Please be advised that the Tukwila Planning Commission approved the
Conditional Use Permit for the Tukwila Baptist Church at their
regular July meeting with the following stipulations:
1. Minimum side yard setbacks shall be 24 feet along the
north and south property lines.
. A 'cross section of the revised site plan, drawn by a
licensed surveyor or engineer, shall depict the pro-
posed site elevation and extent of excavation and shall
be submitted with the building permit.
L 3. Excavation in the hillside shall comply with existing
building code.
4. Provision for landscape treatment of the eastern side
of the property shall be made on the site plan.
The site plan shall be revised to reflect the final
site plan of 3 structures showincr intended building
sizes and building. locations and shall be approved
by the Planning Commission prior to issuance of
building permit.

Mr. Satterstrom read the staff report and drawings of the proposal were displayed.
Chairman Kirsop opened the public hearing at 8:20 P.M.
Mr. Stoknes explained that the applicant had met with the City's Public Works,
Planning and Fire Departments and had made revisions. They wish to take it off
the agenda and put it back on the agenda for next month.
Mr. Horst Ehmke and Mr. Bruce Mecklenburg displayed and explained drawings.
Mrs. Avery asked how much recreation space was allowed to be in concrete. Mr.
Satterstrom explained that 50% is allowed to be "covered," per recreation space
ordinance.
Chairman Kirsop asked to see elevations. Mr. Mecklenburg displayed and explained
elevation drawings.
Mrs. Avery asked if the proposal was for apartments or condominiums. Mfr. Mecklen-
burg said it was for condominiums.
MOTION BY MR. BOWEN, SECONDED BY MRS. AVERY AND CARRIED TO TAKE THE EHMKE -KATO
REZONE OFF OF THE AGENDA AND RE- ADVERTISE IT FOR NEXT MONTH'S MEETING.
Mr. Richards voted NO.

Mr. Ed Hunt explained that additional information was needed and was not complete

Mr. Satterstrom read the staff report and drawings of the proposal were displayed.
Chairman Kirsop opened the public hearing at 8:45 P.M.
Mr. Leon Cook, Chairman of the Building Committee, represented Tukwila Baptist
Church. He explained the drawing and proposal. He stated he felt redesigning
is not in the best interest of the City and delaying will not help anything.
Mrs. Velma Lee, 552.9 South 149th, stated she preferred the church facing her
property rather than a parking lot.

Mr. W. C. Livsey, 5531 - 149th South, stated he felt the same way as Mrs. Lee.
Mr. Cook explained that 2 of the 3 portables presently being used will be removed
and the other will be relocated on the other side of parking lot from church.
P1r. Bowen asked if the property next to the church property was still being con-
sidered for park property. Mr. Stoknes explained that it had been considered
but the owners were not interested in selling it.
Chairman Kirsop closed the public hearing at 9:00 P.M.
Mr. Satterstrom recommended adding "and elevation drawings drawn by a licensed
land serveyor or engineer" to point 4 of the staff report recommendation.
Mr. Cook submitted a surveyors drawing which he felt was adequate. He mentioned
he had given it to the Planning Department about 3 weeks ago.
After reviewing the surveyors drawing submitted by Mr. Cook, Mr. Satterstrom
further revised point 4 to read as follows:
4. A cross section of the revised site plan and elevation drawings drawn
by a licensed land surveyor or engineer depict proposed elevation,
grading plan and extent of excavation.
Mr. Richards stated that the zoning code requires 3 times the minimum yard set-
backs on conditional uses. The plans did not show this and thus, was in viola-
tion of the zoning code.
Mrs. Avery stated her concern regarding the stability of the soil on the property
where the cut was to occur. Mr. Stoknes explained that there were city laws that
cover cut's.
MOTION BY MR. SOWINSKI AND SECONDED BY MRS. AVERY TO APPROVE THE CONDITIONAL USE
PERMIT FOR TUKWILA BAPTIST CHURCH WITH THE FOLLOWING STIPULATIONS:

There was a discussion regarding portables and the number of buildings that will
be on the site.

