Following the reading of the Staff Report, the Public Hearing was opened at 9:18 P.M. Don Dally, Representing Pacific Townhouse Builders, took issue with some of the conditions proposed by Staff. He stated that Condition 2 dealing with drainage is not possible with the current design of the plat; most of the trees will have to be removed; Condition 6 regulating grade of the fire lane cannot be met. MOTION CARRIED 3 -0.. B) DEVELOPMENT PLAN & LANDSCAPING - "SUNWOOD" PHASE II Mark Caughey read the Staff Report introduction and recommendations. Don Dally, representing Pacific Townhouse Builders, responded to proposed conditions in the Staff Report. Regarding architectural materials, he noted that they do not plan to use stucco on any Phase II structures; only cedar siding or shakes will be used. Regarding the requirement for an automatic irrigation system, he stated that Phase I was not required to install such a system, and therefore Phase II should also be exempt therefrom. AGENDA ITEM CITY OF TUKWILA PLANNING DIVISION CITY COUNCIL STAFF REPORT • 80 -31 -SUB - "Sunwood" Preliminary Plat As you are aware, the previously approved preliminary plat for the "Sunwood" project expired in February of this year. In order to pursue further con- struction of the multi - family portion of Sunwood, Pacific Townhouse Builders has requested your approval of a 6 -lot preliminary plat for the 3.2 acre single - family district of the Sunwood site. Following a public hearing before the Planning Commission on August 28, 1980, the Commission drafted a recommendation to approve the preliminary plat, subject to stipulations enumerated in the accompanying resolution. Please note that stipulation 7 requires Pacific Townhouse Builders to record a final R -1 plat before obtaining construction permits for Phase II. Effectively, this provision could delay permit issuance for 6 to 8 months while all of the complex steps to approve a final plat are completed. No doubt, the applicants will wish to discuss this stipulation with you, as it represents a hardship, in their estimation. It is the opinion of the Planning Commission that ample time was allowed during construction of Phase I to complete the platting requirement per Ord. 1071, and that the ap- plicants are less likely to follow through with this obligation if it keeps being pushed farther and farther back in the project's scheduling. Stipulation 3(c) or Ordinance 1071 requires final plat ap- proval for the R -1 District of the Sunwood site before occupancy certificates are released for any construction within the project. A pre- liminary plat approved by the City Council in February, 1979 has expired. Accordingly, occupancy of Phase I is in jeopardy until the subdivision process is completed or stipu- lation 2(c) is modified or eliminated. The proposed plat before you is nearly identical with that approved in 1979, with the exception of a relocated fire lane to the north edge of the R -1 District. As you may be aware, some preliminary grading and fill work have already been done in this area, due to an apparent misunderstanding be- tween Pacific Townhouse Builders and the City. Pacific Townhouse Builders has initiated platting procedures to subdivide • the land depicted in Exhibit "A" to facilitate release of Phase I occu- pancy permits according to City Ordinance 1071. 2. The wooded site has a varied topography with some slopes in'excess of SITE. Page 2 20 percent on the west side of the site. A small pond is located on the east side of the site which provides storm water detention. 3. A preliminary investigation of soil conditions indicates that shallow glacial till, weathered on the upper 2 or 3 feet, grades downward into a glacial sand and gravel formation. Characteristics include an impervious nature which will cause greater runoff than from most other native soils, and highly erodable if exposed on steep slopes. 4. Ordinance #1071 reclassified the subject property from R -1 -12.0 to R -1 -9.6 zoning, requiring that the minimum sizes of the single - :family lots be 9,600 sq. ft. (Exhibit B). 5. The proposed development is 3.15 acres in total size. The site is proposed to be divided into 6 lots, 1 open space tract; and a 30' wide fire lane corridor with an average lot size of about 17,000+ square feet. 6. The City of Tukwila Comprehensive Land Use Policy Plan, Natural Environment, Objective 3, Policy 1 states: "Discourage development on slopes in excess of 20 percent." Generally it is not desirable to develop slopes of greater than 20 percent due to the problems of con- struction, access, and the degree to which grading activities disturb the landform." 7. The project developer proposes to make the following disposition of tracts A & B of the Plat: - Tract A: Will be deeded to the owners of Lots 1 through 6, a one -sixth (1/6) ownership basis. Because of the elevation of Tract A in relation to sanitary sewer hook -up, the property will never be able to be built on. - Tract B: Will be deeded to the "Sunwood" Condominium Association. The southern fifteen feet (15') of the Tract will be utilized for the emergency fire lane access and trail connection as required under Ordinance 1071. The northern fifteen feet (15') of Tract B will be utilized as a buffer area between Lots 1 and 2 and the Sipe and school property. 8. An agreement pursuant to the City of Tukwila Ordinance #1071 provides the following conditions: (1) The developer shall design the storm water system to retain storm water to a ten year storm interval with the following objectives built in: (a) Oil separators /water quality control (b) Ground water recharge (c) Controlled outlets from ponds (d) Outfalls to go into approved systems (2) The developer shall provide a trail connection form 62nd Avenue South to Tukwila Elementary School. Page 3 9. The 6 lots are proposed to be served by a 40 foot wide cul -de -sac running north - south, extending from 62nd Avenue South. The street is proposed to be dedicated to the City as a part of subdivision. 10. The information provided in the preliminary plat of the subject sub- division meets the requirements where applicable of Section 17.24 Minimum Standards for Residential Subdivision Design of the Tukwila Subdivision Code. 11. Comments received from other city agencies relative to this application are as follow: a) Fire Dept: No part of the fire access corridor shall exceed 14% grade. b) Building Dept: Lot 1 may not be buildable due to drainage con - figurization and fill placement for fire access corridor. c) Recreation Dept: Acceptance of Tract "A" as public open space has been rejected by the Parks Commission; integrity of 62nd Avenue trail should be maintained. CONCLUSIONS: 1. The cul -de -sac meets Tukwila Public Works Department requirements. 