On August 8, 1979 your agent, Mr. Lynn Takeuchi of MacKenzie Engineering,
Inc. brought to the City Building Department, site and building plans and an
application for a building permit for your project on 42nd Avenue S. and
Interurban Avenue.
By this letter we are informing you and MacKenzie Engineering that we
will not process the building permit application until the provisions and
requirements outlined in T.R. Monaghan's letter of May 15, 1979 to Mr. Takeuchi
have been fulfilled. To be specific, items 3 through 6 of that letter must
be complied with.
In addition, certain conditions were placed on your Shoreline permit that
must be complied with. They are per the attached "Conditions of Shoreline
Management Substantial Development Permit ".
Specifically, the following need to be resolved as follows:
1) Items 1, 4, 5, 6, 7, 8, 9, and 10 must be demonstrated as
complied with prior to issuance of the building permit.
2) Item 2 is covered by the first part of this letter regarding
access.
3) Item 3 is an information item regarding maximum office
development potential.
It is imperative that your company consider the items in this letter on
an item -by -item basis and resolve them. The City would be remiss in allowing
further processing of permits until the terms of this letter have been resolved.

CONDITIONS OF SHORELINE MANAGEMENT SUBSTANTIAL DEVELOPMENT PERMIT
TRAMMELL CROW
(MF #79 1 - SMP)
1. A public access easement will be given to the City of Tukwila along
the edge of the access road to ordinary high water line by separate
legal document prior to the end of the 30 day review period of the
State of Washington.
2. Access and the configuration of the intersection of the private access
road with Interurban Avenue and 42nd Avenue South is to,be approved
by the Tukwila Department of Public Works.
3. That the maximum office area to be constructed is 33,000 square feet
without providing additional on -site parking and obtaining a Revision
to Shorelines Substantial Development Permit.
4. That all roof - mounted equipment be screened from view from State
Highway 599.
5. That a 10 -foot wide landscaping strip or decorative fence, to be
approved by the REsponsible Official at the time of issuance of build-
ing permit application, be placed along the subject property's southern
and eastern boundaries.
6. That the landscaping along the shoreline be completed prior to the
issuance of the building permit for the third building.
7. That a detailed landscape plan be submitted with the building permit
application for review by the Planning Division.
8. That all landscaped areas be provided with underground sprinklers.
9. That the sidewalk indicated on the plans, dated 21 March 1979, be .
constructed of concrete and extended to eastern property line.
10. That a culvert or bridge sufficient to handle a 25 year storm fre-
quency be provided to cross the creek on the property. The design
is to include safety barriers for the sidewalk.

As a result of my letter to you of April 30, 1979 regarding the proposed access
plan to the above - referenced site,you presented an alternate plan as I requested
which shows the proposed site access road further to the south using Seattle City
Light right -of -way to develop an "S" -curve access road to the project. After
reviewing this scheme, we have concluded that it is not desirable and, therefore,
rejected. This rejection was verbally communicated to you earlier.
As a result of subsequent conversations with you, you were requested to submit
a written report and revised conceptual plan based upon the verbal report and
detailed analysis presented by your transportation consultant, Mr. Victor Bishop,
P.E. of Transportation Planning and Engineering, Inc. on April 25, 1979. We
received Mr. Bishop's written report and revised plan on May 11, 1979 and have
reviewed it."
We find that the report does not provide sufficient data to substantiate that
the left turn south onto Interurban Avenue South merging with the 806 south-
bound thru vehicles on Interurban Avenue is a safe and acceptable movement. We
have, therefore, discussed this with Mr. Bishop this morning and told him to
provide us with his calculations for capacity, gap analysis and required merge
distance for this movement. He assures us that, in his opinion, this merge is
safe and acceptable and will provide us with the data in a supplemental report
within a few days.
The balance of the data in his report confirms his verbal report to us on April
25 and is reflected on the revised plan.
The substance of Mr. Bishop's report is summarized.. . . "I have demonstrated
through quantitative as as qualitative analysis, using acceptable and
applicable engineering standard practices and procedures, that the proposed
access plan as revised can reasonably be expected to operate in a safe and
efficient manner."

