Please be informed that the Planning Commission approved said application with the following conditions: 1. The subject we permit shall be valid only for the period of 30 June to 3 July 1980 inclusive. 2. The staging area for lodging and feeding of circus animals shall be located as far to the east of the Doubletree Inn as practical to minimize disturbance to guests at that faci- lity. Now that the conditional use permit has been approved by the City's Planning Commission, a business license may be authorized by. the City Clerk's office. Chairman Kirsop convened the regular May meeting at 8:05 p.m. in the City Coun -. cil chambers of Tukwila City Hall. Other commissioners in attendance were Mr. Arvidson, Mr. James, Mr. Orrico, and Mr. Richards. Fred Satterstrom re- presented the planning staff. The minutes of the regular April meeting were reviewed. MOTION BY MR. JAMES AND SECONDED BY MR. ORRICO TO APPROVE THE MINUTES OF THE 24 APRIL 1980 MEETING. MOTION APPROVED. Mr. Statterstrom read the staff report on the conditional use permit applica- tion by Circus Vargas. Mr. James Heathfield, Marketing Manager for Circus Vargas, explained the layout of the circus operation and the manner in which the tent would be erected. Also explained the location of the animals involved in the show and agreed to locate them as far to the east as possible away.from possible interference with the operations of the Doubletree Inn. MOTION BY MR. ARVIDSON AND SECONDED BY MR. ORRICO TO APPROVE THE CONDITIONAL USE PERMIT FOR CIRCUS VARGAS SUBJECT TO THE FOLLOWING CONDITIONS: 1. THE CONDITIONAL USE PERMIT SHALL BE VALID ONLY FOR THE PERIOD 30 JUNE TO 3 JULY 1980 INCLUSIVE. 2. . MOTION CARRIED WITH MR. RICHARDS VOTING N0. • Mr. Satterstrom read the staff report on the development plans for. Record Stationery/ Office Supply. . Lee Hanson, architect for the project, explained the details of the layout and operations of the proposed development. , . Discussion of the Planning Commission largely concerned itself with the graphics and signing aspects of the proposal. ..Mr. Kirsop stated that he thought the City should exercise restraint in authorizing additional sign area.. Mr. Richards said he thought many things could be done architecturally to stimulate the design of a building in lieu of graphics /supergraphics. 1 ing Commission( ( Page 2 tes of Reg. Mtg. 29 May 1980 2 June 1980 Mr. Arvidson stated that if the building were sold at some time in the future, the Record Stationery graphics might be painted over and the building would then becom"nondescript ". Mr. Hanson stated that in his opinion the advertising aspect of the proposed mural could be separated from the graphic aspect. Discussion then related to the precedent - setting .nature of the proposal. Com- mission discussed the International Harvestor sign of four years ago where a sign was felt to be an "integral part of the main building design." Generally acknowldeged that this signage was a structural part of the building as opposed to present proposal before the Planning Commission which was merely paint added on to a building. Mr. Jerry Lee, graphics man representing the applicant, explained their favor- able experience in the City of Renton. Suggested that their concept might appear to be a "can of worms" but could be beautiful once implemented. Mr. Al Pieper, Building Official, reviewed various parts of.the sign code with the commissioners. Stated that the code might not allow the full 150 sq. ft. sign area maximum. Discussion followed regarding placement and size of signs allowed by the code. Mr. Richards stated he felt that the mural might potentially become an advertis- ing logo for the company. Said he felt there was a difference between supergraphics which were relevant to a building and graphics which were relevant to a business, the latter constituting a sign for advertising purposes. MOTION BY MR. ORRICO AND SECONDED BY MR. RICHARDS TO APPROVE THE SITE AND DEVELOP- MENT PLANS AS DEPICTED IN EXHBIT D BUT TO EXCLUDE FROM THIS APPROVAL ANY GRAPHICS OR SIGNING AS PRESENTED. MR. JAMES MOVED TO AMEND THE MAIN MOTION BY REQUIRING A.5 -FOOT LANDSCAPE STRIP ON THE SOUTH SIDE OF THE BUILDING AND AN OUTSIDE _:TRASH_ AREA SUBJECT TO PLAN- NING STAFF APPROVAL. MR. TUKWILA PLANNING COMMISSION Minu s prepared by: r" - v red at erstrom, Planner Eileen Avery, Secretary 26 May 1980 AGENDA ITEM IVa INTRODUCTION Again this year, as in years past, South - center Shopping Center will sponsor a tradi- tional "Big -Top" circus event within its parking area. In addition to the main arena,' the parking area will be used to hold tempo- rary living quarters for circus employees, as staging areas for various circus vehicles, and as protective areas for circus animals. FINDINGS 1) TMC 18.64.020 requires a conditional use permit for circuses, carnivals, and street fairs. b) c) CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT CONDITIONAL IISE PFRMIT (TFMPORARY) - CTRCIIS VARGAS 2) Proposed dates for the Southcenter Circus Vargas performance are 30 June 3 July 1980 inclusive. 3) Proposed location of the circus within Southcenter frontage, immediately east of the Doubletree Inn. is on the Strander Blvd. (SEE, Exhibit A) 4) Doubletree Inn management was advised by staff of the proposed circus event in close proximity to their buildings, and indicated no objection. 5) Circus Vargas management supplies the following information relative to their operation: a) General Lot Layout of the circus' facilities per Exhibit "B ". Solid Waste Disposal -- all solid waste material, including animal wastes, will be placed in a "40- yard" dumpster which will be removed daily and replaced with an empty one.' Securiit -- The circus has its own security personnel to assist with crowd control, equipment protection, and parking direction when needed. Little or no need for supplementation with regular Tukwila Police personnel is anticipated. d) Animal Management -- a trained animal handler will be on duty to protect and supervise circus animals on a 24 -hour basis during the course of the event. Fire Safety -- a fire safety certificate for the main tent is attached (Exhibit C), and additional requirements may be imposed and enforced by the Tukwila Fire Dept. 6) Circus Vargas has held similar performances at Southcenter in recent years without any major safety or health impacts on the community. CONCLUSION Staff is assured that Circus Vargas has taken reasonable precaution to safeguard the public health and welfare, and can be expected to conduct the proposed event without significant impact upon the general convenience of the community or upon Tukwila's emergency service organizations. RECOMMENDATION Staff recommends approval of application 80 -14 -CUP subject to the following conditions: 1) The subject use permit shall be valid only for the period 30 June to 3 July 1980 inclusive. 2) Staging area for lodging and feeding of circus animals shall be located as far to the vjs'£ of the Doubletree Inn as practical to minimize disturbance of guests at that facility.
