The regular September meeting of the Board of Adjustment was called to order by Chairman Duffle at 8:05 p.m. Members present were: Mr. Duffie, Mrs. Aitmayer, Mrs. Regel and Miss Morgan. Al Pieper, Building Official, was present repre- senting the Building Department. MOTION BY MRS. ALTMAYER AND SECONDED BY MRS MAY 3, 1979 MINUTES. MOTION CARRIED. MOTION BY MRS. ALTMAYER AND SECONDED BY MRS MINUTES AS PRESENTED. MOTION CARRIED. MOTION BY MRS. ALTMAYER AND SECONDED BY MRS MINUTES AS PRESENTED. MOTION CARRIED. OLD BUSINESS Miss Morgan arrived at 8:10 p.m. MOTION BY MISS MORGAN AND SECONDED BY MRS. REGEL TO APPROVE THE MAY 3, 1979 MINUTES AS PRESENTED. MOTION CARRIED. A meeting to discuss the sign code with the Mayor between September 6 and Sep- tember 22 was discussed. Miss Morgan requested information on her term expiration. The Board reqeusted information on the Planning Commission public hearing on the zoning code. NEW BUSINESS 1 . REGEL TO POSTPONE APPROVAL OF THE . REGEL TO APPROVE THE JUNE 7, 1979 . AGENDA ITEM IV A : VARIANCE TO SIGN CODE: Puget Sound Mutual Savings Bank REQUEST: VARIANCE from Section 19.32.140 (A) APPLICANT: Puget Sound Mutual Savings Bank LOCATION: 275 Andover Park West INTRODUCTION: The plans for the proposed sign have been reviewed by the Building Department for compliance with Title 19 of the Tukwila Municipal Code (TMC). The proposed sign meets Code requirements relative to design and size. The proposed sign would violate Section 19.32.140 (A) of the TMC which states "Signs on faces of buildings. One sign is permitted for each street upon which the property fronts." The applicant has applied for a variance from the "quantity of signs" restriction. FINDINGS: The proposed sign would increase the number of signs on the building face to three. The building is basically triangular in shape. One side of the build- ing faces Strander Boulevard. One side of the building faces Andover Park West. One side of the building faces the Southcenter parking lot. A sign permit number 79 -013 authorizing two signs was issued March 20, 1979. A variance from Section 19.32.140 (A) is required for additional building mounted signs. CRITERIA FOR GRANTING VARIANCE /CONCLUSIONS: 1. The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located; Conclusion: Additional signs would be a grant of special privilege. 2. That such variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property, to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; Board of Adjustment Page 2 Staff Report August 6, 1979 Conclusion: No special circumstances relating to size, shape, or topography exist, therefore, no variance is necessary. 3. That the special conditions and circumstances do not result from the actions of the applicant; Conclusion: If special circumstances are presumed to exist, the design and placement of the building are the result of actions of the applicant. (See Item 2) 4. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated; Conclusion: The granting of the variance will not be detrimental to public welfare or injurious to property in any way. 5. The authorization of such variance will not adversely affect the implementa- tion of the Comprehensive Land Use Plan; Conclusion: The Comprehensive Land Use Plan will not be affected by this proposal. 6. That the granting of such a variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties in the same zone or vicinity. Conclusion: The property rights possessed by other owners in the vicinity are the same as those rights granted the applicant. ANALYSIS: There is a need to inform the public of the service available. Some of the public may be wandering in the parking lot looking for the bank facility. The Sign Code Section 19.32.140 allows one sign for each street upon which the property fronts and one free standing sign. Some merit exists in the applica- tion as a third sign on the building could replace the allowed free standing sign and might contribute less to visual clutter than a free standing sign.
