SUBJECT: Board of Architectural Review Action - BSH Phase II
At its meeting of 24 September 1981, the Tukwila Board of Architectural
Review approved development plans for B.S.N. Phase II located at the
westerly terminus of Upland Drive. The Board's approval was based on
Exhibits A-lst Revision and B-lst Revision of the application, with the
following stipulations:
1) Prior to issuance of building permits, the applicant shall field -
stake the north property line of the site and the 50' setback
line to insure adequate field compliance with zoning regulations.
2) A fence or other comparable traffic control barrier shall be
constructed,;on the west edge of the rail easement depicted on
Exhibit "A" -1st Revision. Specifications for said barrier shall
be subject to Public Works Department approval.
Two parking stalls at the south end of the building shall be
eliminated to increase loading -area maneuvering space.
4) Signing to protect the two rail- easement crossing points shall be
installed per specifications of the Public Works Department.
5) Detailed landscape planting and irrigation specifications and
graphics shall be submitted in conjunction with the building
permit plan set.

Mr. Caughey presented the staff report, and Herb Bittman was present on
behalf of the application.
Discussion centered on defining an alternative solution to chain -link fencing
of the truck loading area. Frank Haverkamp, representing Union Pacific
Railroad, indicated their approval of the project but concurred with an alter-
native barrier approach to the suggested fence.
In response to Mr. Arvidson, Mr. Caughey stated that the precise alignment of
the Minkler Boulevard extension has not yet been defined.

B) Remodel Plan - 3M Building: Andover Park West
Mark Caughey read the staff report, and Fred Stumpf, Architect, was present
on behalf of the project.
Mr. Stumpf stated that the green - tinted glass spandrel panels used in the
existing structure are not readily attainable - therefore, they wish to use
a reflective glass throughout. After discussion, Chairman Kirsop stated the
consensus of the Board that use of such material is not generally encouraged
in this community.
Regarding sidewalk installation, Mr. Stumpf discussed some of the problems
associated with compliance and some potential solutions to the design ob-
structons already present. Mr. Caughey noted that the final solution would
be subject to approval by the City Council Public Works Sub - Committee.
MOVED BY MR. SOWINSKI, WITH MR. ORRICO'S SECOND TO APPROVE THE 3 -M BUILDING
REMODEL PLAN, ACCORDING TO EXHIBITS HAD _ "D" OF THE APPLICATION, WITH THE
FOLLOWING STIPULATION:
1) SIDEWALKS SHALL BE INSTALLED ALONG THE ENTIRE FRONTAGE OF ANDOVER

explained.

size and number of signs allowed under this application.

INTRODUCTION
A preliminary proposal for B.S.H.
Phase II was first presented to
the Board at the June, 1981 meeting.
At that time, several concerns were
expressed about access across the
adjoining rail easement and ade- ,"
quacy of setback distances from the
future extension of Minkler Blvd.
Exhibit A - 1st revision has been
submitted in response to those
site - design concerns, and Exhibit
B - 1st revision depicts a new
configuration for the 2 -story
warehouse /office building.
We have circulated the revised site plan to officials of the Unison
Pacific Railroad who inidcated that their previous concerns for a
more - limited, more - carefully identified access corridor have been
satisfied.. Whereas the previous site configuration allowed vehicles
to cross the rail-easement at random, the new concept restricts
traffic interface to two points, each at one extreme of the project.
Union Pacific has suggested that the fence proposed along the west
edge of the rail easement adjacent to the project loading space be
protected by a guard rail, since truck maneuvering in the area will
undoubtedly expose the fence to greater risk of damage. We consider
their suggestion valid in light of damage already sustained by the .
rail easement fence at Zach's Restaurant.
B) Setbacks
During the last review session, staff noted that the westerly exten-
sion of Minkler Blvd. along the north edge of the site is an imminent
priority of the City's street improvement program. The applicant has

provided a 50' setback from existing property line as required by the
C -M zoning ordinance. The precise alignment of the future Minkler
extension cannot be determined at this time, and it is difficult to
be certain that the provided setback will remain conforming once the
roadway width is finalized. However, the applicant has fulfilled
the present ordinance obligations.
The letter of agreement by which Union Pacific Railway has authorized
access across their trackage to serve this site specifies a minimum
20' setback from centerline of the tracks to the building edge. It is
not certain from the drawings that this condition has been met, and
the dimension should be added to the final site plan.
C) Maneuvering Space
The engineering staff has suggested deleting 2 of_ the 4 parking
stalls immediately- adjoining the south end of the building to increase
available area for truck maneuvering. Adequate on -site parking will
remain with deletion of these stalls.
RECOMMENDATION
Staff recommends approval of the development plan for B.S.H. Phase II
according to Exhibits A - 1st revision and B - 1st revision of the application
subject to the following conditions:
1) Prior to issuance of building permits, the applicant shall field -stake
the north property line of the site and the 50' setback line to insure
adequate field compliance with zoning regulations.

