First, allow'me on behalf of the City Council to welcome Denny's, Inc. to the Tukwila business community. While it is distressing. tous .to hear of the discouraging sales results at your north end store to date,.I feel it is important for us to make you aware of our policy with regard to business identification graphics so that you may understand clearly the Board of Adjustment's action last fall in denying your sign variance request. It has been the conscious policy of the City Council and Administration to encourage commercial business operators in the community to design all aspects of their projects, including signage, within the limits prescribed . by the municipal code. Thus we place great importance on the lity of the individual property developer to examine our codes and policies carefully during the initial feasibility study phase of a project to be sure that he or she can live -with those constraints without . seeking a variance. We must assume that your decision to locate a high - volume restaurant on 48th Avenue South recognized some of the site's potential disadvantages: awkward freeway exit patterns, the significant difference in .grade between the freeway and your restaurant site, the amount of heavy. vegetation screen existing between the restaurant site and freeway, and the fact that 48th.Ave. So. is a dead -end street. We must also assume that your site selection analysis included an inquiry into the City's sign code provisions, and that your company determined that you could accept the amount of signage permitted, even if a variance request was refused. Specifically, I am referring to your present signage code and the resulting damaging effect on sales at the above unit. As you know, we recently opened for business near the inter- section of 1 -5 and Interurban with the expectation of pro- viding nearby residents and freeway commuters with a fine restaurant and, at the same time, to make a return on invest- ment, A couple of things changed from the initial planning stages that have caused considerable concern at Denny's. The general economic conditions, of course, dictate a fluxuation in our business and it is vital to our success to take every precaution available to insure as great an exposure as possible to our potential customer. It is my belief that the lack of good exposure to traffic on I -5 by not having a freeway oriented sign, is directly responsible for poor sales performance to date. As the trees on the north side of our building begin to bloom, visibility will be further impeded. We are willing to spend additional sums for the cost of installing a freeway sign cap- able of eliminating the lack of visibility from the freeway in a determined effort to increase sales that will benefit your city through sales taxes, as well as, increase our potential for a return, The Honorable Mr. Todd April 17, 1980 Page 2 I request you consider the effect of signage on a freeway business from an economic viewpoint and make necessary changes to the code favorable to future sales. Property located at 13100 48th Avenue South adjacent to Interstate Route 5, and east of Interurban Avenue. Assistant Planner Mark Caughey read the staff report and the applicant's statement of fact into the record. Representatives of the applicant present: David Servine, SIMCO Signs of Everett • Bob Laine, Denny's Restaurants • Ray Smith, Heath Signs, Los Angeles Mr. Servine expressed his appreciation to the board for their consideration of this request, and explained that the purpose of his presentation tonight is to demonstrate that strict interpretation of Title 19 will result in unnecessary visual and economic hardship for Denny's. Further, they wish to demonstrate the minimal nature of their variance request in relation to existing topographic conditions, and the manner in which appropriate signing can help overcome adverse site conditions. The applicants then presented a slide photograph study which attempted to demonstrate their rationale for the proposed freestanding sign height request in relation to field conditions. . The board then discussed the proposal relative to the following principal points: - The need to identify the "Denny's" brand -name from the freeway - The :advisability of granting a height variance in light of the May 1980 abatement procedure which may require removal of other existing signs in the immediate vicinity. - The appropriateness of locating a commercial use in an M -1 zone and then requesting special development consideration. Mr. Smith, Mr. Lane and Mr. Servine all responded to these and other points of dis- cussion, and attempted to formulate alternative approaches to minimize the degree of variance requested. However, the concensus of the board was to react to the applica- tion as presented, and to avoid attempting to redesign the proposal. AGENDA ITEM IV -A : VARIANCE TO SIGN CODE: Denny's Restaurant (79 -31 -V) INTRODUCTION: 1. Denny's Restaurant is now under construction at the above -noted location, and is located within a M -1 (Light Industrial) zoning district. 2. Per Section 19 -32 -170, the project is allowed a freestanding sign height of 45' feet, as commercial uses are permitted in the light industrial zone (TMC 18.40.010 (1)) 3. The applicants contend that their economic success depends on attracting trade from travelers on adjacent Interstate Route 5, and that the topography of the site in relation to the freeway (See Exhibit D) necessitates a sign height of seventy (70') feet to accomplish that purpose. 