Specifi- cally, a minimum distance of 40' between . the identified mean high water elevation and the nearest wall of the building must be maintained. The trail easement boundaries requested by the City which extend between the Tecton building and the edge of the shoreline are not used for the setback cal- culation baseline. You may recall that 1 acre of the northerly portion of the Van Woerden site was dedicated to the City last year, and is now under development design through an I.A.C. Grant administered by the Recreation Department. As a condition of the Tecton Shoreline Permit, an easement adjoining the park site was required by the Shoreline official to complete the Christensen Green Belt Trail System along the dike of the Green River shoreline. The attached agreement will finalize the grant of easement, and will allow the applicant.to strengthen a portion of the easement for use as an emergency fire access lane. We urge Council to approve the accompanying resolution and authorize the City Clerk to record this easement in favor of the City so that pending development permits for Tecton can be released. CID OF IU';: ;•.lA APR 2 3 1980 The following report, in letter format, concerns this office's recent archaeo- logical test coring at the proposed Tukwila Development site. The work was under- taken by Stephen Elmore on April 17 -18, 1980. The proposed Tukwila Development site is located in an ox -bow of the Green River, bounded by the Green River dike at the north and east, by Christensen Road to the west and by an east -west line running from the point approximately 500 feet south of the Christensen Road /Baker Boulevard intersection to the south. The property is generally level, with old buildings of a former feed lot located in the northern quarter of the property and pasture grass covering the remainder. The test coring was carried out by laying out a 25 meter grid over the property and taking core samples at each intersection of the grid to a depth of 150 centi- meters. Soil from the cores was then observed for signs of cultural activity or occupation (charcoal staining, lithic debitage, bone or shell, etc.) within the matrices. An extremely compacted fine - grained sand layer was encountered at various core locations from a depth of 10 centimeters to 55 centimeters, and in these locations it was impossible to core further. Of the forty core locations laid out on the grid, 23 were impenetrable because of this compacted sand layer. The remaining 17 locations (42.59) were successfully cored and yielded no evidence of cultural occupation or activity. Though the planned coring activity was reduced a large amount by the compacted sand layer, the relatively even distribution of the suc- cessful cores would tend to help reduce the likelihood of cultural occupation or activity within the proposed development site, and each of the successful cores indicated a sterile blue clay (generally associated with marshy areas) by the 150 centimeter level. Based on the lack of cultural influence being discovered within the matrices of the successful cores, we would recommend that the project be al- lowed to proceed. i Harley Jensen April 21, 1980 Page Two a Our recommendation should not be interpreted as permission to proceed with the project in question. This report contains professional opinions on cultural re- sources which might be affected by the proposed development. This report should be submitted to the appropriate review agencies for their comments prior to the commencement of any ground- disturbing activities. Should, in the course of subsequent construction activities on the site, cultural remains be discovered, work should be stopped immediately in that area and the Office of Archaeology and Historic Preservation in Olympia should be notified with- out delay. A qualified archaeologist should then assess the significance of the find prior to resumption of work in that area. We appreciate your concern for and interest in the cultural resources of the re- gion and are happy to assist in the early stages of your project. F i l e 80 -4 -SMP FROM: Mark Caughey DATE: 1.4 April 1980 SUBJECT: STATUS OF VAN WOERDEN SITE SUPPLEMENTAL TRAIL EASEMENT Following approval in July 1978 of a short plat and SMP to divide the Van Woerden site into four parcels, the applicants agreed to dedicate a 20' wide shoreline trail easement landward from the sites' river frontage and a one acre park site on the north edge. City Ordinance 1066 accepted these dedications. Subsequently, the 0.C.D. staff requested the applicants to provide a 25' wide grant of easement adjoining the south edge of the park site in order to route the Christensen Trail System along the top edge of the existing flood control dike. The applicants prepared the easement document, in cooperation with OCD Staff who contracted with Wilsey & Ham, Inc., to produce a legal description and plat thereof at city expense. The property owners, Morris Piha Co., requested that the easement document be recorlded by the City prior to 31 December 1979. However, this was not done. On 1 January 1980, the Piha Co. entered into an earnest money purchase contract with Tecton Co. of California for sale of the Van Woerden site. In March 1980, Tecton Co. filed an application with the City for a shoreline management substan- tial development permit to construct a 3 -story office building on segregation Parcel 1 adjoining the dedicated park site. On April 8, 1980, the Planning Director requested Piha Co., as owner of record, to finalize the grant of easement before the SMP was to be mailed to the Department of Ecology. Mr. Stan Piha indicated that terms of the aforementioned earnest money agreement forbade the addition of any new encumbrances on the property. Further, he stated that finalization of the contract of purchase is contingent upon Tecton's securing a valid SMP from the City. Accordingly, I have taken the following actions with respect to the easement matter: 1) Issued shoreline management permit 80 -4 -SMP and transmitted complete package to Department of Ecology. 2) Imposed condition on shoreline permit to require recordation of the trail easement prior to issuance of building /grading permits for this site. .
