RE: OCCUPANCY CERTIFICATE - SEGALE PROJECT #791 -T
Dear Mr. Bennett:
Our letter- to you of 29 August 1979 contained a copy of a
memorandum to the City Building Official recommending delay
in issuance of your .. occupancy certificate. This recommenda-
tion was based on my error with respect to the status of
your landscape plan approvals by the Board of. Architectural
Review -- their review was conducted on 26 July 1979 and a
planting plan was approved. Accordingly, I have asked the
Building Official to proceed with a temporary occupancy
certificate (see attachment). According to our conversation
this afternoon with Mr. Crumbaugh, the london plane trees on
the 180th Street frontage of the site cannot be installed
before mid- october; if you will notify us when these trees
are placed, we can then follow- through with a clear certifi-
cate of occupancy.
Please disregard my letter of 29 August 1979, and accept my
apologies for any inconveniences which it may have caused.

SEGALE BUSINESS PARK - SEATTLE TRUST OCCUPANCY CERTIFICATE
The Planning Division hereby recommends release of a
temporary certificate of occupancy for this project.
The required street trees for the 180th Street frontage
of the site cannot be installed before mid - October; at
such time as these plantings are installed, this office
will have no objection to issuance ,of a permanent occu-
pancy certificate.
Please disregard our previous comments on this matter as
contained in our memorandum of 27 August 1979.

site, thus necessitating additional site expansion.
By eliminating any landscaping restriction, we will be
in a position to provide a more timely response to
additional queing area should it become necessary.

Dear Mr. Crumbaugh:
The Tukwila Planning Commission at its regular April meeting, completed
review of the above - referenced project.
The Commission, carrying out its obligations under section 18.60.035 of
the Tukwila Municipal Code, approved the development plans subject to
the following conditions:
1. That the trees be relocated to the backside of the sidewalk.
2. That in the case of a traffic problem on public right -of -way
resulting from the queing of automobiles for the drive -in
teller, the developer will provide an additional drive -in
teller window and gueing lane, if determined by the Depart-
ment of Public Works as a possibile solution.
3. That a detailed landscape plan be approved by the Board of
Architectural Review prior to occupancy.
4. That the signs shown on the site plan are not approved with
the site plan and require separate approval as required by
TMC.

unused streets have been used for trails and various parts of the City have
been connected by the trails. The area of Allentown would be in the 6 year
street program. The City regards Allentown as a residential area. Chairman
Kirsop said the commitment of the City to improve the residential environment
has been evidenced by the purchase of the Foster Golf Course. Mr. Wills asked
if the improvements spoken of would be paid by L.I.D.s or by the City of Tukwila?
Fred Satterstrom said the 6 year street program is at City expense, also the trails
and recreation. He said the zoning will not involve the property owner in any
money. He said he could not speak for other improvements the community might
demand.
Wayne Matthews, audience, said because he has a vacant lot he is in favor of
sewers. He asked how soon could they anticipate sewers in the area? Chairman
Kirsop said he would guess in five years or so the area will be largely sewers.
Mr. Matthews asked about the City feeling toward sewers. Chairman Kirsop said
the City is tied to King County Health Department. Mr. Garnett asked if the
federal governmnet proposed financing for the sewers? Chairman Kirsop said
federal funds are not as available as they used to be.
Mr. Swanson, audience, asked about the radish patch that is owned by King County.
He asked what will happen to that, will it be annexed? Fred Satterstrom said it
is in the annexation area, King County will own it but Tukwila will maintain it
as a park.
Chairman Kirsop said since there were no further questions, the Public Hearing
would be closed at 9:36 p.m.
MOVED BY RICHARDS, SECONDED BY SOWINSKI, THAT THE PLANNING COMMISSION RECOMMEND
THE CITY COUNCIL ADOPT THE PROPOSED ZONING PATTERN FOR THE ALLENTOWN AREA AS
GENERALLY SHOWN IN EXHIBIT I OF THE STAFF REPORT AND AS MORE SPECIFICALLY
ILLUSTRATED IN THE MAP ENTITLED "PROPOSED ZONING FOR THE POTENTIAL ALLENTOWN
ANNEXATION AREA" INCLUDED IN PLANNING DIVISION FILE MF 79- 11 -CA, SAID ZONING
TO BECOME EFFECTIVE UPON ANNEXATION TO THE CITY OF TUKWILA. *
Mr. Richards remarked that most of the questions asked by the residents of Allentown
were about the sewer rather than the zoning. He stated the annexation will not
cause any difference in sewage. Chairman Kirsop remarked there were no objections
to the zoning plan map as proposed and the majority of the discussion was related
to the sewer problems. Mr. Richards remarked that the truck traffic was discussed.
He said it seemed to him the Burlington- Northern trucks should be rerouted as
suggested.

