This letter is to inform you that construction permits for Building 1 of
Project 422 are approved by this office following review of you application
dated 27 June 1980. Stipulations accompanying this approval are as follow::
1) Phase One Boundary: Improvements authorized under Phase One
approvals shall be limited to those depicted on the 21 July 1980
phasing diagram transmitted to us by letter on 24 July 1980.
Completion of Internal Raodways: As indicated in the attached • _.
memorandum from Senior Engineer Phil Fraser, an inspection of `.
the condition of the existing pavement within Southcenter South
will be needed. Fulfillment of this requirement will be necessary
before Project 422 Phase II permits are issued.
3) Subdivision: Before Phase II permits for Project 422 are issued,
compliance with TMC Title 17 is required.
We appreciate your cooperation in completing this review.

In response to your July 14, 1980 correspondence, I met briefly
with you on July 23, 1980, to discuss the concerns expressed
in your letter. Specifically:
1) Final Plat - I presented you with Sheets 1 through 4 of 4 of
the original plat linen showing all recording data and the
30' Shoreline Access Easement.
2) Status of Road Improvements: I presented you a copy of the
Development Agreement as executed by Mayor Todd and Mr.
Bruce McCann on June 27, 1974, which recites:
Paragraph 2: "Developer has delivered to City the plans and
specifications for the Development and City acknowledges the
plans and specifications for the Development to conform to
the standards established by City and its engineers.
Developer shall complete the Development in accordance with
said plans and specifications and all applicable State
statutes and City ordinances."
Paragraph 22: "As soon as the utilities in the streets are
completed and accepted, the streets will be paved up through
the first layer of asphalt. The final layer of paving will
be delayed until the contiguous property is substantially
developed."
Accordingly, we have every intention of completing the street
improvements as soon as the utility connection for the remaining
parcels are completed and accepted.

3) Compliance with TMC Title 17 - As discussed, you are at liberty
to approve the permit on only one building per recorded lot.
This being the case, we request that you permit the construction
of. Building l'(Phase I construction on the attached). Our .
Phase II construction permit application will be placed in
abeyance, pending the submission of a Binding Site Improvement
Plan. In the interim, our Phase II permit application dated
June 27, 1980 -,'is a matter of record.
Your concurrence with the above and the timely approval of our
Phase I permit application is appreciated.

SUBJECT: SOUTHCENTER SOUTH, PROJECT 422
Our office is currently reviewing your application for development permits to
construct two industrial buildings on parcel 17 of the Southcenter South complex.
To complete our plan check process, we ask your ccoperatton in resolving the
following areas of concern:
1) FINAL PLAT: Our files indicate that a final plat for South -
center .South was approved by City Council in May, 1974. How-
ever, we do not have a recorded copy of the final plat as filed
with the county. We request that you supply us a copy of the
final plat for our records; it is important for us to have this
document to ascertain that the 30' wide Shoreline Access Ease-
ment required under the site's Shoreline Management Permit
(MF #76- 05 -SMP) is included as part of the recorded subdivision.
STATUS OF ROADWAY IMPROVEMENTS: Per the attached_memorandum from
former Planning Director Kjell Stoknes to former Public Works
Director Terry Monaghan, it seems that the status of acceptance
by the City of roadway improvements within Southcenter South is
unclear. I agree with the writer's assertion that this matter
should be resolved before further building activity in the complex
is'allowed to proceed. I urge you to contact the Public Works
Director, Ted Uomoto, and arrange a meeting to discuss and con- .
elude this matter. Our office will need written confirmation from
,Public Works that their concerns relative to street improvements
in the complex are satisfied.
3) COMPLIANCE WITH TMC TITLE 17: Subdivision requirements in the
City of Tukwila provide that no more than one building may be
:constructed on a single lot of record. Thus, 1ot.17 must be
further divided by Short Plat or Binding Site Improvement Plan
to place each building requested under the subject permit on its
own segregation parcel. This requirement must be met before •
building permits can be released; application materials are
enclosed.

The City of Tukwila, a municipal corporation in the State
of Washington, hereinafter referred to as "City, "and::8ruce E.
McCann, hereinafter referred to as "Developer" agree as follows:
WHEREAS, City operates and maintains within its boundaries
a system of sewage disposal and a storm drainage system, a water
system, a street - lighting system and a system of paved streets,
all within its boundaries, which can serve the property of

.DEVELOPER'S' AGREEMENT
Developer, and
WHEREAS, City has a comprehensive plan covering storm
drainage, sanitary sewer, water and minimum standards for the
control and design of storm and sanitary sewer facilities within
City, as well as street lighting and paved streets, and
WHEREAS, Developer desires to construct certain sanitary
sewage, storm drainage, water facilities, street lighting and
public streets facilities at his own cost and to dedicate these
facilities to City for connection with, delivery to and operation
and ownership by City, said improvements being hereinafter called
the "Development,"
NOW, THEREFORE, IT IS AGREED:
1. The land or real property for which the Development
is requested and to which this Agreement applies is real estate
in Tukwila, Washington, described in the Plat entitled South -
center South Industrial Park and approved May 6, 1974, by the
City Council of Tukwila which is by this reference made a part
hereof as if set out in full.

2. Developer has delivered to City the plans and specifi-
cations for the Development and City acknowledges the'plans
and specifications for the Development conform to the standards
established by City and its engineers. Developer shall complete
the Development in accordance with said plans and specifications,
and all applicable State statutes. and City ordinances. Final

revised plans and specifications shall be presented to City at

least fifteen (15) days prior to commencement of construction.

