Minutes of the regular meeting of 25 October 1979.

The . short subdivision committee was convened by Chairman Kjell Stoknes at
2:23 p.m.
ITEM #1: APPLICATION 79 -32 -SS - UNIFER /SPEEA SHORT PLAT
Representing the applicant: Bruce Solly, Unifer Co.
Committee members examined the proposed short plat application materials and
generally agreed that the document is complete and accurate. The applicants
propose to divide an existing 2.0 + acre'. lot lying north of Southcenter Boule-
vard between 51st and 52nd avenues into two parcels. Each separate parcel will
contain an office structure.
Mr. Fraser suggested that the committee's action to approve the short plat be
conditioned to require the applicant to execute all agreement to participate
in a Local Improvement District at such time as one may be formed in the project
vicinity. Mr. Solly pointed out that he is already required to complete such
an agreement as a condition of the project's City Council - approved waiver
request. Mr. Crawley suggested that the proposed condition is redundant and
unnecessary. Discussion followed as to the merits of imposing the suggested
condition.
MR. STOKNES MOVED, WITH MR. FRASER'S SECOND, TO APPROVE APPLICATION 79 -32 -SS
ACCORDING TO THE FOLLOWING CONDITION:
1. PRIOR TO RECORDATION OF THE APPROVED SHORT PLAT, THE APPLICANT SHALL
EXECUTE A DEVELOPERS AGREEMENT TO PARTICIPATE IN A LOCAL IMPROVEMENT
DISTRICT. SAID DOCUMENT SHALL CONTAIN THE SIGNATURES OF THE MAYOR AND
CITY CLERK OF THE CITY OF TUKWILA.
MOTION CARRIED 2 -1, MR. CRAWLEY DISSENTING
The committee meeting adjourned at 2:38 p.m.

DEVELOPMENT AGREEMENT
WITNESSETH:
THIS INSTRUMENT executed this date in favor of the City of Tukwila,
a municipal corporation of the State of Washington (hereinafter called
"City "), SPEEA Properties, Inc., a non profit corporation of the State of
Washington, Bruce W. Solly, and Leroy Bowen, (hereinafter called "Owner ").
WHEREAS, Owner is the owner in fee simple of the property on described
exhibit X, attached hereto and made a part hereof following described
property (hereinafter called "the Property "):
located in the City of Tukwila, King County, Washington; and
WHEREAS, the City's Department of Public Works has determined that in
order to provide for the public health, safety and general welfare with
respect to the subject property and other property located in the vicinity of
this property, a local improvement district may be formed for the purpose of
improving 52nd Avenue, South;
WHEREAS, Owner is willing to equitably participate in said local improve-
ment district in the event it is created;
NOW, THEREFORE, in consideration of the terms and conditions contained
herein, the parties hereto covenant and agree as follows:
1. In the event the City finds that the creation of a local improvement
district which will include within its boundaries the subject property to this
Agreement is within the public health, safety and general welfare, the Owner
agrees to participate equitably in said LID, and hereby waives any right to
protest the formation of any said LID; provided, however, that the improvements
constructed within said LID especially benefit the property and that the share
of the cost is equitable to the Owner.
2. In the event said Local Improvement District is formed, and Owner
has already constructed at its expense and improvements to its portion of the
street in conformance with all applicable federal, state and local laws, rules
and regulations, then the Owner shall not be assessed for any such improvements