BOARD OF ARCHITECTURAL REVIEW
A. Development Plan - BSH Investments, Phase II. Requesting approval of
site and architecture for an office - warehouse complex at the easterly
terminus of Upland Drive.
Mark Cuaghey presented the staff report. Herb Bittman, Project Architect
was present on behalf of the application.
W. Bittman presented a revised site layout diagram which attempts to
address the matters raised in the staff report. The revised proposal res-
tricts access across the rail easement to two points, eliminates truck man-
euvering over the tracks and provides access to the future extension of
Minkler Boulevard. He emphasized his willingness to work cooperatively with
the City and the Union Pacific Railroad to resolve project concerns.
Frank Haverkamp, representing Union Pacific Railway, agreed with the areas
of concern expressed in the staff report. A copy of the rail easement
document was distributed and discussed.
' Mr. Collins described the work done to date on the proposed Local Improve-
ment District which will include improvement of Minkler Blvd. He emphasized.
the potential advantages to the property - owner, the railroad and the City
by accessing the site from Minkler Blvd. once it is improved.
After discussion, it was the Board's consensus to accept the staff's re-
quest for a continuance of this matter to allow further research on the
access issue.

to clarify your permitted use of Lot 4 in Upland's Tukwila
Industrial Park, Tukwila, Washington.
Site improvements indicated on the attached print titled
"Upland Drive Business Park" may be constructed providing:
1) That no permanent building improvement is constructed
closer than twenty (20) feet from the center line of any
railroad track.
2) 'The westerly railroad track indicated on the map may
be paved over to provide access to Unit K with the specific
requirement that you, your successors or assigns in interest
will not park on or within nine (9) feet of the track or
at any time block the track. Should this occur, the Union
Pacific Railroad continues to reserve the right to construct
fences or any other structures deemed appropriate to main-
tain the access, operation and integrity of the track. This
requirement also applies to the other tracks on the site.
Our operating department will be instructed to refrain
from the storage of boxcars on all tracks, especially the most
westerly. track. You are requested to place warning signs.at_.
two locations along the westerly track specifying an "Emergency
Access Firelane. Do Not Block ". This signing will help to
insure that no trains block access to Unit K for an extended
period of time.

DISCUSSION
Our concern with this project rests
almost exclusively in the area of
site access. As indicated on site
plan Exhibit A, the parking area and
warehouse loading zone are accessed at numerous points traversing the railroad
spur easement which now bisects the property. We are concerned about the po-
tential public safety impacts represented by the applicant's proposal to allow
unrestricted interface of automotive and rail traffic. It appears that this
topic was discussed during the Board's review of Phase I, but that detailed
analysis was deferred until future consideration of Phase II. Thus, we con-
sider the access issue to be fully open for reconsideration.
A. Public Works Department Concerns: The Public Works Director has reviewed
the project site plan and has severe reservations about its safety and
adequacy:
- There is virtually no control of railway /auto grade crossing, resulting
in a haphazard pattern of movement between vehicles and rail traffic.
- There does not appear to be adequate space to maneuver truck traffic at
the warehouse loading area without backing operations across the rail
easement.
- Use of "blind" aisles in the parking area may increase incidents of
backing movement, exacerbating accident potential.

back up space.
It is the opinion of the Public Works Department that the access /circulation sys-
tem as proposed is both inconvenient and unsafe. They do not object to a clearly
delineated, channeled crossing point over the railroad tracks (such as that de-
signed for the auxiliary parking area at Zach's Restaurant); they do question
the apparent randomness of the current circulation proposal.
Staff has also consulted with representatives of the Union Pacific Railroad re-
garding this project. Their official response from the Portland regional office
has not reached us in time to be included in this report; however, we expect to
pass on their comments to you verbally at the Public Hearing. Further, our
discussion with the local U.P. management staff indicates their concerns are
much the same as those of the Public Works office - -this is, access should be pro-
vided at a safely controlled point of interface, and vehicles should be physically
prevented from overhanging the clearance limits of the easements. Specifically,
we have asked the railroad's legal and engineering departments to provide the
following information.
- Does the easement document contain any verbage which restricts or controls
vehicle crossing configurations?
- Does Union Pacific Railroad have any internal standards or policies relating
to use of railway easements for access to private property or use as maneu-
vering space by vehicles entering and leaving the adjoining private lands?
The north edge of the Phase II site is adjoined by the right -of -way for future
expansion of Minkler Boulevard from Andover Park West to Southcenter Parkway.
At the present time, the City Council is working with our transportation con-
sultant group to prepare a Local Improvement District proposal for improvement
of Minkler Blvd., with actual construction to begin as early as 1982. Logically,
access to the Phase II site should come from Minkler Blvd. thereby reducing or
averting the need to interface with the rail easement surface.
CONCLUSION
At this time, staff feels that we have fairly well defined the questions perti-
nent to the site plan review process, but that we have not yet assembled an
adequate data base from which to generate the appropriate responses. It is
not often that staff requests a continuance on a specific application; however,
the complexity of factors impinging upon the circulation /access aspects of :the
B.S.H. project require additional time for adequate study. We suggest, then,
that the Board continue this application to the July, 1981, meeting so that
further consultation between the applicant, staff and outside agencies can
hopefully result in a consensus recommendation as to the most efficient and
safe design approach.