Based upon his analysis and professional opinion and recommendation, I approve the
conceptual access plan dated May 11, 1979 to the subject property based upon the
following conditions:
1. Mr. Victor Bishop, P. E., provide the additional data referenced above
to substantiate that the southbound left-turn from the access road onto
Interurban Avenue South and the southbound thru traffic merge is a safe
and acceptable movement.
2. The approval is based upon the data (vehicle counts, use projections,
assumptions and gap analysis) submitted and accepted. If, through actual
experience, the property generates more volume than projected, the City
of Tukwila, through the exercise of its police power, may disallow a
turning movement and /or require changes or corrections to correct an
access deficiency. The cost of such changes or corrections may be imposed
on the property owner. A covenant attesting to and agreeing to these
conditions must be entered into by Trammell Crow, binding them and /or
their successors to these conditions. The approved access construction
plan and supporting. data will be exhibits to this covenant.
3. A covenant between Trammell Crow and the City be executed to provide that,
in effect, Trammell Crow and /or their successors if they become owners or
developers of the adjacent property to the south will develop new access
to serve this property and the future development and to void the access
which will be approved at this time.
4. The.City must have written assurances that all existing access easements
on the property are being maintained and in no way being physically
encumbered by any development of the property by Trammell Crow or their
agents.
5. Submittal of a detailed engineering and construction plan of the con -
ceptually approved access plan for review and approval must be submitted
prior to issuance of a curb cut construction permit.
6. Written concurrence and approval of the conceptual access plan by the
King County Department'of Public Works is also required.
In addition to the comments contained herein, I have noted on the revised plan
some additional comments which should be incorporated or addressed during.the
final design. If there are any further questions regarding this letter or if
I may be additional assistance, please contact me.

Dear Mr. Piper, Mr. Blaylock, & Mr. Frazer:
I would like to extend our thanks to you for your recent cooperation
and consideration concerning caption project. We plan to start con-
struction of the two storm water out fall structures and installation
of the 9' diameter culvert the week of June 18th. As outlined in our
letter of June 5, we will have the appropriate permits to commence
this portion of the project. We discussed in your office on June
14th that we were currently in a process of preparing building permit
and final access plan drawings. We anticipate these drawings will be
ready to file in approximately six weeks. In order to have the pro-
ject proceed in a timely and cost effective manner, we would like to
obtain permits which would allow us to strip the site, import struct-
ural fill (to build up the building pads), and install sewer systems.
Phillip you indicated the normal proceedure is to obtain a building
permit which covers grading and structural fill. However, you suggest
ed I speak with Roger Blaylock and Al Piper. If they would agree to
a modified proceedure, you and your department would cooperate in
the form of issuing the necessary permits for the outlined site work
prior to issuance of a building permit. Al and Roger have agreed to
review and issue the permits we require to accomplish the previously
stated work prior to issuance of building permit. We filed for site
drainage permit and utility extension sanitary sewer permit on March
6, and submitted revised plans May 24, which incorporated and respond-
ed to your comments. We anticipate approval of these plans will be
forthcoming in the near . future. We plan to apply for a fill permit
June 18th, and it is our understanding the excavation contractor'
will obtain the required hauling permit. The proceedure for sequenc-
ing of permits as outlined in this letter will be most beneficial to
the successful completion of this project. If you detect any descrep-
ancies or have any questions or comments, please call.

1. This permit is granted under authority of Chapter 159, Sessions Laws of 1935.
(Chapter 86.16. RCW)
2. No property rights are granted herein, nor does this permit absolve permittee
from liability for any damage which may be suffered to life or to property, public or .
private, by reason of works, structures and improvements authorized hereunder.
3. This permit does not obviate the necessity of obtaining other permits required
by federal, state, or local law.
4. The permittee shall remove, at his own expense, all falsevorks, structures and
materials incident to the construction of the work herein authorized. Works and
structures erected under permit covering a specific period of time shall be removed by
the permittee at his own expense upon the expiration of said period or at the expira-
tion of any extension of time which may be granted.
5. Should permittee fail to remove, at the proper time, materials, works and
structures referred to under paragraph 4, the director reserves the right to have
it done at the expense of the permittee.
6. Any alteration of plans for works and structures made subsequent to the filing
of an application or the issuance of permit shall be subject to approval by thv director.

