SHORT SUBDIVISION COMMITTEE
Minutes of the Meeting of 15 October 1980.
Committee members present: Ted Uomoto, Public Works Director
Jim Hoel, Fire Marshall
Mark Caughey, Acting Planning Director
The meeting was called to order at 4:05 P.M. by Acting Chairman Caughey.
ITEM #1: APPLICATION 80 -37 -SS - WILLIAM HALFORD
Mr. and Mrs. Halford were present on behalf of the application.
The proposed short plat would create three lots from 2.5 existing lots
fronting on 58th Avenue South. The Committee discussed the adequacy and avail-
ability of utility services to the proposed subdivision, and determined that
sufficient capability exists. The setback diagram shown in the staff report
was also discussed; the applicants are aware that the "buildable" area of
proposed Lot 3 is constrained.
MOVED BY MR. UOMOTO, WITH MR. HOEL'S SECOND, TO APPROVE APPLICATION
80 -37 -SS WITH THE FOLLOWING STIPULATION:
1) PRIOR TO RELEASE OF BUILDING PERMITS FOR LOT 3, APPLICANT
WILL SUBMIT FOR STAFF APPROVAL A TREE INVENTORY AND REMOVAL
DIAGRAM.
1 ITEM #2: APPLICATION 80 -36 -SS - PATTON /MAGRUDER
Donald Moody and Larry Brown were present on behalf of the application.
Mark Caughey presented to the Committee a copy of the Superior Court order
which divides the Lutes Estate into two sub - areas. The court's direction
has resolved the concern discussed in the staff report relative to the
number of lots affected by the application.
Ted Uomoto noted that that portion of South 139th Street adjacent to Lot 3
of the plat has not yet been vacated by the City Council. Mr. Moody explained
what use will be made of the area if the application to vacate is approved.
Considerable discussion followed relative to the status of utilities avail-
able to serve the proposed plat. The Committee conclused that a conceptual
development plan for the entire plat area, along with a report on the condi-
tion and type of sewer lines found on the Interurban Avenue frontage, is
needed before a decision to approve the application can be made.
BY UNANIMOUS CONSENT, THE COMMITTEE TABLED APPLICATION 80 -36 -SS PENDING
CONCLUSION OF RESEARCH ON UTILITY SERVICE CAPACITY.

Short Subdivision Committee Meeting - 9 October 1980
The next Short Plat Committee Meeting will be two weeks from today at
2:00 P.M. in Conference Room #3. The following cases will be reviewed at
that time:
Item 1: 80 -37 -SS (Halford; 58th Av. So.)
The proposed short plat consists of three parcels, two of which front
directly on 58th Av. So. A third proposed parcel is served by an ingress/
egress utility easement across proposed Parcel 2. Resulting lot sizes are
6400 sq. ft. ± on Parcel 1; 11070 sq. ft. ± on Parcel 2; 11600 sq. ft. t
on Parcel 3. Each proposed lot meets zoning- mandated minimum sizes.

Staff is concerned, however, that the minimum setback distances prescribed
for Lot 3 may result in a narrow, highly constrained "buildable" area. While
the lot as designed meets the minimum principal of acceptability insofar as
creation of a legal building site is concerned, we wish to point out that
the economic return potential of the lot may be impaired due to the limited
building envelope permitted.
We also note that the westerly portion of Parcel 3, as well as portions of
the access easement to Parcel 3 contain large specimen trees which might be
destroyed if Parcel 3 is developed. Due to the extent of existing develop-
ment on Parcels 1 and 2, there seems to be little space available for adjust-
ment of the easement location. We suggest, therefore, that a condition be
imposed on the plat approval requiring staff approval of a tree inventory
' and removal plan prior to release of building permits for Lot 3.
Item 2: 80 -36 -SS (Patton /Magruder; Interurban Avenue)
The proposed plat would consolidate a number of existing small parcels,
and fragments of abandoned roadway into a foulr lot subdivision with common
access easement. This action is taken prior to submission of an application
for rezoning of those portions of Lot 1 -3 lying westerly of the west boundary
of the Seattle gardens tracts.
Staff suggests that the proposed short plat is unacceptable as submitted
for the following reasons:
1) Boundary of Lot 3 includes public right -of -way: The northern-
most 20' wide portion of Lot 3 extending 125' west of Inter-
urban Avenue is currently the existing right -of -way of S. 139th
St. A petition to vacate this area has been submitted to city
council, but is opposed by staff due to the presence therein of
existing utility lines. Council action on the requested vacation
is still pending. Thus, the boundary and description of Parcel 3
shold be revised to exclude public lands.
Creation of a "fifth parcel" results from present short plat
boundary: Comparing the proposed short plat boundary with the
total parcel affected by this application reveals the de -facto
creation of a fifth parcel fronting on 56th Place So. Staff
contends that the action of establishing a west boundary line for
Parcels 1 and 2 in fact establishes an east boundary for that
residual portion of site west of the proposed short plat area.
That parcel will be subject to the same constraints of develop -
ability and saleability as any. of the four other parcels of the
plat. Thus, we contend that the plat as submitted does not comply
with Section 17.08.020 of the Municipal Code restricting short
plats.to four or fewer parcels. We suggest that the applicants
be directed to follow formal subdivision procedures outlined in
TMC Section 17.12. prior to pursuing the rezone process.