Pursuant to our meeting 13 July 1981, this letter will serve to clarify
the front yard setback for your property. It is the opinion of the City
Attorney and Public -Works Department that the extension of Minkler Blvd.
from Andover West to Southcenter Blvd. is essential to traffic improve-
ment in Tukwila. As you are aware a proposed traffic L.I.D. in the com-
mercial /industrial area lists the Minkler street extension as a very
high priority for improvement of traffic circulation and, in fact, suggests
the construction will be completed by 1983. Also, the Tukwila Six Year
Transportation Plan schedules the Minkler street extension for 1982 -1983,
and it is identified as the fourth priority item out of a total of 57
projects.
Hence, it should be recognized that, if the road is constructed as planned,
the front yard for the BSH Investment Project Phase II will be Minkler Blvd.
The Tukwila Municipal Code 18.32.030(c) Height, Yard and Area Regulations
states "the minimum setback from all publicly used rights -of -way shall be
adequate to provide a park -like atmosphere and at least fifty feet" for the
C -M district.
Structures standing within this setback will be designated nonconforming
upon the construction of the right -of -way. These structures are legally
allowed to continue existing, however all modifications made to the struc-
ture must be in conformance with the City of Tukwila Zoning Ordinance.

Subject: Development Plan - B.S.H. Investments, Phase II
Thank you for taking the time to meet with me yesterday regarding this
development proposal. The Tukwila Board of Architectural Review will be
meeting on 25 June 1981 to consider this application. As part of our
pre - hearing staff research effort, we are requesting consultation with
Union Pacific Railroad since a portion of an adjacent railway easement
may be affected by the project.
The enclosed plot plan depicts several points at which project - generated
vehicle traffic crosses the existing railway easement on the easterly
edge of the site. We are concerned that this design concept may repre-
sent a circulation safety hazard, and may violate the terms of the
easement agreement. Your official response to the following points of
information will be helpful to the Board in addressing these concerns:
1) What is the effective date and auditor's file number of the 30'
wide easement bi- secting the B.S.H. property?
2) Does that easement document contain any verbage which restricts
or controls vehicle crossing configurations?
Does Union Pacific Railroad have any internal standards or poli-
cies relating to use of railway easements for access to private
property, or use as maneuvering space by vehicles entering and
leaving the adjoining private lands?
4) Does the Union Pacific Railroad have specific comments to offer
on this project proposal which will become part of the official
record of proceedings?

OREGON - WASHINGTON RAILROAD & NAVIGATION COMPANY, a cor-
poration of the State of Utah, Grantee:
WITNESSETH, That Grantor, for and in considera-
tion of the sum of One Dollar ($1.00), the receipt whereof
is hereby confessed and acknowledged, has granted, bargained,
sold and conveyed and by these presents does grant, bargain,
sell and convey unto Grantee, its successors and assigns, a
PERPETUAL EASEMENT for a right of way for the construction,

relocation of railroad trackage over and across the land
situate in King County, State of Washington, described in

together with the right of ingress and egress to, from and

when necessary, removing said railroad trackage.

This easement is made subject to all outstanding
superior rights and to the right of Grantor to renew such
rights and to extend the term thereof, and subject also to
all conditions, limitations, restrictions, encumbrances,
reservations and other interests of any person with respect
to said land.
It is expressly made a condition of this easement
that if Grantee, its successors or assigns, shall abandon
the premises described in Exhibit A for railroad trackage
purposes, then and in that event all the rights herein
granted shall cease and determine and the title to the land
described in Exhibit A shall be relieved of the burden of
this easement; and it is further agreed that nonuser of the
easement herein granted for a period of one (1) year shall
be deemed an abandonment of said premises.
TO HAVE AND TO HOLD the above - mentioned easement
unto Grantee, its successors and assigns, forever.
