. The new garage strucutre is proposed at the same 20' front setback distance. 3) The depth of the subject property is 162 feet's per TMC 18.12.080, the normal front -yard setback requirement would be 30'. 4) TMC 18.60.080, however, provides for possible reduction of the front - yard setback requirement as follows: 18.60.080 Residential districts -- Modification of front yard requirements.
