BOEING MCCANN PROJECT #294 BOUNDARY LINE ADJUSTMENT

other related materials or equipment.

inspecting, maintaining and operating the jointly used drainage
system and fire prevention system shall be borne by the parties
in ratio to their respective use thereof, such costs being obligations
appurtenant to their respective real property as set forth in
Exhibit "A" attached hereto.
(3) The parties and their respective agents, servants, employees
and contractors, shall, as to the real property of the other as set
forth in Exhibit "A" attacihed hereto, have the right to enter upon
the $nd for the purpose of constructing, installing, replacing,
repairring, inspecting, maintaining and operating the jointly used
drainage system and jointly used fire prevention system.
(4) 4 The obligations of this mutual easement 'Shall be appurtenant
to and run with the land for the benefit of the parties or their
respective, successors in title.

FOR AND IN CONSIDERATION of the mutual benefit to be derived from
the improvements of the jointly used drainage system and fire prevention
system and the use of the paved maneuvering areas all serving their respective
properties and other good and valuable consideration, WILLIAM E. BOEING, JR.,
as his separate estate, and MESABI WESTERN CORPORATION, a Minnesota
corporation, hereby convey and quit claim to each other a perpetual non-
exclusive easement under, over, through and across their respective properties
shown on Exhibit "A" attached hereto and made a part hereof for the purpose of
constructing, installing, replacing, repairing, inspecting, maintaining and
operating a jointly used drainage system and a fire prevention system and for
the purpose of ingress and egress to and from their properties by them or their
agents, servants or tenants.
(5) In the event that the parties by mutual agreement terminate
the Joint use of the drainage system and/or fire prevention system
referred to by this easement, then those easements shall be of
no further force and effect.

Dear Mr. Stoknes: Re: Boeing Project 425 and 426
This will confirm our meeting on rune 14, 1979, regarding the question
of legal access to the above stated projects currently in the permit
stage with your city offices.
Mr. Boeing, or his successors, will grant mutual non - exclusive
easements for ingress and egress of a minimum of 24 feet extending
from the curb cut on the cul -de -sac of the North Access Road following
the real property line between the above stated projects northerly and
terminating at Uplands Drive. The easements will be recorded of
record no later than August 1, 1979.
I trust that the foregoing satisfies the paramount condition which
has delayed progress of the permit pr • e s s .