DEVELOPMENT PLANS: SEGALE PROJECT #791 -
Roger Blaylock; Assistant Planner, ,read the staff report, stating the matter had
been tabled from'the ast P_l.anni1 Commission meeting. He said specific plans
have been presented for the treatment of South 180th Street and the location of
the sidewalk and the landscaping.
Chris Crumbaugh, representing the M. A. Segale Company, said he had no conflict
with the Staff Report.
Mr. Richards said this site plan shows two signs that are apparently free standing,

Roger Blaylock said they should not be approved in this site plan. They will
have to be approved by the sign code. He said the curb cuts will have to be
reviewed by the Public Works Department. Mr. Sowinski noted the trees are spaced
40 feet apart. Roger Blaylock said the Segale landscaping has been 40 feet
apart for trees. Mrs. Avery said in walking the area she thought 30 feet spacing
would be much too close. She said the trees are over the sidewalks and she likes
the way they are planted. They are quite large trees and if they were 30 feet
apart they would be too close.
MOVED BY RICHARDS, SECONDED BY SOWINSKI, THAT THE PLANNING COMMISSION APPROVE THE
DEVELOPMENT PLANS WITH THE FOLLOWING CONDITIONS: (1) THAT THE TREES BE RELOCATED

Roger Blaylock, Assistant Planner, said this project had been tabled from the
last meeting of the Planning Commission. Some modifications have been made in
the plans. Mr. Blaylock read the Staff Report, including the findings, conclusions,
and recommendation. He indicated the area on the wall map.
MOVED BY SOWINSKI, SECONDED BY MRS. AVERY, THAT THE PLANNING COMMISSION APPROVE THE
DEVELOPMENT PLANS SUBJECT TO THE FOLLOWING CONDITION: (1) THAT LANDSCAPE PLANS
BE REVIEWED AND APPROVED BY THE BOARD OF ARCHITECTURAL REVIEW PRIOR TO THE '
ISSUANCE OF A CERTIFICATE OF OCCUPANCY. MOTION CARRIED.
DEVELOPMENT PLANS: McCann Projects #425 and #426
Roger Blaylock, Assistant Planner, read the Staff Report. Ed Hunt, representing
McCann Construction, said these projects are similar and the building would have
six to seven tenants. Roger Blaylock said he was sure a fire lane will be
required.
MOVED BY SOWINSKI, SECONDED BY ORICCO, THAT THE PLANNING COMMISSION APPROVE THE
DEVELOPMENT PLANS FOR McCANN PROJECTS #425 AND #426 AS SUBMITTED SUBJECT TO THE
FOLLOWING CONDITIONS: (1) THAT DETAILED LANDSCAPING PLANS BE APPROVED BY THE
PLANNING COMMISSION PRIOR TO THE ISSUANCE OF AN OCCUPANCY PERMIT. (2) THAT THE
REQUIRED NUMBER OF PARKING SPACES FOR EACH BUILDING BE USEABLE. THE PLANNING
DIVISION IS GIVEN THE AUTHORITY TO ADJUST THE LOCATION OF THE PARKING BETWEEN
THE BUILDING DEPENDING UPON INDIVIDUAL TENANT IMPROVEMENTS. MOTION CARRIED.
Mr. Blaylock suggested two or three additional items on the agenda be considered
at this time, although the Staff Reports were not included in the agenda package.
Mr. Sowinski and Mrs. Avery felt it was unfair to consider the items at this time
since the Commissioners did not have the material.

