Mr. Pieper explained the issuance of a temporary sign permit for Pacific Stereo
and the stipulations attached to it.
MOTION BY MR. GOE AND SECONDED BY MISS MORGAN THAT THE PUBLIC HEARING BE CLOSED.
MOTION CARRIED.
The public hearing was closed by Chairman Duffie.
There was a discussion on the size and setback requirements of the sign. Mr.
Blaylock mentioned that the present sign would comply to the setback require-
ments if it were parallel to Southcenter Parkway.
Miss Morgan mentioned her concern regarding limiting the second sign in scope
to be in line with the ordinance. She also mentioned another issue to include
in a motion that no other free standing sign be allowed on the property either
as subdivided or Binding Site Improvement. Also that at no time can this sign
be added to or become a shared directional sign.
Mr. Pieper explained the sign code only allows one free standing sign per build-
ing and if there are two signs on one post, each building is considered to have
one free standing sign.
Mr. Goe mentioned he did not care for what they were being asked to approve in
the variance. He preferred the sign(s) to be shorter.
The Board members discussed variance criteria as it related to the Pacific Stereo
Sign.
MOTION BY MR. GOE AND SECONDED BY MRS. REGEL TO REJECT THE GRANTING OF THE VARIANCE
BASED ON THE REASON IT DOESN'T MEET THE VARIANCE CRITERIA. MOTION CARRIED.
Mr. Blaylock explained to Mr. Peterson that the action of the Board of Adjustment
is final and conclusive unless within ten (10) days from the date of the action
the adverse party makes application to the King County Superior Court for a writ
of certiorari, a writ of prohibition, or a writ of mandamus per section 18.72.060
of the Tukwila Municipal Code.

Mr. Blaylock presented the staff report explaining that special permission was
needed from the Board of Adjustment to expand a non - conforming building.
Chairman Duffie opened the discussion and asked if there were any members of the
public wishing to speak for the project. Bob and Jean Davidson spoke in favor of
the proposal.
Mrs. Elanor McLester presented a model of the residence and proposed expansion.

BUILDING - McLester
REQUEST: EXPANSION OF NON - CONFORMING BUILDING

COMPREHENSIVE PLAN: Low Density Residential
INTRODUCTION:
8:00 P.M.
The McLesters are proposing to expand their home located at 5118 South 164th by
converting the existing garage into a family room and constructing a new two car
garage. The new garage would be 22 feet by 22 feet, (Exhibit A).
FINDINGS:
1. The house was built under a building permit issued by King County on May 12,
1960.
2. The property was annexed to the City of Tukwila on July 5, 1960.
3. The subdivision was subdivided under King County standards. The lots are
legal non - conforming lots in size.
4.. The residence sets back thirty (30) feet from the paving on South 164th
Street and fifty (50) feet from the centerline of the street right -of -way.
The building is a legal non - conforming building as a result of setbacks.
5. A ten (10) foot high laural hedge screens the house from the street.
6. TMC 18.18.040 requires a fifty -five (55) foot setback from the centerline of
the street; however, TMC 18.60.080 allows an exception to the front yard
requirements in cases where other buildings on the same block have front
yards that are less than required by TMC.

7. The other residences on the north side of South 164th Street are setback
twenty (20) feet from the right -of -way.
8. The new garage would be located twenty -two (22) feet from the right -of -way.
9. TMC 18.68.040 requires that the Board of Adjustment grant special permission
to expand a non - conforming building, plus it limits the expansion to a maximum
of 25% of the ground area of the original building.
10. The existing residence and garage is in excess of 2,300 square feet. The new
garage (484 square feet) is approximately 21% of the ground area of the
original building.
CONCLUSIONS:
1. The residence, when annexed, was a legal non - conforming building along with
most of the other buildings in the vicinity. Normally the variance criteria
would be reviewed for the reduction of the front yard setback requirements;
however, TMC 18.60.080 specifically allows an exception if other buildings
in the same block do not meet the normal setback requirements of TMC. This
is an example of that special condition. The other residences on the block
are setback approximately twenty (20) feet from the right -of -way. Therefore,
the granting of special permission is appropriate.
2. Special permission must also be obtained as required in TMC 18.68.040 from
the Board of Adjustment for the expansion of a non - conforming building. The
request does not increase the non - conforming front yard setback nor does it
increase the building over 25% of the ground area of the original building.
The staff recommends that the Board of Adjustment grant special permission to
expand the residence located at 5118 South 164th Street as presented in Exhibit
A, which has a minimum setback of 22 feet from the right-of-way.
