1. This permit is granted under authority of Chapter 159, Sessions Lava of 1935.
(Chapter 86.16. RCW)
2. No property rights are granted herein, nor does this permit absolve permittee
from liability for any damage which may be suffered to life or to property, public or
private, by reason of works, structures and improvements authorized hereunder.
3. This permit does not obviate the necessity of obtaining other permits required .
by federal, state, or local law.
4. The permittee shall remove, at his own expense, all falseworks, structures and
materials incident to the construction of the work herein authorized. Works and
structures erected under permit covering a specific period of time shall be removed by
the permittee at his own expense'upon - the expiration of said period or at the expira—
tion of any extension of time which may be granted.
5. Should permittee fail to remove, at the proper time, materials, works and
structures referred to under paragraph 4, the director reserves the right to have
it done at the expense of the permittee.
6. Any alteration of plans for works and structures made subsequent.to the filing
of an application or the issuance of permit shall be subject to approval by the director.
7. The director shall be notified by the permittee of the completion of works, under
this permit so the department may make final inspection and give final approval.
8. The action taken by the .department herein shall not imply or create any liability
for any damages against the state, as provided by RCW 86.16.100. .
9. When necessary to provide for the proper maintenance.or operation of the works,
structures, or improvements as authorized herein, the department may issue supplementary
orders providing for such.
10. This permit is subject to further special conditions as follows:
A. The water surface elevation for the Green River, with a controlled
discharge from the Howard Hanson Dam of .12,000 cfs as measured at
Auburn (Porter Gauge), is 26.0 feet (Mean Sea Level Datum) at the
site. The proposed finished floor elevation is shown to
be at elevation 26.5 feet.
B. Approval of this development and other applications will reduce the
storage area for flood waters, resulting in a higher elevation for
the 100 -year frequency floodplain, unless improvements are made to
discharge flood waters from the flood plain.
11. This permit is accepted subject to provisions of law and regulations ' 'and
conditions herein prescribed.

SUBJECT: TECTON PROJECT; SETBACK INTERPRETATION
Please forgive my delay in responding to your request for written confir-
mation of the setback computation methodology for this project. As I
stated to you verbally, setback provisions affecting the Tecton project .
are contained in Chapter 6 of the Tukwila Shoreline Master Plan. Specifi-
cally, a minimum distance of 40' between . the identified mean high water
elevation and the nearest wall of the building must be maintained. The trail
easement boundaries requested by the City which extend between the Tecton
building and the edge of the shoreline are not used for the setback cal-
culation baseline.

Tecton Project (Christensen Road) - Supplemental Shoreline Easement
On 9 April 1980, a Shoreline Management Substantial Development
Permit for construction of a multi -story office building on a
portion of the former Van Woerden property between Christensen
Road and the Green River was approved. You may recall that 1 acre
of the northerly portion of the Van Woerden site was dedicated to the
City last year, and is now under development design through an
I.A.C. Grant administered by the Recreation Department. As a
condition of the Tecton Shoreline Permit, an easement adjoining
the park site was required by the Shoreline official to complete
the Christensen Green Belt Trail System along the dike of the
Green River shoreline. The attached agreement will finalize
the grant of easement, and will allow the applicant.to
strengthen a portion of the easement for use as an emergency
fire access lane.
We urge Council to approve the accompanying resolution and
authorize the City Clerk to record this easement in favor
of the City so that pending development permits for Tecton
can be released.

In order to accommodate the desire of the City of Tukwila to develop and
maintain a recreational trail along the easement area on your property and
to assist you in devising plans for future, additional development of your
property, the City will permit you to use the recreational trail right -of-
way for installation of a fire lane as required by City regulations.
In the event that it is necessary for you to have a fire lane within the
easement area, a construction of said lane will be at your sole expense.
Assuming your full compliance with all applicable laws, rules and regula-
tions regarding the development of your property, this agreement should
allow you to develop the balance of your property in a manner similar to
that portion now under construction.