8. The action taken by the department herein shall not imply or create any liability
for any damages against the state, as provided by RCW 86.16.100.
9. When necessary to provide for the proper maintenance or operation of the works,
structures, or improvements as authorized herein, the department may issue supplementary
orders providing for such.
10. This permit is subject to further special conditions as follows:
A. The water surface elevation for the Green River, with a controlled .
discharge from the Howard Hanson Dam of 12,000 cfs as measured at Auburn
(Porter Gauge), is 14.3 feet (Mean Sea Level.Datum) at the subject site.
The proposed finished floor elevations are shown to be at elevation 16.5
feet. Also, the river bank or setback berm is at least 2 feet above the
maximum controlled water surface for the Green River.
B. Approval of this development and other applications will reduce the
storage area for flood waters, resulting in a higher elevation for the
100 -year frequency floodplain, unless improvements aremade to discharge
flood waters from the flood plain.
C. Additional improvements to this site will require State Flood Control Zone
Permits. •
11. This permit is accepted subject to provisions of law and regulations
conditions herein prescribed.

the Trammell Crow Company for the development of a warehouse park on
the Duwamish River. The revision includes the placement of two storm
water outfall'structures. The design was identical to those contained
in'your public notice. The revision becomes effective eight (8) days
after the date of issuance (June 5, 1979).

Please find enclosed revisions to the above referenced shore-
line management permits issued by the City of Tukwila. The
first revision to S.M.S. permit number N- 1131 -17 -A (76 -10 -SMP)
relocates a portion of the Christensen Road Greenbelt bicycle /
pedestrian. trail. The revision to the Trammell Crow, Inc.
Shoreline Management Number N- 2259 -17 -A (79 -1 -SMP) is to include
two (2) storm water outfalls structures that were omitted by
error when the City obtained modifications from the original
application submitted in December.

Application has been received from MacKenzie Engineering, Inc., 2850
Northwest 31st, Portland, Oregon 97210 (ATTN: Mr. Reg McDonald, tele-
phone (503) 224 -9560) on ehalf of TRAMMELL -CROW Company for Department
of the Army permit in accfrdance with Section 10 of the River and
Harbor Act of March 3, 1899 and Section 404 of the Clean Water Act for
certain work described below and shown on the inclosed prints.
PROPOSED WORK:
a. Location: In the Duwamish River at Tukwila, Washington.
b. Physical Character: Place fill; install outfall.
c. Purpose (as explained by the applicant): Provide bank
protection for new storm drainage outfall.
The evaluation of the impact of the activity on the public interest
will include application of the guidelines promulgated by the
Administrator, EPA, under authority of Section 404(b) of the Clean
Water Act.
Preliminary review by the Seattle District indicates that this work
will not significantly affect the quality of the human environment.
The preparation of a Federal Environmental Impact Statement is not
anticipated at this time.
Preliminary determinations indicate that the proposed activity will
not affect endangered species, or their critical habitat, designated
as endangered or threatened pursuant to the Endangered Species Act of
1973 (87 Stat. 844). Formal consultation pursuant to Section 7 of the
Act with the Department of the Interior is not required for this
proposed activity.
Any person may request, in writing, within the comment period specified
in this notice, that a public hearing be held to consider this applica-
tion. Requests for public hearings shall state, with particularity,
the reasons for holding a public hearing.

Presently unknown archeological, scientific, prehistorical or histori-
cal data may be lost or destroyed by work to be accomplished under the
requested permit. The work is not located on a property registered in
the National Register of Historic Places.
The decision whether to issue a permit will be based on an evaluation
of the probable impact of the proposed activity on the public interest.
That decision will reflect the national concern for both protection
and utilization of important resources. The benefit which reasonably
may be expected to accrue from the proposal must be balanced against
its reasonably foreseeable detriments. All factors which may be
relevant to the proposal will be considered; among those are conserva-
tion, economics, aesthetics, general environmental concerns, historic
values, fish and wildlife values, flood damage prevention, land use,
navigation, recreation, water supply, water quality, energy needs,
safety, food production and, in general, the needs and welfare of the
people.
Comments on these factors will be accepted and made part of the record
and will be considered in determining whether it would be in the best
public interest to grant a permit. Comments should refer to the refer -
ence number shown above and reach this office not later than 11 May
1979 to insure consideration.

Notice is hereby given that a request is being filed
with the Department of Ecology for certification, as
provided in Section 401 of the Federal. Water Pollution
Control Act (PL -92 -500), as amended by the Clean Water
Act of 1977 (PL -95 -217), that a proposed discharge to
navigable waters, resulting from the project described
in the Corps of Engineers Public Notice No. OYB - 005596
will comply with the applicable provisions of the
Federal Water Pollution Control Act as amended and
other state laws.
Any person desiring to present views on the request in
relation to water pollution considerations pertaining
to the project may do so by providing the same in
writing to the Department of Ecology, Office of Field
Operations, Olympia, Washington 98504 within 20 days
of publication of this notice.