BY ADDING THE FOLLOWING:

Mr. Bowen excused himself from participation on this item due to conflict of interest.
Mr. Stoknes read the staff report, a letter from Mr. Charles Baker, Architectural
Control Committee and Mrs. J. Frandsen, President of Strains Transportation Com-
pany. (Both letters are attached as a part of these minutes.)
Chairman Kirsop opened the public hearing at 10:05 P.M.
Mr. Carl Johnson, representing Garfield Truck Lines, explained the warehouse proposal.
Mrs. Frandsen, 4640 Summerset N.W., Bellevue, described the proposal further. She
mentioned they will repair the asphalt in the parking lot as needed as well as the
curbs. She mentioned they distribute mostly Proctor and Gamble products who have
strict requirements which they comply with.
Chairman Kirsop closed the public hearing at 10:20 P.M.
A discussion regarding the parking lot followed. Mrs. Frandsen mentioned they
intend to park the trucks at the south end of building.
Mr. Richards asked if.the number of parking spaces met code requirements after
the trucks were parked. Mr. Stoknes answered NO.
Mr. Richards suggested referring this item to the Board of Adjustment to deter-
mine if the proposal is a truck terminal and determine the issue on parking.
Mr. Satterstrom mentioned that the burden of getting a variance should be on the
applicant, not the City. The Planning Commission may . refer the item to the Board
of Adjustment and if the Board determines that it is not a truck terminal, then
the applicant should apply for a variance from the parking requirement.
MOTION BY MRS. AVERY, SECONDED BY MR. SOWINSKI AND CARRIED THAT THE ISSUE OF
WHETHER OR NOT GARFIELD TRUCK LINES, IN THIS OPERATION, IS ACTING AS A TRUCK
TERMINAL BE REFERRED TO THE BOARD OF ADJUSTMENT.
Mr. Johnson agreed to bring this item before the Board of Adjustment during their
September meeting.
Chairman Kirsop recessed the meeting at 10:55 P.M.

STAFF REPORT
CONDITIONAL USE PERMIT: TUKWILA BAPTIST CHURCH
Tukwila Baptist Church wishes to construct a new church and make site
alterations at the location of the present church located at 14742 Macadam
Road. Pursuant to Section 18.12.040 (1) of the Tukwila Municipal Code,
churches require a granting of a conditional use permit from the Planning
Commission prior to being allowed.
Criteria for approval are stated in Section 18.64.010 of the Tukwila
Municipal Code and Section 18.12.040 (b) (1) - (4).
FINDINGS
1. The property is located in an R -1 -7.2 single- family zone (single - family
residential - 7,200 square feet minimum lots);
2. The Comprehensive Plan for the area shows it all as future single- family;
3. The surrounding existing land uses are all single - family, with the exception
of some group living quarters for the elderly several hundred feet to the
south;
4. The proposed setbacks for the main church structure are as follows:
a. Rear setback on the east side - 33 feet (cut into the east bank);
b. Side elevation on the south side - Setback proposed is 7 feet;
c. North side setback is proposed at 44 feet, however, portable buildings are propo5
d. The front setback to the west is proposed at approximately 288 feet. thei

6. The main church structure is proposed to have composition shingle on the
roof and the exterior siding of the building is proposed to be a combina-
tion of cedar, brick and stucco;
7. 68 parking spaces are proposed. Required parking for the church is inter-
preted to be 46 parking stalls. Reference Section 18.56.110 and 18.56.120.
(This computation is made on the basis of seating capacity in the primary
church area. It assumes . that the classrooms and fellowship hall are inci-
dental to the primary area and that the various portions of the church are
not used at the same time except for classrooms which are used by children
which would not effect the parking requirement.)
8. Seven (7) classrooms are proposed in the new facility.

CRITERIA FOR PLANNING COMMISSION TO USE IN THE REVIEW OF A CONDITIONAL USE PERMIT
APPLICATION
The following are items listed in the Tukwila Municipal Code which the Planning
Commission should use in their decision deliberation on this conditional use per-
mit application:
1. That the use must be located in accordance with at least one of the following
situations:
a. On a corner lot immediately adjacent to or across the street from a
public park, public playground, or a parkway, which has a right -of -way
width of at least 120 feet; or
b. On a parcel or tract of land entirely surrounded by streets or streets
and alleys; or
c. On a lot immediately adjoining or immediately opposite on the other side
of the street from R -3 to M -1 districts, inclusive; or
d. On a lot approved by the Planning Commission as being a location where
such building will not materially injure neighboring property for residential
use.
COMMENT: It appears that this proposed property would qualify for either item
a or item c.above, since there is RMH zoning across the street on a very small
and narrow piece. Due to the narrowness it is highly likely that it is unbuild-
able and that the freeway adjacent to the west, would appear to also qualify
under item a above. Reference: Tukwila Municipal Code Section 18.12.040 (b)
(1) - (4).
2. The use will not materially injure the appropriate use of neighboring property.
COMi•1ENT: The placement of the large proposed church structure into the hill
side and closer to the established single - family area can be seen as a potential
problem. The impact of this building, would probably be lessened if the struc-
ture were located more to the western side of the property where the present
church is located. Additionally, setbacks are required to be three times that
required in residential area -s. Side setbacks need not exceed eight feet in
a single family area. Three times this figure would be a minimum of a 24 -foot
setback on each side. Rear yard setbacks in a residential area is 25% of the
lot debth or 30 feet, which ever is less. In this case the applicants are
proposing the minimum rear yard setback required for single family homes. This
does not appear to be reasonable due to the bulk of this structure.
3. The development will conform to the general intent of the zoning ordinance,
including the necessary off street parking and loading facilities for such
uses.
COMMENT: It appears that the proposal is consistent with the necessary off
street parking and loading facilities and the intent of the Tukwila Zoning Ordinanc(
excepted as noted earlier in this report.