4. See applicants statement of fact for technical justification of proposed sign height /area. 1. Visibility of the site, and therefore ease of identifying appro- priate freeway exits to access "Denny's" site is extremely limited by topography of.roadway and streetside vegetation. (See Exhibit C) Staff has verified these conditions in field. However, whether a sign can be seen from the freeway is not a valid variance criteria, but a function of site selection. 2. Existing "Mobil" station sign immediately adjacent to Denny's site is eighty (80') feet tall, and seems just visible in time to exit safely from northbound direction of I -5. This is a non - conforming sign which will have to be removed by May of 1980. 3. Other commercial -use establishments in immediate vicinity of Denny's site display freestanding signs in excess of 45' in height, i.e. TUK -INN - 65' + high marginal freeway visibility (N /B) UNION 76 GASOLINE - 85' + high - good freeway visibility (Both Dir.) MOBIL GASOLINE - 80' ± high marginal freeway visibility (N /B) These are all non - conforming. STAFF CONCLUSION: A. Concept of "Least Variance" from prescribed regulation. In establishing the proposed 70' sign height, the applicants have under- taken extensive field studies (see statement of fact, 2nd page, paragraph 4, under "Requirements For Overcoming Adverse Site Conditions" for des- cription of Methodology) to determine the least amount of height over the 45' limit otherwise allowed which will adequately identify the restau- rant business to the owners satisfaction. It should be noted, however, that the State Highway Department will provide advertisement signs on the freeway, if Denny's will pay the cost of said sign. This would notify motorists of a Denny's at the next exit. B. Concept of "Minimum Signing To Accomplish'The Intended Purpose of Ade- quately- Identifying A Business Establishment ". One of the principal intents of a municipal sign ordinance is to control visual clutter resulting from display of advertising structures. In the present case, some justification exists for contending that the proposed sign will contribute to visual clutter of the immediate vicinity of "Denny's ". However, as the site is already entitled to a 45' high freestanding sign per Title 19, the resulting "clutter" of numerous freestanding signs in a relatively small geographic area is already a foregone conclusion. While one may not clutter more than the other, it does set a precedence and is not a variance criteria. EVALUATION: (AREA VARIANCE) ITEM 2: Request For Sign Area Variance 1. Pages 2 -3 of Applicant's Statement of Fact attempts to quantify minimum copy size necessary to identify site at freeway speeds. 2. Proposed 63 "/40" letter size requires proportionate background area of 220 square feet; 41 square feet is maximum area permitted for each face per Table 1 of the TMC 19.32.140. 3. Proposed sign area variance represents 600% increase in surface area beyond that permitted in Title 19. 2 STAFF CONCLUSION: The concept of sign area as a proportion of sign height is somewhat elusive to express in strict ratios. Staff believes that the visual relationship depicted on Exhibit "A" between size and height is reasonable, but only if the Board should elect to approve the proposed height variance. In keeping with the concept of "Least Variation" discussed above, staff suggests the variance not allow the "Always Open" and "Cocktail" portions of the sign, as shown on Exhibit "A ". Note that TMC, Sec. 19.32.140 (B) limits copy content to company name, logo or activity but specifically precludes "advertising" messages. These two items are advertising messages. FINDINGS: CRITERIA FOR GRANTING VARIANCE /CONCLUSIONS: 1. The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located; Conclusion: Additional sign height and area would be a grant of special privilege. 2. That such variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property, to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. Conclusion: Special circumstances relating to topography do not exist; therefore, the variance is not justified. Individual locational criteria of businesses is not a valid variance criteria. 3. That the special conditions and circumstances do not result from the actions of the applicant; Conclusion: Special conditions are as a result of the applicants actions since they purchased the site in its present condition. 4. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated; Conclusion: The granting of the variance would not be detrimental to public welfare or injurious to property. 3 MC /mkb Enclosures: Exhibits A, B, C, and D. The authorization of such variance will not adversely affect the implementation of the Comprehensive Land Use Plan; Conclusion: The Comprehensive Land Use Plan will not be affected by this proposal. 