The proposed west -most pole should be relocated approximately .5 stall- widths farther east." These changes have been noted on your grading permit plan set which has been approved by this office and returned to the Building Dept. The landscape irrigation plan by Ralph Mickelson is also approved stipu- lation 2 of the Board of Architectural Review's action of 15 November 1979. That the recommendation of approval is based on Exhibits A, B, and C of application 79 -34 -R, except as may be amended by the following conditions: 2. Planning Commission Page 5 C Minutes 15 November 1979 Mr. James expressed his appreciation to the speaker for the quality and substance of his presentation. Kathryn Harrison - Spoke primarily to the R -1 portion of the Draft Zoning Ordinance. - Commended the Commission for its effort, and intended no personal attack on staff or; the Commission by way of` expressed criticisms - Height limit now reduced 5'; representing an unwise architectural 'restriction for smaller homes or smaller parcels. - Proposed 30' setback measurement points are vague and should be clarified as in the present text to eliminate conflict at the building permit level. - Proposed 10' minimum rear year setback open to possible inequity. - New zoning ordinance text is vague in its interpretation of home occu- pation activities. - Numerous deletions in Draft #3 of permitted uses in R -1 which should be reinstated: a. Police /fire stations should be conditional R -1 uses to accommodate growth. ■ b. Wells should be permitted to accommodate need for a back -up water system. - Proposed document is difficult to use due to numerous cross- references. All text pertinent to a particular zone should be locateable in that portion of the ordinance text. Having heard from all persons present who desired to address the Commission, Chairman Kirsop closed the public hearing and invited all present to participate in the study session at the regular meeting of 20 December 1979. At that time, the Commission will begin its analysis of comments received during the preceding weeks of public testimony. At the request of staff, the Commission recessed at 9:19 and reconvened at 9:28. AGENDA ITEM V A. PUBLIC HEARING: Application 79 -34 -R, Jack A. Benaroya Co., requesting rezone from R1 -12 to R -P of lands commonly known as the "Canyon" parking area of Parkway Plaza West, generally located on the west side of Southcenter Blvd., north of South 180th Street, containing approximately 0.75 acres. Assistant Planner Mark Caughey explained that the applicants, on advice of staff, have modified their application to request C -2 zoning, consistent with the proposed draft zoning ordinance and map, and consistency with the comprehensive plan. He then presented the staff report. MOTION CARRIED 7 -0. Planning Commission Page 6 Minutes 15 November 1979 Joel Benoliel, representing the Benaroya Company, stated his agreement with the staffs' findings and conclusions, and directed the Commission's attention to the zoning plat on display, noting that it matched the legal description of the rezone area accompanying the staff report. In response to Chairman Kirsop's question, Mr. Benoliel stated that his company would have no difficulty meeting the area lighting requirement discussed in the staff report. In response to Mrs. Avery's question, Bob Fehnel of the Benaroya Company explained that pedestrians will cross the adjacent rail easement at the same point as will vehicle traffic due to a 42' grade difference along the mutual limit of the parking area and rail easement. MOVED BY MR. SOWINSKI, WITH MR. ORRICO'S SECOND, TO APPROVE APPLICATION 79 -34 -R SUBJECT TO CONDITIONS AS FOLLOW: 1. THAT THE RECOMMENDATION OF APPROVAL IS BASED ON EXHIBITS A, B, AND C OF APPLICATION 79 -34 -R, EXCEPT AS MAY BE AMENDED BY THE FOLLOWING CONDITIONS: 2. We make this request on the basis of the recommendation and advice of the Planning Department that C -2 would be the more appropriate classification. In order to proceed with construction of these improvements, staff has determined that an application for rezoning will be needed. The subject lands are currently zoned R1 -12, in which public parking facilities are not a permitted use. However, the Tukwila Zoning Qrdinance provides for such activity in its R -P zone (copy attached). As an alternative approach, the property could be rezoned to the same designation as that of the office building which the parking area will serve. Our office will be pleased to assist you in preparing the necessary docu- ments to complete the rezoning application -- please feel welcome to call upon us.