The following report, in letter format, concerns this office's recent archaeo-
logical test coring at the proposed Tukwila Development site. The work was under-
taken by Stephen Elmore on April 17 -18, 1980.
The proposed Tukwila Development site is located in an ox -bow of the Green River,
bounded by the Green River dike at the north and east, by Christensen Road to the
west and by an east -west line running from the point approximately 500 feet south
of the Christensen Road /Baker Boulevard intersection to the south. The property
is generally level, with old buildings of a former feed lot located in the northern
quarter of the property and pasture grass covering the remainder.
The test coring was carried out by laying out a 25 meter grid over the property
and taking core samples at each intersection of the grid to a depth of 150 centi-
meters. Soil from the cores was then observed for signs of cultural activity or
occupation (charcoal staining, lithic debitage, bone or shell, etc.) within the
matrices.
An extremely compacted fine - grained sand layer was encountered at various core
locations from a depth of 10 centimeters to 55 centimeters, and in these locations
it was impossible to core further. Of the forty core locations laid out on the
grid, 23 were impenetrable because of this compacted sand layer. The remaining
17 locations (42.59) were successfully cored and yielded no evidence of cultural
occupation or activity. Though the planned coring activity was reduced a large
amount by the compacted sand layer, the relatively even distribution of the suc-
cessful cores would tend to help reduce the likelihood of cultural occupation or
activity within the proposed development site, and each of the successful cores
indicated a sterile blue clay (generally associated with marshy areas) by the 150
centimeter level. Based on the lack of cultural influence being discovered within
the matrices of the successful cores, we would recommend that the project be al-
lowed to proceed.

Our recommendation should not be interpreted as permission to proceed with the
project in question. This report contains professional opinions on cultural re-
sources which might be affected by the proposed development. This report should
be submitted to the appropriate review agencies for their comments prior to the
commencement of any ground- disturbing activities.
Should, in the course of subsequent construction activities on the site, cultural
remains be discovered, work should be stopped immediately in that area and the
Office of Archaeology and Historic Preservation in Olympia should be notified with-
out delay. A qualified archaeologist should then assess the significance of the
find prior to resumption of work in that area.
We appreciate your concern for and interest in the cultural resources of the re-
gion and are happy to assist in the early stages of your project. Should you have
any questions regarding this report or our recommendation, please feel free to con-
tact this office at your convenience.

SUBJECT: STATUS OF VAN WOERDEN SITE SUPPLEMENTAL TRAIL EASEMENT
Following approval in July 1978 of a short plat and SMP to divide the Van Woerden
site into four parcels, the applicants agreed to dedicate a 20' wide shoreline
trail easement landward from the sites' river frontage and a one acre park site
on the north edge. City Ordinance 1066 accepted these dedications.
Subsequently, the 0.C.D. staff requested the applicants to provide a 25' wide
grant of easement adjoining the south edge of the park site in order to route
the Christensen Trail System along the top edge of the existing flood control
dike. The applicants prepared the easement document, in cooperation with OCD
Staff who contracted with Wilsey & Ham, Inc., to produce a legal description and
plat thereof at city expense. The property owners, Morris Piha Co., requested
that the easement document be recorlded by the City prior to 31 December 1979.
However, this was not done.
On 1 January 1980, the Piha Co. entered into an earnest money purchase contract
with Tecton Co. of California for sale of the Van Woerden site. In March 1980,
Tecton Co. filed an application with the City for a shoreline management substan-
tial development permit to construct a 3 -story office building on segregation
Parcel 1 adjoining the dedicated park site. On April 8, 1980, the Planning
Director requested Piha Co., as owner of record, to finalize the grant of easement
before the SMP was to be mailed to the Department of Ecology. Mr. Stan Piha
indicated that terms of the aforementioned earnest money agreement forbade the
addition of any new encumbrances on the property. Further, he stated that
finalization of the contract of purchase is contingent upon Tecton's securing a
valid SMP from the City.
Accordingly, I have taken the following actions with respect to the easement
matter:
1) Issued shoreline management permit 80 -4 -SMP and transmitted
complete package to Department of Ecology.
2) Imposed condition on shoreline permit to require recordation
of the trail easement prior to issuance of building /grading
permits for this site.