RECOMMENDATION
It is recommended that the conditional use permit application requested here be .
referred back to the applicant for redesign consistent with the following guide-
lines:
1. Minimum side yard setbacks be 24 feet both on the north and south property
lines.
2. The principal new church building proposed be relocated to the western
portion of the property.
3. The site plan be redesigned to show the above changes.
4. A cross section of the revised site plan in an east /west direction be
submitted.
5. Minimal excavation be allowed into the hill side.
6. If any deviations to the above items are proposed, that mitigating
measures be submitted, for example, landscaping or earth berming, etc.
7. Provisions for landscape treatment of eastern slope of property.
In essence, this recommendation is to table this item for redesign and for recon-
sideration during a continued public hearing during the month of August.
The Planning Commission should also consider the three portable classrooms on the
site as they effect the appearance of clutter. The proposed building has seven
(7) classrooms proposed therefore making questionable the need for the portables.

We are in receipt of your building permit application on the Tukwila Baptist
Church as it relates to the new church structure. We have reviewed this with'
the codes of the City and the approval of the conditional use permit by the
Tukwila Planning Commission and have the following comments:
1. Per the approval of the conditional use permit by the Planning Com-
mission on August 11, 1978, the cross section of the revised site
plan drawn by a licensed professional engineer shall depict the
proposed site evations and ext of excavation nhl be s
mitted with the el building permit. ten This excavation t o co ly with
the 1976 Uniform Building Code. Sheet 7 of your proposed set of
building plans shows the cross section. This sheet must be stamped
by a professional engineer.
2. The Planning Commission, on August 11, 1978, requird that provisions
for landscape treatment of the eastern side of the property to be
made on the site plan. On March 22, 1979, they revised that to
state that "East bank landscaping be completed 90 days after comple-
(� � tion of grading. If grading is done in the winter time it would be
I expected that in lieu of a landscape being done 90 days after that
some kind of erosion control plan of a temporary nature would be in
effect." In relation to this, your site plan must be changed to show
a mix of evergreen and deciduous trees in addition to the proposed
landscaping and ground cover plants closer on center. Also, your
erosion control method must be shown.
3. Two of the portables presently on the property must be removed within
90 days of issuance of the certificate of occupancy on the structure
01C- or after occupancy by the church. This will be placed as a condition
on the building permit.
4. Approval of any building permit for the church structure does not in-
clude the gymnasium addition. This must be handled under a separate
0-- permit process.
5. No excavation is to be done in the ten -foot sewer easement on the east
side of the property without specific written approval of the Tukwila
Public Works Department.

to be 2 -feet wide. These planting areas must be a minimum of /

of the City of Tukwila. You should expect other review comments from the

6. The Tukwila Municipal Code requires screening for driveways or
parking facilities adjacent to single- family land. Please revise
your site plan to indicate your method of screening treatment on
the north and south property line. It can be accomplished by
0 either a solid screen planting and /or a decorative obscuring
fence 6 -feet high. If a planting area option is chosen, it would
need to be a minimum of 5 -feet in width.
7. It is noted that the parking area is to be crushed rock. Your
G� site plan must show the method of identifying the parking spaces
and the method of providing wheel stops.
8. This site plan must identify the treatment of the land adjacent
to the north and south side of the building. It appears your
intent to gravel this area for access to the rear portion of the
L property. This should be verified or stated on the site plan and
V the method of turning a vehicle around on the rear portion of the
property shown, if it is the intent to have a driveway in these
areas.

PUBLIC HEARING: REZONE, R -1 to C -1 (McCann #352 and McCann #353)
Mr. Stoknes read the Staff Reports explaining that an Environmental Impact State-
ment was required for both proposals and that he sent a letter to Mr. McCann
stating alternative to Environmental Impact Statement. Staff has not received
a response from them'as yet. He suggested that the Commission table both items
one more time and if there is still no response, the items should be stricken
from the agenda until staff does receive a response.
Motion by Mr. Bowen, seconded by Mrs. Avery and carried to table the hearings
on these matters until the next regular meeting.
PUBLIC HEARING: REZONE, R -3 and C -1 to R -4 (Ehmke -Kato)
Mr. Stoknes recommended that this item be tabled to the next regular meeting.
