Webster, Ir., Special Assistant Attorney General Paula Anne Mills Russell, Secretory City of Tukwila Boyd Annexation Action 80 -7 -A Notice of Intention - Supplemental Data Item 1: Geographic Setting The annexed territory is immediately contiguous to an established single - family residential neighborhood in the McMicken Heights area at the westerly edge of Tukwila. Homes and lot sizes within the annexa- tion area are comparable in scale to those within the adjoining incor- porated area. Topography of the area is gently - sloping from north -to- south. Single - family detached residential is the predominant land useage pattern for a least one mile west, south and north of the annexed area. East of the annexation area across the escarpment of Interstate 5 is the Southcenter Industrial and Commerce District which is well - buffered from the McMicken Heights neighborhood by extreme differences in land form and vegetation overstory. The annexed area is fully - accomodated by utility systems provided and maintained by a number of service purveyors. A complete discussion of service capacities is provided underi;tem 6 of this discussion. Item 2: Population of the Annexed Area At the time of the City's approval of the Boyd Annexation, nine (9) persons resided in the annexed territory. See line 12 of the Certifi- cate of Annexation filed with the State Office of Financial Management attesting to the area's population. Item 3: Comprehensive Plan The annexed territory is included in the City's Comprehensive Land Use Plan which was adopted in September 1977. The site is designated thereon as "low- density residential ", as are other properties situated nearby, (See, Exhibit A). Item 4: Development Potential Of the five parcels which comprise the annexation area, only one has the potential for subdivision and subsequent development. The Boyd Homesite, 16813 53rd Ave. South, can be further divided into three additional single - family lots of 9600 square feet each as provided in City zoning regulations. Item 5: Comparative Zoning Per Section 6 of Ordinance 1205, the entire annexation site is zoned R -1 -9.6 (single - family residential, 9,600 sq. ft. minimum lot size). Item 6: Service Delivery Infrastructure service delivery systems are already in place and are ade- quate in capacity for both the existing and potential development of the annexation area. The following table describes existing infrastructure components and identifies alternative agencies which might be available: All existing franchise agreements which serve the area, such as telephone, natural gas and cable television, will remain in effect and unchanged. Exhibits "J" through "M" show the generalized bound. Aries of service districts within 1 mile of annexation. • Police services, now provided by King County, will be provided by Tukwila. It is the routine practice of the Tukwila Police Department to respond to emergency service calls at the urban fringe in concert with County forces. Thus, no appreciable difference in police services are anticipated in the annexation area. Fire protection, for the immediate future, will be pro- vided by District 23. Eventually, fire protection responsibility within Tukwila west of 53rd Ave. South may be assumed by the Tukwila Fire Depart - ment following negotion of service boundaries. Item 7: Influence of Existing County Policies There are currently no other County policiesor regulations adopted sub- sequent to the County's Comprehensive Plan which directly affects the annexation area. The emerging "General Development Guide" under prepara- tion by the King County Planning Division staff will designate this area as "Urban ", and will not necessarily inhibit further infilling development. Item 8: Taxation Differential While a detailed, quantitative analysis of this topic is beyond the scope of this report, some general observations may be noted regarding the fis- cal impacts of this annexation. First, Tukwila is generally - acknowledged Page. -3 80,741_ . to..have.one of the lowest taxation rates of any jurisdiction, in Washington State. While the County consolidated levy rate will remain constant even after annexation, such items as the road levy, library levy and service charge for fire protection will be removed, slightly- decreasing millage and resultant real estate taxes. We believe that annexation of the proposed area will benefit the residents thereof not only with lower -costs for public services, but with enhanced response time from critical safety and health agencys of the city government. C. D. Tyler, 16833 53rd Avenue South, said he is one of he people involved. He has reviewed the legal description on the petition and finds errors. There are five lots involved and the dimensions of the lots don't match. Mr. Tyler explained the discrepancies. He asked about fire protection and utility services and was told they would not change. He asked about the tax base and was told they would be assessed in accordance with the Tukwila tax structure which is about 1 mil cheaper that the County. Mr. Tyler said he is not against the annexation. He felt the legal description should be corrected and Mayor Todd assured him that it would be if it was wrong. He said RCW 25.02.170 p ohibits the use of centerlines to define annexation boundaries. e petitioners have proposed to use half- street segments of South 168th and South 170th Streets as their boundaries. If the Council accepts the petition it appears that a revised plat and legal descrip- tion adhering to property and right -of -way lines only should be provided. The petitioners have met with representatives of the Fire and Public Works Departments and determined that adequate traffic and emergency service access is available to the annexation area without opening South 168th Street to 53rd Avenue. He said he would suggest that instead of taking just part of the block that the annexation take the entire block of four streets. This would also clarify political jurisdictions. Mr. Caughey suggested this annexation request go to the Community Affairs Committee for study. He said his office would help formulate guidelines. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE BOYD ANNEXATION PETITION BE PUT IN THE COMMUNITY AFFAIRS COMMITTEE FOR STUDY. MOTION CARRIED.
