Because of increased play during the summer months and because it is better to perform construction work when the course is less crowded and during the dry months, we would like to begin work as soon as permits or approvals are given. If at all possible, we would like to extend Shoreline Management Permit #79 -35 to enable us to perform the construction during this spring and summer. The permit will cover only the irrigation work that is part of the grass tee and greens work. For my other work (parking lot, clubhouse or maintenance building), we will apply for a new permit. Please accept this as our formal request to extend the permit and complete the construction during the appropriate construction months. As we understand it, Phase II of the project consists of .installing underground irrigation equipment on that portion of the golf course situated easterly of and adjacent to the river. It appears that you will need no further review by this office to carry -out Phase II improvements. Please note for the record that the Shoreline Management Permit was approved in December, 1979. According to Section WAC 173 -14- 060(2) of the Shoreline Management Act Guidelines, construction authorized under this permit must be completed within 5 years of the date of issuance. As a reminder, therefore, Phase II should be completed on or before 20 December 1984. Redmond, WA 98052 RE: Interpretation - WAC 173 -14 -040 (9) Dear Madame /Sir: The City of Tukwila owns the Foster Golf Course. This course pre- sently has a manual irrigation system which is not adequate to keep the course green in the summer. The City is proposing to replace the present manual system with a completely new fully automatic sprinkler system. The pump station on the north portion will be discontinued and one ± 60 horsepower pump added where the other pump is beside the bridge crossing the Duwamish River. The method of removing water from the river will be the same, however, we have a water rights request pending for 1,200 gal. /min., up from the present 300 gal. /min. No work is proposed from the mean high water level and riverward. As I interpret WAC 173 -14 -040 (9), this proposed action is exempt and would not require a substantial development permit. Do you agree with this interpretation? I would appreciate a response as soon as possible so we could pro- cess the permit, if necessary, and still be able to begin construc- tion prior to January 1, 1980. They interpret this exemption, ROW 90.58.030 3(e)(viii) and MAC 173 -14- 040(9), to apply to agricultural irrigation only. They were involved in the hearings on the exemptions and this one was proposed to exempt maintenance of wasteways for agricultural projects. They interpret the legislative intent as not applying this exemption to uses other than agricultural. A substantial development permit would be required for the project you outlined for a golf course irrigation. system.