Grantor shall not use the surface of said easement, however, the property shall
be allowed by Grantee to be used in determining the property setback from the
property line, provided, however, that access to the trail for purposes of public
safety, including fire vehicle and police vehicle access, for the benefit of
serving Lot 1 shall be allowed.

Grantor, for and in consideration of the sum of one dollar ($1.00) and other
valuable consideration, receipt of which is acknowledged, Grantor grants, conveys,
and confirms to Grantee, its successors and assigns, a perpetual easement for
public access for the purpose of constructing and operating a recreational trail
open to the public, and related construction and improvements, accross and upon
the property described on the attached "Exhibit A" and further shown on the map

Grantee shall have the right without prior institution of suit or proceeding at
law, at such time as may be deemed appropriate by Grantee, to enter upon said
property for the purpose of operating, maintaining, repairing, replacing or

incurring legal obligations or liability therefor; provided, said operating,
maintaining, repairing, replacing, or reconstructing of a public recreational
trail or related improvements shall be accomplished in such a manner that private
improvements shall not be disturbed or destroyed. In the event they are dis-
turbed or destroyed, they will be replaced in as good a condition as they were
immediately before the property was entered upon by Grantee.
Further, Grantor shall have the right to construct the trail on the easement to satisfy any fir i
lane requirements of the Grantee for Lot 1. Access points to the trail for fire
lane purposes shall be the responsibility of the Grantor and should be complete
in conjunction with development of the property.

Grantee will provide and maintain landscaping for the entire easement area, as
felt appropriate by Grantee, based upon the use of the easement, the overall
trail plans and the surrounding environment. Consideration will be given in
developing a landscape plan to minimize any disturbance there may be from
trail users to any improvements that may be made on Lot 1. The trail surface
shall be located on the north and east side of the dike top, as described in
this easement.
This shall be a covenant running with the land forever and shall be binding on
Grantor's successors, heirs and assigns.

COMMENTS:
1) Prior to issuance of any permit for on -site work, especially filling or
grading, the applicant shall prepare a document setting forth strategy
to control construction - related noise, dust, vibration and traffic impacts
upon the community, and upon the river bank and wetlands.
2) Prior to commencement of site preparation, the applicants shall supply a
tree removal diagram describing the trunk diameter, height, specie, location
and health of all trees on this site to be removed or retained. Priority of
retention should be given to clusters or groves of significantly -sized tree
specimens.
3) Prior to commencement of site preparation, especially filling or grading,
an archaelogical investigation of this site shall be conducted at no: cost
to the city according to the method described in Alternative 2, Page 2 of the
23 May 1978 letter from the University of Washington contained in City of

ACCEPTING A DEDICATION OF CERTAIN LANDS ALONG THE
. GREEN RIVER FOR PARK AND RELATED PURPOSES.
WHEREAS, Southcenter Investors in desirous of developing certain land
along the Green River; and
WHEREAS, the developer is desirous of dedicating land along the River
to the City of Tukwila for park - related purposes; and
WHEREAS, the developer, acting under its own free will and volition and
without any consideration or other inducement from the City, makes this dedication.
WHEREAS, the City's adopted Park and Open Space Plan, as adopted by
Ordinance #964, shows this piece of property as desirable park property for the
City of Tukwila. (Reference Tukwila Park and Open Space Program, page 42, item 9.)
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DOES ORDAIN AS
FOLLOWS:
Section 1. A rivers edge trail on the east and park land on the west is
hereby accepted by the City of Tukwila as City park property pursuant to the .
attached map and legal descriptions. (SEE, Exhibit "A" and Exhibit "B" attached.)
Section 2. This land dedication is a desirable element of the Tukwila
Park and Open Space system and is a significant asset to the public.
Section 3. The dedication of this land to the City of Tukwila is
consistent with the goals and policies of the Shoreline Master Program in that
it does provide maximum access of the public to the Green River.