AGENDA ITEM VI A DEVELOPMENT PLANS: Segale Project #791 -T
Development plans have been submitted by the Mario A. Segale Company for a temporary
bank building to be located on the southwest corner of the intersection of Andover
Park West and South 180th Street. A permanent structure will be constructed on the
southeast corner of the same intersection.
FINDINGS:
1. The plans call for the construction of a 1,344 square foot building with parking
for 16 cars to be used for a bank.
2. A design of the drive up teller window in the bank allows for the stacking of
nine (9) cars.
3. Access is proposed to both Andover Park West and South 180th Street. The curb -
cut on Andover Park West is 250 feet from the intersection. The 45 angled
17 -foot wide access lanes on South 180th Street eliminate left turn traffic
movements. The entrance is located west of traffic controler so it will not
trip the signals, while the exit is located east of the first traffic controler
assuring that the timing of the signal is correct.
4. The property is zoned M -2. Across South 180th Street to the north the property
is zoned C -M. To the east, west and south the property is zoned M -2.
5. The development plans forthe bank (Exhibit A) show the existing raised landscap-
ing on the northeast corner of the site at the main entrance to the Segale
Business Park. A landscaping strip of fifteen (15) feet in width is shown
along both Andover Park West and South 180th Street. Five (5) to six (6)
feet of the landscaping is located on the public right -of -way for South 180th
Street.
6. The development plans (Exhibit C) for the sidewalk and landscaping along South
180th Street west of the immediate bank site call for six (6) feet of land-
scaping (lawn) on public right -of -way, a five (5) foot wide washed aggregate
sidewalk, and a five (5) foot landscaped strip behind the sidewalk.
7. The sidewalk along Andover Park West is completed. It is similar to the
proposed sidewalk along South 180th Street.
8. The development plans show trees placed on approximately 40 foot centers
along both Andover Park West and South 180th Street. The trees are shown
located in the sidewalk along the front edge. The existing landscaping along
Andover Park West has utilized London Plane Trees of approximately 21 to 3
inches in diameter and 12 to 15 feet in heighth. It is anticipated that
similar trees will be used along South 180th Street.

9. Landscaping is not shown on the south and west sides of the bank.
CONCLUSIONS:
1. The bank is an allowed use in the M-2 district and parking is provided in
excess of that required by TMC.
2 Any drive -up window can result in the possible back up of traffic. In most
cases it would appear that nine (9) spaces proposed for queuing would be
adequate. However, the 1st and 15th days of the month may create an enormous
demand on the bank's facilities where traffic may back up and block the
entrance on South 180th Street. The lack of landscaping on the west and
south sides of the site was discussed in response to the possible addition of
a second drive -in window if demand exceeded capacity.
3. The points of access onto both Andover Park West and South 180th Street have
been carefully reviewed by both the Public Works Department and our traffic
consultant. They are satisfied with the locations and design.
4. TMC 18.56.055 requires a special landscaping strip of fifteen (15) feet when
M -2 property is across a public wa- from C -M property. The applicant has
provided sixteen (16) feet of landscaping and sidewalk of which six (6) feet
is on the public right. -of -way for South 180th Street. The right -of -way for
South 180th Street is seventy -two (72) feet and the present paving of sixty
(60) Would allow five (5) 'twelve (12) foot lanes. Therefore, we do not anti-
cipate any immediate widdening of South 180th Street.
5. Eventhough South 180th Street will probably not be widdened, the landscaping
could be dramatically affected if wideening did occur. The London Plane
trees placed on the street side of the sidewalk might have to be replaced.
Their location could also create a sight clearance problem. The same boule-
vard affect could be obtained by placing the trees on the backside of the
sidewalk.
RECOMMENDATION:
The staff recommends that the Planning Commission approve the development plans
with the following conditions:
1. That the trees be relocated to the backside of the sidewalk.

Commission at their regular meeting on Thursday, April 26, 1979.
However, it is anticipated that your application will not be heard
until a planned continued meeting on Wednesday, May 2, 1979. This
is a result of an anticipated lengthy public hearing involving
possibly as many as 400 people concerning the proposed zoning for
the Allentown Annexation. We are informing you early of this situation
hoping to save your time and expense at sitting through three or four
hours of public hearings.
The continued regular meeting is scheduled in the POLICE TRAINING ROOM

Dear Mr. Kirsop:
The record should reflect the fact that:

I have reviewed the minutes of the March 22, 1979 Planning
Commission meeting. It appears that the minutes are not a
verbatum transcript but rather a paraphrasing of major
points of discussion. This is a standard practice of
bodies which hold lengthy and involved meetings.
There are several points which I ask to be included in
the record of the review of development plans for Segale
Project 791 -T.
1. Mr. Segale was offering on his own initiative to install
sidewalks and large trees all the way along the east
side of South 180th Street from Andover Park West to
his western property line near Southcenter Parkway. That
Mr. Segale made this offer at no cost to the city and
that installation would be without regard to timing of
development.
2. That we indicated in other locations throughout the
city public right -of -ways are being used for sidewalks
and that we were proposing instead putting a grass
landscape strip on the street right -of -way and then a
sidewalk behind the grass strip.
3. That we indicated we were attempting to work these
installations out with the city within the requirements
and intent of the T.M.C.