CD 3. No construction shall be commenced before the Public
Works Director of the City of Tukwila or his designee (herein
the "Director "), has notified Developer in writing that the
plans and specifications have been approved.
4. The Director shall perform all inspection of the
Development and no development facilities shall be covered
prior to inspection. If any work should be covered prior to
inspection, it must, if required by the Director, be uncovered
for. examination. Developer agrees to comply with all of City's
reasonable inspection requirements. Developer shall maintain
at the construction area at all times during construction a
representative to whom the Director's notices may be given
during construction. Said representative shall be• designated
•
in writing by Developer.
5'. Upon completion of construction and upon the certifi-
cation from the Director that the Development meets the minimum
standards of City, Developer shall convey to City all permanent
facilities of the'Development, together with necessary easements
for general utility construction and maintenance.
6. Developer shall notify City of the date the work and
construction described in this Agreement shall commence. Said
notice shall be given not less than seven (7) days before said
commencement date. After the work is commenced, it shall be
promptly carried to completion in a workmanlike manner, pro-
vided that Developer's obligation to complete the Development
shall be extended in the event of circumstances beyond Developer's
control, including but not limited to fire, flood, snow, freezing,
rainfall, unusual weather conditions, acts of God, labor Zisrctes,
including strikes and lockouts, acts of war, riots, government
priorities and availability of materials.
7. Developer may prepare and call for bids for construc-
tion described herein or negotiate a construction agreement for
• said construction; however, a construction agreement with the
general contractor shall not be executed prior to approval of
.:such agreement by the Director for the purpose of maintaining
•• City construction and material standards and inspection rights.
8. Developer will procure all necessary State and County •
licenses and permits for construction.
9. Testing all systems within the Development shall be
performed as required by the Director in accordance with City
.requirements to determine that such systems conform to the
plans' and. specifications.

10. Developer shall pay: City for inspection fees
• charged by Harstad & associates, a sum not to exceed $15,000
during a period of 120 days. ' In addition, Developer shall
pay all overtime charges and shall pay for all services
required beyond the 120 day period to complete the project.

Such expenses
shall be paid within thirty (30) days of being billed to Developer
by City. Developer agrees to deposit $4,000 with City, which
deposit shall be security for payment of the expenses set forth
herein.
11. In the event that defects due to faulty labor, work-

manship or materials appear in the Development within one (1)

N year from date of completion, Developer shall, at his expense,

d correct the same. This warranty is given in lieu of all other
warranties, expressed or implied, and the implied warranties of
merchantability and fitness for a particular purpose are hereby
disclaimed and excluded. Upon *completion of the construction,
but prior to delivery to City.of the Development, Developer
shall deliver to City a bond in the amount of fifteen percent
(15 %) of construction costs conditioned upon the prompt comple-
tion of repairs necessary within one (1) year from date of com-
pletion of the Development, arising from said faulty.labor,
workmanship or materials. The form of the bond shall be approved
by City.
12. Developer hereby agrees to indemnify and hold City
harmless from any and all claims which may be asserted against
City as a result of the construction or maintenance. of the work
described.in Agreement prior to acceptance by City. De-
veloper shall maintain in full force and effect during construc-
tion liability insurance satisfactory to City.
13. 'City and Developer agree that in carrying out the
terms of this Agreement, Developer shall be acting as an inde-
pendent contractor and in no respect shall be deemed agent of
City.
14. Developer shall not assign this Agreement without the
written consent of City.
15. City covenants and agrees that it will maintain and
operate the Development after satisfactory completion and
acceptance in accordance with the terms of this Agreement.
16. Partial waiver or waiver by acquiescence by City
of any provisions or conditions of this Agreement shall not be
a waiver of any other provision or condition of this Agreement.
17. Work and construction performed under this Agreement
shall not be connected to City sewer or water lines until
,certified by the Director.
18. Upon completion of construction, Developer shall
submit to City in writing a statement of moneys expended to
perform construction described therein.
19. This Agreement shall constitute an easement and servi-
tude and a covenant running with the land upon the property
described in this Agreement and shall be binding upon the heirs,
assigns, grantees and successors in interest to Developer.
20. when notified by the Director to make any changes
or corrections to conform to the plans and specifications,
Developer shall promptly make said changes or corrections.

21. Developer will landscape and maintain the landscaping
of the 10' wide planting islands in the Boulevard. When fifty
percent (50 %) of the property is sold, the responsibility for
maintenance may be assigned to and assumed by an Owner's
Association through provisions of the protective covenants,
and Developer's obligation of maintenance shall thereupon be
terminated.
.22. As soon as the utilities in the streets are completed
and accepted, the streets will be paved up through the first
layer of asphalt. The final layer of paving will be delayed until the
• contiguous property is substantially developed.

established by the City of Tukwila under its Shoreline Management Program), measured
from the ordinary high water mark along the westerly boundary of the plat.
The owners In fee simple, their successors or assigns reserve the right to assume
the obligation to landscape and maintain planting Islands within the city streets.
There shall be no direct access to SR -181 through lots abutting an SR -181 with the
exception of access to the public parking area for ten cars and access for emergency
vehicles.
The utility easements Indicated on the face of the plat are to be used for the bene -'
fit of said plat for underground utilities and drainage purposes and Incidental pur-
poses thereto. Said easements can be entered upon at any future date for maintenance
or construction purposes and for the purposes of serving other properties with util-
ities. Easement areas and Improvements thereon which are damaged in•the course of
servicing, maintenance or construction of utilities shall be restored by the owner
of the utility.
Public pedestrian access will be allowed throughout the length of the shoreline of
the Green River for 30 feet inland from the water edge of the top of'the dike. Such
easement shall not be Inconsistent with the existing diking maintenance easement.
The right is served to the owners In fee simple of the land hereby platted and their
successors and assigns to establish railroad rights-of -way and grant to railroad
companies the right to construct and maintain railroad tracks, including lead tracks
and spur tracks, and operate locomotives and cars thereon.
