Enclosed is a copy of City of Tukwila Shoreline Management Substantial
Development Permit 80 -7 -SMP and related materials. The subject permit
has been approved by this office after processing in accordance with
the Shoreline Management Act of 1971 and the State Environmental Policy
Act. This permit is in compliance with provisions of the Shoreline
Master Plan Program adopted by this municipality.
The subject permit will allow remodeling and change of use for two ex-
isting buildings to allow the manufacturing and retailing of candy pro --
ducts.

General's Office, we have determined that you may obtain building permits
from the City to construct interior improvements to manufacturing Building "A"
of your property at 14040 Interurban, without waiting for finalization of the
Shoreline Management Permit process. The enclosed letter to D.O.E.. explains
our findings in greater detail.
Please contact Mr. Pieper in the City Building Department for further assis-
tance in processing your interior improvement permit application.

During our conversation this afternoon, I described to you the general facts
concerning a building permit request filed with our office to convert an .
existing concrete products manufacturing facility to a candy manufacturing
plant. During that. conversation I presented the following facts about this
matter:
•
1) The subject site is directly adjacent to the Green River within
the city limits of Tukwila.
2) The subject building was constructed prior to enactment of the
Shoreline Management Act.
3) The applicant wishes to obtain a building permit for interior
improvements only, with exterior improvements limited to mainte-
. nance and repair.
Our discussion has given me the following understanding of your office's advice
in regard to processing this application:
1) Standard substantial development permit application procedures should
be undertaken for the change of use only on the converted manufacturing
building.
A building permit for interior improvements to effect conversion of
the manufacturing structure to candy production may be issued to the
applicant prior to completion of the substantial development permit
process for change of use.
3) The building permit issued under step 2.above.rou1d. allow the applicant
to begin the conversion process;. however, actual production of finished
goods could not begin until the substantial development permit for
change of use is finalized by D.O.E.

Following our conversation, I checked with the
Department of Ecology to receive its comments on the ap-
plicability of the Shoreline Management Act to remodelling
and reconstruction work contemplated by Mr. O'Dell in con-
nection with the relocation of Hazel's candy factory to the
Aden Corporation site on Interurban Avenue.
Mr. Norman Kirkham of the Department of Ecology
stationed in Redmond, Washington (telephone: 885 - 1900)
brought to my attention several important aspects of the
Shoreline Management Act which might have bearing on your
decision as to whether or not Mr. O'Dell is required to
comply with the Act.
First, he called my attention to RCW 90.58.030(3):
"(d). "Development" means the use con-
sisting of the construction or exterior
alteration of structures; dredging, drilling;
dumping; filling; removal of any sand,
gravel, or minerals; bulkheading; driving of
piling; placing of obstructions; or any
project of a permanent or temporary nature
which interferes with the normal public use
of the surface of the waters overlying lands
subject to this Chapter at any state of water
level;

of the state; except that the following
shall not be considered substantial develop -,
ments for the purposes of this Chapter:
(i) Normal maintenance or repair of
existing structures or developments, including
damage by accident, fire or elements . . ."
Since the Shoreline Management Act only applies to
activity that comes within the definition of "development,"
it appears that the alteration of the interior of the buildings
involved in the applied -for building permit do not come within
the scope of the Act. That being the case, it would seem to
be safe for the City to issue its building permit for the
activity involved in the reconstruction within the existing
structures without the necessity of compliance with the
Shoreline Management Act.
To the extent that there are other portions of the
proposed construction activity that consisted of external
type construction, it might seem proper to continue the
existing procedure initiated by publication earlier this
week with respect to that portion of the activity alone and
issue the building permit for the noncovered activity at
this time.
I would be pleased to discuss this with either
your office or the City Attorney if either of you have any
questions. Alternatively, Mr. Kirkham has indicated that he
would be able to lend any technical assistance that you
might request.
I hope that this will assist you in processing
this matter.