Reflecting on the final statement as indicated in those
minutes, I hope we can all forget the atmosphere of the
March 22, 1979 meeting and go on with our business, it
being obvious through hindsight (20 -20 vision) that
this was a mere aberration and not a normal occurrence.
The Commission has been fair and equitable with
applicants in the past, and these comments were directed
to the specific occurrence and atmosphere of the evening,
and not intended to reflect on the Commission as a whole
or its performance, which has been superior.
I.am sure that a free flow of thoughts, ideas, alternatives,
and discussion will continue in the future as it has in
the past.

3. THE PARKING AREA IN FRONT OF THE BUILDING SHALL BE STABILIZED AND SUR-
FACED WITH GRANULAR FILL PRIOR TO THE CONSTRUCTION OF THE BUILDING.
THIS AREA SHALL BE USED FOR THE CONSTRUCTION STAGING AREA OF THE BUILDING.
4. LANDSCAPING ISLAND SHALL BE LOCATED AT THE END OF THE PARKING
AISLES.
5. THE SLOPE OF THE PARKING LOT WHERE THE PARKING STALLS ARE LOCATED SHALL

INCLUDE THE LOCATION OF THE TREES BEING SAVED ALONG THE WESTERN AND
NORTHERN PROPERTY LINES TOGETHER WITH AN EXPLANATION ON HOW THEY ARE
GOING TO BE SAVED.

VELOPMENT PLANS: SEGALE PROJECT #791 -TT"
Mr. Blaylock read the staff report and explained that the site plan on the wall
was different from that reviewed in the staff report.
Mr. Crumbaugh, speaking for the M. A. Segale Company, began a presentation asking
a question of staff whether a sidewalk had to be put in along 180th Street.
Mr. Blaylock responded that the Sidewalk Plan adopted in 1977 required a sidewalk
along South 180th Street.
Mr. Crumbaugh asked which side of 180th Street is the sidewalk supposed to go on?
Mr. Richards objected to the presentation of Mr. Crumbaugh and he stated that the
Planning Commission was given an exhibit, which we are supposed to be dealing
with tonight and it appears to indicate a sidewalk. Therefore, the question is
kind of asinine. The discussion should center on the proposed plan as submitted
and not on the legal question.
Mr. Crumbaugh stated that a sidewalk has been shown and it is intended to place
a sidewlak in that area aong 180th Street. The question is that the staff report
tells us to put the sidewalk in a certain place. We are trying to give things
that we do not feel are required and I do not like the attitude of the report
that tells us to give more than what is required.
Mr. Richards asked Mr. Crumbaugh which site plan are we discussing, this one
that was originally submitted or some other one?
Mr. Crumbaugh stated that he wanted to propose another site plan to the Commission.
Mr. Richards objected to the policy of last minute presentation of plans. He wanted
a specific plan to review not three or four possible plans.
Mr. Crumbaugh presented an ammended plan for review. The plan showed a revised
access onto Andover Park West.

Mr. Richards objected again because the plan did not comply with the landscaping
requirement of TMC.
Mr. Crumbaugh stated that this was an oversite of the architect.
Mr. Crumbaugh continued discussing the proposed placement of the sidewalk and land-
scaping along South 180th Street. The method used is to place five feet of land-
scaping on each side of a five foot wide sidewalk. The Planning Commission does
not need to consider the width of the landscape area; it only needs to consider
where the sidewalk is going to be.
Mr. Richards stated that Mr. Crumbaugh was wrong, the developments included the
area of the landscaping.
Mr. Crumbaugh stated that he was not trying to take an advisary position. He con-
tinued stating that in other locations throughout the City public right -of -way is
being used for landscaping.
Planning Commission discussed the site plan in more detail.
Mrs. Avery asked about the location of the drive up window. She expressed her
concern about traffic problems and congestion resulting from a banking facility.
MOTION BY MR. RICHARDS, SECONDED BY MR. ORRICO TO TABLE THE DEVELOPMENT PLANS TO
THE NEXT REGULAR MEETING TO INCLUDE THE LOCATION OF THE SIDEWALK AND LANDSCAPING
STRIPS THAT WERE PROPOSED IN THE VERBAL PRESENTATION. IT WAS TO ALSO INCLUDE THE
PROPOSED LANDSCAPING ALONG THE SOUTH AND WEST PERIMETERS OF THE SITE AND THAT A
SECOND SET OF PLANS BE SUBMITTED TO SHOW THE TOTAL DEVELOPMENT OF THE SIDEWALK
AND LANDSCAPING ALONG SOUTH 180TH STREET. MOTION CARRIED. MR. JAMES, MR. ORRICO
AND MR. RICHARDS VOTED YES. MRS. AVERY AND MR. SOWINSKI VOTED NO.
Mr. Crumbaugh wanted the record to show that, "I did not come up here to make
an advisary position, I just made some requests at clarification of the staff.
I totally resent what was done to me here tonight. I did not deserve that."
DEVELOPMENT PLANS: McCANN PROJECT #464
Mr. Blaylock informed the Planning Commission that the architect, Tom Croonquist,
had requested that the item be tabled for revisions until the next meeting.
MOTION BY MRS. AVERY, SECONDED BY MR. ORICCO TO TABLE THE DEVELOPMENT PLANS UNTIL
THE NEXT REGULAR MEETING. MOTION CARRIED.
LANDSCAPE PLANS: MORGAN OFFICE BUILDING /6100 SOUTHCENTER BOULEVARD OFFICE BUILDING
The Planning Commission considered both items together. Mr. Blaylock read both
of the staff reports.
Mr. Bruce Morgan stated that he agreed with the staff report.