6. Conclusion: The' property rights possessed by other owners in the vicinity will not remain the same as -those rights granted to the applicant, since they will have to remove their larger signs in May of 1980. REASON FOR REQUESTING VARIANCE Application and request for a variance from Section of the Tukwilla sign code pertaining to size and height for freestanding on premise signs. A broad application of height and square footage limitations in the Tukwilla sign code to this site adjacent to I - creates an extra - ordinary economic hardship and unfair competetive situation for Denny's Restaurant. The code denies Cenny's the full use of its property anc' restricts the permitted restaurant use. It further hampers Denny's marketing stratedgy by overly restricting the use of the propertys visual component. Full use of the visual componet is essential to the quiet enjoyment of the zoned use and the economic success of the restaurant. The visual component together with the adjacent traffic density on 1 -5 and the proximity to the Interurban off -ramps form the basis for the sites tax base value. ECONOMIC IMPORTANCE OF FREEWAY SIGN VISIBLE FROM 1 - Denny's is an automobile oriented business mostly dependent on Interstate 5 traffic. The site was selected because of its proximity to the freeway and other freeway oriented businesses. Traffic count Northbound at SR 599 Exit to Interurban is 106,800 cars per day. Southbound near the exit to SR 181 (Interurban Ave) is 92,400 cars per day. (Showalter, Washington State Dept. of Trans- portation). According to "Automobile Facts And Figures," on the average there are 1.7 occupants per car. That is 333,6+0 people pass this site in a 24 hour period in both directions on 1 -5. As a freeway oriented business, Denny's marketing is aimed at this audience. One of the first tasks within any marketing program is to acieve consumer awareness. An on premise sign, visible, legible and.readable from 1 -5 is Denny's most important marketing tool for achieving this goal. The importance of signs to the economic health of freeway businesses and the part they play in providing information to motorists has been established by numerous studies. The interstate system accounts for $30 billion per year in tourism income, $8.7 billion of which is for food products alone. (Visual Communication thru Signage, Vol 2) The results of a study by Colorado State University concluded that more than 42% of freeway motorists were attracted to freeway Co ervices by on pre,se signs visible from freeway. (Electric 6igns ntribution to the Communications Spectrum) A study by 3 -M National of the Detroit freeway system in 1971 concluded that a sign provided the opportunity for 35% market coverage and a repetition of over 25 times per month. SPECIAL CONDITIONS AT SITE MAKING VARIANCE NECESSARY Adverse site condition, special conditions exist at this site and area adjacent to 1 -5 1. Terrain, physical properties of Denny's building site in re}ationship to freeway bed. Building site is 18' be1cw the freeway grade. (See Exhibit) 2. Natural vegetation, large and medium size trees o-, right -of way and adjoining property block view of restaurant 3. Location of offramps from 1 -5 Northbound and South`.cund to Interurban Ave and configuration of freeway 4. Automobile speed, width of freeway 5. Readability distance of sign 6. Building frontage on 48th Avenue South which is not a highway or urban arterial. Total reliance on 1 -5 by Denny's 7. Existing uses and signage in vicinity of site. REQUIREMENTS FOR OVERCOMING ADVERSE SITE CONDITIONS The adverse site conditions can be overcome only by allowing a sign that can be seen by 1 -5 motorists. The size and height of the sign are determined by three factors: visibility, legibility and readability. To be visible on the freeway, the sign must be 70' above the building grade or 52' above the freeway grade. This will allow the sign to he seen in advance of the offramps allowing for sufficient driver reaction to make a safe exit. The height required to clear starve of the trees was determined by flying a target from a boom truck. The target was only visible at 70' when viewed from Northbound 1 -5 in advance of the offramp to SR 599. Visibility Southbound was limited at this height but target was visible approximately 5/10 of a mile and furtber form offramp to SR 181. (Test documented on film) Size of the sign must be determined by the size of the letters needed to be legible and readable to motorists in advance of exit. One inch of letter height for every 50 feet of distance is required. Tests also show that for most people to read any un- familiar name at 1000 feet, the letters must be at least 18" high. Automobile speed, size of highway affect size of letters also. In a study done by the Baltimore Planning Department, certain reaction times of drivers were concluded. The reaction time for a driver on a six lane road is 11 seconds. At 55 MPH (80.67' /Sec) an auto will travel 837.37' before a driver can comprehend and react to a sign. The size of the Denny's sign to meet this criteria would have be even larger thi, the sign proposed. The Defny s sign wi T have letters 60" and 48 "- with a total background area of 269 squ$r feet. A sign this size is required to be visible, legible and readable from the freeway . There is no adverse impact on the adjacent area. Other freeway oriented business in vicinty have similar or larger signs to achieve full use of visual component and permitted property use. (Tuk -Inn, Texaco, Mobil, Union.) The mobile display is 80' overal height and has; area of 420 square feet per face.