2. Utilities shall conform to the Tukwila Public Works requirements. 3. It is important to consider whether each lot is buildable in consider- ation of the steep slopes and soil conditions. The average lot size is approximately 16,000 sq. ft., well over the minimum required lot size of 9,600 sq. ft. of this residential zone. Increasing the lot sizes of those lots which are on steep slopes, or which are subject to excess filling requirements may increase the development potential of individual homesites. 4. The Sipe family, residing adjacent to the northeast corner of the plat area, has expressed concern that the proposed fire lane location may tempt the City to extend S. 151st St. westerly into the Sunwood site as a public thoroughfare at some future time. This situation would produce increased noise, congestion and odor in the vicinity of their home. The fire corridor is to be closed by barriers to all but emergency vehicles; the northerly half thereof will be planted as buffer to the Sipe and elementary school sites; the fire lane is expected to serve as a trail connection from 62nd Avenue to the elementary school; the internal street network of Sunwood Phases I & II is 24' wide, inadequate as a through public street. For these reasons, it is safe to conclude that the City does not intend to extend S. 151st St. westerly of its present terminus as public roadway. Page 4 RECOMMENDATION: NOTE: Staff recommends the Planning Commission adopt the Findings and Conclusions of the staff report as the basis upon which to recommend the City Council approve the Sunwood Preliminary Plat (Application 80 -31 -SUB) with the fol— lowing stipulations: 1. A detailed soils report of the area to be covered by the cul -de -sac and utilities shall accompany construction plans of said street and utilities. 2. Natural drainage shall not be blocked or changed in course as a result of the development. The existing detention pond shall be maintained in a condition equal to or better than its present condition. 3. There shall be no unnecessary removal of existing trees (conifers 4 inches in diameter or greater, deciduous trees 8 inches or greater measured 2 feet from ground level) during construction of required improvements. 4. A detailed surface water drainage plan shall be submitted to the Public Works Department and Planning Division for approval. 5. Prior to issuance of building permits for Phase II construction, a complete final plat application shall be submitted in accordance with Title 17 of the Tukwila Municipal Code. Completeness of said application shall be determined by the Planning Director within two (2) working days of its submittal to the Planning Division. 6. Maximum grade of the fire access corridor shall not exceed 14%. 7. Prior to release of building permits for Phase II of the Sunwood project, applicants shall submit for staff approval a Comprehensive Planting Plan for the northerly 15' of Tract "B" of Preliminary Plat 80 -31 -SUB. During City Council discussion of the premature work begun on the fire access corridor, a former partner of Pacific Townhouse Builders revealed a conflicting claim of ownership to the R -1 portion of the Sunwood project. MEMORANDUM TO: Al , Building Official FROM: Fred Satterstrom, Planning Supervisor t DATE: 2• May 1979 SUBJECT: Park Place Grading Permit I have reviewed the Planning Division files on the Parke Place development and find nothing which would pre -empt the City from issuing a grading per- mit prior to a building permit if certain conditions are fulfilled. It should be understood that the grading permit of which I speak relates only to the grading activities required for roadway and parking lot areas, and specifically excludes any grading for building sites. This area is defined by a red line on the grading permit application maps. Following are the Planning Division's recommendations: 1. Grading activities to be conducted between the hours of 8:00 a.m. and . 5:00 p.m., Monday - Friday. At no other times are any grading activ- ities authorized per this permit. 2. No blasting or use of explosives is authorized per this grading per- mit. Any such activity must be requested under separate cover. 3. The developer shall retain all flora located in the R -1 zone north and east of the ridge line between the ridge line and the single- family lets (R -1 zone) and east of buildings 5, 6, and 8, in a natural growth reservation zone, as designated on the site plan. Trees may be selectively cut east of the ridge line in the R -2 zone where necessary for installation of Improvements, although efforts shall still be made to preserve vegetation lin the R -2 area. 2. To preserve the visual landscape buffer in the R -2 zone at the north edge of the property, the developer shall retain all flora within 2.D so 25 feet south of the north edge of the property in the R -2 zone in a waral growth preservation zone, as designated on the site plan. 3. To enhance the visual landscape buffer between the project err the residential area to the north, the developer shall install and ;r,:r.tiin in the natural growth preservation zone established pursuant to 7 a ;.ion 2 above, additional conifers 10 to 12 feet in height when planted, Netee necessary to improve the landscape buffer. 4. The developer's restrictive covenants to be re.orded shall provide that no owner or resident of the project may cut trees in that zone, except that the home - owners' association may authorize cutting or pruning required by death or disease of trees or by a hazard to safety. The covenants shall also require maintenance of vegetation in the zones by the homeowners' association. 6. At the time each phase of the project is submitted to the ;Planning Commission for review, the developer shall stake all proposed uilding sites in that phase. The sites shall be inspected by an official ¶ the Department of Community Development. The developer shall design access at the southeast corner of the project so that vehicular traffic will be routed south on 62nd Avenue South, despite the low probability of increased traffic along 153rd Street. The City shall install road striping and directional controls .to aid the routing of traffic south on 62nd Avenue South. r 10. The responsible official reserves all rights to require mitigating measures in conjunction with the relevant laws related to the State Environmental Policy Act at the time of building permit application.