AGENDA ITEM V C 1 LOPMENT LANS: Swale Pro'ect #791 -T
Development plans have been submitted by e ega e Company for a temporary
bank building to be located on the southwest corner of the intersection of Andover
Park West and South 180th Street. A permanent structure will be constructed on the
southeast corner of the same intersection.
FACTS:
1. The plans call for the construction of a 1344 square foot building with parking
for 16 cars to be used for a bank.
2. A design of the drive up teller window in the bank allows for the stacking of
seven (7) cars.
3. Access is proposed to both Andover Park East and South 180th Street. Both curb -
cuts would be approximately 120 feet of the intersection.
4. The property is zoned M -2. Across South 180th Street to the north the property
is zoned C -M. To the east, west and south the property is zoned M -2.
5. The development plans show the existing raised landscaping on the northeast
corner of the site at the main entrance to the Segale Business Park. A land-
scaping strip of fifteen (15) in width is shown along both Andover Park
West and South 180th Street. Five (5.) feet of the landscaping is located on
the public right -of -way for South 180th Street. The southern and western boundaries
of the site have a five (5) foot landscaping strip.
6. The sidewalk is located five (5) feet in from the edge of the curb on both Andover
Park East and South 180th Street. It physically divides the fifteen (15) feet of
landscaping into a five (5) foot wide strip along the curbs and a ten (10) foot
strip behind the sidewalk.
CONCLUSIONS:
1. The bank is an allowed use in the M -2 district and parking is provided in excess
of that required by TMC.
2. Any drive -up window can result in the possible back up of traffic. In most cases
it would appear that seven (7) spaces proposed for queuing would be adequate.
However, the 1st and 15th days of the month may create an enormous demand on the
bank's facilities where traffic may back up and block the entrance on South 180th
Street.

3. The access onto South 180th Street will result in possible traffic congestion.
A detailed traffic demand analysis has not be completed for the intersection;
however, the Department of Public Works has stated that there is a possible
conflict with the newly installed traffic light and east /west traffic flow.
In all probability until a traffic study is completed, the proposed location
of access onto South 180th Street will be denied. However, a 45 degree right -
turn entrance -only could be used without creating left turn conflicts on South
180th Street.
4. TMC 18.56.055 requires a special landscaping strip of fifteen (15) feet when
M -2 property is across a public way from C -M property. The applicant has
provided fifteen (15) feet of landscaping; however, five (5) feet is on pub -
lic right -of -way and at sometime in the future South 180th might have to be
widened. Therefore, it seems logical that the fifteen (15) feet of landscap-
ing be provided on the applicant's property. A question arises whether to
consider the sidewalk as a portion of the required landscaping. A sidewalk
when placed immediately adjacent to the curb adds to the visible starkness of
most streets; however, when a sidewalk is setback from the curb the aesethic
impact of the sidewalk is mitigated. In the particular case of Segale Business
Park, it appears that sidewalk was to become part of the landscaping. The result
has been to create more of a boulevard affect and spaciousness. If the applicant
wishes to continue this development pattern, it would appear that the sidewalk be
set -back ten (10) feet from the present curb of South 180th Street to allow for
the possible future expansion of the street.
RECOMMENDATION:
The staff recommends, based upon the evidence, that the Planning Commission approve
the development plans with the following conditions:
1. That a fifteen (15) foot wide landscaping strip be provided along South 180th
Street off of the public right -of -way. (The sidewalk can be counted as part
of the landscaping strip, if it is . set back at least five (5) feet off the
public right -of -way.
2. That access onto South 180th Street be approved by Public Works.
